Report to the Board of Supervisors
Prepared by the Maricopa County Planning and Development Department
Board Hearing Date: August 4, 2021
Case #/Title: Z2019087 – NEC Bethany Home & Citrus
Supervisor District: 4
Applicant/Owner: Earl and Curley, P.C. / Thomas R Russell Revocable Trust
Request: Zone Change with Overlay from Rural-43 to R1-10 RUPD and
R1-18 RUPD
Site Location: Generally located at the NEC of Citrus Rd. and Bethany Home
Rd. in the Glendale area
Site Size: Approx. 37 acres
County Island Status: City of Glendale
Additional
Comments: The applicant requests a rezone from Rural-43 to R1-10 RUPD
and R1-18 RUPD to develop the site as a single-family
residential subdivision consisting of 82 lots. The Commission
also voted to approve the related preliminary plat case
(S2020007). The subject property is located within the White
Tank/Grand Avenue Area Plan, which designates the site as
Rural Densities (0 – 1 d.u./ac.). The proposal includes R1-18
RUPD lots (#1-16) to be located along the eastern and
northern boundaries of the site to create a buffer or
transitional zoning from the existing adjacent Rural-43 zoned
neighboring properties to the requested interior R1-10 RUPD
smaller lot areas. Staff received comments from the City of
Glendale and has included recommended condition ‘g’ to
address their comments concerning an annexation
agreement with the City to provide for wastewater services.
Staff has not received any other correspondence or calls
concerning the requests and there is no known opposition.

3. Dedication of right-of-way along the following roadway alignments will be
required as part of subdivision plat:
Citrus Road: 10 feet (to provide a total width of 65 feet); and

m. Noncompliance with the conditions of approval will be treated as a violation in
accordance with the Maricopa County Zoning Ordinance. Further,
noncompliance of the conditions of approval may be grounds for the Planning
and Zoning Commission to take action in accordance with Chapter 3 (Conditional
Zoning).
n. Non-compliance with the regulations administered by the Maricopa County
Environmental Services Department, Maricopa County Department of
Transportation, Drainage Review Division, Planning and Development
Department, or the Flood Control District of Maricopa County may be grounds for
initiating a revocation of this Zone Change as set forth in the Maricopa County
Zoning Ordinance.
o. The granting of this Zone Change has been at the request of the applicant, with
the consent of the landowner. The granting of this approval allows the property
owner to enjoy uses in excess of those permitted by the land use existing on the
date of the application, subject to conditions. In the event of the failure to comply
with any condition of approval, the property shall change to the land use
designation that existed on the date of the application. It is, therefore, stipulated
and agreed that revocation due to the failure to comply with any conditions does
not reduce any rights that existed on the date of application to use, divide, sell or
possess the property and that there would be no diminution in the value of the
property from the value it held on the date of application due to such revocation.
The Zone Change enhances the value of the property above its value as of the
date the Zone Change is granted and changing to the prior land use designation
results in the same value of the property as if the Zone Change had never been
granted.
p. The following Luke Air Force Base condition shall apply:
Thomas E Russell Revocable Trust and successive owners shall notify future
owners/tenants that they are located near a military airport with the following
language:
“You are locating in a residential dwelling inside the State Statute defined “territory
in the vicinity of a military airport,” which means that aircraft flying in this area are
authorized to fly as low as 1,500 feet above the ground. You will be subject to
direct overflights and noise by Luke Air Force Base jet aircraft in the vicinity.
Luke Air Force Base may launch and recover aircraft in either direction off its
runways oriented to the southwest and northeast. Noise will be more noticeable
during overcast sky conditions due to noise reflections off the clouds.
Luke Air Force Base’s normal flying hours extend from 7:00 a.m. until approximately
midnight, Monday through Friday, but some limited flying will occur outside these
hours and during most weekends.
For further information, please check the Luke Air Force Base website at
www.luke.af.mil/urbandevelopment or contact the Maricopa County Planning
and Development Department.”

