This horse stands 16 hands tall and he is registered with the American Quarter Horse Association as "Denali." Denali has a calm temperament and disposition and will be a positive addition to the Sheriff's Mounted Patrol Unit, which operates out of the Lake Patrol Division. IGA WITH CITY OF BUCKEYE REGARDING HIGH INTENSITY DRUG TRAFFICKING AREA Approve an Intergovernmental Agreement ( IGA) with the City of Buckeye regarding HIDTA (High Intensity Drug Trafficking Area) that allows Maricopa County Sheriff's Office (MCSO) to reimburse overtime and provide certain equipment for the Buckeye employee(s) assigned to the Maricopa County High Intensity Drug Trafficking Area (HIDTA) Maricopa County Drug Suppression Task force (MCDST). This IGA supersedes the current IGA with the City of Buckeye that was approved in agenda C-50-22-115-X-00 on February 23, 2022 and expired on June 30, 2023. This IGA is effective retroactive to July 1, 2023 upon board of Supervisors approval and ends June 30, 2024. The value of the overtime paid in this IGA is not to exceed $30,000. The City of Buckeye has been a HIDTA partner for several years. Stryker is more than 9-years-old and has recently experienced a mild seizure and is ready to be retired from service. AMENDMENT TO AGREEMENT NUMBER 1024 WITH MARICOPA ASSOCIATION OF GOVERNMENTS FOR THE TRAVEL REDUCTION PROGRAM Approve Amendment Four to Agreement Number 1024 between the Maricopa Association of Governments (MAG) and Maricopa County (County) through the Air Quality Department (MCAQD) in the not-to-exceed amount of $962,347. The purpose of this amendment is to fund the Unified Planning Work Program and revise the scope of services. This amendment is effective from October 1, 2023, to September 30, 2024. All other terms and conditions of the Agreement remain in full force and effect. The Agreement between MAG and MCAQD is reoccurring and has been approved by the Board of Supervisors in previous years. The cash or in-kind match is not applicable, indirect cost is fully recoverable, ongoing cash contributions not applicable. The Agreement is not mandated, and the activities are 100% financially supported by the Agreement from MAG. The Agreement does not go through the bid process. There are no costs that will need to be absorbed by the MCAQD’s operating budget. An amount of up to $346,000 will be passed through to the Regional Public Transportation Authority as an external service provider upon separate agenda and approval for services provided between October 1, 2023, and September 30, 2024. This item has been budgeted and approved by the Board of Supervisors with the adoption of the FY2024 MCAQD budget. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditures of these revenues are not prohibited by the budget law. AMENDMENT TO INTERGOVERNMENTAL SERVICE AGREEMENT WITH ARIZONA DEPARTMENT OF ENVIRONMENTAL QUALITY FOR ARIZONA STATE CLEAN DIESEL GRANT PROGRAM MATCHING FUNDS Approve and authorize the Chairman to execute Amendment 7 to Intergovernmental Service Agreement ADEQ18-182669 between the Maricopa County Air Quality Department (MCAQD) and the Arizona Department of Environmental Quality (ADEQ) for ADEQ to provide matching funds to MCAQD for the EPA FY23-24 Arizona State Clean Diesel Grant Program. This IGA Amendment will provide matching funds to support MCAQD’s FY23-24 DERA Work Plan to retrofit or replace diesel powered vehicles through annual sub-award agreements until December 30, 2026. An annual Amendment will be required to update the Work Plan and any future match funding dollar amounts. The Work Plan for Amendment 7 will expire on December 30, 2026, and will provide for $400,000 in “matching” funds to allow additional DERA funding in the amount of $222,604 from the EPA. Title VII, Subtitle G, Section 793 of the Diesel Emissions Reduction Program (DERA) in the Energy Policy Act of 2005 authorizes the U.S. Environmental Protection Agency (EPA) to support grant, rebate, and loan programs, administered by eligible states or territories, which are designed to achieve significant reductions in diesel emissions. This program is referred to as the State Clean Diesel Grant Program. The grant program is reoccurring and has been awarded to the department in previous years. Cash, indirect costs or in-kind match are not applicable as this amendment is for the “matching” funds required for the state program. This assistance is funded by a grant from EPA, Award ID# 5A-98T64901 which provides full federal funding in the amount of $161,467. This grant supports the