138. IGA WITH ARIZONA DEPARTMENT OF EDUCATION TO PROVIDE CAPACITY PROJECTS TO DISTRICT SCHOOLS Approve Intergovernmental Agreement (IGA) No: 23-12-ED, ESSER – Maricopa County Teacher-Powered Schools and Social Emotional Lesson Plan Template Projects, between Arizona Department of Education (ADE) and Maricopa County by and through the County School Superintendent (CSS). These projects are aimed at addressing student learning loss resulting from the COVID-19 pandemic through evidence-based practices and will apply the use of ESSER funds from ADE. The IGA shall become effective from and after the date of execution and expire September 30, 2024. Maricopa County is authorized to enter into this IGA under A.R.S. §11-952 for the purposes of exercising joint powers or contracting for services. The grant award is in the amount of $675,000 for the Teacher-Powered Schools Project for the project period from July 1, 2022 through September 30, 2024 and $107,280 for the Social Emotional Lesson Plan Template Project for the project period from July 1, 2022 through June 30, 2024. This is a new grant award and is not expected to reoccur. The grant does not require an in-kind match, however, $139,000 of County monies already budgeted in the general fund will be used to support the projects. Ongoing cash contributions are not required. This is not a mandated function but provides a benefit to students by addressing learning loss resulting from the COVID-19 pandemic. The grant award was competitive. Although the grant would have allowed for indirect costs to be recovered, the grant proposal did not include indirect costs, therefore indirect costs will be zero. As a result of this IGA and pursuant to A.R.S. §42-17106(B), approve an adjustment to the FY 2023 County School Superintendent (D370) Schools Grants Fund (715) Operating (OPER) revenues and expenditures budget in the amount of $453,640. Revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This budget adjustment does not alter the budget constraining the expenditure of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. Funding for this Agreement is provided by a Grant from ADE and will not affect the County’s general fund. (C-37-23-016-X-00)

COMPETITION IMPRACTICABLE CONTRACT WITH EDUCATION EVOLVING Approve a competition impracticable contract with Education Evolving, a non-profit organization, for $205,000 to complete work for the ESSER LEA Capacity Building Support Grant provided through the Arizona Department of Education. This grant was accepted by the Board of Supervisors at its December 7, 2022, meeting (C-37-23-016-X-00). (C-37-25-007-X-00)
