Board Hearing Date: August 4, 2021
Case #’s/Title: CPA2021001 & Z2021001 – ASLD 117th Ave. & Williams Rd.
Supervisor District: 4
Applicant/Owners: Rose Law Group, PC / Arizona State Land Department
Requests: 1) General Comprehensive Plan Amendment (CPA) to change
the land use designation in the White Tank/Grand Avenue
Area Plan from Mixed-Use Employment to Single-Family
Transitional Lot (3-5 d.u./acre) on approx. 52 acres. CPA case
approval is by Resolution.
2) Zone Change with Overlay from Rural-43 to R1-6 RUPD on
approx. 196.8 acres.
Site Locations: CPA - Generally located on the east side of 117th Ave. approx.
595’ north of the Pinnacle Peak Rd. alignment in the Peoria
area.
Zone Change - Generally located on the east side of 117th
Ave. between the Calle Lejos and Via Montoya alignments in
the Peoria area.
Site Size: Approx. 198.6 acres
County Island Status: Yes, Peoria
Additional
Comments: The applicant seeks a CPA and Zone Change for a residential
development of up to 770 single-family homes. The City of
Surprise commented on the proposal requesting that either a
traffic impact study or analysis (TIS/TIA) be submitted to the
City for approval or at a minimum the County complete the
Williams Deer Valley Road Project. MCDOT does not require
a TIS/TIA to be approved until the time of preliminary plat
approval. Staff included a condition that the applicant shall
provide a copy of the TIA/TIS to the City of Surprise for review
at the time of platting. The AFMA sent comments regarding
fire service to be addressed during the platting process. No
comments were received from other relevant municipalities.
The applicant held a public meeting that had 8 resident
attendees and 12 attendees total on February 11, 2021 and
incorporated public feedback regarding open space into
the conditions of approval.

Commission
Recommendation (CPA2021001): On 7/8/21, the Commission voted 7-0 to recommend
approval of CPA2021001 subject to conditions ‘a’ – ‘d’:
a. Development of the site shall comply with the Legal Description entitled “Arizona
State Land Zoning Parcel”, consisting of 2 pages, dated March 22, 2021, and
stamped received May 5, 2021, except as modified by the following conditions.
b. Development and use of the site shall be in substantial conformance with the
Narrative Report entitled “ASLD – 117th Avenue and Williams Road”, consisting of
18 pages, dated June 3, 2021, and stamped received June 3, 2021, except as
modified by the following conditions.
c. Development and use the site shall be in general conformance with the land use
exhibit entitled “ASLD-MC-117th Ave & Williams Dr” dated March 12, 2021 and
stamped received May 5, 2021, except as modified by the following conditions.
d. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows
the property owner to enjoy uses in excess of those permitted by the land use
existing on the date of the application, subject to conditions. In the event of the
failure to comply with any condition of approval, the property shall change to the
land use designation that existed on the date of the application. It is, therefore,
stipulated and agreed that revocation due to the failure to comply with any
conditions does not reduce any rights that existed on the date of application to
use, divide, sell or possess the property and that there would be no diminution in
the value of the property from the value it held on the date of application due to
such revocation. The Comprehensive Plan Amendment enhances the value of
the property above its value as of the date the Comprehensive Plan Amendment
is granted and changing to the prior land use designation results in the same value
of the property as if the Comprehensive Plan Amendment had never been
granted.
Commission
Recommendation (Z2021001): On 7/8/21, the Commission voted 7-0 to recommend
approval of Z2021001 subject to conditions ‘a’ – ‘m’:
a. Development of the site shall comply with the Zoning Exhibit entitled “Arizona State
Land Property”, consisting of 40 pages, dated December 20, 2019, and stamped
received May 5, 2021, except as modified by the following conditions.
b. Development of the site shall be in substantial conformance with the Narrative
Report entitled “ASLD – 117th Avenue and Williams Road”, consisting of 44 pages,
dated revised June 28, 2021, and stamped received June 28, 2021, except as
modified by the following conditions.
c. The following R1-6 RUPD Zoning District standards shall apply:
1. Min. Front Yard: 10’