operation of the PM2.5 ambient air monitoring network. The program is required by the EPA and 40 CFR Part 50, Part 53, Part 58. The grant supports personnel, maintenance, equipment purchase, and parts used in repair of sampling equipment. The Agreement and Budget is effective from May 1, 2023, until June 30, 2024. This agreement is subject to applicable EPA regulatory and statutory provisions, all terms and conditions of this agreement and any attachments. The FY2024 MCAQD composite indirect rate of 35.34% will be applied to the direct charges of $11,428. Indirect costs of $4,039 are fully recoverable. A capital equipment expense of $146,000 is included in the budget but excluded for the purposes of Indirect cost calculations. The grant award is one-time for the purpose of obtaining equipment to support the existing MCAQD PM 2.5 monitoring program. The cash or in-kind match is not applicable, indirect cost is fully recoverable, ongoing cash contributions not applicable. The grant activity is mandated by the Clean Air Act utilizing the 2012 Particulate Matter (PM) National Ambient Air Quality Standards (NAAQS). AGREEMENT WITH U.S. DEPARTMENT OF HOMELAND SECURITY FOR BIOWATCH PROGRAM Approve an Agreement between the United States Department of Homeland Security (DHS) and Maricopa County through the Air Quality Department, in the not-to-exceed amount of $784,429. This Agreement is funded by a grant from the DHS (Award Number 06OHBIO00003-18-00) with the purpose of continuing funding for the BioWatch program. The BioWatch Program provides air-monitoring, analysis, notification procedures, and risk assessment to 30+ jurisdictions. This program can substantially minimize the catastrophic impact of a biological attack. Bio Watch is managed by the DHS Countering Weapons of Mass Destruction Office. The Agreement is effective from June 1, 2006, until May 31, 2025, while the budget program period is effective from June 1, 2023, until May 31, 2024. The FY2024 Air Quality composite indirect rate of 35.34% will be applied to the direct charges of $550,049. The Grant activities are administered by the Maricopa County Human Services Department. The purpose of the Grant is for the County to address lead hazards in pre-1978 housing units which will provide safer homes for families with children under the age of 6 or pregnant women with low- and moderate-income. The County will also perform healthy homes assessments in housing units and work with Maricopa County Department of Public Health to perform blood lead level testing for children living in the homes. The purpose of the Amendment is to extend the period of performance, at no cost to the government, for twelve (12) months. The period of performance is revised to read: June 29, 2020, to July 28, 2024, = 54 months. The Human Services Department submitted a request to extend the period of performance due to the COVID-19 pandemic. The Grant funding remains unchanged at $1,782,710 with County’s match obligation remaining at $258,027 for a Total Instrument Amount of $2,040,737. 38. AMENDMENT TO AGREEMENT WITH AREA AGENCY ON AGING REGION ONE, INCORPORATED FOR SERVICES Approve Amendment No. 2 to the financial Agreement between Area Agency on Aging, Region One, Inc. (Contractor) and Maricopa County administered by its Human Services Department. The purpose of the Agreement is to coordinate and expand services in Maricopa County for adults 60 years of age and older and adults with disabilities. The County provided the Contractor with American Rescue Plan Act (ARPA) funds under ALN 21.027 for Agreement activities. The Agreement term is September 1, 2021, through June 30, 2024. The Purpose of the Amendment is to address the following: A. Reduce Agreement funding by $3,177,901 from $10,600,000 to a new funding amount of $7,422,099. Funding shall be reduced in the following sections: 3.2 Analyst from $200,000 to $165,000 a reduction of $35,000. 3.3 Applications , administration of grants from $8,800,000 to $5,657,099, a reduction of $3,142,901. B. Revise section 3.0 (Contractor Responsibilities), in the following subparagraphs and sub-subparagraphs to be removed in their entirety and replaced with the following: 3.2 The Contractor shall utilize no greater than $165,000 to hire an analyst to research and analyze factors affecting the recruitment and retention of Direct Care Workers in Maricopa County 3.3 The Contractor shall review applications, administer grants to qualified agencies, and distribute up to $5,657,099 on behalf of the County to partner agencies serving Maricopa County residents: 3.3.1 Distribute up to $1,968,499 in grants to Senior Centers located in Maricopa County. This will allow Senior Centers to reopen and provide services and/or address support gaps caused by or worsened by COVID-19. 