CARDINALS NEST Case #: Z240017 Supervisor District: 4 Applicant and Owner: Josue Velazquez / Emiliano Velazquez Request: Zone Change from R1-6 to R-4 with a Plan of Development for multi-family residential development Site Location: Generally located 620’ north of the NEC of Glendale Ave. & 80th Ave. in the Glendale area Commission Recommendation: On 08/7/25, the Commission voted 7-0 (motion by Commissioner Hernandez D5 and second by Commissioner Whitney D3) to adopt a motion recommending the Board of Supervisors approve Z240017 subject to conditions ‘a’ – ‘g’ a. Development of the site shall be in substantial conformance with the Site Plan entitled “Cardinal Nest”, consisting of one full-size sheet, stamped received March 28, 2025, except as modified by the following conditions. Staff may determine slight refinements to remain in substantial conformance with the approved site plan. Minor and major amendments to the site plan will be determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance. b. Development of the site shall be in substantial conformance with the Narrative Report entitled “Cardinals Nest Rezone”, consisting of five pages, dated March 26, 2025, and stamped received March 28, 2025, except as modified by the following conditions. c. Any amendments to the Plan of Development shall be processed administratively through a new Plan of Development application with Maricopa County Planning & Development. d. The following Planning Engineering conditions shall apply: 1. Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 2. Based on the conceptual design nature of the information submitted, changes to the site layout and/or a reduction in the number of buildings lots may be necessitated by the final engineering design of the subdivision drainage infrastructure. 3. Retention basins to drain within 36 hours. 4. The site is not located in a Special Flood Hazard Areas (SFHAs). The Flood Control District has no comments on this application. 5. The subject site is presently located within the County’s Urbanized Area, but site disturbance appears less than one (1) acre. A Storm Water Pollution Prevention Permit (SWPPP) from the County (PND) is not required. This does NOT preclude the requirement to obtain a Construction General Permit (CGP) Notice of Intent to Discharge (NOI) from the State (ADEQ), as may be required. e. Non-Compliance with any Maricopa regulations will be grounds for possible revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. f. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. g. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change. The Zone Change enhances the value of the property above its value as of the date the Zone Change is granted and reverting to the prior zoning results in the same value of the property as if the Zone Change had never been granted. ES-2025-002 MOBILE HOME PARKS – RECREATIONAL VEHICLE PARKS Pursuant to A.R.S. §36-184(B)(5) and §11-251.05, convene the scheduled public hearing to solicit comments and consider the adoption of proposed revisions to Chapter IX, Section 2-9 of the Maricopa County Environmental Health Code (MCEHC). The proposed revisions will result in deregulation by no longer requiring permits for mobile home parks that do not offer space for recreational vehicles and will align MCEHC with the Arizona Administrative Code (A.A.C.) rules for mobile home parks and recreational vehicle parks. [ES-2025-002 Mobile Home Parks/Recreational Vehicle Parks]. This item will become effective immediately upon the Board of Supervisors' approval. GRANT FUNDING FROM CONSTABLE ETHICS, STANDARDS AND TRAINING BOARD FOR EQUIPMENT PURCHASE-BALLISTIC VESTS Approve the application and acceptance of grant funds from Constable Ethics, Standards and Training Board (CESTB), (Grant Number CNA25-110), in the not-to-exceed amount of $2,500 for the purpose of purchasing ballistic vests for two new Constables. The grant award begins on July 1, 2024 and ends on December 31, 2025. Authorize the Chairman to sign all documents related to these grant funds, as applicable. The grant allows a 0% rate for indirect costs which may be incurred by the Constables or Maricopa County for the administration of this grant. The Maricopa County Department of Finance has calculated the Constables' composite indirect cost rate at 9.67%, or $241.75. The recoverable indirect cost of administering this grant is $0; the non-recoverable indirect cost is $241.75. Upon receipt of funds and pursuant to ARS §42-17106(B), approve revenue and expenditure appropriation adjustments to the Constables (D250) General Fund (100) Non-Recurring (NRNP) budget associated with the grant in the amount of $2,500 for FY 2026. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. This budget adjustment does not alter the budget constraining the expenditure of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The grant award is non-recurring and a cash or in-kind match is not applicable. Indirect cost is non-recoverable in the amount of $241.75. Future ongoing cash contributions are not required after the grant period. The grant award is not a mandated function but provides a benefit to the citizens in allowing an increase in safety for constables/deputy constables. The grant award is non-competitive. APPROPRIATION ADJUSTMENT FOR COUNTY ATTORNEY SPECIAL REVENUE FUND Pursuant to A.R.S. $42-17106(B), approve the following transfer of expenditure authority within the FY2026 Budget: a) Increase the expenditure authority in the County Attorney (D190) RICO (213) RICO Arizona State Shared Funds Non-Recurring (RAZ1) budget by $1,000,000. b) Decrease the expenditure authority for the Non-Departmental (D470) Non-Departmental Grants Fund (249) Non-Recurring Non-Project (NRNP) in the line “Unassigned Contingency” by $1,000,000. The County Attorney has identified initiatives that will enhance the public’s safety. These projects are of a one-time nature and will be resolved by the end of the 2025-2026 fiscal year. The County Attorney proposes to utilize $1,000,000 in existing fund balance of the County Attorney (190) RICO (213) fund. ACCEPT FUNDING FROM THE ARIZONA ATTORNEY GENERAL’S OFFICE FOR THE FY 2026 VICTIMS’ RIGHTS PROGRAM (VRP) Approve the Agreement and acceptance of $183,000 in advance grant funding from the Arizona Attorney General’s Office, Victims’ Rights Program (VRP). The Award Agreement is A.G. # 2026-046. The term of this funding is July 1, 2025 through June 30, 2026. The Sheriff’s Office is mandated by Arizona Revised Statues Title 13, Chapter 40 (Crime Victim’s Rights) and Title 8, Chapter 3 (Victim Rights for Juvenile Offenses) requires victim notification upon a suspect’s arrest, next court appearance, release from custody, post-conviction/post adjudication release etc. This funding award offsets a portion of the cost to meet this mandate and provides funding for positions as follows: .34 FTE of six (6) Justice System Clerk positions, and .32 FTE of one (1) Justice System Clerk Supervisor position. The award also funds certain operating expenses. The remaining annual cost burden of this mandate, calculated to be $256,188, is funded within the MCSO annual appropriation. The MCSO indirect cost rate for FY26 is 27.66%. Unrecoverable indirect costs associated with this Agreement are estimated to be $50,617.80 and will be absorbed by the Detention Fund. This funding is recurring, there is no matching requirement nor is there a competitive bid process for this grant. The grant award does not require ongoing cash contributions after the grant period end date. These revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. This funding is competitive and does not require a match. The funding is recurring and has been awarded to the Sheriff’s Office for over seven years. AGREEMENT WITH U.S. ENVIRONMENTAL PROTECTION AGENCY Approve an Agreement between the U.S. Environmental Protection Agency (EPA) and Maricopa County through the Air Quality Department (MCAQD) in the not-to-exceed amount of $1,147,680. The purpose of this grant is to provide assistance to MCAQD in its efforts to implement air pollution control programs throughout Maricopa County as required by 40 CFR Part 50, Part 53, and Part 58. This agreement is funded by a grant from the EPA, Award ID# A00905225 and provides full funding. This agreement and budget are effective until September 30, 2025. The FY2025 Air Quality composite indirect rate of 36.10% will be applied to the direct charges of $843,262. Per the EPA award letter, the indirect cost of administering this grant is $304,418 and is allowable and fully recoverable. The grant award is reoccurring and has been awarded to the department in previous years. The cash or in-kind match is not applicable, and ongoing cash contributions are not applicable. The grant award is mandated by the EPA Clean Air Act, Section 105. The grant award is noncompetitively bid. There are no costs that will need to be absorbed by the department’s operating budget. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation; therefore, expenditures of these revenues are not prohibited by the budget law. AMENDMENT TO AGREEMENT WITH THE MARICOPA ASSOCIATION OF GOVERNMENTS Approve a Government Services Contract (GSC) (1307) amendment agreement between the Maricopa Association of Governments (MAG) and Maricopa County Air Quality Department (MCAQD) in the not-to-exceed amount of $962,347.00. The purpose of this agreement is to support Air Quality Department program efforts. This Agreement and budget are effective from October 1, 2025, until September 30, 2026. The FY2026 MCAQD indirect cost rate of 36.81% will be applied to the direct charges of $450,513.12. Per the MAG award agreement, the indirect cost of administering this grant is $165,833.88 and is allowable and fully recoverable. The grant award is reoccurring and has been awarded to MCAQD in previous years. The cash or in-kind match is not applicable, and ongoing cash contributions are not applicable. This grant award is a mandated function of the MCAQD per Arizona Revised Statutes (ARS) §49-581 et seq. The grant award is noncompetitively bid. ACCEPT FUNDS FROM DEPARTMENT OF HOMELAND SECURITY FOR SECURING THE CITIES PROGRAM Approve the grant fund carry-over of $2,857,000 from Department of Homeland Security, Grant No. 24CWDSTC00018-03-00 