2. Min. Rear Yard: 15’
3. Min. Lot Area: 5,175 sq. ft.
4. Min. Lot Width: 45’
5. Min. Lot Area Per Dwelling Unit: 5,175 sq. ft.
6. Max. Lot Coverage: 55%
d. The number of total dwelling units permitted shall not exceed 770 dwelling units.
e. The developer shall provide 15% open space appropriately dispersed throughout
the boundaries of the subdivision which may consist of retention, drainage areas,
and passive and active recreational spaces.
f. The following Planning Engineering conditions shall apply:
1. Without the submittal of a precise plan of development, no development
approval is inferred by this review, including, but not limited to number of
proposed building lots/units, drainage design, access and roadway
alignments. These items will be addressed as development plans progress
and are submitted to the County for further review and/or entitlement.
2. A traffic impact study (TIS) must be submitted with future entitlement
(preliminary plat or POD) application(s) as is required by MCDOT. The TIS
must also be submitted to the City of Surprise for their review.
3. Any approval and progression in the entitlement process may be
contingent on the progression of MCDOT TIP TT0248 which includes
extension of Williams Drive across the Agua Fria River to Deer Valley Road
which extends through the site.
4. The only access that will be allowed for the Williams Drive/Deer Valley Road
alignment will be at one location along Parcel G as a right-in right-out. A
second access point for Parcel G will be needed along the 117th Avenue
alignment.
5. Future right-of-way dedications, offsite improvements, and any additional
right-of-way needed shall be addressed by future entitlement (preliminary
plat or POD) application(s) and submittal of a traffic impact study (TIS)”.
6. R/W dedication (130 feet)) along the development site’s portion of
Pinnacle Peak Road will be required as part of any future entitlement
application(s), unless otherwise determined by MCDOT Planning.
7. Engineering review of re-zone cases is conceptual in nature. All
development and engineering design shall be in conformance with
Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies
and Standards; Floodplain Regulations for Maricopa County; MCDOT
Roadway Design Manual; and current engineering policies, standards and
best practices at the time of application for construction.
g. All outdoor lighting shall conform to the Maricopa County Zoning Ordinance.

h. Development of the site shall be in compliance with all applicable Maricopa
County Air Quality rules and regulations.
i. Prior to zoning clearance or Final Plat approval, developer(s) and/or builder(s)
shall establish emergency fire protection services, covering all real property
contained within the project area during course of construction and shall obtain
a ‘will serve’ letter substantiating coverage from the applicable fire service
provider.
j. Amendments to the site plan and narrative report shall be processed as a revised
application in accordance with Maricopa County Zoning Ordinance Article 304.9.
k. Noncompliance with the conditions of approval will be treated as a violation in
accordance with the Maricopa County Zoning Ordinance. Further,
noncompliance of the conditions of approval may be grounds for the Planning
and Zoning Commission to take action in accordance with Chapter 3 (Conditional
Zoning).
l. Non-compliance with the regulations administered by the Maricopa County
Environmental Services Department, Maricopa County Department of
Transportation, Drainage Review Division, Planning and Development
Department, or the Flood Control District of Maricopa County may be grounds for
initiating a revocation of this Zone Change as set forth in the Maricopa County
Zoning Ordinance.
m. The granting of this Zone Change has been at the request of the applicant, with
the consent of the landowner. The granting of this approval allows the property
owner to enjoy uses in excess of those permitted by the land use existing on the
date of the application, subject to conditions. In the event of the failure to comply
with any condition of approval, the property shall change to the land use
designation that existed on the date of the application. It is, therefore, stipulated
and agreed that revocation due to the failure to comply with any conditions does
not reduce any rights that existed on the date of application to use, divide, sell or
possess the property and that there would be no diminution in the value of the
property from the value it held on the date of application due to such revocation.
The Zone Change enhances the value of the property above its value as of the
date the Zone Change is granted and changing to the prior land use designation
results in the same value of the property as if the Zone Change had never been
granted.

