39. AMENDMENT TO IGA WITH THE CITY OF SURPRISE FOR HOME INVESTMENT PARTNERSHIPS PROGRAM ACTIVITIES Approve Amendment No. 1 to the Intergovernmental Agreement (Agreement) between the City of Surprise (City), a member of the Maricopa HOME Consortium, and Maricopa County administered by its Human Services Department. The purpose of the Agreement is for the City to provide Tenant Based Rental Assistance (TBRA) to eligible individuals that reside in the City of Surprise. TBRA funds may also be utilized to assist residents with security deposit for housing. The County and the City collectively are referred to as the “Parties.” The purpose of the Amendment is to address the following: A. Extend the termination of the Agreement from September 30, 2024 through September 30, 2025. B. Add an additional Work Statement (“2021 Work Statement”) for the City to provide security deposits to eligible individuals to help pay for privately-owned rental housing in the City of Surprise. The expenditure term for this Work Statement for All costs incurred or expensed shall be reimbursable through September 30, 2025. C. The County shall provide Surprise with a total funding of $185,929 for Amendment No. 1. D. The Agreement amount shall now be increased to total not-to-exceed amount of $370,784. E. Revise Section 1 (General Provisions) to address the following paragraphs: 1. Paragraph 5.0 (TERMINATION) to address the Termination process. 2. Paragraph 8.0 (GENERAL REQUIREMENTS) to address the General Requirements process. 3. Paragraph 13.0 (DISPUTES) to address the Disputes process. 4. Paragraph 21.0 (AUDIT DISALLOWANCES) to address the Audit Disallowances process. 5. Paragraph 32.0 (AGREEMENT COMPLIANCE MONITORING) to address the Compliance Monitoring process. 6. Paragraph 33.0 (CONTINGENCY RELATING TO OTHER CONTRACTS AND GRANTS) to address the Contingency process. 7. Paragraph 36.0 (INSURANCE) to address the Insurance process. 8. Paragraph 39.0 (NONDISCRIMINATION) to address the Nondiscrimination, Equal Opportunity, and Equal Access process. 9. Paragraph 47.0 (PROPERTY) to address the Property process. 10. Paragraph 50.0 (EMPLOYMENT DISCLAIMER) to address the Employment Disclaimer process. 11. Paragraph 51.0 (CERTIFICATION REGARDING DEBARMENT, SUSPENSION, INELIGIBILITY AND VOLUNTARY EXCLUSION) to address the Debarment process. 12. Paragraph 52.0 (CONTRACTOR EMPLOYEE WHISTLEBLOWER RIGHTS AND REQUIREMENTS TO INFORM EMPLOYEES OF WHISTLEBLOWER RIGHTS) to address the Whistleblower process. 13. Add the following new paragraph – 55.0 FORCE MAJEURE F. Revise Section 2 (Special Provisions) to address the following paragraphs: 1. Paragraph 4.0 (AUDIT REQUIREMENTS) to address the Audit Requirements process. 2. Paragraph 6.0 (PROGRAM INCOME) to address the Program Income process. 3. Paragraph 20.0 (GENERAL CONDITIONS) to address the General Conditions process. G. Revise Section 4 (Compensation) to address the following paragraph: 1. Paragraph 3.0 (TIMELINESS) to address the Timeliness process. The Agreement is amended to incorporate the changes contained in this Amendment No. 1. All other terms and conditions of the Agreement shall remain the same and unchanged and in full force and effect as executed by the Parties. 68. AMENDMENT TO IGA WITH THE CITY OF SURPRISE FOR HOME INVESTMENT PARTNERSHIPS PROGRAM ACTIVITIES Approve Amendment No. 2 to the Intergovernmental Agreement (Agreement) between the City of Surprise (City), and Maricopa County administered by its Human Services Department. The purpose of the Agreement is for the City to provide Tenant Based Rental Assistance (TBRA) to eligible individuals that reside in the City of Surprise. The Agreement term is through September 30, 2025. The County and the City collectively are referred to as the “Parties.” The purpose of the Amendment No. 2 is to address the following: A. Change Lead Agency Point of Contact. B. Revise Section 3 (Work Statement) to address the following: Add an additional 2022 Work Statement for the City to provide Tenant Based Rental Assistance to residents within the City , as certified a “High” priority in the Consolidated Plan. If the City has completed the required Environmental Review, expenditures may be retroactive to July 1, 2022. The expenditure term for this Work Statement for all costs incurred expenses shall be reimbursable through September 30, 2025. The County shall provide the City with $200,703 for the Work Statement provided by PY22 HOME Investment Partnership Program (HOME) through the U.S. Department of Housing and Urban Development (HUD) funds, under ALN 14.239. C. The Agreement funding amount shall be increased from $370,784 to $571,487 in HOME funds. The Agreement is amended to incorporate the changes contained in this Amendment No. 2. All other terms and conditions of the Agreement shall remain the same and unchanged and in full force and effect as executed by the Parties. The purpose of the Agreement is for the City to provide Tenant Based Rental Assistance (TBRA) to eligible individuals that reside in the City of Surprise. The Agreement term is through September 30, 2025. The County and the City collectively are referred to as the “Parties.” The purpose of the Amendment No. 3 is to address the following: A. Revise Section 3 (Work Statement) to add two new Work Statements for HOME funded activities: 1. 