Project Summary:
1. The applicant is requesting a Zone Change with Overlay (Z2019087) to change the
current Rural-43 zoning district designation to R1-10 RUPD and R1-18 RUPD. A Preliminary
Plat (S2020007) is also being requested on the subject site for an 82-lot/7-tract single-
family residential subdivision. The expectation is that the residential community will be
subsequently platted if the zone change is approved and development standards are in
place. The subject property is located in the White Tank/Grand Avenue Area Plan and
is part of the Glendale Municipal Planning Area. It is currently one parcel (APN 502-28-
576) as is approximately 37-acres. The site has an Agricultural Exemption (LU20020051) for
a nursery operation.

2. The applicant is proposing to vary the zoning district standards for the two zoning districts.
According to the applicant, the average lot area per dwelling unit for each zoning district
and the total is as follows: 12,765 sq. ft. (R1-10 RUPD), 28,949 sq. ft. (R1-18 RUPD), for a total
of 15,923 sq. ft. The existing and proposed standards for each zoning district are listed
below:
Z2019087 & S2020007

3. The proposed zoning exhibit (below) shows the larger R1-18 RUPD lots adjacent to the
Rural-43 properties to the north and east of the subject site to essentially create a
buffer/transition area between the smaller R1-10 RUPD lots. These smaller lots are focused
internal to the site and adjacent to the two major arterials. There would be a total of 16
R1-18 RUPD zoned lots and 66 R1-10 RUPD zoned lots. It should also be noted that many
of the lots within R1-18 RUPD along the northern boundary of the site (lots 1-8) would be
over 30,000 sq. ft. in lot area.
Z2019087 Zoning Exhibit
4. Internal streets for the subdivision would be public. There would be two access points –
one from Bethany Home Rd. to the south and the other from Citrus Rd. to the west. There
Z2019087 & S2020007

would be a total of 4.45 acres of open space, which is approximately 14.8% of the future
net area. With the Preliminary Plat, the applicant is requesting waiver of the Subdivision
Regulations standards for residential street cul-de-sac length which requires these
portions of the streets to be no longer than 1,000 feet or frontage for more than 15 lots
where they are proposing 18 lots on this stretch of Peck Ct. at the northern portion of the
site.
5. Although the site is under the 40-acre threshold requirement for a Comprehensive Plan
Amendment (CPA) per department directive, the narrative for Z2019087 asserts that the
proposed development meets some of the goals and objectives of the White
Tank/Grand Ave. Area Plan:
“Land Use:
Goal L1: Promote efficient land development that is compatible with adjacent land uses,
is well integrated with the transportation system, and is sensitive to the natural
environment.
The proposed development, rather than a series of lot splits, is designed in a master-
planned and cohesive manner and includes related improvements to adjacent
roadways. As a previously developed site, the proposed development has no adverse
impact on the natural environment.
Objective L1.1: Encourage the timely and orderly expansion of urban service areas.
The proposed development will include the development of the adjacent roadways as
required by Maricopa County, as well as the extension of water and sewer, where
needed to serve this development.
Transportation:
Goal T1: Improve the roadway network to meet future transportation needs, promote
safety, and mitigate congestion.
As noted above, the proposed development will include the development of the
adjacent roadways as required by Maricopa County.
Economic Development
Objective ED1.5: Improve housing conditions in unincorporated communities.
The proposed development will provide for new housing opportunities in this
unincorporated area of Maricopa County.”

Adopted Plans:
9. White Tank/Grand Avenue Area Plan (Adopted: 2000): This plan identifies the subject site
as Rural Densities (0 – 1 d.u./ac.).
10. City of Glendale General Plan (Revised: 2016): This plan identifies the subject site as Low
Residential LDR 1 (0 – 1 d.u./ac).
Public Participation Summary:
11. The applicant has complied with the Maricopa County Citizen Review Process with the
required posting of the site and notification by first class mail to adjacent property owners
and HOA’s within 300’ of the subject parcel and notification to interested parties. Staff
received no opposition or support letters from nearby property owners. The applicant
also provided a Public Participation Results Report on June 17, 2021 stating no objections
to the requests received at this time.
12. Staff received a comment letter from City of Glendale (attached) on September 23, 2019
for the Z2019087 case. It states that “the proposed rezoning request is not in conformance
with the city’s General Plan, and a General Plan Amendment is required to be filed with
and approved by the City of Glendale prior to the City of Glendale supporting the
rezoning request.” The letter also mentions that “in accordance with the Loop 303
agreement between the City of Glendale and the EPCOR utility, the applicant will need
to come to an agreement with the City of Glendale to obtain wastewater services to be
provided by a private provider.” Lastly, the letter notes that the site is within the Luke Air
Force Base (LAFB) Graduated Density Concept with maximum residential density of up
to 2 dwelling units per acre within ½ mile of the 65 LDN noise contour, and that the site
would not comply with these requirements. Staff has reached out to City of Glendale to
confirm that these comments still stand and if there are any updates based on the most
recent submittal. As of writing of this report, staff has not received a response. The
applicant stated to staff that they spoke with Glendale and they have backed off on the
mentioned requirements. However, staff has no formal correspondence to confirm this
statement.
13. Staff received comment letters from LAFB (attached) indicating that the proposed
density of the site is in accordance with the Graduated Density Concept of 2.0 d.u./acre
within ½ mile of the 65 Ldn. LAFB also noted that the proposed project will not impact
flight operations at LAFB, and also recommended a strong notification program to
potential residents regarding LAFB operations and that the applicant review sound
attenuation requirements.