Project Summary:
1. The applicant is requesting a Comprehensive Plan Amendment (CPA) to change the
land use designation from Mixed Use Employment to Single-Family Transitional Lot on
approx. 52 acres. The subject property is located in the White Tank/Grand Avenue Area
Plan and is part of the Peoria Municipal Planning Area. The Peoria General Plan
designates the property as Suburban Residential (5 to 12 d.u./acre).
2. In addition to the CPA proposal, the applicant is requesting a Zone Change with Overlay
from Rural-43 to R1-6 RUPD. The zone change to R1-6 RUPD will take place on approx.
198.6 acres and is intended to develop into a residential community of 770 single-family
dwelling units. The expectation is that the residential community will be subsequently
platted if the zone change is approved and development standards are in place.
3. Legal descriptions are provided for the areas comprising the CPA and zone change. The
site is relatively flat and is currently used as agricultural/vacant land owned by the Arizona
State Land Department. The property is in close proximity to several other subdivisions of
similar density such as Crossriver, Tierra Del Rio, Camino Del Lago, Coldwater Ranch, and
Vistancia.
4. The narrative provided for CPA2021001 asserts that the proposed development meets
the Comprehensive Plan Amendment criteria in the following manner:
Whether the amendment constitutes an overall improvement to the Comprehensive Plan
and is not solely for the good or benefit of a particular landowner or owners at a particular
point in time.
The applicant outlines key important benefits of the proposed amendment including
providing additional housing stock to ease the County-wide shortage, additional
revenue through sales taxes and development fees, and the creation of jobs. For
example, the narrative notes that there is a potential for the residential development to
create over 2,000 full-time jobs and generate substantial government revenue based
upon projections from NAHB’s National Impact of Home Building and Remodeling report.
The auction/sale of the property will bring additional funding to K-12 public education as
the dedicated beneficiary of the State Trust Land on this parcel.
Whether the amendment will adversely impact all or a portion of the planning area.
A. Altering acceptable land use patterns to the detriment to the plan.
The applicant states that the amendment will unify land uses in the immediate
surrounding area and be consistent and compatible with nearby subdivisions of
similar density (3-5 d.u./acre).
B. Requiring public expenditures for larger and more expensive public infrastructure.
The applicant has stated that expenditures for larger and more expensive public
infrastructure such as roads, sewer or water required as a part of the development
shall be borne by the developer.
CPA2021001 & Z2021001

C. Requiring public improvements to roads, sewer, or water systems that are needed
to support planned land uses.
The applicant notes that some of the funding for ROW servicing the site is already
allocated as part of the Deer Valley Road Project. The applicant has stated that
expenditures for larger and more expensive public infrastructure such as roads,
sewer or water required as a part of the development shall be borne by the
developer.
D. Adversely impacting planned uses because of increased traffic.
The narrative suggests that a Traffic Impact Analysis (TIA) will be submitted to the
County and City of Surprise for review during a future preliminary plat/entitlement
process. The site and surrounding area are primarily designated as Small Lot
Residential which is similar to the use designation proposed and that the traffic
associated with residential developments is therefore anticipated. The applicant
notes that construction of the roadways in and around this site will be a positive
development for residents living in the area as current access routes have limited
connectivity.
E. Affecting the livability of the area or the health or safety of present and future
residents.
The narrative states that their proposal for residential will bring improved safety as
the result of new lighting, streets and resident population that will inhabit the area.
In addition, the proposed residential development provides a lower intensity use
than commercial or industrial uses.
F. Adversely impacting the natural environment or scenic quality of the area in
contradiction of the plan.
According to the applicant, the site does not impact the natural environment or
scenic quality of the area or the nearby Agua Fria River. The applicant states that
the site will maintain some natural desert landscaping at buildout and does not
expect views to be impacted.
Whether the amendment is consistent with the overall intent of the Comprehensive Plan.
The narrative notes consistency with the intent of both the Vision 2030 Comprehensive
Plan and White Tank/Grand Avenue Area Plan. The intent of the Vision 2030 Plan is to
maintain a high quality of life by: protecting public health and safety, promoting stable
economic growth, maintaining a healthy environment, providing adequate community
services and ensuring that tax money is spent efficiently. The applicant states that the
residential community be desirable, promote safety through the development of
uninhabited land and will help promote stable economic growth through job creation
and promote development of local roads for more access opportunities in an
underserved area.
CPA2021001 & Z2021001

