Site Location: Generally located 650’ east of the SEC of Patton Rd. and 227th Ave. in the Wittmann area Commission Recommendation: On 5/11/23, the Commission voted 8-0 to adopt a motion recommending the Board of Supervisors approve MCP2023001 subject to conditions ‘a’ – ‘e’: a. Development of the site shall be in substantial conformance with the Site Plan entitled “Vertical Bridge US-AZ-7062“, consisting of 7 full-size sheets, dated May 4, 2023, and stamped received May 4, 2023 except as modified by the following conditions. b. Failure to comply with conditions after a reasonable opportunity to bring the property into compliance may result in the initiation of revocation at a public hearing. Commission Recommendation: On 5/11/23, the Commission voted 7-0 to adopt a motion recommending the Board of Supervisors approve Z2022211 subject to conditions ‘a’ – ‘e’: a. Development of the site shall be in substantial conformance with the Site Plan entitled “Conceptual Site Plan – Northern 54“, consisting of 1 full-size sheets, dated March 2, 2023, and stamped received April 11, 2023 except as modified by the following conditions. Staff may determine slight refinements to remain in substantial conformance with the approved site plan. Commission Recommendation: On 5/11/23, the Commission voted 8-0 to adopt a motion recommending the Board of Supervisors approve Z2023008 subject to conditions ‘a’ – ‘g’: a. Development of the site shall be in substantial conformance with the Site Plan entitled “ BUSHNELL“ , consisting of 7 full-size sheets, dated March 15, 2023 and stamped received March 22, 2023, except as modified by the following conditions. Staff may determine slight refinements to remain in substantial conformance with the approved site plan. Minor and major amendments to the site plan will be determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance. b. The Red Letter process has been started by the applicant; applicant to notify ADOT of proposal through the Red Letter Process, RedLetter@azdot.gov, due to proximity to State Route 87. 5. Engineering review of planning and/or zoning cases is for conceptual design only. All site improvements associated with the special use permit shall be removed within 90 days of such expiration or termination of use. e. Prior to issuance of a building permit, written confirmation will be required from the emergency fire protection jurisdiction having authority that the facility has been designed in accordance with their regulations and requirements, and that emergency fire protection service will be provided to the facility. f. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Special Use Permit as set forth in the Maricopa County Zoning Ordinance. g. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, and at the time of expiration of the Special Use Permit, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, or the expiration of the Special Use Permit, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the Special Use Permit. The Special Use Permit enhances the value of the property above its value as of the date the Special Use Permit is granted and reverting to the prior zoning results in the same value of the property as if the Special Use Permit had never been granted. Staff Recommendation: The applicant provided staff with an updated zoning exhibit illustrating a 197’ lattice tower topped by a required 2’ FAA warning light for an overall height of 199’. Therefore, staff recommends that Board motion for approval of Z2023008 include the Commission recommended conditions ‘a’ – ‘g’ but with revised condition ‘a’ to read: a. Development of the site shall be in substantial conformance with the Site Plan entitled “ BUSHNELL“ , consisting of 9 full-size sheets, dated May 9, 2023 and stamped received May 15, 2023, except as modified by the following conditions. Staff may determine slight refinements to remain in substantial conformance with the approved site plan. STATE RETIREMENT SYSTEM GOVERNMENT PROPERTY LEASE TAX Under A.R.S. § 42-11102(C), the Arizona State Retirement System (ASRS) may elect to have the taxes on its income producing properties based upon their full cash value as determined by this Office ("voluntary contributions") or pursuant to A.R.S. § 42-6201 et seq., it may provide for a government property lease tax ("GPLET"). The ASRS has timely notified the Assessor's Office that it is electing to have its sole property in Maricopa County taxed under the GPLET framework for tax year 2023. That property is a high-rise office building located at 3300 N. Central Ave, Phoenix (APN #118-37-021P). The computed tax due on or before December 1, 2023 is $143,843.00. (C-12-23-004-X-00)

