AMENDMENT TO INTERGOVERNMENTAL AGREEMENT FOR REGIONAL EMERGENCY OPERATIONS MANAGEMENT AND DISASTER SERVICES BETWEEN MARICOPA COUNTY, ARIZONA AND THE CITY OF SCOTTSDALE This Amendment to the Intergovernmental Agreement (“Amendment”) between Maricopa County, a political subdivision of the State of Arizona (“County”) and the City of Scottsdale, a municipal corporation of the State of Arizona (“City”) is made and entered into _j(_ day of Mas , 2023. RECITALS WHEREAS the Parties recognize that continuing to have an intergovernmental agreement for regional emergency operations management and disaster services will enhance the emergency preparedness of their respective communities and; WHEREAS, the Parties now mutually desire to amend the existing Intergovernmental Agreement to extend the expiration date of the original term. NOW THEREFORE, in consideration of the mutual promises and obligations set forth herein, the Parties hereto agree as follows. TERMS 1. The recitals above are incorporated into this Amendment by this reference. 2. This Amendment shall be effective on June 30, 2023 (“Effective Date”) contingent on approval by the governing authorities of the parties whether approval is given on, before or after that date. The reference to Effective Date in the introductory paragraph of the Intergovernmental Agreement is modified as above by this provision. 3. All terms and clauses of the Intergovernmental Agreement remain in effect except as modified herein. 4. The following section of TERMS OF THE AGREEMENT is replaced and superseded in the Agreement: 6. The term of this Agreement shall commence on the Effective Date and continue until June 30, 2028, unless sooner terminated as provided herein. This Agreement may be terminated by either party giving written notice of such intention to the other party not less than ninety (90) days prior June 30 of the year during which notice is given, which shall be the effective date of the termination. This Amendment may be executed in two (2) or more counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument. The signature pages from one (1) or more counterparts may be removed from such counterparts and such signature pages all attached to a single instrument so that the signatures of all parties may be physically attached to a single document.