Additionally, the narrative discusses the vision of the White Tank/Grand Avenue Plan
which describes the Northwest Valley “as a place that enjoys a high quality of life and
encourages planned community developments”. The applicant states that the planned
community will provide a high quality of life due to its close proximity to nearby
commercial uses such as retail, restaurants, entertainment and employment. The
applicant has agreed to include 15% open space appropriately spaced throughout the
community.
The extent to which the amendment is consistent with the specific goals and policies
contained within the plan.
The narrative also states that the subject site meets the following goals and objectives of
the White Tank/Grand Avenue Area Plan. The applicant’s narrative report provides
details about how this project intends to meet these goals and policies.
White Tank/Grand Avenue Area Plan
Land Use Goal L1: Promote efficient land development that is compatible with adjacent
land uses, is well integrated with the transportation system, and is sensitive to the natural
environment.
Land Use Objective L1.1: Encourage the timely and orderly expansion of the Urban
Service Area.
Land Use Policy L1.1.2: New residential development with gross densities greater than 1.0
dwelling units per acre shall be located within the Urban Service Area. Maximum gross

Adopted Plans:
10. White Tank/Grand Avenue Area Plan (Adopted: 2000): This plan identifies the subject site
as Mixed Use Employment and Small Lot Residential. The Mixed Use Employment
category identifies locations for major employment centers. Uses permitted in the Mixed
Use Employment designation include offices, light industrial parks, business parks,
research parks, government facilities, post-secondary educational facilities and major
medical facilities. Residential uses are not permitted under the Mixed Use Employment
designation. The Small Lot Residential (2 – 5 d.u./acre) category identifies areas where
increased residential density development is appropriate and urban services such as
sewer, water, schools, parks and fire and police protection are available.
11. City of Peoria General Plan (Adopted: 2020): This plan identifies the subject site as
Suburban Residential (5 – 12 d.u./acre). The suburban residential designation is intended
to provide a range of residential uses from small lot attached and detached single-family
to multi-family residences. These areas of the City are a more intense residential land use,
and residences may have limited private outdoor space, thereby relying on common
open space amenities for recreation and connection with nature.

Public Participation Summary:
12. The applicant has complied with the Maricopa County Citizen Review Process with the
required posting of the site and notification by first class mail to adjacent property owners
and HOA’s within 300’ of the subject parcel and notification to interested parties.
13. Five signs were posted on site in accordance with applicable regulations. The applicant
advertised the CPA along with the Zone Change. Advertising the Comprehensive Plan
Amendment is not required; however, the applicant included the CPA request for public
participation purposes. A Public Participation Results Report was submitted to Staff in
accordance with County requirements.
14. The applicant held a virtual public meeting on Thursday, February 11, 2021. There were
12 attendees of the meeting including 8 nearby residents from nearby residential
communities. Some of the issues discussed included open space/park amenities and
traffic impacts. The applicant did take these issues into account when preparing their
second submittal and increased their open space commitment to 15%. The applicant’s
Public Participation Results Report indicated that the applicant received and responded
to correspondence from neighbors. The correspondence indicated questions and
concerns about potential multi-family development, site amenities/open space, traffic
impacts and potential school overload.
15. Staff received no opposition or support letters from nearby property owners. Staff
received one request for information from Christian Williams who wanted access
instructions for the meeting.
16. The American Fire and Medical Association (AFMA) sent Staff comments about fire
service requirements to the site. These comments are related to the precise
development of the site (or plat) and will be addressed during the platting process.
17. Staff also received comments on the proposal from the City of Surprise. The City of
Surprise requested a Traffic Impact Analysis (TIA) to be sent to the City for review as the
City has concerns about the capacity of access from El Mirage, Bell Road, 117th Avenue
and Happy Valley Road. Alternatively, they requested that at minimum the County
complete the Williams Deer Valley Road Project. Staff from Planning and Development
and MCDOT responded back to the City of Surprise noting that as this site is conceptual
in nature, MCDOT does not require a TIA until the time of preliminary platting and offered
to forward Surprise a copy of the TIA once received. MCDOT staff also sent additional
information about the area to the City. No further comments were received from
Surprise. Staff received a request for information from the City of Peoria; however, the
City of Peoria did not comment on the site. Likewise, Staff received no comments from
the City of Glendale.
Outstanding Concerns from Reviewing Agencies
18. N/A
Staff Analysis:
CPA2021001 & Z2021001

