35. IGA RENEWAL WITH CITY OF PHOENIX Approve and execute Amendment 2, the Intergovernmental Agreement between City of Phoenix and Maricopa County. Amendment 2 modifies a prior approved agenda item submitted as C-88-20-006-3-01 that was approved during the February 10th, 2021 Board Meeting. The purpose of this Agreement is to set forth the parties’ respective rights and obligations with respect to Phoenix’s acceptance of Maricopa County’s Recyclables, as amended by Amendment 1 (C-88-20-006-3- 01)( Agreement). Rate changes as provided by the City of Phoenix will occur with this Amendment 2 but cost to the County is not projected to increase. This Agreement is extended from February 19, 2021 through February 18th, 2022. There will be three more options to extend. All other terms and conditions of the Agreement are not changed in this amendment; they remain the same in full force and effect. (C-88-22-037-X-00)

The purpose of this Agreement is to set forth the parties’ respective rights and obligations with respect to Phoenix’s acceptance of Maricopa County’s Recyclables, as amended by Amendment 1 (C-88-20-006-3-01 approved by the Board on February 10, 2021), Amendment 2 (C-88-22-037-X-00 approved by the Board on September 1, 2021) and Amendment 3(C-88-22-037X-01 approved by the Board on February 23, 2022). Rate changes as provided by the City of Phoenix will occur with this Amendment 4 and increased costs for the first and second quarter of fiscal year 23.