Outstanding Concerns from Reviewing Agencies
14. N/A
Staff Analysis:
15. Staff is supportive of the applicant’s requests for a zone change with overlay and
preliminary plat on the subject site. The transitional zoning from R1-18 RUPD adjacent to
existing Rural-43 zoned lots and interior R1-10 RUPD lots adjacent to major arterials is a
mindful way to develop the site. The areas currently north of Bethany Home Rd. in the
area are mostly rural zoned, while there are subdivisions south of Bethany Home Rd. with
like zoning and densities such as Russell Ranch, Savannah, and Zanjero Trails to the west.
The subject site is also close to the Loop 303 for adequate access only approximately 1-
mile to the east. The requested waiver to permit a cul-de-sac with more than 15 units is
also supported given that the site has two proposed permanent points of access to the
two major arterials adjacent to the property.
16. In regard to the Zone Change request, the applicant is requesting several setback
standards to be varied for the R1-18 RUPD and R1-10 RUPD zoning districts as well as
increasing maximum lot coverage to 50% for each, reducing minimum lot width to 80’
and minimum lot area to 17,700 sq. ft. for R1-18 RUPD. Staff finds all of the applicant’s
requests reasonable in that the applicant has provided almost 15% of the future area as
open space and received LAFB approval of the proposal. Also, as previously mentioned,
lots along the northern border of the site (lots 1-8) would be at least 30,000 sq. ft. each
according to the proposed preliminary plat layout and lot area table.
17. Staff will include a recommended condition for Z2019087 to address City of Glendale’s
comments regarding EPCOR water and an agreement with the City regarding
wastewater services. Otherwise, the comments regarding a General Plan Amendment
through the City is not within the authority of the County. If the City would like the site for
future annexation, that would be between the City and the owner/applicant.
Recommendations (Two Motions – Z2019087 & S2020007):
18. For the reasons outlined in this report, staff recommends the Commission motion for
Approval of Z2019087, subject to conditions ‘a’ – ‘p’.

e. The following Planning Engineering conditions shall apply:
1. Without the submittal of a precise plan of development, no development
approval is inferred by this review, including, but not limited to drainage
design, access and roadway alignments. These items will be addressed as
development plans progress and are submitted to the County for further
review and/or entitlement.
2. A traffic impact study must be submitted with the preliminary plat
application.
3. Dedication of right-of-way along the following roadway alignments will be
required as part of subdivision plat:
Citrus Road: 10 feet (to provide a total width of 65 feet); and

Note that the above widths are considered minimum widths. Additional
dedication may be required pending improvements that may be required
by the MCDOT approved Traffic Impact Study.
4. The applicant shall contact County Real Estate to formally abandon the 30’
foot R/W shown along the Rose Lane alignment.
5. Engineering review of planning and/or zoning cases is for conceptual
design only. All development and engineering design shall be in
conformance with Section 1205 of the Maricopa County Zoning

