AMENDMENT TO IGA WITH ARIZONA DEPARTMENT OF HEALTH SERVICES FOR PUBLIC HEALTH EMERGENCY PREPAREDNESS PROGRAM Pursuant to A.R.S. §42-17106(B), approve appropriation adjustments resulting in a net increase to revenue and expenditures of $1,603,707 in FY 2022 for Public Health (D860) Public Health Grants Fund (532) Non-Recurring (NRNP) budget. Approve an amendment to retro-active, cost-reimbursement Intergovernmental Agreement (IGA) No. CTR055214 for the Public Health Emergency Preparedness Program between Arizona Department of Health Services (ADHS) and Maricopa County by and through its Department of Public Health (MCDPH). Funding is provided to improve the preparedness of each community in the event of a public health emergency. Nothing in this Agreement is meant to supplant or in any other way discourage existing planning and coordination between County and Tribal Health Departments. This Agreement is designed to increase participation in the ongoing development of the State and County Health Preparedness Infrastructure through the CDC Public Health Preparedness Cooperative Agreement with the ADHS. 1.1 The Scope of Work is hereby revised and replaced, as a result of the addition of the Workforce Development Grant tasks and deliverables; 1.2 The Price Sheet is hereby revised and replaced, as a result of the addition of the Workforce Development Grant funding; 1.3 Exhibit B has been added. The WORKFORCE DEVELOPMENT GRANT is a new award, and it is uncertain whether it will reoccur after the initial 2-year period. The Price Sheet is for the additional funding for the WORKFORCE DEVELOPMENT GRANT to the current PHEP IGA. The additional 2-year funding is in the amount of $3,207,415 from July 1, 2021 through June 30, 2023. This new additional amount does not pertain to the original amount of $2,747,578, which was approved by the Board of Supervisors as C-86-22-216-X-00. The IGA term began July 1, 2021 and terminates June 30, 2026. Maricopa County Department of Public Health’s Indirect Rate for FY22 is 17.97%. Funding is provided to improve the preparedness of each community in the event of a public health emergency. This amendm ent revises the Scope of Work, Price Sheet and adds Exhibit A (CFR200.332 Requirements for pass-through entities) and Exhibit B (Grant Deliverables from the Bureau of Public Health Emergency Preparedness). This amendment is for Budget Period 4 which includ es the Period of Performance of July 1, 2022 through June 30, 2023. The purpose of this amendment is to include ADHS PHEP Grant Deliverables to MCDPH and specify ADHS expanded authority to carryover of unobligated balances from one (1) budget period to a s ubsequent budget period. The Unobligated funds may be used for purposes within the scope of the project as originally approved. The amendment further clarifies the budget timeline in Section 4.1.6 and states that COVID grant funds may be applied to approve d Contractor expenses incurred up to and March 15, 2023. This also applies to the Workforce Development grant funds. The total not-to-exceed amount is $3,174,569.00 ($1,941,093 for PHEP & $1,233,476 for CITYRD) for the Budget period four (4) from July 1, 2 022 through June 30, 2023. The IGA term began July 1, 2021 and terminates June 30, 2026. MCDPH’s Indirect Rate for FY23 is 17.24%. The indirect costs are estimated at $285,435.37 for PHEP & $181,381.15 for CITYRD all of which is fully recoverable. Depart mental indirect rates are reestablished at the beginning of each fiscal year and the future indirect rates will be collected at the corresponding rates. This Agreement is designed to increase participation in the ongoing development of the State and County Health Preparedness Infrastructure through the CDC Public Health Preparedness Cooperative Agreement with the ADHS. It is mutually agreed that the Intergovernmental Agreement referenced is amended as follows: 1. Pursuant to Terms and Conditions, Provision Six (6) Contract Changes, subsection 6.1 Amendments, the Contract is hereby revised with the following: 1.1. The Price Sheet is revised and replaced. 1.2. The indirect costs are estimated at $439,726.61 and are fully recoverable. The PO’s not-to-exceed amount is $40,000.00 for the budget period September 01, 2025, through August 31, 2026. The term of the IGA is September 01, 2021, through August 31, 2026. This is year five (5) of the initial five (5) year grant award and it is not certain if it will continue beyond this year. The award was non-competitive and there is no cash or in-kind match required. This project is not a mandated function but provides a benefit to Maricopa County residents by providing public health strategies for extreme heat effects. Should the grant be discontinued, ongoing cash contributions would not be required. The Department of Health’s indirect rate for FY26 is 16.69%. Indirect costs are estimated at $5,721.14, which are fully recoverable. Departmental indirect rates are re-established at the beginning of each fiscal year, and the future indirect rates will be collected at corresponding rates. The PO’s not-to-exceed amount is $40,000.00 for the budget period September 01, 2025, through August 31, 2026. The term of the IGA is September 01, 2021, through August 31, 2026. This is year five (5) of the initial five (5) year grant award and it is not certain if it will continue beyond this year. The award was non-competitive and there is no cash or in-kind match required. This project is not a mandated function but provides a benefit to Maricopa County residents by providing public health strategies for extreme heat effects. Should the grant be discontinued, ongoing cash contributions would not be required. The Department of Health’s indirect rate for FY26 is 16.69%. Indirect costs are estimated at $5,721.14, which are fully recoverable. Departmental indirect rates are re-established at the beginning of each fiscal year, and the future indirect rates will be collected at corresponding rates. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law.
