DOMRES 90 Case #: MCP250001 (Supervisorial District: 4) Applicant and Owner: Jack Gilmore - Gilmore Planning and Architecture / Speedworld, LLC Request: Military Compatibility Permit (MCP) with a Plan of Development (POD) for outdoor industrial storage in the Rural-43 MAAMF zoning district Site Location: Generally located between 199th Ave. on the west and 195th Ave. on the east, on both the north and south sides of Frontier Dr. in the Wittmann area Commission Recommendation: On 4/9/26, the Commission voted 8-0 (motion by Commissioner Toma, D4, seconded by Commissioner Rochwalik D3) to adopt a motion recommending the Board of Supervisors approve MCP250001 subject to conditions ‘a’ -‘g’. a. Development of the site shall be in substantial conformance with the Site Plan entitled “Domres 90 Site Plan“, consisting of 2 full-size sheets, dated January 2026, except as modified by the following conditions. Staff may determine slight refinements to remain in substantial conformance with the approved site plan. Minor and major amendments to the site plan will be determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance. b. Development of the site shall be in substantial conformance with the Narrative Report entitled “Application for Military Compatibility Permit for Domres 90”, consisting of 35 pages, dated August 13, 2025, except as modified by the following conditions. c. The following Planning Engineering conditions shall apply: 1. Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 2. Based on the conceptual design nature of the information submitted, changes to the site layout may be necessitated by the final engineering design of the site’s drainage infrastructure. 3. Maricopa County does not supply water, fire or sewer services. It is the applicant/owner’s responsibility to coordinate and secure water, fire and sewer services for this site. 4. Sealed final Grading and Drainage (Site Infrastructure) Plans and Sealed Final drainage report must be submitted with the application for Building Permits 5. Lintel openings and calculations with final drainage report at building permit phase shall have 50% clogging factor. Flows shall represent the 100yr flows. 6. All channels shall have 1 foot of freeboard. 7. Drainage and private access easements shall be dedicated for this site in accordance with the DPSM. Recordation must be provided prior to building permit issuance. 8. Percolation methods for retention basins shall be provided to drain entire basin within 36hours. 9. Roadway- 195TH Avenue- Maintain/dedicate the 55’ ROW. 10. Roadway- Frontier Drive shall remain private roadway but driveway connection to 195th Ave shall be per MCDOT Roadway design manual. 11. An updated traffic impact study is required for each additional new use and must be approved by MCDOT. d. The following Rural-43 MAAMF standards shall apply: 1. Setbacks: 195th Ave – 40’, 199th Ave – 40’, South MCP Boundary – 40’, North MCP Boundary – 20’, Interior lot lines, noise contours, APZ2, and Frontier Dr. – 0’ 2. Screening: Minimum 6' solid wall along MCP perimeter 3. Paving: Pavement off 195th Ave (Frontier Dr.) then stabilized milled asphalt e. All buildings subject to noise attenuation as per ARS § 28-8482(B). f. Prior to issuance of a building permit, written confirmation will be required from the emergency fire protection jurisdiction having authority that the facility has been designed in accordance with their regulations and requirements, and that emergency fire protection service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. g. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property may be considered for revocation to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the MCP. The MCP Development enhances the value of the property above its value as of the date the MCP is granted and reverting to the prior zoning results in the same value of the property as if the MCP had never been granted. Development of the site shall be in substantial conformance with the Site Plan entitled “Off-17 RV and Boat Storage”, consisting of 3 full-size sheets, dated October 29, 2025 except as modified by the following conditions. Staff may determine slight refinements to remain in substantial conformance with the approved site plan. Minor and major amendments to the site plan will be determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance. b. Development of the site shall be in substantial conformance with the Narrative Report entitled “Off 17 North Storage”, consisting of 7 pages, dated July 2025, except as modified by the following conditions. c. This special use permit is valid for a period of 10 years and shall expire on May 6, 2036 or upon termination of the use for a period of 90 or more days, whichever occurs first. All site improvements associated with the special use permit shall be removed within 90 days of such expiration or termination of use. d. Prior to construction permitting the applicant shall provide documentation from the Arizona State Land Department showring legal access to the site. e. The following Planning Engineering conditions shall apply: 1. First-Flush retention volumes must be provided prior to building permit issuance. First-flush volume must be drained through infiltration. 2. Work within the Deadman Wash SFHA will require a Floodplain Use Permit issued concurrently with the Building Permit through PND. 3. Applicant is responsible for procuring any required permissions needed for site access and access improvements. 4. Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 5. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property may be considered for reversion to the zoning that existed on the date of application in accordance with Maricopa County Zoning Ordinance requirements. Development of the site shall be in substantial conformance with the zoning exhibit entitled “Zoning Map“, consisting of 1 page stamped received February 19, 2026, except as modified by the following conditions. Staff may determine slight refinements to remain in substantial conformance with the approved site plan. b. Development of the site shall be in substantial conformance with the narrative report entitled “Salome Village Shops“, consisting of 13 pages stamped received March 11, 2026, except as modified by the following conditions. Staff may determine slight refinements to remain in substantial conformance with the approved site plan. c. Administrative approval of a Plan of Development will be required prior to approval and issuance of construction permits to develop and establish use of the site. Prior to issuance of a building permit, written confirmation will be required from the emergency fire protection jurisdiction having authority that the facility has been designed in accordance with their regulations and requirements, and that emergency fire protection service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. d. The zone change is applied to restrict the use of the site. Until such time as the site is served by sewer, uses on the site shall only be those acceptable to the Maricopa County Environmental Services Department (MCESD) that can be accommodated by septic systems. A public water system and public sewer system shall be required prior to establishment of any non-residential use that requires potable water. e. The following Planning Engineering conditions shall apply: 1. Further entitlements such as a Plan of development (POD), will require: a. Submittal of an approved traffic impact statement (less than 1year old), updated TIS or TIS waiver. b. Engineered Grading and drainage plans and compliance with drainage and floodplain regulations. c. Compliance with MCDOT planning comments from the PA250132 for Right of way dedication and/or preservation. 2. Engineering and drainage review was based on a zone change submittal without a plan of development. Therefore, without the submittal of a precise plan of development, no development approval is inferred by this review, including, but not limited to number of proposed building lots/units, drainage design, access and roadway alignments. These items will be addressed as development plans progress and are submitted to the County for further review and/or entitlement. 3. Engineering review of re-zone cases is conceptual in nature. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 4. The county does not provide fire service; therefore, it is incumbent that the applicant seeks service and approval of plans from the jurisdictional fire service provide. f. The following Maricopa County Environmental Services conditions shall apply: 1. Wastewater is not permitted to discharge to an adjacent parcel’s septic system. 2. If conducting food service in unincorporated Maricopa, a grease trap will be required by Onsite Wastewater program. 3. Setback requirements must be maintained per Arizona Administrative Code, Title 18, Chapter 9, Article 312, C (Features Requiring Setbacks). 4. Projected flows between 3,000 and 24,000 gallons per day require a 4.23 General Permit and may require nitrogen treatment. 5. If the wastewater flow exceeds 24,000 gpd or if an activated sludge treatment process is to be used, then a wastewater treatment plant may be required. 6. Additionally, an Individual Permit through the Arizona Department of Environmental Quality (ADEQ) may be required. 7. Per the Safe Drinking Water Act, any water system that supplies more than 25 people or 15 service connections per day for at least 60 days per year is classified as a Public Water System (PWS). 8. If the above criteria are met, a Public Water System application and a New Source Approval application are required and must be submitted to the MCESD’s Drinking Water Program. A water quality analysis report will be required with submittal and is good within one-year of testing. 9. An Approval to Construct application is required to be submitted to the MCESD’s Treatment Program for all PWS water treatment facilities. 10. An Approval to Construct application is required to be submitted to the MCESD’s Subdivision & Infrastructure Program for all PWS water system infrastructure. g. The following Maricopa County Department of Transportation conditions shall apply: 1. Salome Highway is classified as an urban principal arterial requiring fee dedication of a 65-foot half street from the center line permit the Maricopa County Zoning Ordinance Section 804. a. It is the developer's responsibility to determine if the existing right of way is fee simple, if it is not then the developer will need to provide the right of way in said form. b. Applicant is required to provide, at applicant’s expense, an American Land Title Association (“ALTA”) Owner’s Policy of Title Insurance showing title vested in Maricopa County, a political subdivision of the State of Arizona. c. Dedication shall be completed by time of permit approval or case closeout if no MCDOT permit is required 2. The above comments do not include identification of utilities or underground facilities within or adjacent to the required right-of-way that may have prior rights and/or require relocation. 