Ordinance; Drainage Policies and Standards; Floodplain Regulations for
Maricopa County; MCDOT Roadway Design Manual; and current
engineering policies, standards and best practices at the time of
application for construction.
f. The following Environmental Services (MCESD) condition shall apply:
1. Obtain new Notice of Intent to Discharge (NOID) from MCESD program.
Water service information to be provided.
g. Prior to approval of the initial final plat or precise plan of development approval,
the applicant shall provide the Maricopa County Planning and Development
Department with an executed pre-annexation service agreement with the City of
Glendale that identifies the details for the provision of water and sewer service. In
lieu of a pre-annexation service agreement, the developer must provide a ‘will
serve’ letter from the certificated water and sewer provider(s). Otherwise,
documentation to be provided from the City of Glendale stating that this type of
agreement would no longer be required.
h. All outdoor lighting shall conform to the Maricopa County Zoning Ordinance.
i. Development of the site shall be in compliance with all applicable Maricopa
County Air Quality rules and regulations.
j. Prior to zoning clearance or Final Plat approval, developer(s) and/or builder(s)
shall establish emergency fire protection services, covering all real property
contained within the project area during course of construction and shall obtain
a ‘will serve’ letter substantiating coverage from the applicable fire service
provider.
k. All habitable buildings constructed within this subdivision shall be constructed to
attain a noise reduction level as per ARS § 28-8482(B).
l. Amendments to the site plan and narrative report shall be processed as a revised
application in accordance with Maricopa County Zoning Ordinance Article 304.9.

For further information, please check the Luke Air Force Base website at

and Development Department.”
Such notification shall be permanently posted on not less than a 3 foot by 5 foot
sign in front of all sales and/or leasing offices and be permanently posted on the
front door of all sales and/or leasing offices on not less than 8½ inch by 11 inch
sign.
19. For the reasons outlined in this report, staff recommends the Commission motion for
Approval of S2020007, subject to conditions ‘a’ – ‘m’.
a. The Final Plat shall be in substantial conformance with the Preliminary Plat entitled
”Citrus and Rose Lane“ consisting of 5 full-size sheets, dated stamped received on

b. Development and use of the site shall in substantial conformance with the
Narrative Report entitled “Citrus and Rose Lane”, consisting of 6 pages, dated
stamped received on May 19, 2021, except as modified by the following
conditions.
c. The following Engineering conditions shall apply:
1. Rose Lane shall be abandoned as part of the Final Plat.
2. At the time of final design, each retention basin drainage area shall be
broken down to indicate the area of R1-18 Lots (Lots 1-16), R1-10 Lots,

Introduction & Purpose of Request:
This application seeks a Rezoning from Rural-43 to both R1-18 RUPD and to R1-10
RUPD to allow for the development of an 82-lot single-family residential subdivision on
approximately 38-gross acres (30-net acres) located at the northeast corner of Bethany
Home Road and Citrus Road in the Waddell area of Maricopa County.
The APN is 502-28-576.
The site has been designed so that the larger lots – which are within the area to be
rezoned to R1-18 RUPD – are placed along the northern and eastern boundaries of the
site. The larger R1-18 PUPD lots are meant to “ring” the portion of the site and create a
buffer of larger lots between the neighboring subdivisions. The smaller lots are located
interior and near the major roads (Citrus and Bethany Home) to the south and west of the
parcel. Two different zoning districts are proposed for this development as described
below.
Description of Proposal:
As noted above, this application seeks a Rezoning from Rural-43 to both R1-18 RUPD
and to R1-10 RUPD to allow for the development of an 82-lot single-family residential
subdivision. The RUPD (“Residential Unit Plan of Development”) is requested to allow for
variations in the development standards of the underlying (as proposed R1-10 RUPD and
R1-18 RUPD) zoning districts.
The site is presently an agricultural use (growing plants for use and sale offsite) and is
zoned Rural-43. A previous Special Use Permit for a retail nursery, approved under
Z2000090 was removed by the Maricopa County Board of Supervisors on June 7, 2006.
As noted above, the proposed development is an 82-lot single-family residential
subdivision, consisting of three (3) different lot sizes as follows:
Area to be zoned R1-18 RUPD:
▪ Lots along the north (Lots 1-8) range in size between 30,028 and 42,310 square feet
to serve as a transition to the existing ~1-acre lots to the north of the subject site.
These lots are designed to generally “match” – lot line-to-lot line – the lots to the north
▪ Lots along the east (Lots 9-16) range in size between 17,700 and 17,800 square feet
to serve as a transition to the existing lots to the east of the subject site.
Area to be zoned R1-10 RUPD:
▪ Lots within the R1-10 RUPD zoning area have a minimum size of 10,000 square feet.