formerly 20CWDSTC00016. This grant provides assistance to the region by developing Preventative Radiological and Nuclear Detection (PRND) programs and integrating them into a national detection architecture. The Securing the Cities program provides training and support to the County and the participating municipalities on radiological detection through the use of federally approved equipment during routine patrols/business and at special events. The grant award begins on August 01, 2025 and ends July 31, 2026. Due to obligated project costs EM will be able to recover $186,407.37 at the approved department Indirect Cost rate of 6.98%. The grant award is reoccurring. There is no match requirement for this grant. Maricopa County does not have to fund any additional costs for the program. The grant award is a non-mandated function and is a non-competitive award. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. 50. FLEET ADDITION AND EXEMPTION FROM MARKINGS Approve addition of one full-size SUV to the County fleet for the Emergency Management Department, specifically the Security Services Division. The vehicle will be sourced from an existing unit that was previously replaced but, based on Equipment Services’ recommendation, is suitable to be returned to service. Also, approve exemption from markings per A.R.S. § 38-538-03 for vehicle #312460. Justification: Due to an increase in patrol activities, Security Services requires an additional vehicle to maintain adequate coverage across County facilities and properties. This vehicle will be primarily used to conduct regular patrols around County buildings and grounds, providing safety and security for County personnel and visitors. Financial Impact: • Estimated annual operating cost: $8,500 • At the end of its useful life, the vehicle will be replaced using General Fund dollars allocated for vehicle replacement. The County provided the Subrecipient with $52,390.00 in U.S. Department of Housing and Urban Development (HUD) Community Development Block Grant (CDBG) Program Year/Fiscal Year 2024/2025 funds under Assistance Listing Number (ALN) 14.231, and $433,521 in Fiscal Year 2025 Emergency Solutions Grant (ESG) funding through an Intergovernmental Agreement (IGA) with Arizona Department of Economic Security (DES) under IGA DI23-002395/ C-22-23-107-X-00. The Agreement total funding amount is $485,911.00. The term of the Agreement is July 1, 2024, through June 30, 2025. The Purpose of the Amendment is to address the following: 1. Award funding in the amount of $385,658 in Emergency Solutions Grant (ESG) funds under ALN 14.231 for Fiscal Year 2026. 2. Revise Contract Amount on Page 1 to reflect a new total Agreement funding amount of $438,048. The funding period of availability for PY24/FY25 HUD CDBG funding remains unchanged and expires 6/30/25. 3. Revise the Contract Termination Date on Page 1 to June 30, 2026. 4. DATA TRANSFER AND USE AGREEMENT WITH ARIZONA STATE UNIVERSITY FOR HOMELESSNESS RESEARCH Approve a non-financial Data Transfer and Use Agreement (DUA) with Arizona Board of Regents for and on behalf of Arizona State University (ASU) and Maricopa County (County) administered by the Human Services Department. ASU and the County are referred to as the “Parties” and individually as the “Party.” ASU as part of a tri-university collaboration, initiated by Arizona Department of Housing (ADOH) wishes to collaborate with the County for a project whose goal is to evaluate homelessness prevention programs across the state by examining the programs, processes and outcomes. The Arizona Housing Analytics Collaborative [AzHAC], housed at ASU, whose members are ASU, University of Arizona and Northern Arizona University, will link data sources from providers who implement housing insecurity and homelessness prevention programs to produce estimates of the incidence and prevalence of homelessness at the city, county and state levels. The County will provide AZHAC access to client data in the Homeless Management Information System (HMIS) who have formally consented to disclosing their data and personally identifying information (PII) with AzHAC to determine housing-related outcomes of participants which are beneficiaries of the Arizona Department of Housing (ADOH) grant funded Preventing Housing Insecurity Flex Funds (PHIFF) program. All use of data provided is solely for the purpose of this project and will be in compliance with Institutional Review Board (IRB) ethical standards, including ensuring the privacy and confidentiality of PII information. PII data may be used by AzHAC for purposes including, but not limited to: 1) Program Evaluation, 2) Needs Assessment, 3) Outcome Measurement, 4) Administrative Tracking, and 5) Quality Assurance to inform program planning, service delivery and systems’ coordination. AzHAC will also gather health and psychosocial characteristics and histories that are most likely to produce homelessness and what interventions result in successful exits from homelessness. The DUA is valid for 3 years from full execution of the Agreement or upon completion of the project, whichever occurs first. The Agreement shall also establish the guidelines for the County to utilize classroom and playground space in identified schools under the District’s control. The Agreement term shall be effective and retroactive to July 1, 2025, and terminate on June 30, 2026. The Head Start program will utilize classroom spaces (at no cost) in 9 District Schools. 