3. Any additional dedication and offsite improvement requirements will be determined by MCDOT Traffic based on a submitted TIA/TIS and the above roadway classification a. TIA/TIS to be submitted to MCDOT via Permit Center at https://maricopacountyaz-energovweb.tylerhost.net/apps/selfservice#/home. b. If a TIA/TIS has been previously submitted, approval is valid for one year. If review for construction is not underway within this time period, MCDOT may request an updated traffic report to assess any changes in condition. h. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. i. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property may be considered for revocation to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change. PROJECT BACCARA Case #: MCP250007 (Supervisorial District: 4) Applicant and Owner: Madison Leake, Burch & Cracchiolo / Baccara Eagle Land, LLC Request: Military Compatibility Permit (MCP) for utility land uses to include gas power generation facility and data center in the IND-3 MAAMF & Rural-43 MAAMF zoning districts Site Location: Generally located north of Olive Rd. and ½-mile west of Litchfield Rd. in the west Glendale area Commission Recommendation: On 4/9/26, the Commission voted 8-0 (motion by Commissioner Toma D4, seconded by Commissioner Leighton D4) to adopt a motion recommending the Board of Supervisors approve MCP250007 subject to conditions ‘a’ -‘p’. a. Development of the site shall be in substantial conformance with the Narrative Report entitled “Project Baccara Military Compatibility Permit Narrative”, consisting of 20 pages, revision dated 3/17/2026, and stamped received 3/19/26, except as modified by the following conditions. b. The Military Compatibility Permit will only allow the following land uses pursuant to MCP250007: 1. Natural gas power generating facility with turbines 2. Backup power with propane and diesel 3. Field electrical substation 4. Data center buildings and appurtenances 5. Screening, parking and security c. The following IND-3 MAAMF and Rural-43 MAAMF zoning district standards shall apply: 1. Maximum gas turbine stack height: 72’ 2. Minimum gas turbine setback: 150’ measured from any lot line. 3. Minimum setback: 75’ measured from any lot line. 4. Minimum parking spaces: Data Center uses 1 : 10,000 sq. ft. of floor space. 5. Minimum parking spaces: Gas Turbine Yard uses 1 : 1,500 sq. ft. of floor space. 6. Minimum screening: Along the north and east perimeter of use, a minimum 8’ high solid wall shall be provided. Along the west and south perimeter of use, a minimum 8’ high anti-climb fence (such as Ameriscar Impasse II or similar) and landscape screening shall be provided. d. Changes to the Baccara Project Military Compatibility Permit MCP250007 with regard to any of the approved land uses or the conditions approved by the Board of Supervisors, shall be processed as a revised application with approval by the Board of Supervisors upon recommendation of the Planning and Zoning Commission. Revised applications shall be in accordance with the applicable zoning ordinance and County regulations in effect at the time of amendment application. Non-compliance with the approved Baccara Project Military Compatibility Permit, including the narrative report or approved conditions constitutes a violation in accordance with the Maricopa County Zoning Ordinance. e. Unless effective annexation into the City of Glendale, prior to approval of a precise Plan of Development approval, the applicant shall provide the Maricopa County Planning and Development Department with an executed pre-annexation service agreement with the City of Glendale that identifies the detail for when the proposed project will be annexed and the provision of water and sewer service. In lieu of pre-annexation service agreement the developer must provide a ‘will serve’ letter from the certificated water and sewer provider(s). f. Unless effective annexation into the City of Glendale, approval by the Board of Supervisors of a Plan of Development will be required prior to approval and issuance of construction permits to develop and establish use of the site. Prior to issuance of a building permit, written confirmation will be required from the emergency fire protection jurisdiction having authority that the facility has been designed in accordance with their regulations and requirements, and that emergency fire protection service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. g. The development and operation of the site shall comply with all Conditions for Compatibility and Additional Requirements identified in the Luke Air Force Base letter dated March 13, 2026, which are incorporated herein by reference. h. The applicant shall submit a Military Compatibility Compliance Report as part of the Plan of Development application and building permits subject to review and approval by the Maricopa County Planning and Development Department, in coordination with Luke Air Force Base, prepared and sealed by qualified professionals, demonstrating compliance with all applicable Luke Air Force Base requirements as outlined in the letter dated March 13, 2026, including but not limited to: 1. Electromagnetic interference (EMF/RFI): A technical analysis demonstrating that the facility will not create interference with military or civilian aviation systems, communications equipment, or radar operations. 2. Airspace and communications (FAA/FCC): Documentation of completed FAA Obstruction Evaluation/Airport Airspace Analysis (OE/AAA), any required spectrum analysis, and all required FCC authorizations, demonstrating that no structure or equipment constitutes a hazard to air navigation or communications. 3. Visibility, lighting, and exhaust/plume impacts: A glare analysis and exhaust/plume study demonstrating that lighting, reflective surfaces, emissions, heat exhaust, or atmospheric effects will not impair pilot visibility or interfere with aircraft operations. 