6. ARIZONA SELF STORAGE ON LINDSAY Case #: Z250037 (Supervisorial District: 1) Applicant and Owner: Jessica Sarkissian, Upfront Zoning & Entitlements, LLC / Arizona Self Storage on Lindsay Road, LLC Request: Zone Change from Rural-43 Special Use Permit (SUP) to C-3 CUPD Site Location: Generally located ¼-mile north of the northwest corner of Lindsay Rd. and Germann Rd. in the Gilbert area Commission Recommendation: On 4/23/25, the Commission voted 7-0 (motion by Commissioner Larwence D1, seconded by Commissioner Leighton D4) to adopt a motion recommending the Board of Supervisors approve Z250037 subject to conditions ‘a’ – ‘g’: a. Development of the site shall be in substantial conformance with the Zoning Exhibit entitled “Arizona Self Storage at Lindsay“, consisting of one full-size sheet, dated March 5, 2026, and stamped received March 10, 2026, except as modified by the following conditions. Staff may determine slight refinements to remain in substantial conformance with the approved site plan. Minor and major amendments to the site plan will be determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance. b. Development of the site shall be in substantial conformance with the Narrative Report entitled “AZ Self Storage at Lindsay Road”, consisting of four pages, dated March 9, 2026, and stamped received March 10, 2026, except as modified by the following conditions. c. Administrative approval of a Plan of Development will be required prior to approval and issuance of construction permits to develop and establish use of the site. Prior to issuance of a building permit, written confirmation will be required from the emergency fire protection jurisdiction having authority that the facility has been designed in accordance with their regulations and requirements, and that emergency fire protection service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. d. The following Planning Engineering conditions shall apply: 1. No new site improvements are being proposed with this request. If any new site improvements or grading are proposed, then detailed Grading & Drainage Plans must be submitted with any Plan of Development and associated building permits on this site. 2. The applicant and/or the property owner shall contact the Town of Gilbert regarding access, right-of-way, and improvements required for Lindsay Rd. 3. Due the site’s location near the Loop 202 San Tan Frwy. the applicant and/or the property owner must notify ADOT via the Red Letter Process, RedLetter@azdot.gov. e. The following C-3 CUPD development standards shall apply: 1. There shall be no interior side setbacks adjacent to rural or residential zoned property. 2. There shall be a minimum of 6’ tall solid wall, chain link fencing with attached view obscuring materials or buildings used for screening of the site’s commercial uses. 3. Entitled uses are limited to storage facilities and ancillary uses or use that according to MCESD can have wastewater disposal accommodated via on-site septic system until such time as sewer is available to the site. f. Noncompliance with any of the conditions assigned to the approval of this Zone Change by the Maricopa County Board of Supervisors may be grounds for revocation in accordance with the requirements and procedures as set forth in the Maricopa County Zoning Ordinance. g. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property may be considered for revocation to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change. The Zone Change enhances the value of the property above its value as of the date the Zone Change is granted and reverting to the prior zoning results in the same value of the property as if the Zone Change had never been granted.
