22. REVISIONS TO CHILD AND ADULT CARE FOOD PROGRAM PERMANENT AGREEMENT WITH ARIZONA DEPARTMENT OF EDUCATION CHILD NUTRITION PROGRAMS Approve revisions to the Child and Adult Care Food Program (CACFP) Permanent Agreement (“Agreement”) with Arizona Department of Education (ADE), Child Nutrition Programs, (A.G. Contract No. KR02-1170-ALS) administered by Maricopa County Human Services Department, Early Education Divisions, Head Start Program. The revised Agreement identifies the individuals authorized to sign any documents that relate to the CACFP activities. Also request authorization for the Chairman to sign the Permanent Agreement and request authorization for the Human Services Department Director to sign all documents related to CACFP activities to include ADEConnect Entity Administration Account documents, which designates the individuals authorized to submit reports to ADE. The Maricopa County Board of Supervisors entered into the Permanent Agreement with ADE on September 25, 2013. Due to staff changes in the Head Start program, a revision to the Permanent Agreement must be submitted to ADE. The revised Permanent Agreement will allow for the County to continue to receive CACFP funds for meals and snacks that meet 1/3 to 2/3 of program participants’ daily nutritional needs. 35. AMENDMENT TO IGA WITH MESA UNIFIED SCHOOL DISTRICT Approve Amendment No. 2 to the Intergovernmental Agreement “Agreement” between Mesa Unified School District and Maricopa County, administered by its Human Services Department. The purpose of Amendment No 2 is to address the following: 1. Extend the Agreement term: October 1, 2020 through September 30, 2021 (Extension Term) 2. The County shall reimburse Mesa Unified School District for food service delivery during the Extension Period for the not to exceed amount of $150,595. 3. Revise Section 28.0 Service Delivery to add items: a. Replace 28.11.2 Meal Count and Costs as listed. 4. Revise Section 29.0 Compensation, subsection 29.1 Funding a. Replace subsection 29.1.2 b. Contract No. KR02-1170-ALS) for the Child and Adult Care Food Program (CACFP), administered by Maricopa County Human Services Department, Early Education Division, Head Start Program. 95. AGREEMENT WITH ARIZONA DEPARTMENT OF EDUCATION FOR CHILD NUTRITION PROGRAM Request approval of the following actions: 1. Approve a new Permanent Agreement with Arizona Department of Education (ADE) Child Nutrition Program Child and Adult Care Food Program Permanent Agreement (Agreement) (A.G. Contract No. KR02-1170-ALS) for the Child and Adult Care Food Program (CACFP), administered by Maricopa County Human Services Department, Early Education Division, Head Start Program. The Agreement identifies requirements related to administration of the CACFP and meals provided to Head Start program participants, and the individuals authorized to sign any documents that relate to CACFP activities. The Agreement allows the Human Services Department to submit an application to ADE for CACFP funds on an annual basis to pay for meals provided to participants. 2. Approve the submission of the Request for ADEConnect Entity Administrator Account form which designates Human Services Department staff to have authority to setup user accounts that will have access to CNPWeb and other Health & Nutrition Services online systems for ADE activities. 3. 83. RECEIPT OF FUNDS FROM ARIZONA DEPARTMENT OF EDUCATION FOR THE CHILD AND ADULT CARE FOOD PROGRAM Approve the acceptance of funds from the Arizona Department of Education (ADE) Child and Adult Care Food Program (CACFP). CACFP funds are provided to Maricopa County and administered by the Human Services Department Early Education Division, Maricopa County Head Start Program. The Head Start Program submitted a funding application to ADE for $977,042 for Program Year 2025, the period of October 1, 2024, through September 30, 2025. Maricopa County Head Start program is an annual reoccurring recipient of CACFP funds from ADE with the submission of an application. Also request authorization for the Human Services Department Director to sign all documents related to acceptance of funds and any additional awards issued subsequently up to the estimated funding amount, as noted in the Permanent Agreement with ADE fully executed in October 26, 2013 (C-22-14-027-G-00) and as amended on August 20, 2025 (C-22-14-027-G-14). The Funds are utilized to provide meals and snacks that meet 1/3 to 2/3 of the daily nutritional needs of the Head Start program participants. The Head Start program submits an annual grant application to the Arizona Department of Education Child and Adult Care Food Program, which is funded and administered at the federal level by the Food and Nutrition Service, an agency of the United States Department of Agriculture (USDA). CACFP provides federal funds to nonresidential child and adult care facilities, emergency shelters, eligible after-school programs and family day care providers who serve nutritious meals and snacks. In Arizona, the Arizona Department of Education (ADE) directly administers CACFP. The goal of CACFP is to improve and maintain the health and nutritional status of children and adults in care settings while promoting the development of good eating habits. The Human Services Department indirect rate for FY2026, approved by the U.S. Department of Health and Human Services is 24% for salaries and employee related expenses. The awarded funds are $977,042 of which $0 is for salaries and ERE, therefore indirect costs are $0 and are not subject to indirect cost recovery. Annual Funding is reoccurring and does not require an in-kind or cash match or a commitment after the end of the term. The services provided by the funds are not mandated services but are a benefit to Head Start program participants by providing nutritious meals and snacks. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. The grant funds do not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. The receipt of the funds does not impact the County fund. Maricopa County Head Start program is an annual reoccurring recipient of CACFP funds from ADE with the submission of an application. ADE provided electronic notification on December 2, 2025, that the Head Start funding and management plan was approved. Also request authorization for the Human Services Department Director to sign all documents related to acceptance of funds and any additional awards issued subsequently up to the estimated funding amount, as noted in the Permanent Agreement with ADE fully executed in October 26, 2013 (C-22-14-027-G-00) and as amended on August 20, 2025 (C-22-14-027-G-14). CACFP funds may be increased throughout the budget year as additional funds are made available to cover unanticipated food costs.