4. Air quality compliance (ADEQ): Evidence of all required air quality permits and demonstration that emissions will comply with applicable federal, state, and local regulatory limits. 5. Fire protection and hazard mitigation: A plan demonstrating that the facility is designed to minimize risks associated with fire, explosion, or aircraft impact, including coordination with and approval by the applicable fire authority. 6. Fuel system design: Demonstration that no natural gas storage will occur on-site and that all fuel delivery and backup systems comply with applicable safety regulations and codes. 7. DoD Siting Clearinghouse review: Documentation confirming submittal to the Department of Defense Siting Clearinghouse and demonstration that any recommendations or conditions resulting from that review have been incorporated into the project design. 8. Sound attenuation and notification: Demonstration of compliance with A.R.S. § 28-8482 and implementation of a notification program informing occupants and users that the property is located within the vicinity of a military airport and subject to aircraft overflights. i. The operation of the facility shall not create visual, atmospheric, or electronic interference with aircraft operations. If such impacts are identified by Luke Air Force Base, the FAA, or other regulatory agencies, the operator shall take corrective action to eliminate the impact. Failure to do so shall constitute a violation of this approval. j. All development standards and design criteria, including amenity and enhancement guidelines, shall be established at the time of precise plan of development or amendment thereto. All precise plans of development or amendments thereto shall be approved by the Board of Supervisors, upon recommendation by the Commission. k. All buildings subject to noise attenuation as per ARS § 28-8482(B). l. The following Planning Engineering conditions shall apply: 1. Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Polices and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 2. If the above criteria are met, a Public Water System application and a New Source Approval application are required and must be submitted to the MCESD’s Drinking Water Program. A water quality analysis report will be required with submittal and is good within one-year of testing. 2. Per the Safe Drinking Water Act, a Community Water System (CWS) is defined as a Public Water System that serves the same 25 or more year-round residents. A Non-Transient Non-Community Water System (NTNCWS) is defined as a Public Water System that serves the same 25 or more persons for at least six months per year. Development of the site shall be in substantial conformance with the Site Plan entitled “J&S Dumpster Service“, consisting of 3 full-size sheets, dated January 2026 except as modified by the following conditions. b. Development of the site shall be in substantial conformance with the Narrative Report entitled “Narrative for SU250039”, consisting of 5 pages, dated February 13, 2026, except as modified by the following conditions. c. This special use permit is valid for a period of 5 years and shall expire on May 6, 2031, or upon abandonment of the use for a period of 90 or more consecutive days, whichever occurs first. d. This SUP will only allow the additional use of the Rural-43 zoned property to park and store refuse bins and trucks associated with the business. The bins must be empty of waste and clean when stored on site. e. Outdoor storage is limited to empty bins only. No compacting or solid waste material is allowed within any bin stored on the property. No cleaning of bins will be allowed on site. All bins will be cleaned prior to re-storage on the lot. f. Per the narrative, the number of bins allowed to be stored/parked on site is 23 or fewer. g. Truck traffic associated with the business is limited to the hours between 6am and 5pm. Business operations will cease on the property at 5pm Monday through Saturday. h. The following Rural-43 SUP standards shall apply: 1. Surface Material: All parking and business storage areas shall be surfaced with minimum of asphalt millings. 2. Lighting: All outdoor lighting shall conform to MCZO, Sec. 1112 and shall be shielded so that light is directed downward below the horizontal plane at bottom of the light source and so that no light trespasses onto adjacent properties. i. The following Planning Engineering conditions shall apply: 1. Agriculturally exempt sites are not exempt from Maricopa County floodplain regulations. The narrative states the majority of the land is being used for the care and training of horses, with improvements such as an arena, barn and multiple horse pens. Any of these features within floodway or floodplain within the Ag Exempt area and use will require permits through Maricopa County Flood Control District (FCD). This is separate from the special use area. You must obtain these permits from FCD prior to the Planning & Development Department issuing any building permits for the new special use area. 2. Basin ponding greater than one foot in depth shall provide methods to percolate runoff within 36 hours. 3. Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 4. Based on the conceptual design nature of the information submitted, changes to the site layout may be necessitated by the final engineering design of the site’s drainage infrastructure. 