103. IGA WITH THE STATE OF ARIZONA FOR THE DEACTIVATION OF SALT RIVER PROJECT (SRP) IRRIGATION STRUCTURE: BROADWAY ROAD BRIDGES AT THE TEMPE CANAL Approve the Intergovernmental Agreement (IGA) between Maricopa County and the State of Arizona, through its Department of Transportation to deactivate a Salt River Project (SRP) irrigation structure: BROADWAY ROAD BRIDGES AT THE TEMPE CANAL. The purpose of this Intergovernmental Agreement is to identify and define the Parties’ respective roles in the deactivation of a non-active and privately owned irrigation delivery facility that is connected to SRP’s canal system. The County is currently in the final design phase of the Broadway Road Bridge Replacement Transportation Improvement Project and needs to expand the structure over the canal system to continue providing the City of Tempe’s primary water supply. The facility, which has been inactive for over a decade, is no longer capable of functioning and resides with the State’s right-of-way. Upon execution of this agreement, the State will deactivate the line and issue Maricopa County an encroachment and demolition permit to remove the facility during the construction phase of the Transportation Improvement Project. The State will also issue annual maintenance permits to complete the necessary inspections of the new structure, and emergency maintenance permits if necessary. This Agreement may be cancelled at any time up to 30 days before the award of the Project contract, so long as the cancelling Party provides at least 30 days’ prior written notice to the other Party.