19. Staff is supportive of the applicant’s requests for a comprehensive plan amendment and
zone change on the subject site. The approximate 3.9 d.u./acre density is in accordance
with the City of Peoria land use designation for Suburban Residential (5 - 12 d.u./acre)
The comprehensive plan amendment to Single-Family Transitional Lot (3 – 5 d.u./acre)
occurs on an approximately 52 acre area designated as Mixed Use Employment. This
area has not developed for this purpose. Additionally, the remainder of the planned
residential development would occur on an area primarily designated Small Lot
Residential (2 – 5 d.u./acre).
20. In regards to the Zone Change request, the applicant is requesting several standards to
be varied for the R1-6 RUPD zoning district including front/rear setbacks, lot area, lot
width, lot coverage and lot area per dwelling unit. Staff finds all of the applicant’s
requests reasonable in that there are several surrounding residential communities of a
similar residential density and the requests are typical of current residential development
design standards. The applicant also worked with staff to commit 15% of the site’s overall
acreage as open space appropriately distributed throughout the boundaries of the
subdivision.
21. It is important to note that the property will be disposed of through the Arizona State Land
Department’s (ASLD) public auction process. The ASLD is mandated by state law to
maximize revenue to the State Land Trust beneficiaries and realizes greater value when
land is sold with a level of entitlement that assures a buyer of allowable land uses. The
designated beneficiary of this particular site is K-12 public schools and the proceeds from
the sale would provide additional education funding.
22. Staff believes that the applicant has acted in good faith to notify nearby owners of the
proposed change by holding a virtual public meeting and keeping staff informed as to
any comments received. Staff notified the City of Glendale about both requests and
received no comments. The applicant will address City of Surprise comments regarding
Peoria Avenue at the time of the Preliminary Plat. Staff received no public opposition
and reviewing agencies have no objection to the requests.
Recommendations (Two Motions – CPA2021001 & Z2021001):
23. For the reasons outlined in this report, staff recommends the Commission motion for
Approval of CPA2021001, subject to conditions ‘a’ – ‘d’.
CPA2021001 & Z2021001

The Comprehensive Plan Amendment enhances the value of
the property above its value as of the date the Comprehensive Plan Amendment
is granted and changing to the prior land use designation results in the same value
of the property as if the Comprehensive Plan Amendment had never been
granted.

CPA2021001 & Z2021001

Zoning).
CPA2021001 & Z2021001

The Zone Change enhances the value of the property above its value as of the
date the Zone Change is granted and changing to the prior land use designation
results in the same value of the property as if the Zone Change had never been
granted.

ASLD – 117th Avenue and Williams Road Comprehensive Plan Amendment | 3

I. Executive Summary
A. Background
The subject property is State Trust Land under management by the Arizona State Land
Department (the “Owner”) and has long standing RU-43 zoning within unincorporated
Maricopa County. Exhibit A – Vicinity Map depicts the subject property and surrounding
area. The extension of the Loop 303 freeway in 2003 brought growth to the area, including
the expansion of the City of Peoria’s jurisdictional boundary and development of County
land. The Deer Valley Road extension, from 109th Avenue to 117th Avenue at the Williams
Drive alignment, which is anticipated to be completed in 2021, will bring accessibility to
this property and allow for growth. The Deer Valley extension has already influenced the
rezoning of land immediately adjacent to the east of the subject property for a planned
residential community called Rose Estates. Now that this property is located between
residential communities of similar densities, and the subject property itself will be bisected
by the future Deer Valley Road extension, it should transition to a type of development
more compatible with the growing surrounding area.
B. Purpose of Request
Rose Law Group, on behalf of the Owner, is requesting a general comprehensive plan
amendment to the White Tank/Grand Avenue Area Plan for a portion of an approximately
198.6 acre property located approximately 1,000 feet south of the southeast corner of 117th
Avenue alignment and Hatfield Road (the “Subject Area” or “Site”). See Exhibit A -
Vicinity Map, attached. A portion of the Subject Area is currently designated as “Mixed
Use Employment” and approximately 51.6 acres is proposed to be amended to “Single
Family – Transitional Lot (3-5 du/ac)”. See Exhibit B – Existing and Proposed Land Use.
The proposed land use designation change will allow for the creation of a new single-
family residential community with comparable density and product size as found in the
general vicinity. A zone change for the Site is being requested concurrently, and a
Preliminary Plat application will follow in the future.
The proposed community is envisioned to include up to 770 lots, with common passive
and active open space. The project site highlights the surrounding landscape by placing
circulation routes and homesites accordingly. Additionally, with the extension of Deer
Valley Road and the associated bridge improvements, vehicular and pedestrian connection
to the east and west is anticipated.
C. On Site and Regional Location
As discussed previously, the approximately 51.6 acres are located within unincorporated
Maricopa County and is State Trust Land under management of the Arizona State Land
Department. The Site is located just east of the W. Pinnacle Peak Rd. and N. 117th Ave
intersection and is approximately 3,470 feet south of the Happy Valley 303 interchange, as
depicted in Exhibit A - Vicinity Map. Approximately 4,160 feet to the east of the Site lies
ASLD – 117th Avenue and Williams Road Comprehensive Plan Amendment | 4