COMMUNITY SOLUTIONS FUNDING PROPOSAL Authorize the Community Solutions Funding Proposal request for the Gila Bend Unified School District, Softball Field improvements in the amount of $1,325,000 with an expected start date of June 19, 2023, and an expected completion date of November 3, 2023. The property was previously used as a softball field, but most recently was used to store construction debris. This project will include reconstructing the field, repairing existing chain link fencing, repairing the irrigation system, installing new dugouts and bleachers and installing lights and a scoreboard. The softball field will be available for use to the students of the Gila Bend Unified School District and the Gila Bend community. The Board of Supervisors’ Community Solutions Funding (CSF) is primarily intended to cover the cost of initiatives that carry the potential of advancing Maricopa County’s Strategic Goals and provide a clear public benefit for Maricopa County residents. The associated Maricopa County Strategic Goal is: Safe Communities. Also, pursuant to A.R.S. 42-17106(B), authorize the following appropriation adjustments to the final FY 2024 budget: 1. Decrease the expenditure authority in the Non Departmental (D470) General Fund (100) Non Recurring (NRNP) budget in the line “Community Solutions Funding” (4711) by $1,325,000. 2. Increase the expenditure authority in the Non Departmental (D470) General Fund (100) Non Recurring (NRNP) budget in the line “D5 – Community Solutions Funding” (4765) by $1,325,000. These actions will have a net zero impact on the County-wide budget and do not alter the budget constraining the expenditure of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. 20. IGA WITH GILA BEND UNIFIED SCHOOL DISTRICT Approve and execute an Intergovernmental Agreement (IGA) between Maricopa County and Gila Bend Unified School District for improving a softball field. Gila Bend owns certain real property which is located at the SW corner of Logan Ave. and Richards St. that is used as a softball field and the property is in a state of disrepair. Gila Bend desires that improvements be made to the property for the public to use and enjoy. Maricopa County desires to use a portion of Community Solutions Funding (CSF) for improvements to the Property. The County shall pay for the improvements of the property in an amount not-to-exceed $1,325,000.00. This Agreement shall become effective as of the date it is fully executed and shall expire on the date of County’s written notification to Gila Bend of Final Completion of the Improvements. Any Party may terminate this Agreement upon furnishing the other Party with a written notice at least thirty (30) days prior to the effective termination date. ACCEPT GRANT FUNDING FROM THE ARIZONA CRIMINAL JUSTICE COMMISSION Approve the application and acceptance of grant funds from the Arizona Criminal Justice Commission (ACJC) through the FY 2023-2024 Drug, Gang, and Violent Crime Program in the amount of $807,390.75, which includes: $807,390.75 in Federal funds under CFDA 16.738 and $0 in State funds. This program requires a cash match of 25%, or $269,130.25. The total award is $1,076,521. These funds are for the enhancement of drug, gang, and violent crime prosecution. This grant agreement, ACJC number DC-24-027, commences on July 1, 2023, and will terminate on June 30, 2024. Authorize the Chairman to sign all documents related to these grant funds, as applicable. The grant funds, $807,390.75, may not be expended for any indirect costs which may be incurred by the Maricopa County Attorney's Office or Maricopa County for the administration of this grant (Agreement Page 8, Paragraph 35). The grant allows a 0% rate for indirect costs or $0 that may be incurred by the County Attorney's Office or Maricopa County for the administration of this grant. The Maricopa County Attorney's Office's composite indirect cost rate for FY24 is 20.20%, or $217,457.24. The recoverable indirect cost of administering this grant is $0; the non-recoverable indirect cost is $217,457.24. Nonrecoverable indirect costs will be covered by the departmental general fund budget. The 25% match requirement will be covered by the departmental general fund. The grant is competitive and reoccurring and does not require ongoing cash contributions after the grant period's end date. This funding directly supports the mandated function of prosecution of criminal cases. 