3.3.2 Distribute up to $988,600 to support the recruitment and retention efforts by Home Care Agencies for Direct Care Workers in Maricopa County. C. Revise section 10.0 (Funding, Invoicing and Payment) in the following subparagraph by removing in its entirety and replacing with the following: 10.6 The County shall pay the Contractor an amount not to exceed $165,000 for the research and data analysis activities as described in Section 3.2 on a cost reimbursement basis. D. As noted in Section 10.7 of the Agreement: Upon execution of this Agreement, the County shall transfer funds to the Contractor in the amount of $5,657,099 for the year one activities as stated in Section 3.0. Contractor funding is reduced as noted in section A, B, and C above. The Contractor shall issue a warrant to Maricopa County in the amount of $1,442,901 no later than July 28, 2023. The foregoing paragraphs contain all the changes made by this Amendment No. 2. All other terms and conditions of the Agreement and Amendment No. 1 remain in full force and effect. 43. FY 2023 EDWARD BYRNE MEMORIAL JUSTICE GRANTS 1. Pursuant to A.R.S. 42-17106, approve acceptance of grant funds from the U.S. Department of Justice, Office of Justice Programs, Bureau of Justice Assistance, for the Edward Byrne Memorial Justice Assistance Grant (JAG) Program through the City of Phoenix. 2. Authorize the Chairman of the Board of Supervisors to execute IGA between City of Phoenix, Maricopa County and City of Mesa. Because disparity exists between the City of Phoenix, Maricopa County and City of Mesa, an IGA is required pursuant to the grant application. This IGA includes allocation to City of Phoenix of $1,099,653 and $290,430 in funds reallocated to Maricopa County Office of the Medical Examiner (OME )( $113,332) and City of Mesa ($177,098). Grant awards are to be expended within three (3) year period of time, starting on October 1, 2023 and ending September 30, 2026. The City of Phoenix has been designated as the fiscal agent for this consortium and municipalities. 3. Authorize Chairman of the Board to sign all documents related to the acceptance of the grant funds. 4. Retroactively, authorize OME Administrative Director to sign all non-financial documents related to the grant application. 5. Pursuant to ARS §42-17106(B), increase the FY 2024 Office of the Medical Examiner (D290) Medical Examiner Grant Fund (224) Operating (OPER) revenue and expenditure budget by $113,332. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation and, therefore, expenditures of these revenues are not prohibited by the budget law. This budget adjustment does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. The grant award is reoccurring and has been awarded to the department previously. The department has no in-kind match requirement or ongoing cash contributions during the grant award period. The grant allows up to 10% for administration which includes indirect costs. The grant award is not a mandated function but provides a benefit to the citizens by providing states and units of local governments with critical funding necessary to support a range of program areas including law enforcement, prosecution and court programs, prevention and education programs, corrections and community corrections, drug treatment and enforcement, crime victim and witness initiatives, and planning, evaluation, and technology improvement programs. The grant award is competitively bid and other eligible agencies may or may not bid on this grant award. Any unallowable indirect costs will be absorbed by the departments. The grant allows a 0% rate for indirect costs, or $0 which may be incurred by the Office of Medical Examiner or Maricopa County for the administration of this grant. The Maricopa County Department of Finance has calculated the Office of Medical Examiner's composite indirect cost rate at 20.29%, or $22,995.06. Approve Notice of Award (NOA) 1 NU58DP007535-01-00, from the Department of Health and Human Services (DHHS), Centers for Disease Control and Prevention (CDC) and Maricopa County by and through its Department of Public Health (MCDPH) to address Alzheimer’s Disease and Related Dementias with an in the not-to-exceed amount of $250,000 per year. This budget period starts on September 30, 2023, and ends on September 