the City of Peoria jurisdictional boundary and to the west is Sun City and the City of
Surprise city limits.
The Loop 303 provides quick access to other regional transportation routes such as
Interstate 17 and Interstate 10, and the Site will be intersected by the future Deer Valley
Road extension, improving the Site’s accessibility even further.
The surrounding area is made up of existing, planned and developing residential
communities, in addition to other Arizona State Land, Bureau of Land Management and
other quarry sites. Table 1-On Site and Surrounding Uses, Comprehensive Plan and
Zoning Designations below provides a summary of the general area.

D. Existing Conditions
The Site is vacant and undeveloped, and is bordered by the Crossriver single-family
residential neighborhood to the west, and vacant undeveloped property to the east. The
property to the east was recently approved for a Comprehensive Plan Amendment
(#CPA2019013) and a zone change (#Z2019112) for a planned residential community
called Rose Estates.
The Site is relatively flat in slope, consisting almost entirely of untouched, natural desert
landscape. Vegetation is sparsely distributed throughout the Site, and includes native desert
plants such as saguaro and common shrubs. Animal life on the Site is not apparent, however
small animals common to Arizona likely traverse the Site and surrounding areas. There are
no sensitive land uses on the Site, however the Site is near the Agua Fria River. The
proposal does not impact the Agua Fria River or any floodplains as they do not exist on the
Site.
The Site falls within the Maricopa County White Tank/Grand Avenue Area Plan and is
designated as “Small Lot Residential (2-5 du/ac)” and “Mixed Use Employment.” As
previously mentioned, the Site is zoned RU-43.
ASLD – 117th Avenue and Williams Road Comprehensive Plan Amendment | 5

E. Roads/Transportation Systems Serving the Proposed Project
A street is proposed on the Pinnacle Peak Road alignment between 117th Avenue and the
Rose Estates property, which is adjacent to the Site to the east. This future street will be
located on the Site and is currently the subject of a Right of Way application submitted to
the Arizona State Land Department by the owners of the Rose Estates property. This Right
of Way area is expected to go to auction in October and will be developed by the private
developers of Rose Estates. Initially, this street will be a private street. When Rose Estates
develops, it is intended that this portion of Pinnacle Peak Road will be dedicated to the
public street system.
Primary access for most of the Site is proposed from Pinnacle Peak Road while secondary
access is gained through N. 117th Ave. A portion of the Site will obtain access from the
future Deer Valley Road extension via a right-in, right-out driveway, and its secondary
access from N. 117th Ave. The future Deer Valley Road extension is a five-lane arterial
roadway with an expected 2021 build out.
All residential and collector streets in the Site will be dedicated to the Maricopa County
public street system, subsequent to construction by the private developers and acceptance
by Maricopa County.
F. Suitability with Surrounding Land Uses
As previously outlined above in Table 1- On Site & Surrounding Uses, Comprehensive
Plan, & Zoning Designations, adjacent land uses are primarily vacant or existing or
proposed single family residential, so little impact is anticipated. Larger residential
developments in the area include Dos Rios, Crossriver, Deer Valley Ranch and Ironwood
residential communities. Specific attention to lot size, density, and open space has been
analyzed in order to provide suitability with existing development.
II. Site Analysis
A. Whether the Amendment constitutes an overall improvement to
the Comprehensive Plan and is not solely for the good or benefit
of a particular landowner or owners at a particular point in time.
The proposed amendment from “Mixed Use Employment” to “Single Family –
Transitional Lot (3-5 du/ac) constitutes an overall improvement to the Comprehensive Plan
as it will allow the development of a longstanding vacant piece of land into a use that is
most suitable not only for the land itself, but for the surrounding community. Additionally,
the proposed change will be a benefit to the larger regional area, Maricopa County and the
State.
ASLD – 117th Avenue and Williams Road Comprehensive Plan Amendment | 6