27. MARICOPA COUNTY ATTORNEY'S OFFICE INTERN STIPEND PROGRAM Approve the creation of an intern stipend program for the Maricopa County Attorney's Office. The Maricopa County Attorney’s Office (MCAO) accepts law student interns who have completed their first two semesters of study. Those in their second (2L) and third (3L) years of study may become a Certified Limited Practice Student by seeking certification through Arizona Supreme Court’s Rule 39(c) program. The certification allows the students to appear in court for hearings, or to conduct trials, under the supervision of a supervising DCA. Interns have the opportunity to work on different types of cases depending on their assigned bureau, including general trial cases, juvenile cases, justice court misdemeanors, and specialized prosecutions. MCAO attracts students from throughout the nation because it is the third-largest prosecution agency in the nation. Additionally, many Arizona residents attend law school out of state and prefer to return to Arizona following graduation. The stipend program is designed to entice the best law school applicants to apply to MCAO. The stipend program will apply only during the summer, which is when students can participate full-time and get the most out of their internship by seeing the life of a prosecutor at MCAO and getting exposed to MCAO’s culture and values. COMPETITION IMPRACTICABLE WITH EDUCATION EVOLVING Approve and execute a one-year Competitive Impracticable contract (“Contract”) between Maricopa County, administered by the Office of County School Superintendent (“County”), and Education Evolving, a non-profit organization, (“Contractor”). The County and the Contractor are collectively referred to here as the “Parties” and individually as a “Party.” The services Education Evolving provides are essential for successful implementation of the Maricopa County Teacher Powered School Network a collaboration between the Maricopa County School Superintendent, Empower Schools and Teacher-Powered Schools. This item accompanies and is essential to four IGA's and one agreement with local school districts and a local charter school to implement the Teacher Powered School Network. Funding for the MCTPSN is provided by the Arizona Department of Education through an ESSER LEA Capacity Building Support Grant. Educational leaders and teachers will be utilizing tools that have been customized to the goals of the grant. Finding a comparable partner that could support the scopes of work, in this time frame, is impractical and would jeopardize the project as a whole . The County will provide the Contractor with $175,000 provided by the Arizona Department of Education through an ESSER LEA Capacity Building Support Grant. FUNDING FROM THE OFFICE OF THE STATE TREASURER FOR TRAINING SIMULATORS (50SIMULTR) – FY24 Approve acceptance of funding appropriation of up to $330,000 from the Office of the State Treasurer to purchase V-300 LE decision making and firearms training simulators. The anticipated term of this funding is July 1, 2023 through June 30, 2024. This is the first time this funding has been awarded to the Sheriff’s Office and it will not be re-occurring. This funding is formulaic and non-competitive. There is no match requirement, or future or ongoing contributions required when the funding period ends.The projected use for these funds is to purchase a V-300 firearms training simulator. This award will not be competitively bid. The house bill specifically identifies the “V-300 LE simulator” for purchase which is offered through VirTra (vendor). These funds are statutory (A.R.S. 12-114; 12-116.08) and indirect cost recovery is not allowed. The Sheriff’s indirect cost rate for FY23 is 12.3%, applicable to the award amount of $330,000 less capital expenses of $330,000 for an indirect cost base of zero ($0) and indirect costs of zero ($0). Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. ACCEPT FUNDING REIMBURSEMENT FROM CITY OF PHOENIX POLICE DEPARTMENT Accept reimbursement funding in the amount of up to $10,000 from City of Phoenix, PD Internet Crimes Against Children Task Force, for which Maricopa County Sheriff's Office (MCSO) is an affiliate authorized in IGA 157605-- 0, AKA C-50-22-139-X-00, approved in an action taken by the Board of Supervisors (BOS) on April 6, 2022. The BOS action taken authorized acceptance of funding in the amount of up to $20,000. The Sheriff’s Office indirect cost rate for FY23 is 12.3%. The indirect cost basis is $10,000. Unrecoverable indirect costs associated with this Agreement are estimated to be $1,230. These unrecoverable indirect costs will be absorbed by the General Fund. This funding is competitive and does not require a match. The funding is recurring and has been awarded to the Sheriff’s Office for over five years. The agreement does not require future or on-going cash contributions after the grant period ends. This funding is not for a specific mandate but supports the Sheriff’s Office overall public safety mandate. The funding notification letter from City of Phoenix is attached to this item. The grant award is a mandated function and provides a benefit to the citizens by providing family counseling services to support juveniles and intended to support their success upon release with the goal of providing behavioral change. The grant award is competitively bid and other eligible agencies may or may not bid on this grant award. If awarded, the department will absorb the costs of the grant award. Funding for this agreement is provided by a Grant from Administrative Office of the Courts (AOC). The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. (C-27-23-002-X-00)

