ALL TRUCKS AUTO PARTS (Supervisorial District: 5) Case #: Z250036 Applicant and Owner: Mohamed Jamal, CPS Engineering, LLC / Enzo Towing, LLC Request: Zone Change Modification of Condition Site Location: Generally located ½ mile west of the SWC of Broadway Rd. and 35th Ave. in the Laveen area Commission Recommendation: On 3/19/26, the Commission voted 6-0 (motion by Commissioner Milhaven D2, seconded by Commissioner Toma D4) to adopt a motion recommending the Board of Supervisors approve Z250036 subject to conditions ‘a’ – ‘l’: a. Development of the site shall be in substantial conformance with the Site Plan entitled “Site Plan” consisting of two full-size sheets dated December 27, 2022, and stamped received December 27, 2022, except as modified by the following conditions. Staff may determine slight refinements to remain in substantial conformance with the approved site plan. Minor and major amendments to the site plan will be determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance. b. Development of the site shall be in substantial conformance with the Narrative Report entitled “All Truck Auto Parts Expansion Project”, consisting of three pages, dated January 19, 2026, and stamped received January 27, 2026, except as modified by the following conditions. c. Prior to final approval of construction permits, the Owner or Developer shall process a lot combination or record a cross-access agreement between APN 105-69-007P and APN 105-69-007M. d. The following Planning Engineering comments shall apply: 1. At the time of application for construction permits, the following comments shall be addressed within the Grading and Drainage Plan and Drainage Report. i. Include the analysis of offsite flows that could impact the project and describe where the water will run and how it impacts adjacent lots. ii. Complete the analysis of onsite runoff for APNs 105-69-007P and 105-69-007M. The Rational runoff coefficients are 0.95 for the entire lot, except that the area below the retention basin high water can use 0.50. iii. Complete the layout and design of the retention basins for APN 105-69-007P and 105-69-007M. iv. Soils testing and drywell selection for infiltration of the runoff in 36 hours shall be completed. v. The drainage report shall be completed for APN 105-69-007P and 105-69-007M and within this drainage report, drainage blocks are required for all new CMU walls, and hydrologic, hydraulic and retention calculations shall be included. vi. Add the finished floor elevation for the new 10’ x 32’ building which is the unlabeled building with the septic system connection and the existing house. 2. Broadway Rd. is in the jurisdiction of the City of Phoenix. At the time of acquisition of construction permits, the owner or developer shall submit correspondence from the City of Phoenix indicating that there are no objections to the driveway use change and access permission remains valid. 3. Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with Section 905 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 4. Based on the conceptual design nature of the information submitted, changes to the site layout may be necessitated by final engineering design of the site’s drainage infrastructure. 5. Detailed Grading & Drainage (Site Infrastructure) Plans must be submitted with the application for Building Permits. e. The following IND-3 IUPD Zoning District development standards shall apply: 1. Uses Permitted – The only permitted uses shall be the following uses: heavy vehicle, truck, semi-truck, and automobile repair; on-site storage and sale of vehicle, truck, semi-truck and automobile parts; contractor yard, industrial storage, and; accessory buildings and uses customarily incidental to the above listed uses including a single caretaker residence. All other uses shall be prohibited. 2. Sight Visibility Triangles (SVTs) - Two SVTs waived at the access point off of the easement leading to the residence. All other SVTs are required. Driveways, Parking and Obstructions greater than 2’ in height are not permitted within required SVTs. 3. Screening – industrial use on the site must be screened from rural or residential land uses by a minimum 8’ solid wall. f. A will serve letter for fire shall be required prior to receiving approval of construction permits. g. Outdoor lighting shall be placed so as to reflect the light away from adjacent residential districts. All outdoor light fixtures shall be fully shielded and directed downward. h. Noise, odor or vibration shall be emitted so that it exceeds the general level of noise, odor or vibration emitted by uses outside of the site. i. Open storage shall be no higher than 6’ plus 1’ in heigh for each additional 3’ of setback form a property line. j. Noncompliance with any of the conditions assigned to the approval of this Zone Change by the Maricopa County Board of Supervisors may be grounds for revocation in accordance with the requirements and procedures as set forth in the Maricopa County Zoning Ordinance. k. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. l. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property may be considered for revocation to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change. The Zone Change enhances the value of the property above its value as of the date the Zone Change is granted and reverting to the prior zoning results in the same value of the property as if the Zone Change had never been granted. The maximum height of the Wireless Communication Facility shall be limited to 109’. e. A Minor Amendment shall be required to co-locate future carriers on the Wireless Communication Facility. f. This special use permit is valid for a period of 30 years and shall expire on April 22, 2056, or upon termination of the use for a period of 90 or more days, whichever occurs first. All site improvements associated with the special use permit shall be removed within 90 days of such expiration or termination of use. g. The following SUP standards shall apply: 1. Max. WCF Height: 109’ 2. Min. Setback from North Lot Line: 215’ 3. Min. Setback from East Lot Line: 210’ 4. Max. Tower Diameter: 3’ 5. Max. WCF Antenna Array Diameter: 16’ 6. This special use permit is valid for a period of 10 years and shall expire on April 8, 2036, or upon termination of the use for a period of 90 or more days, whichever occurs first. Detailed Grading and Drainage (Site Infrastructure) Plans must be submitted with the application for Building Permits. 4. The entire site and adjacent half-streets’ runoff shall be retained onsite. If portions of adjacent right-of-way are controlled by other jurisdictions, the adjacent half-streets’ runoff shall be retained unless separately addressed by the other jurisdictions. 5. Sufficient retention volume shall be provided onsite to retain the required 100-year, 2-hour runoff from all contributing areas. Retention basins with stormwater depths exceeding one foot shall provide one foot of freeboard. 6. All retention basins shall drain within 36 hours per County requirements. f. Prior to occupying the existing residence or any portion thereof for any use associated with the Special Use Permit, the applicant shall obtain a Building Permit to retrofit the existing residence or associated structures (including restrooms) to meet current commercial building code requirements as applicable and shall obtain a Certificate of Occupancy for the retrofitted building prior to occupancy. g. Amplified noise must conform to Maricopa County Noise Ordinance (P-23) that was adopted February 15, 2006 and is regulated by the MCSO. Section IV Noise; and further there shall be no amplified noise that can be heard from within closed residential structures greater than 500’ from the boundary of the subject property. h. Prior to issuance of a building permit, written confirmation will be required from the emergency fire protection jurisdiction having authority that the facility has been designed in accordance with their regulations and requirements, and that emergency fire protection service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. i. Alcohol is not permitted on site unless a Special Event Liquor License is obtained through the Clerk of the Board. j. There shall be no overnight camping. k. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, and at the time of expiration of the Special Use Permit, the property may be considered for revocation to the zoning that existed on the date of application. AMENDMENT TO IGA WITH THE GOVERNOR'S OFFICE OF YOUTH, FAITH, AND FAMILY FOR ADVANCE FORENSIC INTERVIEWING TRAINING Approve Amendment 1 to the existing Intergovernmental Agreement (IGA) No. IGA STOP MCAO 090125 01 between the Governor’s Office of Youth, Faith, and Family and the Maricopa County Attorney’s Office (C 25 26 003 X 00). This amendment authorizes the acceptance of program income generated from registration fees for the Advanced Forensic Interviewing Training (AFIT) program. It permits using such income for allowable training-related expenses. The amendment does not increase the original amount of federal grant funding awarded. Additionally, approve a three-month extension of the program period to December 31, 2026, to allow MCAO to fulfill the goals and objectives approved by GOYFF. MCAO receives federal grant funding to support the Advanced Forensic Interviewing Training (AFIT) program, which provides specialized training for Law Enforcement, Deputy County Attorneys, and Department of Child Safety professionals. Registration fees are charged to participants who are from outside Maricopa County or who are not law enforcement or MCAO staff. Under federal grant rules, these fees constitute program income. The current IGA does not explicitly authorize MCAO to accept or expend program income. Amendment 1 provides this authority and allows MCAO to use program income in accordance with grant guidelines, retroactive to the grant start date of September 1, 2025. Program income will be used solely to offset eligible training expenses, including