2023 TBRA Work Statement. The City shall provide Tenant Based Rental Assistance (TBRA) to eligible individuals and families that reside in the greater Surprise area. The County shall provide the City with HUD PY2023 HOME under ALN 14.239 funding in a not-to exceed amount of $252,694 funds for this activity. The expenditure timeframe is through June 30, 2024. 2. 2023 UC-TBRA Work Statement. The City shall provide Tenant Based Rental Assistance (TBRA) to eligible individuals and families that reside in the greater Surprise area. The County shall provide the City with HUD PY2019 HOME under ALN 14.239 funding in a not-to exceed amount of $147,729 in HOME funds for this activity. The expenditure timeframe is through June 30, 2024. B. The Agreement funding amount shall be increased from $571,487 to $971,910 in HOME funds. The Agreement is amended to incorporate the changes contained in this Amendment No. 3. All other terms and conditions of the Agreement and previous Amendments remain the same and in full force and effect as executed by the Parties. AMENDMENT TO IGA WITH CITY OF SURPRISE FOR HOME INVESTMENT PARTNERSHIPS PROGRAM ACTIVITIES Approve non-financial Amendment No. 4 to the Intergovernmental Agreement between the City of Surprise, and Maricopa County administered by its Human Services Department. The purpose of the Agreement is for the City to provide Tenant Based Rental Assistance (TBRA) to eligible individuals that reside in the City of Surprise. The Agreement term is through September 30, 2025. The County and the City collectively are referred to as the “Parties.” The purpose of the Amendment No. 4 is to address the following: A. Change the Point of Contact for Maricopa County B. Revise the expenditure timeframe for all work performed, or costs incurred or expended for the 2023 Work Statement activities, which shall hereby be extended from June 30, 2024, through September 30, 2025. The purpose of the Agreement is for the City to provide Tenant Based Rental Assistance (TBRA) to eligible individuals that reside in the City of Surprise. The Agreement term is through September 30, 2025. The purpose of the Amendment No. 5 is to address the following: A. Extend the term of the Agreement from September 30, 2025, through September 30, 2026. B. Add required Federal clause. C. Revise Section 3 (Statement of Work) to add 2024 TBRA Work Statement: 1. The City shall provide Tenant Based Rental Assistance to residents in the West Valley. 2. The County shall provide the City with $195,685 PY24 HOME funds provided by the U.S. Department of Housing and Urban Development (HUD), under ALN 14.239. 3. All work performed, or costs incurred or expended shall be reimbursable through September 30, 2026. D. The Agreement funding amount shall now be increased from $971,910 to $1,167,595 in HOME funds. The Agreement is amended to incorporate the changes contained in Amendment No. 5. All other terms and conditions of the Agreement shall remain the same and unchanged and in full force and effect as executed by the Parties. 78. AMENDMENT TO IGA WITH THE CITY OF SURPRISE FOR HOME INVESTMENT PARTNERSHIPS PROGRAM ACTIVITIES (Supervisor District: 4) Approve financial Amendment No. 6 to the Intergovernmental Agreement (Agreement) between the City of Surprise (City), and Maricopa County administered by its Human Services Department. The purpose of the Agreement is for the City to provide Tenant Based Rental Assistance (TBRA) to eligible individuals that reside in the City of Surprise. The Agreement term is through September 30, 2026. The above-named Agreement is amended as follows in attached Amendment No. 6 to the Agreement: A. Add the City of Surprise Unique Entity Identifier (UEI) to Page 1 of the Agreement. B. Add $207,649 in PY2025 HOME funding for a new Agreement total of $1,375,244 and extend the term of the Agreement through September 30, 2027. C. Add required Federal clause to Section 1 (General Provisions). D. Revise Section 2 (Special Provisions) as follows: 1. Paragraph 15 (Subcontracts and Vendors). 2. Paragraph 22 (Violence Against Women Reauthorization Act of 2013). E. Revise Section 3 (Statement of Work).
