All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 2. Based on the conceptual design nature of the information submitted, changes to the site layout may be necessitated by the final engineering design of the site’s drainage infrastructure. 3. Maricopa County does not supply water, fire or sewer services. It is the applicant/owner’s responsibility to coordinate and secure water, fire and sewer services for this site. 4. Sealed final Grading and Drainage (Site Infrastructure) Plans and Sealed Final drainage report must be submitted with the application for Building Permits. d. The following IND-2 IUPD Zoning District standards shall apply: 1. Maximum Electric Transmission Line Height – 199’ 2. Maximum Building Height - 90' (Not including gas generating facility stack height up to 199’) 3. Maximum Lot Coverage - 60%, solar panel arrays are not calculated as lot coverage. 4. Article 902.91 – All uses except for parking, loading, unloading, storage, electric generation, electric storage and electric transmission infrastructure shall be conducted within a completely enclosed building. 5. Site Enclosure and Screening – At a minimum, chain-link fencing and gates shall be allowed on the perimeter of the project. One (1) foot of barbed wire strands will be incorporated atop 6-foot fencing for additional security. Up to 12' aluminum anti-climb fencing allowed. 6. Permitted uses – Solar electric generating facility and Battery Energy Storage System (BESS) – including ancillary offices and ancillary uses only, Gas generating facility and ancillary uses including accessory electrical substation, other power equipment, and distribution facilities. Water storage and treatment. All Uses Permitted in the IND-2 Zoning District where wastewater can be accommodated via onsite septic and water systems until such time that sewer and/or water service is available to the site. e. Noncompliance with any Maricopa County regulation shall be grounds for initiating a revocation of this zone change as set forth in the Maricopa County Zoning Ordinance. f. The IUP overlay is applied to restrict the use of the site. Until such time as the site is served by sewer, uses on the site shall only be those acceptable to the Maricopa County Environmental Services Department (MCESD) that can be accommodated by septic systems. A public water system and public sewer system shall be required prior to establishment of any non-residential use that requires potable water. g. Administrative approval of a Plan of Development will be required prior to approval and issuance of construction permits to develop and establish use of the site. Prior to issuance of a building permit, written confirmation will be required from the emergency fire protection jurisdiction having authority that the facility has been designed in accordance with their regulations and requirements, and that emergency fire protection service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. h. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. i. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property may be considered for reversion to the zoning that existed on the date of application in accordance with Maricopa County Zoning Ordinance requirements. It is, therefore, stipulated and agreed that reversion of the zoning due to the failure to comply with any conditions does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such reversion of the zoning. This zone change enhances the value of the property above its value as of the date the zone change is granted, and reverting to the prior zoning results in the same value of the property as if the zone change had never been granted. A Plan of Development is approved subject to the site plan entitled, “Site Plan for 330 S 75th Avenue,” consisting of three full-size sheets, dated January 2026, and stamped received January 14, 2026. The Plan of Development may be amended administratively under a separate application as long as the amendment complies with the established IUPD development standards as approved by the Board of Supervisors. If alterations on any existing structure reach the 50% substantial improvement threshold, the entire structure must be brought into compliance with the Floodplain Use Regulations (i.e. FFE at or above the regulatory flood elevation or the structure must be floodproofed). 3. Any development in the floodplain will require a floodplain use permit issued concurrent with building permit(s) required for site development. The proposed maintenance building will be required to meet current floodplain regulations. 4. The subject premises is located within the County’s Urbanized Area and will disturb more than one (1) acre. A Storm Water Pollution Prevention Permit (SWPPP), issued by the County (PND), will be required prior to issuance of any building permits required for site development. The following engineering conditions shall apply: 1. There is currently no County access to the site from the south. The County completed Hidden Waters Parkway North feasibility study in 2012. The applicant shall refer to the preferred alignment study and coordinate with MCDOT to determine accessibility of the site. 2. Wash T2N-R5W-S33E ultimately outfalls into the Hassayampa River. Site also contains the Hassayampa River itself. Refer to Arizona Department of Environmental quality for a list of protected surface waters (PSWL) and Waters of the U.S. (WOTUS), regulated under the Clean Water Act and ADEQ requirements. Consult ADEQ for Hassayampa River which may be regulated by ADEQ as a federally protected water. 