26. AGREEMENT WITH U.S. ENVIRONMENTAL PROTECTION AGENCY AIR POLLUTION CONTROL PROGRAM CLEAN AIR ACT SECTION 105 GRANT Approve an Agreement between the U.S. Environmental Protection Agency (EPA) and Maricopa County through the Air Quality Department (MCAQD) in the not-to-exceed amount of $1,208,856. The purpose of this grant is to provide assistance to MCAQD in its efforts to implement air pollution control programs throughout Maricopa County as required by 40 CFR Part 50, Part 53, and Part 58. This agreement is funded by a grant from the EPA, Award ID# A00905223 and provides full funding. This agreement is retroactively effective from October 1, 2022, to September 30, 2023. The FY2023 Air Quality composite indirect rate of 25.15% will be applied to the direct charges of $965,920. The recoverable indirect cost of administering this grant is $242,936; the non-recoverable indirect cost is $0. The grant award is reoccurring and has been awarded to the department in previous years. The cash or in-kind match is not applicable, indirect cost is fully recoverable, ongoing cash contributions not applicable. The grant award is mandated by the EPA Clean Air Act, Section 105. The grant award is noncompetitively bid. There are no costs that will need to be absorbed by the department’s operating budget. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation; therefore, expenditures of these revenues are not prohibited by the budget law. A budget adjustment is not required. (C-85-24-009-X-00)
