Development of the site shall be in substantial conformance with the site plan entitled “Preliminary Site Plan“, consisting of 2 full-size sheets, dated 5/29/2024 except as modified by the following conditions. Staff may determine slight refinements to remain in substantial conformance with the approved site plan. Minor and major amendments to the site plan will be determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance. b. Development of the site shall be in substantial conformance with the narrative report entitled “Salt Works USA”, consisting of 18 pages, dated August 2023, except as modified by the following conditions. c. The following zoning district IUPD standards shall apply: 1. Max height: 50-feet (new construction) & 100-feet (existing buildings) 2. Funeral home (mortuary or chapel) 18. Hotel, motel or resort 19. Liquor store 20. Lumber yard 21. Medical marijuana dispensary or marijuana establishment 22. Miniature golf course or driving range 23. Mobile home or travel trailer and recreational vehicle sales or service 24. Parking lot and public garage (vehicle storage) 25. Permanent recreation facilities (rodeo, auction, swap meet, campgrounds & sites rented for private events) 26. Pet boarding 27. Printing (lithography and publishing establishments) 28. Recreation centers 29. Theaters 30. Truck stop (accessory facilities, wash, repair, freight, storage, warehousing or distribution) 31. Zoos (including wild or exotic animals for private or commercial basis). e. Accumulation, pilling or stockpiling of salt is prohibited in outdoor areas. All accumulation, piling and stockpiling shall occur within the warehouse or the silo. f. The following planning engineering condition will apply: 1. For sites located within the County’s Urbanized Area, a Storm Water Pollution Prevention Permit (SWPPP) from the County will be required prior to issuance of any construction permits. This does NOT preclude the requirement to obtain a Notice of Intent to Discharge (NOID) from the State (ADEQ), as may be required. 2. Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 3. Based on the conceptual design nature of the information submitted, changes to the site layout and/or a reduction in the number of building lots may be necessitated by the final engineering design of the subdivision drainage infrastructure. 4. The site is not located in a Special Flood Hazard Areas (SFHAs). The Flood Control District has no comments on this application. g. Site access via adjacent private easements will be improved per Maricopa County paving standards. Applicant is responsible for coordinating with MCDOT to improve adjacent 107th Ave ROW access. MCDOT TIS approval is required prior to any construction permit. h. The applicant/property owner shall submit a ‘will serve’ letter for fire protection services for the project site. A copy of the ‘will serve’ letter shall be required as part of the initial construction permit submittal. i. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. j. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property shall be considered for reversion to the zoning that existed on the date of application pursuant to Maricopa County Zoning Ordinance requirements. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation. The zoning enhances the value of the property above its value as of the date the IND-2 IUPD zoning is granted and reverting to the prior zoning results in the same value of the property as if the zoning had never been granted. 18. FY25 VICTIMS' RIGHTS GRANT FUNDING FROM ARIZONA ATTORNEY GENERAL Approve receipt of FY 2024-2025 grant funds from the State of Arizona, Office of the Attorney General, in the amount of $339,400.00. These grant funds will support mandated functions by covering direct costs of implementing victims’ rights laws pursuant to Arizona Revised Statues Title 13, Chapter 40, and Title 8, Chapter 3, Article 7, that impact prosecutorial agencies as an entity type. This agreement retroactively commenced on July 1, 2024, and terminates on June 30, 2025. In accordance with Victims’ Rights Program Guidelines, Section IV, page 5, the grant allows a 0% rate for indirect costs, or $0 that may be incurred by the County Attorney’s Office of Maricopa County for the administration of this grant. The Maricopa County Attorney’s Office FY2025 composite indirect cost rate is 15.530%, or $52,708.82 The recoverable indirect cost of administering this grant is $0; the non-recoverable indirect cost is $52,708.82. Nonrecoverable indirect costs will be covered by the department's general fund budget. This grant is non-competitive and does not require a match. The grant award does not require ongoing cash contributions after the grant period ends. Authorize the Chairman of the Board of Supervisors, or designee, to sign all documents related to this award. Grant revenues are not "local revenues" for the purpose of the constitutional expenditure limitation, and therefore expenditure of the funds is not prohibited by the budget law. This award agreement is in the amount of $339,400.00. This award will ensure that victims of crime are notified of the progress of criminal proceedings. This grant will expire at the end of the agreement. There is no long-term expectation of continued funding for this grant; however, the County Attorney’s Office has been receiving grant funds from the Attorney General’s office for victim services since FY96/97, the most recent award was for FY 23/24 in the amount of $339,400. ACCEPT FUNDING REIMBURSEMENT FROM PHOENIX PD Approve acceptance of up to $30,000 from City of Phoenix, PD Internet Crimes Against Children Task Force, for which Maricopa County Sheriff's Office (MCSO) is an affiliate authorized in IGA 157605--0, AKA C-50-22-139-X-00, approved in an action taken by the BOS on April 6, 2022. The IGA terminates December 22, 2027. The Sheriff’s Office indirect cost rate for FY25 is 26.71%. The indirect cost basis is $30,000. Unrecoverable indirect costs associated with this Agreement are estimated to be $8,013. These unrecoverable indirect costs will be absorbed by the General Fund. This funding is competitive and does not require a match. The funding is recurring and has been awarded to the Sheriff’s Office for over six years. The agreement does not require future or on-going cash contributions after the grant period ends. This funding is not for a specific mandate but supports the Sheriff’s Office overall public safety mandate. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. The Sheriff’s Office is mandated by Arizona Revised Statues Title 13, Chapter 40 (Crime Victim’s Rights) and Title 8, Chapter 3 (Victim Rights for Juvenile Offenses) requires victim notification upon a suspect’s arrest, next court appearance, release from custody, post-conviction/post adjudication release etc. This funding award offsets a portion of the cost to meet this mandate and provides funding for positions as follows: .32 FTE of five (5) Justice System Clerk positions, .32 FTE of one (1) Justice System Clerk Senior and .32 FTE of one (1) Justice System Clerk Supervisor position. The award also funds certain operating expenses. The remaining annual cost burden of this mandate, calculated to be $370,467, is funded within the Maricopa County Sheriff's Office (MCSO) annual appropriation. The MCSO indirect cost rate for FY24 is 26.71%. Unrecoverable indirect costs associated with this Agreement are estimated to be $48,879.30 and will be absorbed by the Detention Fund. This funding is recurring, there is no matching requirement nor is there a competitive bid process for this grant. The grant award does not require ongoing cash contributions after the grant period end date. These revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. 41. MARICOPA COUNTY WIOA LOCAL PLAN FOR PROGRAM YEARS 2025-2028 Approval for the following action regarding the Maricopa County Workforce Development Board (MCWDB) as set forth below: 1. Approve the Maricopa County Workforce Innovation & Opportunity Act (WIOA) Local Plan for 2025-2028. Maricopa County, excluding the City of Phoenix, is the Local Workforce Development Area (LWDA) ARIZONA@WORK –, the workforce network of business and employment-related service providers for Maricopa County. In accordance with WIOA, the Local Plan must be approved by the Chief Elected Officials. The Maricopa County Local Plan is from January 1, 2025 through December 31, 2028. The Maricopa County Local Plan must be in place to reflect the current and projected needs of the workforce system consistent with the State plan. AGREEMENT WITH U.S. ENVIRONMENTAL PROTECTION AGENCY Approve an Agreement between the U.S. Environmental Protection Agency (EPA) and Maricopa County through the Air Quality Department (MCAQD) in the not-to-exceed amount of $1,141,402. The purpose of this grant is to provide assistance to MCAQD in its efforts to implement air pollution control programs throughout Maricopa County as required by 40 CFR Part 50, Part 53, and Part 58. This agreement is funded by a grant from the EPA, Award ID# A00905224 and provides full funding. This agreement and budget are effective until September 30, 2024. The FY2024 Air Quality composite indirect rate of 35.34% will be applied to the direct charges of $843,386. Per the EPA award letter, the indirect cost of administering this grant is $298,016 and is allowable and fully recoverable. The grant award is reoccurring and has been awarded to the department in previous years. The cash or in-kind match is not applicable, and ongoing cash contributions are not applicable. The grant award is mandated by the EPA Clean Air Act, Section 105. The grant award is noncompetitively bid. There are no costs that will need to be absorbed by the department’s operating budget. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation; therefore, expenditures of these revenues are not prohibited by the budget law. FY25 AGREEMENT WITH THE MARICOPA ASSOCIATION OF GOVERNMENTS Approve an Agreement between Maricopa Association of Governments (MAG) and Maricopa County through the Air Quality Department (MCAQD) in the not-to-exceed amount of $962,347. The purpose of this Agreement is to support Air Quality Department program efforts. This Agreement and budget are effective from October 1, 2024, until September 30, 2025. The FY2025 MCAQD indirect cost rate of 36.10% will be applied to the direct charges of $452,863.33. Per the MAG award agreement, the indirect cost of administering this grant is $163,483.67 and is allowable and fully recoverable. The grant award is reoccurring and has been awarded to the department in previous years. The cash or in-kind match is not applicable, and ongoing cash contributions are not applicable. RESTRICTED DONATION BUDGET ADJUSTMENT In accordance with A.R.S. §42-17106(B), approve the following adjustments to the FY 2025 budget: Increase the expenditure authority (only) for the Animal Care and Control (D790) Animal Care Donations Fund (575) Operating (OPER) by $50,000, and authorize the use of fund balance for the carryover of the Fear Free restricted donation. This donation was received but not spent in FY 2024 due to vendor delays and is to be used solely for the Fear Free Intake and Safe Waiting Space Initiative. Donation funds are not local revenues for the purpose of the