7. OFF 17 NORTH STORAGE Case #: SU250007 (Supervisorial District: 4) Applicant and Owner: Shaine T. Alleman, Tiffany & Bosco, P.A. / North Pioneer Road Storage, LLC Request: Special Use Permit (SUP) for commercial storage and outdoor parking of recreation vehicles, boats, and travel trailers on a Rural-43 zoned parcel Site Location: Generally located 3,000’ northwest of I-17 and Daisy Mountain Dr. in the Anthem area Commission Recommendation: On 4/9/26, the Commission voted 7-1(motion by Commissioner Toma D4, seconded by Commissioner Leighton D4) to adopt a motion recommending the Board of Supervisors approve SU250007 subject to conditions ‘a’ -‘i’. a. Development of the site shall be in substantial conformance with the Site Plan entitled “Off-17 RV and Boat Storage”, consisting of 3 full-size sheets, dated October 29, 2025 except as modified by the following conditions. Staff may determine slight refinements to remain in substantial conformance with the approved site plan. Minor and major amendments to the site plan will be determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance. b. Development of the site shall be in substantial conformance with the Narrative Report entitled “Off 17 North Storage”, consisting of 7 pages, dated July 2025, except as modified by the following conditions. c. This special use permit is valid for a period of 10 years and shall expire on May 6, 2036 or upon termination of the use for a period of 90 or more days, whichever occurs first. All site improvements associated with the special use permit shall be removed within 90 days of such expiration or termination of use. d. Prior to construction permitting the applicant shall provide documentation from the Arizona State Land Department showring legal access to the site. e. The following Planning Engineering conditions shall apply: 1. First-Flush retention volumes must be provided prior to building permit issuance. First-flush volume must be drained through infiltration. 2. Work within the Deadman Wash SFHA will require a Floodplain Use Permit issued concurrently with the Building Permit through PND. 3. Applicant is responsible for procuring any required permissions needed for site access and access improvements. 4. Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 5. Based on the conceptual design nature of the information submitted, changes to the site layout may be necessitated by the final engineering design of the drainage infrastructure. 6. Detailed Grading and Drainage Plans must be submitted with the application for Building Permits 7. Noncompliance with any Maricopa County regulation shall be grounds for initiating a revocation of this zone change as set forth in the Maricopa County Zoning Ordinance. f. following Rural-43 SUP standards shall apply: i. Minimum Side Setback: 40' ii. Minimum Street-side Setback: 40' iii. Minimum Screening: 8’ CMU iv. Pavement: Crushed Asphalt v. Vehicle Height Restriction: No vehicles taller than 6 feet in height may be stored within the side or street-side setback areas. vi. Lighting: All lighting must be fully shielded and directed downward so that no light trespasses beyond the parcel. g. The following Rural-43 SUP standards shall apply: (1) Minimum Side Setback: 40’. (2) Minimum Street-side Setback: 40’. (3) Minimum Screening: 8’ CMU. (4) Pavement: Crushed Asphalt. (5) Vehicle Height Restriction: No vehicles taller than 6 feet in height may be stored within the side or street-side setback areas. (6) Lighting: All lighting must be fully shielded and directed downward so that no light trespasses beyond the parcel. h. Prior to occupying the existing residence or any portion thereof for any use associated with the Special Use Permit, the applicant shall obtain a Building Permit to retrofit the existing residence to meet current commercial building code requirements as applicable and shall obtain a Certificate of Occupancy for the retrofitted building prior to occupancy. i. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property may be considered for reversion to the zoning that existed on the date of application in accordance with Maricopa County Zoning Ordinance requirements. It is, therefore, stipulated and agreed that reversion of the zoning due to the failure to comply with any conditions does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such reversion of the zoning. This zone change enhances the value of the property above its value as of the date the zone change is granted, and reverting to the prior zoning results in the same value of the property as if the zone change had never been granted.