5. Maricopa County does not supply water, fire or sewer services. It is the applicant/owner’s responsibility to coordinate and secure water, fire and sewer services for this site. 6. Sealed final Grading and Drainage (Site Infrastructure) Plans and Sealed Final drainage report must be submitted with the application for Building Permits j. Noncompliance with any of the conditions assigned to the approval of this Special Use Permit by the Maricopa County Board of Supervisors may be grounds for revocation in accordance with the requirements and procedures as set forth in the Maricopa County Zoning Ordinance. k. GRANT FUNDING FROM U.S. DEPARTMENT OF EDUCATION FOR INNOVATIVE APPROACHES TO LITERACY Approve application for grant funding from the U.S. Department of Labor on behalf of the U.S. Department of Education (ALN 84.215G) in the maximum amount of $4 million over a period of up to 60 months October 1, 2026 - September 30, 2031. The grant’s purpose is to provide funding for programs that expand access to high-quality books, strengthen school library programs, and promote literacy development in high-need LEAs with a goal of increasing reading proficiency. There is not a match requirement for this grant. If awarded the full $750,000 for fiscal year 2027, the recoverable indirect cost of administering this grant will be $112,500. Future ongoing cash contributions are not required after the grant period. The grant award will help support the Superintendent in meeting the mandate in A.R.S. §15-302 to collaborate with the department of education and other state agencies to assist schools in using student data, staff development, curriculum alignment, and technology to improve student performance. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. GRANT FUNDING FROM U.S. DEPARTMENT OF EDUCATION FOR TEACHERS AND SCHOOL LEADERS Approve application for grant funding from the U.S. Department of Labor on behalf of the U.S. Department of Education (ALN 84.374A) in the maximum amount of $12,000,000 over a period of up to 36 months October 1, 2026 - September 30, 2029. The grant’s purpose is to develop, implement, improve, or expand human capital management systems (HCMS) for teachers, principals, or other school leaders who raise student growth and academic achievement, support workforce readiness, and close the achievement gap between high- and low-performing students. In addition, applicants can also receive competitive preference points for projects or proposals that are designed to advance meaningful learning, including high-quality and proven interventions that will directly benefit student learning outcomes. There is a 50% match requirement, which can be cash or in-kind contributions and will be provided by participating school districts or contractor or absorbed by the Superintendent’s operating budget. Grant funds must be used to supplement, and not supplant, other Federal or State funds that would otherwise be expended to carry out activities under this program. If awarded the full $1.5 million for fiscal year 2027, the recoverable indirect cost of administering this grant will be $120,000. Future ongoing cash contributions are not required after the grant period. The grant award will help support the Superintendent in meeting the mandate in A.R.S. §15-302 to collaborate with the department of education and other state agencies to assist schools in using student data, staff development, curriculum alignment, and technology to improve student performance. The grant award is competitive and previously was awarded to the County School Superintendent beginning October 2024 before being terminated by the federal government in February 2025. ACCEPT FUNDING FROM US IMMIGRATION AND CUSTOMS ENFORCEMENT FOR OVERTIME IN RELATION TO JOINT OPERATION EXPENSES Approve for FY26, acceptance of up to $30,000 in reimbursement funding from US Immigration and Customs Enforcement Treasury Forfeiture Fund for officers assigned to the Joint Operation. The US Immigration and Customs Enforcement agreement commenced February 29, 2008, and will continue for an indefinite period until terminated by one or both parties. Acceptance of this agreement was approved by the Board of Supervisors on February 20, 2008 under C-50-08-546-2-00. The FY26 reimbursement funding begins October 1, 2025 and will terminate September 30, 2026. The Sheriff’s Office indirect cost rate for FY26 is 27.660%. AGREEMENT WITH THE ARIZONA DEPARTMENT OF ENVIRONMENTAL QUALITY Approve a Government Services Contract (GSC) (EV25-0037) agreement between the Arizona Department of Environmental Quality (ADEQ) and Maricopa County Air Quality Department (MCAQD) in the not-to-exceed amount of $846,661. The purpose of this agreement is to support Air Quality Department program efforts. This Agreement and budget are effective from July 1, 2026, until June 30, 2027. The FY2026 MCAQD indirect cost rate of 36.10% will be applied to the direct charges of $671,661. Per the ADEQ award agreement, the indirect cost of administering this grant is $178,156 and is allowable and fully recoverable. An amount of up to $175,000 will be passed through to the Regional Public Transportation Authority as an external service provider upon separate agenda and approval for services provided between July 1, 2026, and June 30, 2027. The County will retain the amount of $671,661. The grant award is reoccurring and has been awarded to MCAQD in previous years. The cash or in-kind match is not applicable, and ongoing cash contributions are not applicable. This grant award is a mandated function of the MCAQD per Arizona Revised Statutes (ARS) §49-581 et seq. The grant award is noncompetitively bid. There are no costs that will need to be absorbed by the department’s operating budget. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation; therefore, expenditures of these revenues are not prohibited by the budget law. 46. BISSELL PET FOUNDATION GRANT AND BUDGET ADJUSTMENT Approve the application and acceptance of grant funds from Bissell Pet Foundation in the amount not-to-exceed $54,780. The grant award is comprised of nine individual grants (one per event) from Bissell Pet Foundation to be awarded to Maricopa County Animal Care & Control (MCACC) during Fiscal Year 2026. The attached “Bissell Pet Foundation Grant Detail” file outlines the award for each grant and the date the funds must be spent by. Grant proceeds must be used solely for the benefit of shelter pets at MCACC. Authorize the MCACC appointed authority, and/or designee, to accept the grant-related terms and submit all grant reports applicable under the grant. Each individual grant award begins upon award acceptance (after the conclusion of the adoption event) and ends one year later. The grant award is not a mandated function but provides a benefit to the citizens in the form of reduced pet adoption fees. In accordance with A.R.S. §42-17106(B), authorize the increase of revenue and expenditure authority in the Animal Care and Control (D790) Animal Control Grants Fund (573) Non-Recurring Non-Project (NRNP) appropriation group by $54,780 in Fiscal Year 2026. The grant allows a 0% rate or $0 for indirect costs. The Maricopa County Department of Finance has calculated the Fiscal Year 2026 indirect cost rate at 12.83% or $7,028.27 The recoverable cost rates for administering this grant are $0 and the Animal Care and Control will absorb the non-recoverable indirect cost of $7,028.27 into the department’s operating budget in the current fiscal year. This grant is non-recurring, and a cash or in-kind contribution is not applicable. There are no future or ongoing contributions required following the grant period. Funding for this agreement is provided by a grant from Bissell Pet Foundation and was competitively bid. The grant cannot be used in any way that decreases the allocation or budget of governmental funds for animal welfare purposes. This request will increase the grant budget appropriation in the Animal Control Grants Fund (573) to accommodate revenues and expenditures authorized by the grant. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation and, therefore, expenditure of the funds is not prohibited by the budget law. The approval of this action does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105 (C-79-26-062-X-00)

The Letter of Promulgation is signed by the jurisdiction’s senior elected or appointed official(s). The implementation letter introduces the plan, outlines its applicability, and indicates that it supersedes all previous plans. 54. AMENDMENT TO IGA WITH CITY OF SURPRISE FOR WORKFORCE DEVELOPMENT AND TRAINING SERVICES (Supervisorial District: 4) Approve financial Amendment No.2 to the Intergovernmental Agreement (IGA) between City of Surprise (“City”) and Maricopa County (“County”), administered by its Human Services Department. The purpose of the Agreement is to integrate the County’s workforce development system into the City’s social and community services resource network. The Parties agree to jointly support workforce development and training efforts that will enable the City’s employers to attract and retain top talent and to provide adult and youth services. Service activities shall be delivered at the City’s Resource Center (“Center”) located at 12425 West Bell Road, Building A, Suite 124, Surprise, Arizona 85378. A Maricopa County Workforce Development Division (WDD) Coordinator will provide services under this Agreement. The current Agreement term is July 1, 2023, through June 30, 2026. The purpose of Amendment No. 2 is to address the following: A. Extend the Agreement expiration date from July 1, 2026, through June 30, 2028 B. Revise Section 7.0 (Funding) to update funding for Fiscal Years 2027 and 2028. For Fiscal Year 2027, the City shall compensate the County in an amount not to exceed $61,701. For Fiscal Year 2028, the City shall compensate the County in an amount not to exceed $63,794. C. Revise and replace Paragraph 6.0 (Administrative Change Orders) with updated language as required. D. Add required Paragraphs to the Agreement. The City shall compensate the County a not to exceed amount of $125,495 for service delivery The Agreement is entered by the parties through a non-competitive process. The City will provide funding to the County to support the workforce development system provided in the City of Surprise area for the Agreement term. Cash, match, or in-kind are not applicable. The County does not have any obligations after the Agreement term. The services provided under this Agreement are not mandated services but provide a benefit to residents in the Surprise area as residents can receive job-seeking services and local employers are assisted with filling vacancies. The Human Services Department’s provisional indirect rate for FY2027 is 24% from the U.S. Department of Health and Human Services for salaries and employee related expenses. The Agreement funding amount is $125,495 of which $101,206 is for salaries and employee related expenses. The estimated recoverable indirect rate costs are $24,289 and fully recoverable. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. The approval of the funding does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant A.R.S. §42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through future budget reconciliation. This Agreement does not contain County General funds. (C-22-23-121-X-02)