3. Engineering and drainage review was based on a zone change without a plan of development. Therefore, without the submittal of a precise plan of development, no development approval is inferred by this review, including, but not limited to number of proposed building lots/units, drainage design, access and roadway alignments. These items will be addressed as development plans progress and are submitted to the County for further review and/or entitlement. 4. Engineering review of re-zone cases is conceptual in nature. All development and engineering design shall be in conformance with Section 905 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 5. The County does not provide fire service; therefore, it is incumbent that the applicant seek service and approval of plans from the jurisdictional fire service provider. e. Unless waived or modified by the County at time of subsequent development applications, the applicant or developer shall document implementation of the best practices and any recommendations by the Arizona Game and Fish Department (AGFD) related to habitat and wildlife resources. Should the Zoning Inspector and/or their designee decide that the owner or developer has not substantially undertaken these best practices in good faith, the owner or developer shall not receive final permits or certificate of occupancy until the best practices are implemented. f. Administrative approval of a plan of development will be required prior to approval and issuance of construction permits to develop and establish use of the site. g. Based on the conceptual design nature of the information submitted, changes to the site layout and/or a reduction in the number of building lots may be necessitated by the final engineering design of the subdivision drainage infrastructure. 3. Stormwater retention volume calculations shall be based on Table 6.3 of the Maricopa County Drainage Policies and Standards. Use 0.95 for commercial/industrial areas and 0.5 for retention basin areas 4. Entitlement case is for the entire parcel and therefore the retention basin will need to be sized for the full contributing area. 5. The Grading and Drainage Plan must indicate that the required stormwater retention volume for the 100 year, 2 hour storm event with one (1) foot of freeboard is provided for the site. Basins one (1) foot or less in depth need not provide freeboard. Provide documentation that the retention basin(s) will drain within 36 hours. (MCZO 1205.7.6-2.a& c) 6. When submitting the plans for a building permit include the septic facilities on the plans. Maintain a minimum 25 foot separation between septic facilities. 7. Drainage Clearance is for fence/wall construction within or along property lines as shown on the approved plans. The drainage clearance does not include verification of property boundaries or easements which is the responsibility of the owner/applicant. Property line and easement disputes that may arise with new wall/fence construction are a civil matter. d. This special use permit is valid for a period of two years and shall expire on April 8, 2028, or upon termination of the use for a period of 90 or more days, whichever occurs first. All site improvements associated with the special use permit shall be removed within 90 days of such expiration or termination of use. e. Prior to utilizing any portion of the site for any use associated with the Special Use Permit, the applicant shall obtain Building Permits to retrofit the existing buildings to meet current commercial building code requirements as applicable and shall obtain a Certificate of Occupancy for the retrofitted buildings prior to occupancy.\ f. The following Rural-43 SUP standards shall apply: 1. Min. Screening: 6-foot screen wall or similar with additional landscaping along the south and west side of the site. 12’ max. allowed fence height outside buildable envelope. 2. Maximum Yard Coverage within Rear Setback: 47% 3. Min. On-Site Parking Spaces: 43 (including 3 ADA accessible) 4. Min. Parking and Driveway Aisles Surfaces: Alternative dust control measures such as decomposed granite or asphalt millings as approved by the County 5. Max. Attendance: 75 total persons on site at any given time 6. No amplified music or speakers at any time 7. No use of generators related to events 8. Outdoor lighting: Other than low intensity fixtures with a maximum candle power of less than 1,000 candelas, all lighting to be fully shielded so that light is emitted downward so as to not trespass onto neighboring properties and at angle of at least 20-degrees beneath the horizontal plane at the bottom of the light source. All shielding shall be within 12” of the light source. No lighting shall exceed 18’ in height. All lighting shall be turned off between the hours of 11:00 p.m. and sunrise. g. Noncompliance with any of the conditions assigned to the approval of this Special Use Permit by the Maricopa County Board of Supervisors may be grounds for revocation in accordance with the requirements and procedures as set forth in the Maricopa County Zoning Ordinance. h. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. i. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. Development of the site shall be in substantial conformance with the Narrative Report entitled “Narrative Report”, consisting of 14 pages, dated January 9, 2026 and stamped received January 12, 2026, except as modified by the following conditions. b. Development of the site shall be in substantial conformance with the Site Plan entitled “Event Space at Gambel Field“, consisting of one full-size sheet, dated revised February 6, 2026, and stamped received February 6, 2026 except as modified by the following conditions. c. Attendance shall be limited to 49 people or fewer on site at any given time during an event. d. Events shall only be held on Fridays, Saturdays and Sundays and only October through April and holidays. There shall be a maximum of 40 events per year. e. The SUP shall be valid for a period of ten years from the date of BOS approval, at which time it may be revisited and considered for extension, amendment or revocation. f. There will be no permitted buildings, structures, plumbing systems, or electrical installations. All structures associated with events shall be erected per manufacturer’s specifications and shall not be erected for more than 96 consecutive hours inclusive of not more than one day before or after an event day. This shall include requirement for portable mats to accommodate ADA-accessible routes. The site shall be restored to pasture after end of each event. g. Portable restroom facilities provided in compliance with the Environmental Health Code minimum ratios and serviced by a licensed provider; the portable toilets shall be permitted by MCESD and removed from the property when not in use. h. Amplified Noise: 1. No live amplified bands. 2. No tubas, accordions, bagpipes. 3. Any speakers will be directed away from occupied neighboring properties and angled towards the ground. i. Lighting: 1. Not more than three days per month. 2. Light towers will not be operated for more than three hours per day. 3. Light towers will be operated away from neighboring properties, and angled towards the ground to eliminate light trespass beyond property lines j. Generators -- emission creating generators over 5,500 watts will not be allowed on site and all participants will be encouraged to avoid generator use and to rely on portable solar or battery powered devices. k. There shall be no overnight camping. l. At least one trash can with 32 gallons capacity for every 25 people expected to be in attendance shall be provided. Trash and refuse disposal shall be pursuant to procedures established by the Maricopa County Environmental Services Department. m. Prior to any event, food concessions shall be permitted by Maricopa County Environmental Services Department (MCESD). Concessionaries must be licensed. The quality and quantity of food and location of concessions shall be approved by the Maricopa County Environmental Services Department. n. Ultimate half-street right-of-way dedication for 331st Ave. adjacent to the parent parcel. The half-street improvements will be waived. o. Prior to operation, written confirmation will be required from the emergency fire protection jurisdiction having authority that the facility has been designed in accordance with their regulations and requirements, and that emergency fire protection service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. There shall be stable access from the public road to the parking and event area for emergency response. p. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, and at the time of expiration of the Special Use Permit, the property may be considered for revocation to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, or the expiration of the Special Use Permit, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the Special Use Permit. The Special Use Permit enhances the value of the property above its value as of the date the Special Use Permit is granted and reverting to the prior zoning results in the same value of the property as if the Special Use Permit had never been granted. Based on the conceptual design nature of the information submitted, changes to the site layout and/or a reduction in the number of building lots may be necessitated by the final engineering design of the subdivision drainage infrastructure. 3. Stormwater retention volume calculations shall be based on Table 6.3 of the Maricopa County Drainage Policies and Standards. Use 0.95 for commercial/industrial areas and 0.5 for retention basin areas 4. Entitlement case is for the entire parcel and therefore the retention basin will need to be sized for the full contributing area. 5. The Grading and Drainage Plan must indicate that the required stormwater retention volume for the 100 year, 2 hour storm event with one (1) foot of freeboard is provided for the site. Basins one (1) foot or less in depth need not provide freeboard. Provide documentation that the retention basin(s) will drain within 36 hours. (MCZO 1205.7.6-2.a& c) 6. When submitting the plans for a building permit include the septic facilities on the plans. Maintain a minimum 25 foot separation between septic facilities. 