Revised May 19, 2021

In addition, open space and retention areas are placed along the western and southern
portions of the site to serve as a landscaped buffer along Citrus Road and Bethany Home
Road, respectively.
Included with this rezoning submittal is also an application for the related Preliminary Plat.
A builder of the homes has not yet been selected; homes will likely be a mix of one- and
two-story homes.
Open space comprises 4.45 acres, or over +/-12% of the development. A landscape
package and any amenities for this development will be selected and designed by the
ultimate developer of this project. All plant materials will comply with the Arizona
Department of Water Resources (“ADWR”) list of low-water use plants.
Access to the site is via two (2) adjacent arterial roadways: Bethany Home Road along
the south, which connects to the Loop 303 approximately 1-½ miles to the east, and Citrus
Road along the west. Although Rose Lane exists along the north, no access is proposed
to this roadway. This roadway may be abandoned if deemed necessary by the developer
and/or MCDOT with the related Final Plat. Interior roads are proposed to be public streets,
constructed to Maricopa County specifications.
The development is proposed to be enclosed by a 6-foot high wall along the perimeter of
the site. This wall will also be selected and designed by the ultimate developer of this
project.
Entry-type signs will be located at each entrance of the development and will comply with
the requirements of Maricopa County. Their design will also be selected by the ultimate
developer of this project.
Lighting, where provided, will comply with Section 1112 of the Maricopa County Zoning
Ordinance.

RUPD:
R1-18 RUPD:
The lot area per dwelling unit is in excess of 10,000 square feet; there are two typical lot
sizes within the R1-18 RUPD area; Lots along the north (Lots 1-8) range in size between
30,028 and 42,310 square feet and lots along the east (Lots 9-16) range in size between
17,700 and 17,800 square feet. Because of the variation in these lot sizes, deviations
from the “base” R1-18 zoning district are needed to address these variations.
The proposed standards are as follows (items in bold vary from the underlying R1-18
development standard):

streets, divided by the total number of lots
R1-10 RUPD:
The minimum lot size is over 10,000 square feet (the minimum lot size in R1-10). A RUPD
(Residential Unit Plan of Development) is proposed as an overlay to the proposed R1-10
zoning for the site to vary the proposed setbacks and to also allow Maricopa County to
stipulate to the proposed larger lot sizes at the locations as shown on the conceptual Site
Plan.
The proposed standards are as follows (items in bold vary from the underlying R1-10
development standard):

The above deviations for both the R1-18 RUPD and the R1-10 RUPD are to provide for
flexibility in the placement of the homes on these very large lots and are more-typical of
what is allowed within the R1-8 and R1-6 zoning districts.
Relationship to the White Tank and Grand Avenue Area Plan:
The subject site is located within the boundaries of the White Tank / Grand Avenue Area Plan.
Within this plan, the proposed development supports a wide range and number of goals and/or
policies. Ones of note include the following:
Land Use:
Goal L1: Promote efficient land development that is compatible with adjacent land uses, is well
integrated with the transportation system, and is sensitive to the natural environment.
The proposed development, rather than a series of lot splits, is designed in a master-planned and
cohesive manner and includes related improvements to adjacent roadways. As a previously
developed site, the proposed development has no adverse impact on the natural environment.
Objective L1.1: Encourage the timely and orderly expansion of urban service areas.
The proposed development will include the development of the adjacent roadways as required by
Maricopa County, as well as the extension of water and sewer, where needed to serve this
development.
Z2019087 - Narrative Report
Revised May 19, 2021

