66. IGA WITH ARIZONA DEPARTMENT OF HEALTH SERVICES FOR HIV PREVENTION SER VICES Approve Intergovernmental Agreement (IGA) CTR064828 for the HIV Prevention Program between Arizona Department of Health Services (ADHS) and Maricopa County by and through its Department of Public Health (MCDPH) to provide grant funding for the HIV Prevention Services. Previous contract (IGA ADHS18-188819) put this program to $280,000, this new contract breaks this program out and adds an additional funding of $43,000 and brings the not-to-exceed amount is 323,000 for the budget period January 1, 2023 through December 31, 2023. The IGA term is January 1, 2023 through December 31, 2028. The grant award is reoccurring and has been awarded to the department in previous years. It is non-competitive and there is no cash or in-kind match required. T he grant award is a mandated function; should it be discontinued, it is not known whether on-going contributions would be required. This grant deviates from County Policy A2505 and does not allow for any indirect cost reimbursement. The Department of P ublic Health’s indirect rate for FY2023 is 17.24 % . Total indirect expenses based on the award are estimated to be $7,413.20 of which none is recoverable. Departmental indirect rates are reestablished at the beginning of each fiscal year and the future in direct rates will be collected at the corresponding rates. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This Amendment do es not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. PURCHASE ORDER FROM ARIZONA DEPARTMENT OF HEALTH SERVICES FOR HIV PREVENTION SERVICES Approve a retroactive purchase order (PO) 712608 for Intergovernmental Agreement (IGA) CTR064828 for the HIV Prevention Program between Arizona Department of Health Services (ADHS) and Maricopa County by and through its Department of Public Health (MCDPH) for services related to the HIV Prevention Program. Funding is in the amount of $268,399.00 for the budget period of August 1, 2024, through May 31, 2025. The IGA term is January 1, 2023, through December 31, 2028. This non-competitive grant deviates from County Policy A2505 and does not allow for any indirect cost reimbursement. The Department of Public Health’s indirect rate for FY25 is 15.79%. Total indirect expenses based on full award are estimated to be $42,004.44 of which none is recoverable. Program costs not covered by the grant will be subsidized by the MCDPH indirect cost pool. PURCHASE ORDER FOR IGA WITH ARIZONA DEPARTMENT OF HEALTH SERVICES FOR HIV PREVENTION SERVICES Approve a retroactive purchase order (PO) 782651 for Intergovernmental Agreement (IGA) CTR064828 for the HIV Prevention Program between Arizona Department of Health Services (ADHS) and Maricopa County by and through its Department of Public Health (MCDPH) for services related to the HIV Prevention Program. The PO was issued by ADHS on June 30, 2025. The not-to-exceed amount is $323,000.00 for the budget period of June 1, 2025, through May 31, 2026. The IGA term is January 1, 2023, through December 31, 2028. The purpose of these funds is to assist MCDPH implement a comprehensive high impact HIV Prevention Program in Maricopa County. This will include providing access to quality HIV testing and Linkage to Care (HTL) for persons residing in Arizona, conduct partner services (PS) expanded testing activities, and provide PS in public and private sectors to all persons newly diagnosed with HIV or previously positive with a new sexually transmitted disease (STD) diagnosis. This non-competitive grant deviates from County Policy A2505 and does not allow for any indirect cost reimbursement. The Department of Public Health’s indirect rate for FY26 is 16.69%. Total indirect expenses based on full award are estimated to be $53,908.70 of which none is recoverable. Program costs not covered by the grant will be subsidized by the MCDPH indirect cost pool. 51. AMENDMENT TO IGA WITH ARIZONA DEPARTMENT OF HEALTH SERVICES FOR HIV PREVENTION SERVICES Approve Amendment No. 1 for Intergovernmental Agreement (IGA) CTR064828 between Arizona Department of Health Services (ADHS) and Maricopa County by and through its Department of Public Health (MCDPH) for HIV Prevention Services. The price sheet reflects a not-to-exceed amount of $323,000.00 for HIV Testing, and $259,052.00 for Hepatitis C Testing for the budget period of June 01, 2025, through May 31, 2026. The IGA term is January 01, 2023, through December 31, 2028. It is mutually agreed that the Intergovernmental Agreement referenced is amended as follows: 1. Pursuant to Terms and Conditions, Provision Six (6), Contract Changes, Section 6.1, Amendments, the contract is hereby revised with the following: 1.1. The Scope of Services is revised and replaced. 1.2. The Price Sheet is hereby revised and replaced. 1.3. Exhibit A is revised and replaced. All other terms and conditions remain unchanged and are according to the original award documents, clarification documents and renewal submission documents. The HIV testing component of this grant deviates from County Policy A2505 and does not allow for any indirect cost reimbursement. Maricopa County Department of Public Health’s indirect rate for FY26 is 16.69%. Total indirect expenses based on full award are estimated to be $53,908.70 of which none is recoverable. The indirect costs associated with the Hepatitis C component of this grant are fully recoverable. Maricopa County Department of Public Health’s indirect rate for FY26 is 16.69%. The indirect costs are estimated at $37,051.00 and are fully recoverable. Departmental indirect rates are reestablished at the beginning of each fiscal year, and the future indirect rates will be collected at the corresponding rates. This amendment combines HIV and Hepatitis C prevention services which provide access to quality testing and Linkage to Care (HTL) for persons residing in Arizona. Although these awards have now been combined, they have both been awarded separately to the Department in previous years, but it is unknown if either will be awarded in the future. Neither of the services is mandated but both provide a direct benefit to the citizens of Maricopa County through the current services they provide. This aware is non-competitive and no cash or in-kind match is required. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This Amendment does not alter the budget constraining expenditure of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105.