7. Drainage Clearance is for fence/wall construction within or along property lines as shown on the approved plans. The drainage clearance does not include verification of property boundaries or easements which is the responsibility of the owner/applicant. Property line and easement disputes that may arise with new wall/fence construction are a civil matter. d. This special use permit is valid for a period of two years and shall expire on April 8, 2028, or upon termination of the use for a period of 90 or more days, whichever occurs first. All site improvements associated with the special use permit shall be removed within 90 days of such expiration or termination of use. e. Prior to utilizing any portion of the site for any use associated with the Special Use Permit, the applicant shall obtain Building Permits to retrofit the existing buildings to meet current commercial building code requirements as applicable and shall obtain a Certificate of Occupancy for the retrofitted buildings prior to occupancy.\ f. The following Rural-43 SUP standards shall apply: 1. Min. Screening: 6-foot screen wall or similar with additional landscaping along the south and west side of the site. 12’ max. allowed fence height outside buildable envelope. 2. Maximum Yard Coverage within Rear Setback: 47% 3. Min. On-Site Parking Spaces: 43 (including 3 ADA accessible) 4. Min. Parking and Driveway Aisles Surfaces: Alternative dust control measures such as decomposed granite or asphalt millings as approved by the County 5. Max. Attendance: 75 total persons on site at any given time 6. No amplified music or speakers at any time 7. No use of generators related to events 8. Outdoor lighting: Other than low intensity fixtures with a maximum candle power of less than 1,000 candelas, all lighting to be fully shielded so that light is emitted downward so as to not trespass onto neighboring properties and at angle of at least 20-degrees beneath the horizontal plane at the bottom of the light source. All shielding shall be within 12” of the light source. No lighting shall exceed 18’ in height. All lighting shall be turned off between the hours of 11:00 p.m. and sunrise. g. Noncompliance with any of the conditions assigned to the approval of this Special Use Permit by the Maricopa County Board of Supervisors may be grounds for revocation in accordance with the requirements and procedures as set forth in the Maricopa County Zoning Ordinance. h. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. i. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, and at the time of expiration of the Special Use Permit, the property may be considered for revocation to the zoning that existed on the date of application. MOU AND COST REIMBURSEMENT AGREEMENT (CRA) WITH THE DRUG ENFORCEMENT ADMINISTRATION FOR HOMELAND SECURITY TASK FORCE INVESTIGATIONS Approve the Memorandum of Understanding (MOU) between the Drug Enforcement Administration (DEA) and the Maricopa County Sheriff’s Office (MCSO). This MOU outlines the mission of the Homeland Security Task Force (HSTF), and formalizes the relationship between the DEA and MCSO, which will govern the process by which MCSO employees are detailed to work with the DEA as part of the HSTF. Approve the Cost Reimbursement Agreement (CRA) between the Drug Enforcement Administration (DEA) and the Maricopa County Sheriff’s Office (MCSO) in the amount of $382,374.87. This funding is recurring and has been awarded to the Sheriff’s Office for the past fourteen (14) years. There is no match requirement. The Sheriff’s Office indirect cost rate for FY26 is 27.66%, applicable to the award amount of $382,374.87 less capital expenses of $5,245.49 for an indirect cost base of $377,129.38 and indirect costs of $104,313.99 which will be absorbed by the General Fund. There are no future or ongoing contributions required after the grant period ends. This is not a mandated function although it supports the MCSO public safety mandate and provides a benefit to the citizens by disrupting the illicit drug trafficking organizations in Maricopa County and the State of Arizona resulting in a more safe and secure community. This is a competitive award. This is reimbursement funding that will be used to purchase capital and non-capital equipment; to maintain &/or repair previously purchased equipment; to secure subscriptions for technical service; to pay monthly data charges relating to several types of equipment; and to secure contracted analyst service. These revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. FY27 AOC FAMILY COUNSELING ALLOCATION Approve the application and acceptance of grant funds from the Administrative Office of the Courts (AOC) in the amount not-to-exceed $280,821 for the purpose of Family Counseling. The grant award will begin on July 1, 2026 and ends on June 30, 2027. The JPD department was awarded $278,239 in FY26. Also, approve the Board Resolution and authorize the Chair to sign all documents related to these grant funds, as applicable. The Juvenile Probation Department indirect rate for FY27 is 24.24%. Total grant indirect costs are estimated to be $68,071 and are not recoverable. The grant does require a cash equivalent match of $70,206. The grant award is reoccurring and has been awarded to the department for over thirteen years. The department has an in-kind match requirement of $70,206 during the grant award period. The grant award is a mandated function and provides a benefit to the citizens by providing family counseling services to support juveniles and intended to support their success upon release with the goal of providing behavioral change. The grant award is competitively bid and other eligible agencies may or may not bid on this grant award. If awarded, the department will absorb the costs of the grant award. Funding for this agreement is provided