As much of the surrounding and nearby area is existing or planned single family residential,
the proposed amendment of the approximately 51.6 acres to Single Family – Transitional
Lot (3-5 du/ac) benefits the local area by bringing comparable single family residential
development, rather than a commercial development that would otherwise disrupt the
residential neighbors. This benefit improves the Comprehensive Plan as it amends the
Mixed Use Employment designation to a designation more appropriate for the area.
For the larger regional area and Maricopa County in particular, the amendment will result
in the development of additional housing stock and thereby help ease the housing shortage
that is currently taking place in Maricopa County. Further, development of the new housing
will create additional jobs and will result in an increased population for the area that will
support nearby businesses. According to the National Association of Home Builders’
National Impact of Home Building and Remodeling report, building an average single-
family home results in the creation of 2.90 jobs and $129,647 in taxes and fees for all levels
of government, supporting police, firefighters, schools, and other important public
services. Therefore, the development of this residential community which proposes 770
conceptual lots may potentially result in the creation of over 2,000 new full-time jobs and
over $99 million in taxes. These benefits that would result from the proposed amendment
are an improvement to the Comprehensive Plan as they represent the highest and best use
of the land. Additionally, the amendment helps integrate the planned Deer Valley Road
extension which is a Maricopa County Department of Transportation project. This benefits
Maricopa County as it immediately makes productive use of the County’s capital project.
The amendment also provides substantial benefits to the State. Since the Site is entirely
State Trust Land, this proposal stands to benefit State Trust Land beneficiaries, with the
designated beneficiary for this parcel being K-12 public education. It may also result in up
to 770 new homes on which each owner will pay an estimated $2,400 per year in property
taxes, for a total of $1,848,000 per year. The new residents will also pay sales taxes as they
spend money at the local businesses.
B. Whether the Amendment will adversely impact all or a portion of the
planning area by:
x Altering acceptable land use patterns to the detriment of the plan.
The amendment does not anticipate altering acceptable land use patterns to the detriment
of the overall plan, as it seeks to unify land uses in the immediately surrounding area. Land
uses surrounding the Site include other vacant State Trust and BLM land, with larger
surrounding uses being primarily residential in nature. An amendment from “Mixed Use
Employment” to “Single Family – Transitional Lot (3-5 du/ac)” will facilitate a planned
residential community that will be consistent and compatible with the immediate and
greater area.
ASLD – 117th Avenue and Williams Road Comprehensive Plan Amendment | 7

x Requiring public expenditures for larger and more expensive infrastructure.
All costs of larger and more expensive infrastructure required as a result of this
development, such as expenditures for roads, sewer or water, shall be borne by the
developer.
x Requiring public improvements to roads, sewer, or water systems that are
needed to support the planned land uses.
This proposal responds to the planned Deer Valley Road extension, in which the State Land
Department provides right of way in the southern-half of the Site to aid in the development
of the future public road. At the time of disposition of the Site, ASLD will include the right
of way with the condition that it be dedicated to the County. The cost of design and
construction of the Deer Valley Road extension improvements has already been allocated
by the Maricopa County Department of Transportation. All costs of larger and more
expensive infrastructure required as a result of this development, such as expenditures for
roads, sewer or water, shall be borne by the developer.
x Adversely impacting planned uses because of increased traffic.
During the permitting process and as required during platting, a Traffic Impact Analysis
(TIA) will take place to ensure that the proposal does not adversely impact traffic for the
area. Additionally, the TIA will be submitted to the City of Surprise for their review. The
Site and surrounding area are primarily designated as “Small Lot Residential”, therefore
planned residential uses were anticipated. Additionally, the Site and surrounding area
benefit from regional connectivity due to their nearness to the Happy Valley/Loop 303
interchange and the future connection to Deer Valley Road which will provide residents
with multiple routes for travel.
x Affecting the livability of the area of health of safety of present and future
residents.
Instead of negatively affecting the health and safety of existing residents, the proposed
amendment will provide additional housing options for the area. Improved safety in the
area is anticipated as a result of new lighting, streets, and resident population that will
occupy the currently uninhabited area. Additionally, the proposed amendment to Single
Family – Transitional Lot (3-5 du/ac) results in a development that provides a lower
intensity use than commercial or industrial uses. Unlike commercial or industrial uses, the
proposed residential would not bring regular commercial traffic and pedestrian activity,
which is beneficial to the nearby residents.
x Adversely impacting the natural environment or scenic quality of the area in
contradiction to the plan.
Minimal impact to the existing natural environment is anticipated as the Site does not fall
within any sensitive land areas. Future residential development for the Site will be of
ASLD – 117th Avenue and Williams Road Comprehensive Plan Amendment | 8