parking for training participants. There is no change to the total federal grant award. MOU BETWEEN GRAND CANYON UNIVERSITY AND MARICOPA COUNTY ATTORNEY'S OFFICE FOR THE USE OF RESOURCES TO COMBAT HUMAN TRAFFICKING Approve the Memorandum of Understanding (MOU) between Grand Canyon University (GCU) and the Maricopa County Attorney’s Office (MCAO) to support the use of MCAO resources by the GCU Public Safety Department in efforts to combat human trafficking within GCU’s jurisdiction and, when appropriate, in coordination with neighboring jurisdictions. Under this agreement, MCAO authorizes GCU to utilize certain MCAO resources for human‑trafficking‑related operations. MCAO will not provide, and is not responsible for providing, any certifications required for GCU personnel to operate those resources. GCU agrees that neither MCAO nor Maricopa County will be held liable for injuries sustained by GCU officers while operating or deploying these resources. RESOLUTION TO APPLY FOR TRIBAL GAMING FUNDS FROM GILA RIVER INDIAN COMMUNITY Pursuant to the Board’s Resolution regarding Processing of Tribal Gaming Fund Applications, dated May 31, 2016 (“Gaming Resolution”), Maricopa County is the administrative pass-through for tribal gaming applications (“Applications”) received pursuant to the State of Arizona Department of Gaming Compact (“Compact”). The Applications seek funds for services that benefit the general public, including public safety, mitigation of the impacts of gaming, or promotion of commerce and economic development. Pursuant to the Board’s Gaming Resolution, Maricopa County defers substantive review of the Applications to the Tribal authorities and places these matters on the consent agenda. Pursuant to the Compact, Sections 12(b) and (d), the Tribe shall perform the substantive review of applications and ensure 12% of its contributions under the Compact go to services that benefit the general public. Accordingly, authorize Maricopa County to accept and pass-through the applications listed below pursuant to the compact agreement for Gila River Indian Community. The total amount of funds awarded will not exceed $760,000.00. Maricopa County Dept of Transportation MCDOT New Video Wall Project $300,000.00 Maricopa County Dept of Transportation Materials Lab Equipment Upgrade Project $300,000.00 Maricopa County Dept of Transportation Guardrail Upgrade Project $160,000.00 Authorize the Chair, or designee in the Office of Budget and Finance (OBF), to sign all application documents and resolutions related to these grant funds, as applicable. RESOLUTION TO APPLY FOR TRIBAL GAMING FUNDS FROM FORT MCDOWELL YAVAPAI NATION Pursuant to the Board’s Resolution, regarding Processing of Tribal Gaming Fund Applications, dated May 31, 2016 (“Gaming Resolution”), Maricopa County is the administrative pass-through for tribal gaming applications (“Applications”) received pursuant to the State of Arizona Department of Gaming Compact (“Compact”). The Applications seek funds for government services that benefit the general public, including public safety, mitigation of the impacts of gaming, or promotion of commerce and economic development. Pursuant to the Board’s Gaming Resolution, Maricopa County defers substantive review of the Applications to the Tribal authorities and place these matters on the consent agenda. Pursuant to the Compact, Sections 12 (b) and (d), the Tribe shall perform the substantive review of applications and ensure 12% of its contributions under the Compact go to services that benefit the general public. DES provides funding to the County for administration of the Housing Support Services in Maricopa County by providing assistance to individuals and families experiencing homelessness, to obtain stable housing as well as emergency shelter and case management services while permanent housing options are located. The Purpose of Amendment No. 8 is to revise the Agreement as follows: A. In accordance with Paragraph 6.0 Extension, extend the term of the Agreement through June 30, 2027. The foregoing paragraphs contain all the changes made by this Amendment No. 8. All other terms and conditions of the Agreement and previously approved amendments remain in full force and effect. AMENDMENT TO IGA WITH CITY OF SURPRISE FOR COMMUNITY ACTION PROGRAM ACTIVITIES (Supervisor District: 4) Approve financial Amendment No. 7 to the Intergovernmental Agreement (IGA) between the City of Surprise (Subrecipient) and Maricopa County, administered by its Human Services Department (County) Community Resilience Division. The County and the Contractor collectively are referred to as the “Parties.” The County contracts with the Subrecipient for the provision of Community Action Program (CAP) services in specific geographic areas and service boundaries. CAP services include the delivery of Crisis Case Management and the coordination of rent and utility benefits to assist low-income households in crisis situations to prevent eviction and move closer to economic self-sufficiency. The