RESOLUTION FOR GENERAL POLICIES CONCERNING THE FINANCIAL MANAGEMENT OF THE FLOOD CONTROL DISTRICT OF MARICOPA COUNTY Adopt Resolution FCD 2022R003, General Policies Concerning the Financial Management of the Flood Control District of Maricopa County, consolidating and affirming the District’s fiscal policies, rescinding and replacing prior policy statements, Resolution FCD 2010R008, 2015R005, 2009R003, 2009R003A, 2009R003B and 2009R003C. Resolution FCD 2022R003 provides consolidated guidance for management of District capital and operating funds by rescinding and replacing past resolutions related to the same topic. The capital budget and program shall include four categories: Primary Capital Improvement Program, Small Project Assistance Program, Major Maintenance and Flood-prone Properties Acquisition. The operating budget shall address requirements related to flood hazard identification, maintenance, regulation, education and necessary administrative support. The Director of the District shall ensure annual proposed operating and capital budgets are prepared to balance flood hazard mitigation needs, fiscal responsibility, sustainability and efficient operation. 84. IGA WITH TOWN OF FOUNTAIN HILLS FOR THE LOVE COURT STORM WATER PIPE IMPROVEMENT PROJECT (Supervisorial District: 2) Approve Intergovernmental Agreement (IGA) FCD 2026A003 for Love Court Storm Water Pipe Improvement Project (Project) between the Town of Fountain Hills (Town) and the Flood Control District of Maricopa County (District). The estimated total Project cost is $145,000. The District’s estimated share of the Project cost is $108,750; the City's estimated share of the Project cost is $36,250. The Town will operate and maintain the completed Project. This Agreement shall become effective as of the date it has been executed by all PROJECT PARTNERS and shall expire two years from that date, or upon Project completion, whichever occurs first. The Town proposed the Project for the District’s evaluation under the District’s Small Project Assistance Program for Fiscal Year 2025. This IGA is proposed in accordance with the terms of the Small Project Assistance Program, adopted by the Board under Resolution FCD 2022R003 (C-69-23-013-X-00). The Love Court Storm Water Pipe Improvement Project includes installation of improvements related to an existing 130 LF of 24" CMP storm water pipe that has reached the end of its service life. AMENDMENT TO IGA WITH THE TOWN OF FOUNTAIN HILLS FOR THE GOLDEN EAGLE PARK DAM DEBRIS MITIGATION IMPROVEMENTS PROJECT (Supervisorial District: 2) Approve Amendment No. 5 Intergovernmental Agreement (IGA) FCD 2020A010 for the Golden Eagle Park Dam Debris Mitigation Improvements Project between the Town of Fountain Hills (Town) and the Flood Control District of Maricopa County (District). The purpose of this Amendment is to extend the PROJECT construction and funding from June 30, 2026, to June 30, 2027. All other terms and conditions of the IGA remain the same. The Town proposed the Project for the District’s evaluation under the District’s Small Project Assistance Program for Fiscal Year 2021. This IGA is proposed in accordance with the terms of the Small Project Assistance Program, adopted by the Board under Resolution FCD 2022R003 (C-69-23-013-X-00). The estimated total Project cost is $121,000. The District’s estimated share of the Project cost is $90,750 and is limited to $500,000; the Town’s estimated share of the Project cost is $30,250. The Town will operate and maintain the completed Project. The Project will reduce the flood hazard to the Golden Eagle Park and to roadways in the vicinity, both of which have experienced historic flooding. (C-69-21-000-X-05)