Transportation:
Goal T1: Improve the roadway network to meet future transportation needs, promote safety, and
mitigate congestion.
As noted above, the proposed development will include the development of the adjacent
roadways as required by Maricopa County.
Economic Development
Objective ED1.5: Improve housing conditions in unincorporated communities.
The proposed development will provide for new housing opportunities in this unincorporated area
of Maricopa County.
Relationship to Surrounding Properties:
The site is presently being utilized as a plant nursery and is zoned Rural-43.
The zoning and characteristics of the surrounding properties are as follows:
North: Rural-43; subdivided (Montana Farms 2) with approximately one-acre size lots
and single-family residences.
South: R1-10; Allen Ranch, a master-planned community, but not yet developed or
subdivided. Currently vacant
East: Rural-43; acre+ size lots (lot splits / un-subdivided) and single-family
residences (on 2 of the 3 adjacent lots)
West: Rural-43; vacant
This area is outside of any noise contours related to Luke Airforce Base, which is located
more than approximately 2-½ miles to the northeast of the site.
The area has seen much recent development and zoning activity since the completion
and opening of the Loop 303, which links I-10 with I-17 through this area.
A number of recent employment-type uses have developed along the Loop 303, mostly
south of Camelback. This employment area, along with Luke AFB, has generated
significant need for housing that is nearby.
Recent housing developments (and/or related zoning activity) in the area include Allen
Ranch, Palm Creek expansion, Sedella, White Tank Foothills, Russell Ranch, Zanjero
Trails, Verrado expansion and Granite Vista to name a few.
This proposed development will help to meet some of this need for housing in this area.

Location and Accessibility:
Access to the site is via two arterial roadways: Bethany Home Road along the south,
which connects to the Loop 303 approximately 1-½ miles to the east, and Citrus Road
along the west. Although Rose Lane exists along the north, no access is proposed to this
roadway.
Circulation System (on & off-site):
As noted above, access to the site is via Bethany Home Road along the south and Citrus
Road along the west.
Both Bethany Home Road and Citrus Road are arterial roadways and follow Section line
alignments. Today, both exist as two-lane paved roadway. Additional roadway
improvements, and/or dedication of rights-of-way, for either or both roadways will be
provided as required by Maricopa County (MCDOT).
No access is proposed to Rose Lane, which runs east-west along the northern boundary
of the site.
Interior roads are proposed to be public streets, constructed to Maricopa County
specifications.
A minimum of 2 parking spaces (in each driveway) will be provided for each home.
A Traffic Statement is included with this submittal.
Development Schedule:
Upon the approval of the requested rezoning, and related Preliminary Plat, the next step
will be to submit a Final Plat (for all or a portion).
At this time, it is unknown if the site will be developed as one or more phases. Phasing
information will be provided at the time of submittal of a Preliminary Plat for the site (or
any portion).
Community Facilities and Services:
The site is located within the Agua Fria High School District. Canyon View High School is
located approximately 1-½ miles to the west.
Z2019087 - Narrative Report
Revised May 19, 2021

The site is also located within the Litchfield Elementary School District. The Scott L. Libby
Elementary School is the nearest elementary school and is located near Perryville Road
and Thomas Road.
As part of this zoning process, we will be reaching-out to both school districts.
The site is near several regional parks: White Tank Regional Park (includes a library) and
Skyline Regional Park.
Within the development, there are open space areas (any amenities have not yet been
determined).
Public Utilities and Services:
Police protection will be provided by Maricopa County Sheriff, and fire protection will be
via a subscription service (such as Rural Metro). Refuse collection will be through a
private provider.
Electric service is provided by APS (Arizona Public Service). Telecommunication services
such as telephone, TV and internet are available through Cox Communication,
CenturyLink and others. It is not likely that natural gas will be made available to this
development, but if it is, it would be supplied by Southwest Natural Gas.
At the time of this submittal, the determination for water and sewer services has not been
determined. This will be secured at the time of Preliminary Plat.