55. IGA WITH ARIZONA DEPARTMENT OF ECONOMIC SECURITY FOR INDUSTRY-DRIVEN SKILLS TRAINING GRANT PROGRAM (Supervisorial District: All) Approve a new financial Intergovernmental Agreement (IGA) between Arizona Department of Economic Security (DES) and Maricopa County, administered by its Human Services Department. The purpose of the Agreement is for the County to identify employers with quality job openings in in-demand industries, with a special focus on paid training opportunities and connecting participants to these sustainable, higher-paying positions by implementing the requirements under the Industry Grant #25A60IN000010-01-01. Key industries include but are not limited to automotive (electric vehicles), aerospace, pharmaceuticals, medical devices, electronics, semiconductors, energy, and general industrial/high-volume goods. Maricopa County will receive administrative funding that will be used for staff costs for data entry, communication with employers, and reimbursement processing. The Agreement term is October 1, 2025, though September 30, 2029. Workforce Innovation and Opportunity Act (WIOA) activities are mandated by the U.S. Department of Labor, as such, the funds are subject to all the provisions of Public Law 113-128 as well as any guidance issued by the U.S. Department of Labor and DES. DES shall provide the County with funding in the amount of $1,630,647 under assistance listing number 17.280, Workforce Innovation and Opportunity Act (WIOA) Dislocated Worker National Reserve Demonstration Grants, which is authorized by U. S. Department of Labor discretionary grant No. 25A60IN000010-01-01 (Exhibit A). The budget period/period of performance is October 1, 2025, through June 30, 2029. Funding for WIOA Title I Assistance Listing Number ALN #17.280 (Dislocated Worker $1,630,647) is authorized by a U.S. Department of Labor for each Program Year. DES contracts with the County on an annual reoccurring, non-competitive basis. There is no cash or in-kind match requirement, and no future or ongoing contributions are required after the Agreement period ends. The Human Services Department provisional indirect rate of 24% by the U.S. Department of Health and Human Services for FY2027 are for salaries and employee related expenses (ERE). The total Agreement funds are $1,630,647 of which $105,377 cost will be allocated for salaries and ERE. The total estimated indirect costs are $25,290 and are fully recoverable. Budget adjustments will be made when the indirect rate costs have been fully negotiated and shall be retroactive to October 1, 2025. The services administered by the Maricopa County Human Services Department Workforce Development Division ARIZONA@WORK - Maricopa County are not mandated services but provide a benefit to Maricopa County residents by providing assistance to job seekers with career and training opportunities, youth, dislocated workers, veterans and to employers that need to fill vacancies. Program services help to establish a stronger workforce in the local area. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the revenues is not prohibited by the budget law. This Grant award does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. The overall budget will be adjusted as necessary to accommodate the grant funding through a future reconciliation. Acceptance of this funding allocation will not impact the County’s General Fund. 56. FFY 2025 EDWARD BYRNE MEMORIAL JUSTICE GRANTS 1. Pursuant to A.R.S. 42-17106, approve acceptance of grant funds from the U.S. Department of Justice, Office of Justice Programs, Bureau of Justice Assistance, for the Edward Byrne Memorial Justice Assistance Grant (JAG) Program through the City of Phoenix. 2. Authorize the Chair of the Board of Supervisors to execute Intergovernmental Agreement (IGA) between City of Phoenix, Maricopa County and City of Mesa. Because disparity exists between the City of Phoenix, Maricopa County and City of Mesa, an IGA is required pursuant to the grant application. This IGA includes allocation to City of Phoenix of $1,113,419 and $297,815 in funds reallocated to Maricopa County Office of the Medical Examiner (OME) ($112,217) and City of Mesa ($185,598). Grant awards are to be expended within two (2) year period of time, starting on October 1, 2026, and ending September 30, 2028. The City of Phoenix has been designated as the fiscal agent for this consortium and municipalities. 3. Authorize Chair of the Board to sign all documents related to the acceptance of the grant funds. 4. Authorize OME Administrative Director to sign all non-financial documents related to the grant application. 5. Pursuant to ARS §42-17106(B), direct the Office of Budget and Finance to increase the Office of the Medical Examiner (D290) Medical Examiner Grant Fund (224) Operating (OPER) FY 2027 Revised revenue and expenditure budget by $112,217 at the beginning of FY 2027. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation and, therefore, expenditures of these revenues are not prohibited by the budget law. This budget adjustment does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. The grant award is reoccurring and has been awarded to the department previously. The department has no in-kind match requirement or ongoing cash contributions during the grant award period. The grant allows up to 10% for administration which includes indirect costs. The grant award is not a mandated function but provides a benefit to the citizens by providing states and units of local governments with critical funding necessary to support a range of program areas including law enforcement, prosecution and court programs, prevention and education programs, corrections and community corrections, drug treatment and enforcement, crime victim and witness initiatives, and planning, evaluation, and technology improvement programs. The grant award is competitively bid and other eligible agencies may or may not bid on this grant award. Any unallowable indirect costs will be absorbed by the departments. The grant allows a 0% rate for indirect costs, or $0 which may be incurred by the Office of Medical Examiner or Maricopa County for the administration of this grant. The Maricopa County Department of Finance has calculated the Office of Medical Examiner's composite indirect cost rate at 17.74%, or $19,907.30. 