64. IGA WITH ARIZONA DEPARTMENT OF HEALTH SERVICES FOR ARIZONA BIRTH DEFECTS MONITORING PROGRAM Approve a cost-reimbursement, Intergovernmental Agreement (IGA) between ADHS and Maricopa County by and through its Department of Public Health (MCDPH), Office of Epidemiology (OE) to provide funding for the ‘Arizona Birth Defects Monitoring Program’ ( AzBDMP ). Maricopa County Department of Public Health will assist Arizona Department of Health Services to fulfill the grant deliverables from the State and Centers for Disease Control and Prevention (CDC) for surveillance, prevention, and referral activities related to the data collection of cancer and birth defects. This surveillance program has been established since 1986 and has well-established protocols for the registration of newborns with birth defects. Surveillance work has included Zika virus transmission, Neonatal Abstinence Syndrome (NAS), and expanded into surveillance of pregnancies and adverse outcomes through CDC and the Council of State and Territorial Epidemiologists (CSTE). The IGA term will begin January 1, 2022 through December 31, 2025, with an option to extend to a total of 5 years. The budget period is from January 2022 to December 2022, for a not-to-exceed amount of $360,000.00. This is the second 5-year term and it is uncertain whether it will reoccur. There is no cash or in-kind match required nor should ongoing cash contributions be necessary. The grant award is not a mandated function but provides a benefit to the citizens with its effort to collect, analyze and understand birth defect related data. The grant award was not competitive. The Department of Public Health’s indirect rate for FY22 is 17.97%. Full indirect costs are estimated at $54,837.67, all of which is recoverable. Departmental indirect rates are reestablished at the beginning of each fiscal year and the future indirect rates will be collected at the corresponding rates. (C-86-22-132-X-00)

It was incorrectly stated that there was no cash or in-kind match required. Exhibit A indicates that $39,018.91 was to be paid by Maricopa County for the budget period of January 1, 2021 through December 31, 2021. The IGA term is January 1, 2022 through December 31, 2025, with an option to extend to a total of 5 years. The PO’s not-to-exceed amount is $360,000 for the budget period January 2024 to December 2024. Maricopa County Department of Public Health will assist Arizona Department of Health Services to fulfill the grant deliverables from the State and Centers for Disease Control and Prevention (CDC) for surveillance, prevention, and referral activities related to the data collection of cancer and birth defects. This is the first 5-year term of this grant and it is uncertain whether it will reoccur. The Department of Public Health’s indirect rate for FY24 is 15.65%. Grant indirect costs are fully recoverable in the amount of $48,715.95. There is no cash or in-kind match requirement as per the original agreement. The grant award is not a mandated function but provides a benefit to the citizens with its effort to collect, analyze and understand birth defect related data. The grant award was not competitive. RESCIND PURCHASE ORDER FOR IGA WITH ARIZONA DEPARTMENT OF HEALTH SERVICES FOR BIRTH DEFECTS MONITORING Rescind the action approved by the Board of Supervisors (BOS) on April 09, 2025, for item C-86-22-132-X-03, the Purchase Order (PO) PO0000688957-2 between Arizona Department of Health Services (ADHS) and Maricopa County by and through its Department of Public Health (MCDPH) for the Arizona Birth Defects Monitoring Program. The rescind action is necessary due to an administrative error. An outdated version of the purchase order was uploaded to the Arizona Purchase Portal (APP) and approved by BOS. The correct PO did not require BOS approval. As such, rescinding the action is necessary to correct the record. (C-86-22-132-X-04)

This PO, in the amount of $50,000, is for the period of January 1, 2025, through December 31, 2025. The total not-to-exceed amount for this period is $360,000.00. The term of the IGA is January 1, 2022, through December 31, 2025. This PO was received from ADHS on August 8th, 2025. The Department of Public Health’s indirect rate for FY26 is 16.69%. Grant indirect costs are fully recoverable in the amount of $51,490.27. The grant award is not a mandated service but provides a valuable benefit to the citizens of Maricopa County through surveillance, referrals, and prevention activities related to birth defects. This award was non-competitive and has previously been awarded to the Department twice. There is no cash or in-kind matching requirement, nor are ongoing cash contributions required. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This Amendment does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. The term of the IGA is January 1, 2022, through December 31, 2025. The delay in processing these POs resulted from an administrative oversight, and we are seeking approval to retroactively align them with the current program period and ensure funding compliance The Department of Public Health’s indirect rate for FY25 is 15.79%. Grant indirect costs are fully recoverable in the amount of $15,980.88. The grant award is not mandated service but provides a valuable benefit to the citizens of Maricopa County through surveillance, referral, and prevention activities related to birth defects.