constitutional expenditure limitations and, therefore, expenditures of these revenues are not prohibited by the budget law. The interface ensures compliance with data standards, facilitating efficient and accurate sharing of information to support coordinated patient care across healthcare providers within the state’s network. ONE-TIME ADDITION TO FLEET FOR SECURITY SERVICES Approve a one-time addition to the fleet for an out of service vehicle that has recently been replaced (#311346 – 2013 Ford Expedition), to assist with Security Services patrols. This vehicle is currently assigned to Emergency Management, but the department would like to assign the asset to Security Services. With increased patrols and staffing at Security Services, the unit will benefit from the additional vehicle to conduct their work. This vehicle will be primarily used to conduct regular patrol monitoring of County areas and buildings. The estimated annual operating expense for the vehicle would be approximately $5,000. Receipt of funding is reoccurring for Licensees that are co-located in the County controlled facility. Cash match or in-kind is not required in the Agreement term. The service provided under this Agreement are not a mandated function but provide a benefit to the citizens by providing residents and employers with job related assistance. Receipt of the funds from the Licensee does not require future or ongoing contributions by the County at the end of the Agreement term. This Agreement is issued through a non-competitive process. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. The approval of this funding does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant A.R.S. §42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through future budget reconciliation. Either Party may terminate the Agreement pursuant to ARS § 38-511, at the end of any fiscal year or with 30-days prior written notice. ACCEPT RYAN WHITE GRANT FUNDS FROM THE HEALTH RESOURCES AND SERVICES ADMINISTRATION FOR LIFE SAVING MEDICAL AND SUPPORT SERVICES Approve the acceptance of grant funds from Health Resources and Services Administration (HRSA) in the not-to-exceed amount of $11,432,797. The grant will provide continued lifesaving medical and support services to people living with HIV/AIDS (PLWHA). The award period begins on March 1, 2025, and ends February 28, 2026. This grant award is reoccurring and has been awarded to the Department for decades. This is a non-competing continuation opportunity and there is no cash or in-kind match required. This is not a mandated service but provides a benefit to citizens of Maricopa County by providing health and support related services for approximately 5,000 PLWHA. Should the grant cease, on-going contributions will not be required. The MCDPH indirect rate for FY25 is 15.79%. Sub-recipient awards will total approximately $9,717,877 and are not subject to indirect cost. The administrative award will total approximately $1,714,920. As such, the full indirect costs of this award are estimated to be $233,859.46. All program costs are allocated to the grant and there will be no burden on the department’s operating budget. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. 67. BOARD OF HEALTH BYLAWS Approve the Bylaws of the Board of Health (BOH). As outlined in Title 36, Chapter 1, Article 4 of the Arizona Revised Statutes (ARS), as amended, the BOH plays a critical role in safeguarding public health within Maricopa County (MC). Its responsibilities include recommending rules, regulations, and ordinances to the Maricopa County Board of Supervisors (BOS), aimed at the protection and preservation of public health. The BOH is appointed by and accountable to BOS, ensuring that its actions align with the county's strategic health priorities. The Maricopa County Department of Public Health (MCDPH), along with the Departments of Environmental Services (MCES) and Air Quality (MCAQ), are integral to the implementation of the BOH’s recommendations. These departments provide the necessary expertise and resources to enforce the regulations and ordinances approved by BOS. By working in conjunction with MCDPH, BOH ensures that public health policies are effectively operationalized, reflecting the community's health needs and concerns. BOH has specific powers and duties relating to the MCDPH, MCES, and MCAQ. In accordance with state law, BOH is tasked with recommending regulatory measures to BOS for adoption and enforcement. These measures are vital for maintaining the health and safety of our community. Furthermore, BOH is empowered to perform other duties that align with state law, ensuring comprehensive oversight and responsive action to emerging public health needs. REVISIONS TO VIDEO RECORDING PROCESSING FEES BY LEGAL LIAISON SECTION Pursuant to ARS 11-251.08 and 39-129, set a hearing for October 23, 2024, to consider the proposed revisions to the processing fees to be charged by the Legal Liaison Section (LLS) of the Sheriff’s Office to the public for video recording requests. The original hearing was held on January 10, 2024. Requested changes are as follows: LLS will charge $25/hour when processing for video recordings which include a review for redaction ($25 per hour X length of video) OR use $25/hour per hour actually worked to produce the record, WHICHEVER IS LESS. The original adoption of the processing fees was January 10, 2024. The rest of the processing fees remains the same: Multiple requests received for the DVDs already processed (i.e. reviewed, redacted, supervisor approved) of the same recording will have a flat fee of $15 per subsequent request after the initial charge.