Application Case #: S2020007
Date Revised: May 19, 2021

Introduction & Purpose of Request:
This application seeks a preliminary plat to allow for the development of an 82-lot single-
family residential subdivision on approximately 38-gross acres (30-net acres) located at
the northeast corner of Bethany Home Road and Citrus Road in the Waddell area of
Maricopa County.
The APN is 502-28-576.
The site has been designed so that the larger lots – which are within the area to be
rezoned to R1-18 RUPD – are placed along the northern and eastern boundaries of the
site. The larger R1-18 RUPD lots are meant to “ring” the portion of the site and create a
buffer of larger lots between the neighboring subdivisions. The smaller lots are located
interior and near the major roads (Citrus and Bethany Home) to the south and west of the
parcel. Two different zoning districts are proposed for this development as described
below.
Description of Proposal:
As noted above, this application seeks a preliminary plat to allow for the development of
an 82-lot single-family residential subdivision. This request also seeks a waiver from the
County’s residential street cul-de-sac length requirement under the Subdivision
regulations. The residential street cul-de-sac, Plate 10, reads: a maximum length 1000’
or 15 lots. This waiver is for the only single cul-de-sac within the Preliminary Plat. This
cul-de-sac is located on northern most street. As designed, the overall subdivision is
designed around one residential entry from Citrus Road and one from Bethany Home
Road to provide an exclusive feel to this residential community. Citrus Road is considered
an arterial street and generally the County wants to limit street connections being close
to each other, when possible, to avoid traffic conflicts and to help traffic flow. Limiting
street connections to arterial streets also helps to eliminate traffic cut-through residential
subdivisions. When consideration is given to Citrus Road arterial street classification and
the drainage/retention requirements for this subdivision it was found that it would be a
better design for this residential community to create a single cul-de-sac along the
northernmost street. While this cul-de-sac slightly exceeds the County’s cul-de-sac
length by the number of lots from 15 to 18, the street width and cul-de-sac radius meets
the County’s requirement. The slight modification should not impact this subdivision or
the County in a negative matter.
The site is presently an agricultural use (growing plants for use and sale offsite) and is
zoned RU-43. A companion rezoning request (Z2019087) seeks to rezone the property
from Rural-43 to R1-18 RUPD and R1-10 RUPD. A previous Special Use Permit for a
retail nursery, approved under Z2000090 was removed by the Maricopa County Board of
Supervisors on June 7, 2006.
S2020007 - Narrative Report
Revised: May 19, 2021

As noted above, the proposed development is an 82-lot single-family residential
subdivision, consisting of three (3) different lot sizes as follows:
Area zoned R1-18 RUPD:
▪ Lots along the north (Lots 1-8) range in size between 30,028 and 42,310 square feet
to serve as a transition to the existing ~1-acre lots to the north of the subject site.
These lots are designed to generally “match” – lot line-to-lot line – the lots to the north
▪ Lots along the east (Lots 9-16) range in size between 17,700 and 17,800 square feet
to serve as a transition to the existing lots to the east of the subject site.
Area zoned R1-10 RUPD:
▪ Lots within the R1-10 RUPD zoning area have a minimum size of 10,000 square feet.
In addition, open space and retention areas are placed along the western and southern
portions of the site to serve as a landscaped buffer along Citrus Road and Bethany Home
Road, respectively.
Ordinance.

Revised: May 19, 2021

S2020007 - Narrative Report
Revised: May 19, 2021

Upon the approval of the requested Preliminary Plat, the next step will be to submit a
Final Plat (for all or a portion).
S2020007 - Narrative Report
Revised: May 19, 2021

Public Utilities and Services:
Police protection will be provided by Maricopa County Sheriff, and fire protection will be
via a subscription service (such as Rural Metro). Refuse collection will be through a
private provider.

RE: First Review of Rezoning Application (Z2019087): NEC Bethany Home &
Citrus located at the Northeast Corner of Bethany Home Road and Citrus
Road, within the Municipal Planning Area of Glendale, Arizona
Dear Mr. Banker:
Thank you for providing this rezoning application to the City of Glendale for review. This
property lies within the City of Glendale’s Municipal Planning Area. The City of Glendale
notes the following items, which need to be addressed prior to further consideration of the
rezoning request:
The property is designated Low Density Residential, up to 1 dwelling unit per acre on the
City of Glendale voter approved General Plan. The proposed rezoning request is not in
conformance with the city’s General Plan, and a General Plan Amendment is required to
be filed with and approved by the City of Glendale prior to the City of Glendale supporting
the rezoning request.
The City of Glendale is a strong partner with Luke Air Force Base. The City of Glendale
supports the Graduated Density Concept for residential development just outside of the
65 ldn noise contour within territory in the vicinity of Luke Air Force Base. The Graduated
Density Concept provides for a maximum residential density of up to 2 dwelling units per
acre within ½ mile of the 65 ldn noise contour. As proposed, a portion of this development
does not comply with this requirement.
The City of Glendale notes that this property is within an unincorporated area surrounded
on all sides by the corporate limits of the City of Glendale.
The City of Glendale notes that in accordance with the Loop 303 agreement between the
City of Glendale and the EPCOR utility, the applicant will need to come to an agreement