MEMORANDUM OF AGREEMENT - DELEGATION OF AUTHORITY OF THE FEDERAL PLAN FOR EXISTING MUNICIPAL SOLID WASTE LANDFILLS Approve the Memorandum of Agreement for the Delegation of Authority of the Federal Plan for Existing Municipal Solid Waste (MSW) Landfills between the Maricopa County Air Quality Department (MCAQD) and the United States Environmental Protection Agency (EPA). The EPA encourages states that do not have approved 111(d) plans to request delegation of authority of the Federal Plan so they can have primary responsibility for implementing the 2016 municipal solid waste landfill emission guidelines until a 111(d) plan is approved. Following Board approval in September of 2022, MCAQD submitted a delegation of authority request to implement the Federal Plan for Existing MSW Landfills to the EPA. The EPA drafted a Memorandum of Agreement incorporating the delegation of authority requirements and it must be signed by the Chairman of the Maricopa County Board of Supervisors. The Federal Plan and corresponding delegation of authority will no longer apply upon the effective date of the approved 111(d) plan for Maricopa County. (C-85-23-057-X-00)

NEW HOPE AGREEMENT WITH PATHWAY FOR PAWS Approve an agreement between Pathway for Paws and Maricopa County, administered by Maricopa County Animal Care and Control, to allow said rescue to transfer animals that have been deemed eligible for the New Hope program. Maricopa County will provide a rabies vaccination, dog license tag, and new owner transfer fee within the first year of transfer for each dog three months of age or older at no cost to the Contractor. The cost for these services is $52 for each animal transferred in FY 2022 and thereafter. Animal Care and Control estimates ten (10) New Hope transfers annually, for a total of $520.00 per year, over the term of the agreement. SRP BUSINESS DEMAND RESPONSE PROGRAM Approve and Execute Agreement to participate in a peak energy load reduction program with Salt River Project (SRP) and their vendor Enel X North America, Inc. to reduce consumption during peak use periods. Participation in the program will help avoid service interruptions or blackouts, reduce the need to build new power capacity and sources, and will generate billing savings with reduced consumption. As part of this agreement, eight (8) County facilities will participate in the program. The program is active from May 1, 2023 to October 31, 2023 and eligible from noon to 9:00 PM with 1-3 hours per event. Program is limited to a maximum of 10 total weekday events. There is no cost to participate and participation can end at any time without penalty. During an activation, the program provides a rebate of $60 KW for reduced demand below benchmark levels. IGA WITH THE ARIZONA HEALTH CARE COST CONTAINMENT SYSTEM FOR BEHAVIORAL HEALTH SERVICES TO THE SERIOUSLY MENTALLY ILL AND REMANDED JUVENILES Approve an Intergovernmental Agreement (IGA) between Maricopa County (the County) and the Arizona Health Care Cost Containment System (AHCCCS) which in effect extends the existing arrangement for the County's funding of behavioral health services for a term of one year from July 1, 2023 to June 30, 2024. County funding for services to the seriously mentally ill (SMI) under this IGA will be $74,452,022 for FY 2023-24. This increases the level of County funding based on an adjustment for inflation for services to the seriously mentally ill by $3,545,334, over the funding paid under the previous IGA in FY 2022-23. The FY 2023-24 IGA also includes funding for non-SMI services in the amount of $3,366,705 and substance abuse services in the amount of $1,489,871 for the one-year term which is equal to the FY 2022-23 level. The IGA will be in effect upon signature of the last party and shall remain in effect until June 30, 2024. The IGA may be amended, further extended or terminated pursuant to the IGA provisions, including a 90-day termination without cause provision. Total County funding for behavioral health services in FY 2023-24 under the IGA will be $79,308,598 for a one-year term. (C-18-23-152-X-00)