County provided the Subrecipient with $386,100 for Fiscal Year 2026 funding for CAP services comprised of but not limited to funding through an Intergovernmental Agreement (IGA) with Arizona Department of Economic Security (DES) under IGA DI25-002428, Community Service Block Grant (CSBG), Low Income Home Energy Assistance Program (LIHEAP) and American Rescue Plan Act (ARPA) funds. The County further provided $115,000 in funding through ARPA State and Local Fiscal Recovery funds (SLFRF) under (ALN) 21.027, all funding to be fully expended by June 30, 2026. The current term of the Agreement is July 1, 2025, through June 30, 2026. The County and the Subrecipient collectively are referred to as the “Parties.” The purpose of Amendment No. 7 is to address the following: A. Revise the Agreement amount to increase the CAP services funding by $27,250 in ARPA-SLFRF funds under ALN 21.027, for Fiscal Year 2026 (FY26), funds to be fully expended by June 30, 2026. B. Update Maricopa County Representative point of contact. C. Revise Section 4 (Budget and Compensation), Paragraph 1.5 (Operating Budget) and replace the CAP Services Operating Budget by incorporating a new attached budget into the Agreement. The County shall provide the Subrecipient with a not to exceed amount of $413,350 for the CAP services budget period of July 1, 2025, through June 30, 2026. As an accredited Health Department, MCDPH is required to maintain and utilize a performance management system that enables the department to establish and evaluate the achievement of goals, objectives, and improvements. MCDPH has been utilizing Envisio as its official program performance management software since 2022, and the system has been approved by the Public Health Accreditation Board. Over the past 4 years, MCDPH has used the platform to monitor and report on programs, grant workplans, receive updates from subcontractors, and evaluate and report on key performance measures. Switching software at this time is not only cost-prohibitive but could jeopardize MCDPH’s accreditation status. The total contract amount will be paid upon execution. NOTICE OF AWARD FROM DEPARTMENT OF HEALTH AND HUMAN SERVICES, CENTERS FOR DISEASE CONTROL AND PREVENTION FOR PUBLIC HEALTH INFRASTRUCTURE DEVELOPMENT Approve Notice of Award (NOA) 6 NE11OE000020-04-03, from the Department of Health and Human Services (DHHS), Centers for Disease Control and Prevention (CDC) and Maricopa County by and through its Department of Public Health (MCDPH) for the Public Health Infrastructure Grant which provides development of performance management infrastructure and enhancement of both internal departmental programs and broader community-wide collaborative efforts. The not-to-exceed amount for this NOA is $0.00, for a total not-to-exceed amount of $48,806,099.00. This NOA Budget Revision reflects the correct redistribution of direct and indirect cost amounts: no funds are being added or subtracted. The NOA award period began on December 01, 2025, and runs through November 30, 2026. The original term of this grant began on December 01, 2022, and runs through November 30, 2027. This is a competitive grant award that has been awarded in the past, but at this time, it has not been determined if it will be recurring. There is no cash or in-kind matching requirement. Should the grant cease, ongoing contributions would not be required. All future year funding is based on satisfactory programmatic performance and the availability of funds. This grant award is not a mandated function but provides a benefit to the citizens in Maricopa County by strengthening public health capacity. Funding for this grant is provided by the CDC. This grant deviates from County Policy A2505 and does not allow for full indirect cost reimbursement, but a maximum of 15% indirect cost reimbursement. The MCDPH indirect rate for FY26 is 16.69%. Program costs not covered by the grant will be subsidized by the MCDPH indirect cost pool. PURCHASE ORDER FOR IGA WITH ARIZONA DEPARTMENT OF HEALTH SERVICES FOR TUBERCULOSIS CONTROL PROGRAM (FEDERAL) Approve a retroactive purchase order (PO) PO844832 for Intergovernmental Agreement (IGA) CTR062104 between Arizona Department of Health Services (ADHS) and Maricopa County by and through its Department of Public Health (MCDPH) for the Tuberculosis Control Program (TB) (Federal). The PO was issued by ADHS on January 29, 2026. This PO is adding funds not-to-exceed $173,744.00 for the budget period January 01, 2026, through December 31, 2026. The IGA term is January 01, 2023, through December 31, 2027. This funding supports MCDPH’s efforts to prevent and control TB in Maricopa County by identifying cases, ensuring completion of treatment, and reporting TB surveillance data. The TB Federal grant award is reoccurring and non-competitive and has been awarded to the Department for several years. There is no cash or in-kind match required, and indirect cost is recoverable. The Department of Public Health’s indirect rate for FY26 is 16.69%. Indirect costs are estimated at $24,850.35 all of which is fully recoverable. Should this grant be discontinued, ongoing cash contributions will be required as this is a mandated function. At this time, there are no costs that will need to be absorbed by the department’s operating budget. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. The PO was issued by ADHS on October 9, 2025. The PO is adding additional funds not-to-exceed $297,521.06 for the budget period of November 13, 2025, through June 30, 2026. The IGA term is July 01, 2024, through June 30, 2029. This funding supports the High-Risk Perinatal Program (HRPP) Community Health Nursing Services, which provide coordinated care for HRPP infants and their families transitioning from the Neonatal Intensive Care Unit (NICU) to home. This award was competitive but has also been awarded to MCDPH in the past. HRPP Community Health Nursing Services are not a mandated function but benefit the community by offering access to high-risk perinatal skilled nursing services. This Agreement shall become effective as of the date it has been executed by all PROJECT PARTNERS and shall expire ten years from that date. AMENDMENT TO IGA WITH CITY OF PHOENIX FOR THE LAVEEN FLOOD MITIGATION PROJECTS – GO- BONDS SET 3 (Supervisorial District: 5) Approve Amendment No. 1 FCD 2024A015A to Intergovernmental Agreement (IGA) FCD 2024A015 for the Laveen Flood Mitigation Projects – GO-Bonds Set 3 Project (PROJECT) between the City of Phoenix (CITY), and the Flood Control District of Maricopa County (DISTRICT). This Agreement shall become effective as of the date it has been executed by all PROJECT PARTNERS and shall expire ten years from that date. This Amendment No. 1 adjusts the DISTRICT funding schedule while leaving the funding amounts unchanged. The PROJECT is located in the developed urban area within the CITY and is intended to mitigate excess stormwater runoff that impacts existing and proposed residences and businesses by using new storm drains, and other drainage features in the area between Broadway Road to Carver Road and 51st Avenue to 7th Avenue. The proposed Laveen Flood Mitigation projects are within the Laveen Area Drainage Master Study (ADMS). The PROJECT will be designed and constructed for a 10-year level of protection. AMENDMENT TO IGA WITH PARADISE RIDGE DRAINAGE IMPROVEMENTS (Supervisorial District: 3) Approve Amendment No. 2 FCD Intergovernmental Agreement (IGA) 2020A030B to Intergovernmental Agreement (IGA) FCD 2020A030 for the Paradise Ridge Drainage Improvements Project (PROJECT) between the City of Phoenix (CITY) and the Flood Control District of Maricopa County (DISTRICT). This Agreement shall become effective as of the date it has been executed by all PROJECT PARTNERS and shall expire ten years from that date. The PROJECT is within the CITY’s jurisdiction and is bounded by State Route 101 on the south, Pinnacle Peak Road on the north, Scottsdale Road on the east, and the 64th Street alignment on the west. The land within the area described above is currently State Trust Land managed by the Arizona State Land Department. This PROJECT will mitigate the Rawhide Wash alluvial fan flooding hazard west of Scottsdale Road by capturing and conveying the 100-year flow in a new drainage channel and appurtenant structures along the approximate Rawhide Wash alignment, west of Scottsdale Road, to the existing culvert system at State Route 101. The PROJECT is the next downstream segment of the Rawhide Wash drainage solution and was identified in the Pinnacle Peak West Area Drainage Master Study. This amendment does not change the previously approved overall project cost. This amendment updates the timing of partner contributions to accommodate adjustments to other Phoenix project schedules. IGA WITH TOWN OF FOUNTAIN HILLS FOR THE LOVE COURT STORM WATER PIPE IMPROVEMENT PROJECT (Supervisorial District: 2) Approve Intergovernmental Agreement (IGA) FCD 2026A003 for Love Court Storm Water Pipe Improvement Project (Project) between the Town of Fountain Hills (Town) and the Flood Control District of Maricopa County (District). The estimated total Project cost is $145,000. The District’s estimated share of the Project cost is $108,750; the City's estimated share of the Project cost is $36,250. The Town will operate and maintain the completed Project. This Agreement shall become effective as of the date it has been executed by all PROJECT PARTNERS and shall expire two years from that date, or upon Project completion, whichever occurs first. The Town proposed the Project for the District’s evaluation under the District’s Small Project Assistance Program for Fiscal Year 2025. This IGA is proposed in accordance with the terms of the Small Project Assistance Program, adopted by the Board under Resolution FCD 2022R003 (C-69-23-013-X-00). The Love Court Storm Water Pipe Improvement Project includes installation of improvements related to an existing 130 LF of 24" CMP storm water pipe that has reached the end of its service life.