57. 230037-ROQ, TERM ARCHITECTURAL SERVICES Approve a contract value increase of $7,999,999.00, $1,142,857 for each of the seven firms on the contract, for On-Call Term Architectural Services as requested by the Facilities Management Department (FMD) for work on projects at various County sites. This contract expenditure authorization will only be used if FMD has budgeted and approved projects to complete within the term of the contract which is set to expire on March 1, 2027. As each firm has different project experience it is difficult to identify in advance which firms may be requested to perform services for future jobs which drives the need that each firm has sufficient expenditure authority available. The firms on the contract are; Arrington Watkins, BWS Architects, DPS Architects, DWL Architects, EMC2 Group, GH2 Architects, and Gensler. The increase is due to an increased estimated usage of the contract through March 1, 2027, by the Facilities Management Department for projects, examples of which are: East Valley Public Health Building, West Courts Building, County-wide building assessments, Watkins Jail and the West Valley Public Health building. 58. 260103-CI, STAFFING SERVICES AND RELATED SERVICES AND SOLUTIONS Approve the Contract between Maricopa County and Acro Service Corporation for professional services for staffing related services and solutions for various County departments on an as-needed basis. NOTICE OF AWARD WITH HEALTH RESOURCES AND SERVICES ADMINISTRATION FOR HEALTHY START INITIATIVE Approve Notice of Award (NOA) 5 H49MC00174‐26‐00 from the Health Resources and Services Administration (HRSA) to Maricopa County by and through its Department of Public Health (MCDPH) to provide support for negative maternal health outcomes for the Healthy Start Initiative (HSI) program. The NOA's not-to-exceed amount is $367,620.00 for the period April 01, 2026, through March 31, 2027. The term of the award is May 01, 2024, through March 31, 2029. HRSA’s Healthy Start grant award is reoccurring and has been awarded to the department in the past. This is a non-competing continuation and there is no in-kind match or ongoing cash contributions required. This is not a mandated service but provides valuable benefits to Maricopa County residents. All program costs are allocated to the grant so there will be no additional burden on the Department’s operating budget. The Department of Health’s indirect rate for FY26 is 16.69%. Indirect costs are estimated at $52,580.15, all of which are recoverable. Departmental indirect rates are re-established at the beginning of each fiscal year, and any future indirect rate will be collected at the corresponding rates. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the revenues is not prohibited by the budget law. This Amendment does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. IGA WITH THE TOWN OF GILBERT TO WAIVE TRAFFIC CONTROL PERMIT FEES (Supervisorial District 1) Approve the Intergovernmental Agreement (IGA) between Maricopa County and the Town of Gilbert to waive traffic control permit fees in certain situations. Under the Intergovernmental Agreement, the Parties agree to reciprocally waive traffic control permit fees for projects meeting specific requirements. This Agreement shall become effective as of the date it is executed by all the governing bodies of the Parties and shall remain in full force and effect until all stipulations previously indicated have been satisfied. This Agreement may be amended only upon written agreement by all Parties. This Agreement will allow for traffic control permit fees to be waived when the Town has a project adjacent to or near County right of way, the County is not a partner to the project, and the Town needs to place traffic control in County right of way for appropriate notice and safety. AMENDMENT TO IGA WITH THE TOWN OF FOUNTAIN HILLS FOR THE GOLDEN EAGLE PARK DAM DEBRIS MITIGATION IMPROVEMENTS PROJECT (Supervisorial District: 2) Approve Amendment No. 5 Intergovernmental Agreement (IGA) FCD 2020A010 for the Golden Eagle Park Dam Debris Mitigation Improvements Project between the Town of Fountain Hills (Town) and the Flood Control District of Maricopa County (District). The purpose of this Amendment is to extend the PROJECT construction and funding from June 30, 2026, to June 30, 2027. All other terms and conditions of the IGA remain the same. The Town proposed the Project for the District’s evaluation under the District’s Small Project Assistance Program for Fiscal Year 2021. This IGA is proposed in accordance with the terms of the Small Project Assistance Program, adopted by the Board under Resolution FCD 2022R003 (C-69-23-013-X-00). The estimated total Project cost is $121,000. The District’s estimated share of the Project cost is $90,750 and is limited to $500,000; the Town’s estimated share of the Project cost is $30,250. The Town will operate and maintain the completed Project.