IGA WITH ARIZONA DEPARTMENT OF ECONOMIC SECURITY FOR WORKFORCE INNOVATION AND OPPORTUNITY ACT ACTIVITIES Approve a financial Intergovernmental Agreement (Agreement) with Arizona Department of Economic Security (DES) and Maricopa County, administered by its Human Services Department The purpose of the Agreement is for the County to administer Workforce Innovation and Opportunity Act Title I (WIOA) program activities in Maricopa County, excluding the City of Phoenix. DES shall provide the County with Program Year 2023/Fiscal Year 2024 (PY2023/FY2024) funding in an amount-not-to-exceed $16,479,365. The period of funding availability for Adult (AD), Dislocated Worker (DW) and Rapid Response (RR) activities is July 1 through June 30. Funding for Youth (YT) activities is April 1 through June 30. The Agreement term is July 1, 2023, though June 30, 2028 and shall be effective on date of last signature. Funding for WIOA Title I Assistance Listing Number (ALN) #17.258 (Adult $4,968,475), ALN #17.278 (Dislocated Worker $6,188,968), and ALN #17.259 (Youth $5,321,922) is authorized by a U.S. Department of Labor for each Program Year. Maricopa County, exclusive of the City of Phoenix, is a designated Local Workforce Development Area (LWDA) under the federal WIOA. As a designated LWDA, services are administered by the Maricopa County Human Services Department Workforce Development Division ARIZONA@WORK - Maricopa County. WIOA services include career and training opportunities, to job seekers, youth, and employers to meet the needs of workforce development in the local area. 55. AMENDMENT TO IGA WITH REGIONAL PUBLIC TRANSPORTATION AUTHORITY 1. Amendment No. 6 to the Intergovernmental Agreement “Agreement” with Regional Public Transportation Authority (RPTA/Valley Metro) and Maricopa County (County) administered by its Human Services Department. The purpose of the Agreement is for RPTA to provide transportation services to eligible Americans with Disabilities Act (ADA) Maricopa County residents that reside in unincorporated areas of the County. The County provides funds to RPTA for transportation services. RPTA and the County shall be referred to as the “Parties.” 2. The purpose of Amendment No. 6 is to address the following: A. Amend the term of the Agreement from June 30, 2023, through June 30, 2024. B. Replace the first paragraph of Attachment A (Annual Service Agreement) at page 16 of the Master Agreement, as was amended by Amendments One, Two, Three, Four and Five which addresses obligations of the Parties for fiscal year 2023 and 2024. C. Replace Section 3.1 of the Master Agreement to address the following: 1. The County shall provide an increase in County General Funds in the amount of $400,000 from $606,239 for a total amount of $1,006,239 for services provided from July 1, 2022, through June 30, 2023 (Fiscal Year 2023). 2. The County shall provide RPTA with $1,270,000 in County General Funds and $804,000 in Arizona Lottery Funds (ALF) for an estimate of 11,000 Paratransit trips and an estimated of 34,000 RideChoice trips for the period July 1, 2023, through June 30, 2024. 3. If it is determined upon the annual reconciliation at year end that the County has underpaid its share of the actual cost of services for the period of FY 2024, RPTA shall use the ALF monies to pay any remaining balances. RENEWAL OF MARICOPA COUNTY HOME CONSORTIUM 3 YEAR-INTERGOVERNMENTAL AGREEMENT Approve the automatic renewal of the Maricopa County HOME Consortium 3-Year Intergovernmental Agreement (“Agreement”) with geographically contiguous municipalities consisting of the cities and town of: Avondale, Chandler, Gilbert, Glendale, Peoria, Scottsdale, Surprise, Tempe, and County of Maricopa (collectively, the “Consortium” or the “Maricopa HOME Consortium” or the “Parties”; and individually, “Consortium Member” or “Party”) for the U.S. Department of Housing and Urban Development (HUD) HOME Investment Partnerships Programs (“HOME”). The Agreement, fully executed on May 28, 2020, designates Maricopa County as the lead agency for the Consortium, and to assume responsibility for ensuring that the Consortium’s HOME Program is carried out in compliance with HUD rules, regulations, and requirements, including requirements concerning a comprehensive housing affordability strategy. The executed Agreement is attached for reference. The Agreement requires renewal on a 3-year basis. Each of the above listed municipalities has approved the automatic renewal of the Agreement, through their individual Councils. Renewal of the Agreement provides full legal authority for the Consortium to continue to undertake or assist in undertaking housing assistance activities for the HOME Program. The Agreement term shall begin on July 1, 2023, through June 30, 2026, for Federal Fiscal Years 2024-2026. Maricopa County Human Services Department oversees the HUD HOME Program and must provide HUD with information that the Agreement automatic renewal has full approval of all the Parties. The Department must also submit an opinion letter from the Maricopa County Civil Services Division’s, Deputy County Attorney assigned to the Human Services Department regarding the County’s compliance with the National Affordable Housing