76. 240056-CMR, MARICOPA COUNTY ELECTIONS FACILITY PHASE 2 GMP#2 Approve and award a Construction Manager at Risk (CMR) Phase 2 Construction Services contract, GMP#2 (Guaranteed Maximum Price), between Maricopa County and Core Construction in the amount of $157,033,185.00 for the construction services of the new Downtown Elections Facility, located at 801 Jefferson St., Phoenix, AZ 85007. The new facility is designed to consist of four stories totaling approximately 260,000 square feet and will include a basement level with three levels above grade. The Phase1 contract was previously approved by the Board of Supervisors for $1,324,514.00 for pre-construction services to include constructability reviews, cost estimating, and value engineering. The Phase 2 contract, GMP#1 was previously approved by the Board of Supervisors for $18,251,519.00 for on and offsite utility improvements, site excavation, and shoring (approximately one city block). Approval of GMP#2 will enable the balance of the construction of the facility that was not included in the previously approved GMP#1. This project is located in Supervisor District 5. NOTICE OF AWARD WITH HEALTH RESOURCES AND SERVICES ADMINISTRATION FOR HEALTHY START INITIATIVE Approve Notice of Award (NOA) 6 H49MC00174‐25‐02 from the Health Resources and Services Administration (HRSA) to Maricopa County by and through its Department of Public Health (MCDPH) to provide support for negative maternal health outcomes for the Healthy Start Initiative (HSI) program. The NOA is in the not-to-exceed amount of $312,324.00 for the period April 01, 2025 through March 31, 2026. The term of the award is May 01, 2024, through March 31, 2029. HRSA’s Healthy Start grant award is competitive, however, this is not the first time it has been awarded to the Department. The grant does not require an in-kind match and ongoing cash contributions are not required. Healthy Start services are not a mandated function but provide valuable benefits to Maricopa County residents. All program costs are allocated to the grant so there will be no additional burden on the Department’s operating budget. The Department of Health’s indirect rate for FY26 is 16.69%. Indirect costs are estimated at $44,671.24, all of which is recoverable. Departmental indirect rates are re-established at the beginning of each fiscal year and any future indirect rate will be collected at the corresponding rates. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the revenues is not prohibited by the budget law. Funding is in the amount of $970,546.50 for the budget period July 01, 2025, through June 30, 2026. The IGA term is July 01, 2022, through June 30, 2029. Maricopa County Department of Public Health’s Indirect Rate for FY26 is 16.69%. The indirect costs are estimated at $138,815.85 and are fully recoverable. Departmental indirect rates are reestablished at the beginning of each fiscal year and the future indirect rates will be collected at the corresponding rates. This award is reoccurring and has been awarded to the department in previous years. Indirect cost is fully recoverable and ongoing cash contributions are not required. The grant award is not a mandated function but provides a benefit to the citizens by strengthening the readiness of the community, to prepare for, respond to, and recover from a public health emergency and/or disaster. The grant award is non-competitive and a 10% in-kind or soft match is required. Maricopa County accomplishes this through the use of general funded employees, professional and outside service contracts, epidemiological data software and warehouse space. Awards were funded by grants from the Centers for Disease Control and Prevention (CDC) of the U.S. Department of Health and Human Services (HHS). ACCEPT FEDERAL FUNDING REIMBURSEMENTS FOR TE081: A DETECTION UPGRADES FOR ADVANCED DATA ANALYTICS Authorize the Maricopa County Department of Transportation (MCDOT) to accept federal funding reimbursements as approved by the Maricopa Association of Governments (MAG) and expend the grant funds for the Department of Transportation: Transportation System Management Project, sub-project TE081 A Detection Upgrades for Advanced Data Analytics up to the total cost of the project. In association with the Maricopa Association of Governments, this project consists of the procurement of video detection systems that is inclusive of all hardware and software at each of the 22 MCDOT-owned and maintained intersections. Necessary field infrastructure upgrades will be installed on existing MCDOT traffic signal infrastructure. All communication infrastructure will tie into existing MCDOT communications infrastructure. Removal of existing technology to be performed at relevant intersections. The estimated construction cost of the project is $953,925.00. MAG has