ORDINANCE NO. 5776
AN ORDINANCE EXTENDING AND INCREASING THE CORPORATE
LIMITS OF THE CITY OF MESA, MARICOPA COUNTY, ARIZONA,
PURSUANT TO THE PROVISIONS OF ARTICLE 7, CHAPTER 4, TITLE 9,
ARIZONA REVISED STATUTES AND AMENDMENTS THERETO, BY
ANNEXING THERETO CERTAIN COUNTY RIGHT-OF-WAY ADJACENT
TO THE EXISTING CITY LIMITS OF THE CITY OF MESA
WHEREAS, Arizona Revised Statute Section 9-471 (0) provides for transferring county
right-of-way or roadway to an adjacent city by mutual consent of the governing bodies
of the county and city if the county right-of-way being transferred is adjacent to the
receiving city and if the governing bodies of the city and county each approve the
proposed transfer at a public meeting of their governing bodies; and
WHEREAS, at a City Council meeting on September 27, 201 O, City Council approved
Ordinance 5001 to extend the corporate limits of the City of Mesa, Maricopa County, by
annexing county right-of-way along Power Road between Baseline Ro.ad and Elliot
Road, however, the county right-of-way was never annexed into the City of Mesa
because the request was never placed on a Maricopa County Board of Supervisors
public meeting for approval due to an error in the legal description of the county right
of-way; and
WHEREAS, the City of Mesa ("City"), Town of Gilbert ("Gilbert"), and Maricopa County
("County''), together are desirous for new improvements to Power Road, between
Baseline Road and Guadalupe Road (a Maricopa C-ounty right-of-way), including the
City annexing the county right-of-way depicted on the map attached hereto as Exhibit A
and legally described in Section 2 below ("Right-of-Way"); and
WHEREAS, the Mesa City Council adopted Resolution No. 8665', on February 6, 2006,
authorizing the City Manager to execute an Intergovernmental Agreement with the City,
County and Gilbert pertaining to said improvements to Power Road including cost
sharing and maintenance of the improvements and the City armexing the Right-of-Way;
and
WHERl;AS, the Maricopa County Board of Supervisors on April 5, 2006, approved the
Intergovernmental Agreement with the City and Gilbert; and
WHEREAS, the Gilbert Town Council on February 28, 2006, approved the
Intergovernmental Agreement with the City and County; and
WHEREAS, the executed Intergovernmental Agreement with tl'ie City, Cour'lty, and
Gilbert was recorded in the Office of the County Recorder of Maricopa County, Arizona
on September 20, 2006, under Docket No. 06-1243602; and
WHEREAS, the Mayor and Council of the City of Mesa desire to comply with the
executed Intergovernmental Agreement and annex the Right-of-Way pursuant to
A.R.S. § 9-471(0).
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
MESA, MARICOPA COUNTY, ARIZONA, AS FOLLOWS:
Section 1: That Ordinance 5001, extending the corporate limits of the City of Mesa,
Maricopa County, Arizona, never went into effect and for clarity is repealed and
replaced with this Ordinance.
Section 2: Pursuant to A.R.S. § 9-471 (0), the Mesa City Council desires to annex to
the City of Mesa the county Right-of-Way located adjacent to the City of Mesa
depicted on the map attached hereto as Exhibit A and legally described below:
A PARCEL OF LAND LYING WITHIN THE EASTERN HALF OF SECTION 1
AND THE NORTHEAST QUARTER OF SECTION 12, TOWNSHIP 1 SOUTH,
RANGE 6 EAST AND ALSO WITHIN THE WESTERN HALF OF SECTION 6
AND THE NORTHWEST QUARTER OF SECTION 7, TOWNSHIP 1 SOUTH,
RANGE 7 EAST OF THE GILA AND SALT RIVER BASE AND MERIDIAN,
COUNTY OF MARICOPA, STATE OF ARIZONA, MORE PARTICULARLY
DESCRIBED AS FOLLOWS:
COMMENCING AT THE NORTHEAST CORNER 'OF SAID SECTION 1, SAID
POINT ALSO BEING THE NORTHWEST CORNER OF SAID SECTION 6 AND
A MARICOPA COUNTY BRASS CAP IN HAND HOLE FROM WHICH THE
WEST QUARTER CORNER OF SAID SECTION 6 BEARS SOUTH 00°49'04"

TO A POINT ON THE SOUTH RIGHT-OF-WAY LINE OF BASELINE ROAD,
SAID POINT ALSO BEING THE POINT OF BEGINNING OF THIS

THE ABOVE DESCRIBED PARCEL OF LAND CONTAINS 15.77 ACRES MORE OR
LESS.
Section 3: Upon the Maricopa County Board of Supervisors approving the transfer of
the Right-of-Way at a regular public meeting as set forth in A.RS. § 9-471 (0), the
Right-of-Way is annexed to the City of Mesa and the current corporate limits of the City
of Mesa are increased to include the Right-of-Way.
Section 4: The recitals above and the exhibit attached hereto are fully incorporated into
this Ordinance by reference.
Section 5: The City Clerk is hereby authorized and directed to forward a copy of
this Ordinance to the Maricopa County Board of Supervisors.
PASSED AND ADOPTED by the City Council of the City of Mesa, Maricopa County,
Arizona, this 17th day of April, 2023.
