56. CONTRACT WITH UMOM HOUSING 9, LLC 1. A financial Contract (“Contract”) between Maricopa County, administered by its Human Services Department (“County”), and UMOM Housing 9, LLC, an Arizona limited liability company, (“Contractor” or “Developer”). The County and the Contractor are collectively referred to here as the “Parties” and individually as a “Party.” The purpose of the Contract is for the Contractor to expand housing availabil ity by constructing a 96-unit rental housing community to be located at 3101 W. McDowell Rd., Phoenix, AZ 85009 (the “Property”). Following U.S. Department of the Treasury guidance, HSD exercised its ability to allocate ARPA funds to the development projec t to be completed by UMOM. The County will provide the Contractor with $6,000,000 in American Rescue Plan Act – Coronavirus State and Local Fiscal Recovery Funds (“ARPA”) under Assistance Listing Number (“ALN”) 21.027 provided to the County by the U. S. T reasury. The Contract term shall begin May 24, 2023, and will expire February 28, 2025. 2. Authorize the Chairman to sign and execute the following: Change Orders/Administrative Changes as listed in Paragraph 8.11 ADMINISTRATIVE CHANGE ORDERS, authorizing the Chairman of the Board of Supervisors to approve and execute upon the recommendation of the Human Services Department Director and Legal Counsel to make changes within the general scope of the Contract on behalf of the County through Adminis trative Change Orders. Administrative Change Orders shall be approved and fully executed by the Chairman of the Board of Supervisors and the authorized representative for the Contractor. Change Orders/Administrative Changes will receive legal review and wi ll be filed with the Clerk of the Board’s office upon full execution. 3. Authorize the Chairman to sign any of the following documents that pertain to the Contract: a. Promissory Notes. b. Deed of Trusts. c. Declarations and other documents.