Act and HUD rules, regulations, and requirements of the HOME Program, implementing the 3-Year Consortium Agreement. As provided in the Board-approved Maricopa County Citizens’ Audit Advisory Committee Charter (Charter), the committee reviewed the charter and is seeking approval of recommended revisions. The committee approved the recommended revisions and authorized the Internal Audit Department to submit the recommendations on the committee’s behalf (approved at 5/17/23 committee meeting). The primary purpose for the revisions is to change the name to Maricopa County Audit Advisory Committee, update terminology, provide clarification, and adjust member qualifications to provide the Board of Supervisors more flexibility in its future appointments of committee members. WRITTEN CERTIFICATION PURSUANT to A.R.S. § 35-393.01: If Contractor engages in for-profit activity and has 10 or more employees, and if this agreement has a value of $100,000 or more, Contractor certifies it is not currently engaged in, and agrees for the duration of this agreement to not engage in, a boycott of goods or services from Israel. This certification does not apply to a boycott prohibited by 50 U.S.C. § 4842 or a regulation issued pursuant to 50 U.S.C.§ 4842. ii. WRITTEN CERTIFICATION PURSUANT to A.R.S. § 35-394: Contractor warrants and certifies that it does not currently, and agrees for the duration of the Agreement, that it will not use: 1. the forced labor of ethnic Uyghurs in the People's Republic of China, 2. any goods or services produced by the forced labor of ethnic Uyghurs in the People's Republic of China, 3. any contractors, subcontractors or suppliers that use the forced labor or any goods or services produced by the forced labor of ethnic Uyghurs in the People's Republic of China. If Contractor becomes aware during the term of this Agreement that the Contractor is not in compliance with this paragraph, Contractor shall notify the County within five business days after becoming aware of the noncompliance. FEDERAL MEMORANDUM OF AGREEMENT WITH CDC FOUNDATION FOR NEGOTIATED INDIRECT COST RATE AGREEMENT (NICRA) STAFF POSITIONS Approve a Federal Memorandum of Agreement (MOA) between the CDC Foundation and Maricopa County by and through its Department of Public Health (MCDPH), Division of Epidemiology and Informatics for negotiated indirect cost rate agreement (NICRA) staff positions. The term of the Agreement shall be July 01, 2023 through June 30, 2024, with a not-to-exceed amount of $188,755.59. The CDC Foundation will be responsible for providing the following direct positions: Federal Budget Analyst, Federal Grants Manager, HR Generalist, Program Manager, Senior Program Manager, Emergency Response Senior Portfolio Manager and Epidemiologist(s). This Federal Memorandum of Agreement is the result of a Competition Impracticable Procurement because MCDPH has not been successful in recruiting or hiring the stated positions to full capacity since the beginning of the pandemic (either hiring as a county employee or through traditional staff agency contracts). The CDC Foundation is the only known and trusted organization to successfully recruit and hire approximately 2,500 public health workers to bridge gaps in the public health workforce across the country. The Competition Impracticable Procurement is in accordance with Maricopa County Procurement Code MC-351 “Competition Impracticable” exceeding the $100,000 threshold. IGA WITH ARIZONA DEPARTMENT OF HEALTH SERVICES FOR IMMIGRANT EMERGENCY CARE AND TESTING Approve a new fixed price Intergovernmental Agreement (IGA), Contract No. CTR065586, Immigrant Emergency Care and Testing (IECT) between Arizona Department of Health Services (ADHS) and Maricopa County by and through its Department of Public Health (MCDPH), Office of Preparedness Response (OPR). The purpose of this IGA is to leverage partnerships between ADHS and the other various Arizona Counties to provide emergency care, infectious disease(s) testing, expending access and quality of emergency health care for immigrants. OPR will work with ADHS to provide emergent health care for the immigrant, which provide key insight on best practices for collecting quality data to analyze and identify sources of infection and outbreaks, and to characterize the impact of disease, to target prevention strategies, and to utilize related departmental community resources. The budget period is December 1, 2022, through November 30, 2023, for a not-to-exceed amount of $1,355,000.04. The IGA Term is December 1, 2022, through November 30, 2027. This is year 1 of the 5-year IGA. There is no cash or in-kind match required nor should ongoing cash contributions be necessary when it ends. The grant award is not a mandated function but provides a benefit to the citizens through the investigation of infectious disease cases and the performance of surveillance activities which will provide insight into best practices in data collection and analysis. The grant award was not competitive. The Department of Public Health’s Indirect Rate for FY23 is 17.24% Indirect costs are estimated at $199,251.11 all of which is recoverable. Departmental indirect rates are reestablished at the beginning of each fiscal year and the future indirect rates will be collected at the corresponding rates. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This Amendment does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. Funding for this Agreement is provided by a Grant from ADHS and will not affect the County’s general fund. (C-86-23-164-X-00)

IGA WITH TOWN OF GILBERT FOR THE COORDINATION OF ROADWAY STANDARDS RELATED TO PRIVATE DEVELOPMENTS Approve the Intergovernmental Agreement between Maricopa County and the Town of Gilbert for the coordination of roadway standards related to private developments. Either Party may terminate this Agreement at any time prior to the expiration date by furnishing the other Party with a thirty (30) day written notice. The purpose of this Intergovernmental Agreement is to identify and define the Parties’ respective roles in the application of Town standards on development-related roadways in County jurisdiction under certain circumstances. The need for this Agreement was identified by a task force of the Department of Transportation manager, other County departments, and private sector development interests to reduce regulation and streamline government processes. There are instances, where a development site is in the Town’s jurisdiction and adjacent roadways to be constructed by the developer, are in the County’s jurisdiction, and the Town is planning to annex the development area and its roadways. In such cases, it may be reasonable to allow the roadways within the county jurisdiction to be designed and constructed to Town standards. Each instance must be authorized by a Letter of Agreement (LOA) approved and signed by the County Department of Transportation Director and the Town Manager, or their designees. 100. IGA WITH CITY OF GOODYEAR FOR THE COORDINATION OF ROADWAY STANDARDS RELATED TO PRIVATE DEVELOPMENTS Approve the Intergovernmental Agreement between Maricopa County and the City of Goodyear for the coordination of roadway standards related to private developments. Either Party may terminate this Agreement at any time prior to the expiration date by furnishing the other Party with a thirty (30) day written notice. The purpose of this Intergovernmental Agreement is to identify and define the Parties’ respective roles in the application of City standards on development-related roadways in County jurisdiction under certain circumstances. The need for this Agreement was identified by a task force of the Department of Transportation manager, other County departments, and private sector development interests to reduce regulation and streamline government processes. There are instances where a development site is in the City’s jurisdiction and adjacent roadways to be constructed by the developer, are in the County’s jurisdiction, and the City is planning to annex the development area and its roadways. In such cases, it may be reasonable to allow the roadways within the County jurisdiction to be designed and constructed to City standards. Each instance must be authorized by a Letter of Agreement approved and signed by the County Department of Transportation Director and the City Manager, or their designees. IGA WITH THE GILA RIVER INDIAN COMMUNITY FOR THE INSTALLATION OF STREETLIGHTS ON 51ST AVENUE FROM SAINT JOHNS ROAD TO KOMATKE LANE AND 83RD, 87TH, AND 91ST AVENUES FROM BASELINE ROAD TO DOBBINS ROAD Approve the Intergovernmental Agreement between Maricopa County and the Gila River Indian Community for the installation of streetlights on 51st Avenue from Saint Johns Road to Komatke Lane and 83rd, 87th, and 91st Avenues from Baseline road to Dobbins Road. Under this Intergovernmental Agreement, the Gila River Indian Community will act as the lead agency for all aspects of the design and installation of the street lighting. Gila River Indian Community has proposed to install street lighting in the Community to improve safety for pedestrian traffic. The proposed improvements will be installed within the County right-of-way. The terms of the agreement are in effect as of the Board of Supervisors’ approval and shall remain in full force and effect until all stipulations have been satisfied, except that it may be amended upon written agreement by all parties. Rescind the resolution adopted September 15, 2021 (C-64-22-320-X-00), by the Board of Supervisors designating Alana Lewicki as Superintendent of Streets. 