29, 2024. The non-competing continuation award period begins on September 30, 2023, through September 29, 2028. This is a competitive grant award, and it will be reoccurring. This is the first time it has been awarded to the department. The department has an in-kind match requirement of $78,379.00 during the grant award period. The grant award does not require ongoing cash contributions for the next five years to maintain the program after the grant period end date. The Department of Public Health’s indirect rate for FY24 is 15.65%. Indirect costs are estimated at $33,830.52, all of which is recoverable. Departmental Indirect Rates are reestablished at the beginning of each fiscal year and the future Indirect Rate will be collected at the corresponding rates. As a part of its established accredited dietetic internship program, the Department of Public Health seeks to provide its dietetic interns with a broad and diverse practicum experience. This agreement with Dignity Health will allow dietetic interns to continue to receive approved practicum experience in clinical nutrition. Supervised by Dignity Health registered dietitians in Dignity Health facilities, interns would continue to be responsible to Public Health. CONTRACT WITH NATIVE HEALTH FOR COMMUNITY HEALTH NEEDS ASSESSMENT Approve a Contract for Service and Business Associate Agreement between Native Health and Maricopa County by and through its Department of Public Health for participating in a Community Health Needs Assessment (CHNA). Native Health shall pay the County for the services described, in the amount of $13,000 per year, for a total not-to-exceed amount of $39,000. The term of this Contract is from July 1, 2023, through June 30, 2026. The Contract may be extended for one (1) additional month, not to exceed a total extended term of eight (8) months, except that the cost will be subject to renegotiation. The Department of Public Health’s FY24 indirect rate for the Fee Fund is 18.67%, indirect costs are estimated at $6,135.75 and are fully recoverable. This contract will provide funds to support MCDPH’s Community Health Needs Assessment (CHNA) aimed to identify the unmet need for health services in the service area and/or proposed service area based on the population served. The Patient Protection and Affordable Care Act (ACA) approved by Congress in 2010 requires hospitals to conduct regular CHNA’s and adopt implementation strategies to meet the needs identified. The SAFER students function under the County’s Division of Epidemiology and Informatics (DEI). The term of this IGA begins July 1, 2023, through June 30, 2028, with a not to exceed amount of $60,000 per year. The budget period begins July 1, 2023, through June 30, 2024. Subject to the availability of funds, the County shall pay the Contractor for the services described, not to exceed the amount listed on the Cover page of the Agreement per year. Compensation will be reimbursed on a monthly fixed rate. On December 8, 2021, Maricopa County and Litchfield Park entered into an Intergovernmental Agreement (C-64-22-096-X-00) for the Improvements and Annexation of Camelback Road from the 145th Drive Alignment to 127th Avenue. Litchfield Park’s annexation of the Project (Ordinance 22-257) unintentionally encroached into the City of Glendale’s 10’ Strip Annexation. Litchfield Park and Maricopa County Board of Supervisors approved Ordinance 22-262, correcting the encroachment, and revised Litchfield Park’s jurisdictional boundary, not to include Glendale’s strip annexation. IGA WITH CITY OF GLENDALE FOR THE EXCHANGE OF SERVICES (ENTENTE) Approve the Intergovernmental Agreement between Maricopa County and the City of Glendale for the exchange of services or reimbursement of services (Entente). This Agreement shall become effective as of the date the Maricopa County Board of Supervisors approves it and remains in full force and effect until either Party terminates it. Either Party may terminate this Agreement at any time before the expiration date of this Agreement by furnishing the other Party with a thirty (30) day written notice. This Intergovernmental Agreement aims to identify and define both Parties' respective roles in the execution of the responsibilities of specific maintenance tasks in areas that cross jurisdictional boundaries. The Agreement provides the opportunity to focus on specific maintenance tasks or emergency highway projects and the availability of the most economical resources by extending beyond jurisdictional or geographical boundaries. The Agreement's