96. AGREEMENT WITH ARIZONA COMMUNITY ACTION ASSOCIATION DBA WILDFIRE FOR UTILITY ASSISTANCE PROGRAMS Approve a revenue Agreement between Arizona Community Action Association DBA Wildfire, an Arizona nonprofit corporation (Wildfire) and Maricopa County, administered by its Human Services Department. The purpose of this Agreement is for Wildfire to provide the County with funding for the administration of the weatherization services, utility repair and replacement, utility deposits and bill assistance (Utility Assistance Programs) to eligible Maricopa County residents. Wildfire will provide the County with Utility Repair, Replacement and Deposit (URRD) funding in the amount of $256,140, comprised of the following: • $213,450 for (A) Direct Services • $42,690 for (B) Program Delivery The term of the Agreement shall be retroactive to July 1, 2023, through June 30, 2024. Wildfire contracts with the County on an annual reoccurring, non-competitive basis to administer the URRD program activities in the County outside the City of Phoenix. The Human Services Department provisional indirect rate is 22.2% by the U.S. Department of Health and Human Services for FY2024 for salaries and employee related expenses. The total Agreement funding amount is $256,140 of which $34,935 is for salaries and employee related expenses. The total estimated indirect costs are $7,755 and fully recoverable and shall be effective as of July 1, 2023. Receipt of the funds from Wildfire does not require in-kind or match funds and no future or ongoing contributions by the County are required at the end of the Agreement term. The services provided under this Agreement are not a mandated function but provides a benefit to the citizens by providing weatherization, utility repair and replacement and utility deposits in dwellings occupied by eligible residents, which will assist in reducing the household’s energy burden. The URRD services focus on providing assistance to persons who are elderly, persons with disabilities, families with children, and households with high-energy burdens to reduce energy costs and improve their health and safety. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. The approval of this funding does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant A.R.S. §42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through future budget reconciliation. Acceptance of this Agreement will not impact the County General Fund. 59. AMENDMENT TO AGREEMENT WITH ARIZONA COMMUNITY ACTION ASSOCIATION D/B/A WILDFIRE FOR UTILITY ASSISTANCE PROGRAMS Approve financial Amendment No. 1 to the Agreement between Arizona Community Action Association DBA Wildfire (Wildfire), an Arizona nonprofit organization and Maricopa County administered by its Human Services Department (County). The purpose of the Agreement is for the County to administer the Utility/Appliance Repair or Replacement and/or Utility Deposits program (URRD). Wildfire provides funding to the County for administration of the URRD program. The purpose of the Amendment is to amend the Agreement as follows: A. The total value of the Agreement will decrease from $256,140 to $161,000. The Direct Service amount will decrease from $213,450 to $134,166.67. The Program Delivery amount will decrease from $42,690 to $26,833.33. The Agreement term is from November 03, 2023 through June 30, 2024 The County will administer the URRD program helping persons with disabilities, elderly, families with children, and households with high-energy burdens to reduce energy costs and improve their health and safety. The URRD program will assist with weatherization, utility repair and replacement and utility deposits in dwellings occupied by eligible residents. The Agreement is amended to incorporate the changes contained in this Amendment. All terms and conditions of the original Agreement shall remain unchanged and in full force and effect. Acceptance of this Amendment will not impact the County General Fund. The amendment shall become effective on the date of last signature. Supervisory District: ALL (C-22-24-013-X-01)