authorized $899,551.00 in federal reimbursement funds available beginning in FY 2025. MCDOT’s local 5.7% match portion is $54,374.00 and will be absorbed by the department’s transportation operations budget. The total project cost of $963,925.00 includes $10,000.00 of funds provided by MCDOT previously used for Preliminary Engineering and are not part of the requested Procurement cost in this authorization. The grant awarded is a one-time award. There are no future or ongoing contributions required after the grant period ends. The grant does not fulfill a mandated service that the department is required to perform. The grant award is a competitively bid, and other eligible agencies may or may not bid on this grant award. MCDOT’s FY 2025 indirect cost rate is 36.80%. All costs under this agreement are for capital expenditures not subject to indirect cost recovery. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. MCDOT’s local 5.7% match portion is $41,308.00 and will be absorbed by the department’s transportation operations budget. The total project cost of $734,710.00 includes $10,000.00 of funds provided by MCDOT previously used for Preliminary Engineering and are not part of the requested Procurement cost in this authorization. The grant awarded is a one-time award. There are no future or ongoing contributions required after the grant period ends. IGA WITH UNIVERSITY OF ARIZONA FOR INTELLIGENT TRANSPORTATION SYSTEMS (ITS) STUDIES Maricopa County, through the Maricopa County Department of Transportation (MCDOT), and the Arizona Board of Regents, on behalf of the University of Arizona (UofA), seek Board approval of a Master Intergovernmental Agreement to collaborate on research-oriented traffic and Intelligent Transportation Systems (ITS) development studies. This Agreement shall become effective as of the date it is approved. Under this five-year agreement, projects may occur within Maricopa County or at UofA facilities, including the Transportation Research Institute in Tucson, and will be initiated through mutually approved project-specific addenda. This partnership will leverage the resources, expertise, and infrastructure of both agencies to advance innovative transportation solutions, improve traffic operations, deploy emerging technologies, and enhance public mobility and safety. Project responsibilities, deliverables, schedules, and cost-sharing will be defined in each addendum, with funding from County, UofA, or joint state and federal grants. 110. IGA WITH TOWN OF GILBERT FOR DESIGN CONCEPT REPORTS FOR THE RIGGS ROAD CHANNEL AND THE SONOQUI WASH RESTORATIONS Approve Intergovernmental Agreement (IGA) FCD 2025A011 for Design Concept Reports for the Riggs Road Channel and the Sonoqui Wash Restorations (PROJECT) between the Town of Gilbert (TOWN) and the Flood Control District of Maricopa County (DISTRICT). This Agreement shall become effective as of the date it has been executed by all PROJECT PARTNERS and shall expire five years from that date. The TOWN has requested that the DISTRICT participate in the development of two Design Concept Repots (DCR) to evaluate the SW0125 Riggs Road Channel Restoration and the SW0070 Sonoqui Wash Restoration for the purpose of identifying solutions to the existing deterioration and maintenance challenges of the channel and the wash. Both were constructed by the DISTRICT and the TOWN in partnership under previous intergovernmental agreements. The estimated cost for each of the two DCRs is $200,000 with the DISTRICT cost share to be fifty percent, not to exceed $100,000 The Riggs Road Channel Restoration project is located on the south side of Riggs Road from east of Higley Road to the East Maricopa Floodway (EMF). The current issues are mainly of an operations and maintenance nature with many of the gabions and check dams failing and the channel eroding in some locations. The goal of this DCR is to identify methods for the restoration of the channel. The Sonoqui Wash Restoration project is located on the north side of Ocotillo Road from the Town’s boundary with Queen Creek to the EMF. The current issues are mainly erosion within the channel and poor low flow and inlet conditions. The goal of this DCR is to identify solutions to improve these conditions. 111. CHANGE ORDER TO CONTRACT FOR PARADISE RIDGE DRAINAGE IMPROVEMENTS Approve Change Order No. 4 in the amount of $600,000.00 to the contract which will allow Wood, Patel & Associates (consultant) to complete all remaining work assignments for Paradise Ridge Drainage Improvements (PROJECT). The Change Order is primarily needed to address unexpected conditions that fall under Arizona Antiquities Act requirements. The Paradise Ridge Channel (extending from the southwest corner of Pinnacle Peak Road & Scottsdale Road, south approximately 2.5 miles to State Route 101) was identified in the Pinnacle Peak West Area Drainage Master Study as being a necessary component to control the alluvial fan flooding in the area. This PROJECT will reduce the flood hazard in the area and complete the final step of a comprehensive solution to this drainage corridor. This agenda item impacts Supervisorial District 3.
