CITY COUNCIL REPORT
SUBJECT: Aqueous Film-Forming Foam (AFFF) Class Action Settlements
MEETING DATE: October 27, 2026
TO: Mayor and Council
FROM: Jamie McCracken, Utilities Director
REVIEWED: Reyes Medrano, Jr., City Manager
PURPOSE:
To request Mayor and Council approval for the City of Tolleson to participate in the Aqueous Film-Forming Foam
(AFFF) multidistrict litigation class action settlements with Amerex, Archroma U.S., Carrier Global Corporation,
and Nation Ford Chemical Company.
BACKGROUND:
The City of Tolleson is participating in multidistrict litigation involving Aqueous Film-Forming Foam (AFFF) and
per- and polyfluoroalkyl substances (PFAS), commonly referred to as forever chemicals.
The litigation involves claims by public water systems related to PFAS contamination of water supplies. The City
has previously participated in settlements involving other defendants in this litigation.
Four additional settlements have received preliminary court approval involving Amerex, Archroma U.S., Carrier
Global Corporation, and Nation Ford Chemical Company.
DISCUSSION:
The proposed action would authorize the City to remain a participating member of the four settlement classes
rather than opt out and pursue separate litigation against these defendants.
The deadline to opt out of these settlements is December 22, 2026. Approval will confirm the City's decision to
participate in the settlements, subject to the applicable settlement terms and claims procedures.
BUDGET IMPACT:
There is no direct expenditure associated with the requested Council action. Any settlement proceeds received
by the City will be determined through the applicable settlement allocation and claims processes.
RECOMMENDATION:
Staff recommends that the Mayor and Council approve the City of Tolleson's participation in the Aqueous Film-
Forming Foam (AFFF) multidistrict litigation class action settlements with Amerex, Archroma U.S., Carrier Global
Corporation, and Nation Ford Chemical Company, and authorize the City to remain a participating member of
the settlement classes.