by a Grant from Administrative Office of the Courts (AOC). The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. GRANTS FUND BUDGET ADJUSTMENT In accordance with A.R.S. §42-17106(B), authorize the increase of expenditure authority in the Animal Care and Control (D790) Animal Control Grants Fund (573) Non-Recurring Non-Project (NRNP) appropriation group by $36,531 in Fiscal Year 2026. Grant funds from Petco Love (C-79-25-014-X-00) was previously awarded and approved in FY 2025 in the amount of $35,000 for the purpose of lifesaving objectives. Due to receiving the grant award late in the fiscal year, ACC was unable to spend it during FY 2025. The one-time expenditure adjustment will allow Animal Care and Control to spend the remaining grant fund balance within the grant term in FY 2026. Additionally, grant funds from Petsmart Charities Adoptions Preparation (C-79-25-010-X-00) was previously approved in FY 2025 in the amount of $30,000 for the purpose of preparing animals for adoption. Due to the timing of adoption events, ACC underspent the FY25 budget of $7,500 by $1,531. The one-time expenditure adjustment will allow Animal Care and Control to spend the remaining grant fund balance within the grant term in FY 2026. Both grants allow a 0% rate for indirect costs to administer this grant. The Maricopa County Department of Finance has calculated the Fiscal Year 2026 indirect cost rate at 12.83%. Total indirect costs on the grant carry-over balance are estimated to be $4,687 and are not recoverable so administrative costs will be absorbed into the Animal Care and Control Fund 572 Operating Budget. Funding for the agreements were provided by grants from Petco Love & Petsmart Charities and both were competitively bid. Both grants are non-recurring, and a cash or in-kind contribution is not applicable. There are no future or ongoing contributions required following the grant period. Grant funds are provided using the advance funding method where funding was received in advance of actual expenditures. There are no future or ongoing contributions required following the grant period. This request will increase the grant budget appropriation in the Animal Control Grants Fund (573) to accommodate expenditures authorized by the grants. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation and, therefore, expenditure of the funds is not prohibited by the budget law. These actions will have a County-wide net impact of zero and they do not alter the budget constraining the expenditure of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. Human Services Department Workforce Development Division provides services for Job seekers, youth and local employers. Facility Improvements were completed in 2015 utilizing funds provided to the County through an Intergovernmental Agreement (ADES 14-054318) (C-22-23-072-3-00) with Arizona Department of Economic Security (ADES) for Workforce Investment Act (WIA) Title 1B services to eligible Youth (ALN 17.259 YOUTH), Adults (ALN 17.258 ADULT), and Dislocated Workers (ALN 17.278 DISLOCATED WORKER) to administer Workforce Development youth program activities. The assets for disposition are no longer useable and require repairs that exceed the costs. 64. TRANSFER OF OWNERSHIP OF RETIRING EQUINE APOLLO Approve the transfer of ownership of retiring mounted equine Apollo to Lieutenant Ranck, SN #S1813. Apollo has served 5 years with the Maricopa County Sheriff's Office (MCSO) Mounted Unit. He has served the Office with strength, calmness and dignity while participating in patrol operations, community engagement events, crowd management details and various law enforcement support functions. Apollo is a 9-year-old Clydesdale and is suffering from several medical issues including severe cartilage degradation, arthritis and hoof abscesses. He has been out of service for the last year while receiving medical treatment. Due to his declining health, it is in his best interest to be retired. Lieutenant Ranck is aware of the medical issues and willing to accept the full care and financial responsibility for Apollo upon transfer of ownership and will be asked to sign the Release and Indemnification. IGA WITH THE TOWN OF CAREFREE FOR THE WHITE WASH AT LEISURE LANE CULVERT REPLACEMENT PROJECT (Supervisorial District: 3) Approve Intergovernmental Agreement (IGA) FCD 2026A006 for White Wash at Leisure Lane Culvert Replacement Project (Project) between the Town of Carefree (Town) and the Flood Control District of Maricopa County (District). The estimated total Project cost is $425,725. The District’s estimated share of the Project cost is $319,294; the City estimated share of the Project cost is $106,431. The Town will operate and maintain the completed Project. This Agreement shall become effective as of the date it has been executed by all PROJECT PARTNERS and shall expire two years from that date, or upon Project completion, whichever occurs first. The Town proposed the Project for the District’s evaluation under the District’s Small Project Assistance Program for Fiscal Year 2026. This IGA is proposed in accordance with the terms of the Small Project Assistance Program, adopted by the Board under Resolution FCD 2022R003 (C-69-23-013-X-00). The White Wash at Leisure Lane Culvert Replacement Project includes installation of 4'x8' culvert, gabion baskets and fill, cutoff walls, rip rap and geotextile in the 5900-6000 block of East Leisure Lane.
