18. APPLY AND ACCEPT ESSER SET-ASIDE/STATEWIDE RECOVER FUNDS FROM THE ARIZONA DEPARTMENT OF EDUCATION Approve the application for and acceptance of $9,979,737.00 from the Arizona Department of Education through RFP BPM004016, ESSER III Set Aside Statewide Recovery Funds. The Maricopa County School Superintendent’s Office will be allocated these discretionary funds as a sub-recipient from the American Rescue Plan ESSER State Funds The term of this grant is May 1, 2022 through September 30, 2024. Authorize the Chairman to sign all documents related to these grant funds, as applicable. In the interest of timeliness to the Arizona Department of Education’s requests, allow the county School Superintendent to sign any related documents, as applicable to this grant. The grant award is One-time, and a cash or in-kind match is not applicable. MCSS’s ADE approved indirect rate for FY 2022 is 2.06 percent. The indirect cost rate allowed by this grant source is 8.00 percent. Total indirect costs on this award are $739,239 of which only $190,354 are allowable. There are no costs that will need to be absorbed by the department’s operating budget. This will be three years of work condensed into 2 year and 6 months. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. This action does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. (C-37-22-023-X-00)

34. COMPETITION IMPRACTICABLE BASIS POLICY RESEARCH Approve a Competition Impracticable (CI) for $1,650,000 for Basis Policy Research, formally of contract serial 171129-RFP. The systems Basis Policy Research owns are essential for successful implementation of the ESSER grant: Learning Acceleration Partnership. The ESSER Grant was approved by the Board of Supervisors on May 4, 2022 (C-37-22-023-X-00) Educational leaders and teachers will be utilizing tools that have been customized to the goals of the grant. Finding a comparable partner that could support the scopes of work, in this time frame, is impractical and would jeopardize the project as a whole . 16. FY2023 COUNTY SCHOOL SUPERINTENDENT BUDGET ADJUSTMENTS In accordance with A.R.S. §42-17106(B), approve the following budget adjustments for Fiscal Year 2023: 1. Increase the expenditure budget for the County School Superintendent (D370) School Communication Fund (782) Non Recurring Non Project (NRNP) budget by $582,612. 2. Increase the expenditure budget for the County School Superintendent (D370) Educational Supplemental Program Fund (790) Non Recurring Non Project (NRNP) budget by $22,485. 3. Decrease the expenditure appropriation in Non Departmental (D470) Non Departmental Grants Fund (249) Non Recurring Non Project (NRNP) Contingency (4711) in the line “Unassigned” by $605,097. 4. Increase the revenue and expenditure budgets for the County School Superintendent (D370) School Grants Fund (715) Operating (OPER) budget by $515,693. The adjustment to Fund 782 is needed after reconciling invoices for the Maricopa County Financial System Services. The adjustment to Fund 790 is needed after reconciling invoices for grant reporting services provided by the Maricopa County School Superintendent’s Office. The adjustment to Fund 715 is needed to increase budget authorization to receive and spend ESSER grant monies, the acceptance of which was approved by the Board of Supervisors at its 5/4/2022 meeting (C-37-22-023-X-00). Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This budget adjustment does not alter the budget constraining the expenditure of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. (C-37-24-000-X-00)