2. Adopt a resolution designating Gant Yasanayake as Superintendent of Streets. Alana Lewicki, who served as the Superintendent of Streets, is to be replaced by the appointment of Gant Yasanayake . The County right-of-way is situated along Power Road from 1,313 feet south of Guadalupe Road to Baseline Road. In accordance with Mesa Ordinance No. 5776 the transferred right-of-way will be treated as newly annexed territory. 105. SETTING OF HEARING FOR THE PROPOSED WOODLAND TERRACE IRRIGATION WATER DELIVERY DISTRICT IMPACT STATEMENT 1. Pursuant to A.R.S. § 48-261 and § 48-263, set a hearing date to receive the impact statement for the proposed Woodland Terrace Irrigation Water Delivery District. The hearing date is set for Wednesday, June 28, 2023, at 9:30 a.m., 205 W. Jefferson, Phoenix, AZ 85003. 2. Pursuant to A.R.S. § 48-261(C), approve a bond in the amount of $250 to be filed with the Board by the persons proposing the district to cover cost incurred by the County. The Clerk of the Board of Supervisors shall post a notice of the hearing in at least three conspicuous public places in the area of the proposed district and shall publish a notice twice in a daily newspaper at least ten days before the hearing. A notice of hearing will be sent to each property owner within the proposed district boundaries. At the hearing on June 28, 2023, the Board will hear those who appear for and against the proposed district and shall determine whether the district will promote public health, comfort, convenience, necessity, or welfare. If the Board of Supervisors determines that the public health, comfort, convenience, necessity, or welfare will be promoted, it shall approve the impact statement and authorize the persons proposing the district to circulate petitions within the following proposed boundaries of the district: Lots 1 through 39, of WOODLAND TERRACE, a Subdivision of the East Half of the Northeast Quarter of the Southeast Quarter, of Section 23, Township 1 North, Range 5 East, of the Gila and Salt River Base and Meridian according to the Plat of Record in the Office of the County Recorder of Maricopa County, Arizona, Recorded in Book 62 of Maps, Page 37. 122. EAC E-POLLBOOK PILOT EVALUATION PROGRAM Approve Maricopa County Elections participation in the U. S. Elections Assistance Commissions (EAC) e-poll book pilot evaluation program. The goal of the EAC e-poll book pilot program is to develop a set of testable guidelines, procedures, and program materials that can help standardize the security, accessibility, and usability of e-poll book systems utilized across the United States of America. The cybersecurity of e-poll book systems has never been more important. IGA WITH MARICOPA COUNTY Approve and execute the Intergovernmental Agreement between the Flood Control District of Maricopa County (DISTRICT) and Maricopa County (COUNTY), administered through its Parks and Recreation Department (MCPRD) (IGA), to allow the DISTRICT unfettered access to any Maricopa County Parks, upon proper notice to the administration of said park, for the purpose of collecting seeds to be used to germinate native plant materials in tall pots, in exchange for the DISTRICT providing native plant materials propagated in tall pots to MCPRD on an as needed and as available basis. The IGA shall become effective as of the date it has been executed by all parties. Term of the IGA is five (5) years with three (3) additional five (5) year automatic renewals unless either party provides notice not to renew. This Agenda Item impacts all Supervisory Districts. FY 2023 BUDGET APPROPRIATION ADJUSTMENT FOR STADIUM DISTRICT Approve appropriation adjustments increasing the FY 2023 Stadium District revenue and expenditure authority for the (D680) Cactus League Operations Fund (F250) Operating (OPER) budget by $2,500,000. This action will adjust the Stadium District budget to reflect the receipt of Car Rental Surcharge Revenues from the State of Arizona Treasurer in compliance with A.R.S. §48-4234 Paragraph G directing the State Treasurer to remit to the District Treasurer the net Car Rental Surcharge Revenues collected during the preceding month. The increase in expenditure authority will allow for the disbursement of Car Rental Surcharge Revenues to the Arizona Sports and Tourism Authority (Authority) in accordance with the Agreement between the District and Authority dated October 22, 2003. The Office of Budget and Finance will facilitate the monthly wire transfers. District revenues are not local revenues for the purpose of the constitutional expenditure limitation and therefore expenditures of these revenues are not subject to the constitutional expenditure limitation. The approval of this action requested does not alter the budget constraining the expenditure of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. (C-18-23-146-X-00)