application will benefit areas in the County and the City where the other Party could complete specific types of routine maintenance or emergency highway project activities based on scheduled work within the area. Individual tasks performed by either Party will be executed upon completing a Letter of Agreement (LOA) approved and signed by the County Department of Transportation Director, City Manager, or their designees. If the value of goods or services exchanged by the Parties is not of equal value, the total aggregate reimbursement to the respective Party will not exceed $250,000 per fiscal year. If no services are exchanged, there is no financial impact. An accounting mechanism will be utilized to track each LOA, as applicable, to identify specific tasks and services and ensure the exchange of these services is of similar value. FEDERAL HIGHWAY ADMINISTRATION FEDERAL-AID PROJECT AGREEMENT: UNIVERSITY DRIVE - HIGLEY ROAD TO POWER ROAD Authorize the Maricopa County Department of Transportation (MCDOT) to accept federal funding reimbursements as approved by Maricopa Association of Governments (MAG) and expend the grant funds for the Department of Transportation: Transportation System Management Project, sub-project TT0612 MCDOT University Drive - Higley Road to Power Road up to the total cost of the project. Estimated construction cost of the project is $2,843,952. MAG has authorized $2,672,417 in federal reimbursement funds which are available in FY 2024. MCDOT’s local match portion is $171,535 and will be absorbed by the department’s operating budget from HURF funds. The grant awarded is a one-time award. There are no future or ongoing contributions required after the grant period ends. The grant fulfills a mandated service that the department is required to perform. The grant award is a competitively bid and other eligible agencies may or may not bid on this grant award. The MCDOT’s FY 2024 indirect cost rate is 32.21%. All costs under this agreement are for capital expenditures not subject to indirect cost recovery. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. 96. AGREEMENT WITH ARIZONA COMMUNITY ACTION ASSOCIATION DBA WILDFIRE FOR UTILITY ASSISTANCE PROGRAMS Approve a revenue Agreement between Arizona Community Action Association DBA Wildfire, an Arizona nonprofit corporation (Wildfire) and Maricopa County, administered by its Human Services Department. The purpose of this Agreement is for Wildfire to provide the County with funding for the administration of the weatherization services, utility repair and replacement, utility deposits and bill assistance (Utility Assistance Programs) to eligible Maricopa County residents. Wildfire will provide the County with Utility Repair, Replacement and Deposit (URRD) funding in the amount of $256,140, comprised of the following: • $213,450 for (A) Direct Services • $42,690 for (B) Program Delivery The term of the Agreement shall be retroactive to July 1, 2023, through June 30, 2024. Wildfire contracts with the County on an annual reoccurring, non-competitive basis to administer the URRD program activities in the County outside the City of Phoenix. The Human Services Department provisional indirect rate is 22.2% by the U.S. Department of Health and Human Services for FY2024 for salaries and employee related expenses. The total Agreement funding amount is $256,140 of which $34,935 is for salaries and employee related expenses. The total estimated indirect costs are $7,755 and fully recoverable and shall be effective as of July 1, 2023. Receipt of the funds from Wildfire does not require in-kind or match funds and no future or ongoing contributions by the County are required at the end of the Agreement term. The services provided under this Agreement are not a mandated function but provides a benefit to the citizens by providing weatherization, utility repair and replacement and utility deposits in dwellings occupied by eligible residents, which will assist in reducing the household’s energy burden. The URRD services focus on providing assistance to persons who are elderly, persons with disabilities, families with children, and households with high-energy burdens to reduce energy costs and improve their health and safety. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. The approval of this funding does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant A.R.S. §42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through future budget reconciliation. Acceptance of this Agreement will not impact the County General Fund.