similar density and follow similar development standards as surrounding land patterns,
thereby ensuring minimal impact to the scenic area.
The Site experiences landscape that is primarily flat and consisting of sparsely distributed
natural desert landscape. There is no known large animal life on the Site, however small
animals common throughout Arizona likely traverse the land. The proposed development
considers and is sensitive to the natural environment, and will maintain some natural
features or natural desert landscaping at build out. The proposed development proposes
only single family residential for the Site, so no views that may otherwise be obstructed by
commercial or industrial development are anticipated to be impacted. The Agua Fria River
exists nearby to the east of the Site, but does not travel through the Site and therefore is not
impacted by the proposed development.
C. Whether the amendment is consistent with the overall intent of the
Comprehensive Plan.
The overall intent of the Maricopa County Comprehensive Plan – Vision 2030 is to
maintain a high quality of life by: protecting public health and safety, promoting stable
economic growth, maintaining a healthy environment, providing adequate community
services, and ensuring that tax money is spent efficiently. This proposal envisions a
planned residential community that meets all of these standards through its commitment to
similar scale and density of surrounding development and by utilizing existing and planned
infrastructure. The proposed residential community’s nearness to other existing and
planned residential communities lends to the desirability of the area, thereby helping to
promote stable economic growth and ensuring efficient use of infrastructure and
community services.
The amendment is consistent with the vision of the Comprehensive Plan which promotes
service to citizens by “working collaboratively, innovatively, efficiently and effectively.”
The Owner and Applicant, in preparation of this proposal, have worked closely with
County Staff to ensure a high quality development is planned for the Site.
The amendment is consistent with and promotes the Comprehensive Plan’s Strategic
Priorities as it will result in the development of a longstanding vacant property, thereby
creating new access routes that improve circulation and increasing outdoor lighting by
bringing residents to an otherwise uninhabited area, which may make residents feel safer.
This, together with the utilization of existing infrastructure and services promotes safer
communities and neighborhoods, which is consistent with the Strategic Priorities.
Additionally, the amendment supports the growth of business enterprises in order to
produce a vibrant and balanced regional economy by bringing new residents that will
purchase goods and services from nearby businesses, strengthening the economy. The
growth of new business, coupled with the introduction of new homeowners to the proposed
residential community will increase tax revenues which reinforces the strategic priority to
build the County’s fiscal strength.
ASLD – 117th Avenue and Williams Road Comprehensive Plan Amendment | 9

By meeting the overall intent of the Comprehensive Plan and by implementing the above
described activities, the amendment is consistent with the Core Principles of the
Comprehensive Plan as a strategically planned residential development that carefully
considers Maricopa County priorities, responsible growth, and past decisions.
Additionally, the amendment is consistent with the overall intent of the White Tank Grand
Avenue Area Plan (“WTGA Plan”), which envisions the Northwest Valley “as a place that
enjoys a high quality of life and encourages planned community developments…”, and as
a “community that provides its residents with the opportunity to work, live, and play” (page
3, WTGA Plan). This proposed amendment will result in the development of a high quality
planned residential community that is highly accessible to nearby commercial uses such as
retail, restaurants, entertainment and employment. The planned residential community’s
nearness to such uses is desirable to homeowners and promotes a high quality of life for
residents by offering the opportunity to work and play close to home, therefore meeting
the vision of the WTGA Plan.
The amendment is also consistent with the WTGA Plan’s purpose and concepts for citizen
engagement, as described on page 4 of the Plan. Specifically, the amendment proposes to
amend the approximately 51.6 acres to Single Family – Transitional Lot (3-5 du/ac), a more
compatible land use to the existing surrounding land uses that are primarily residential or
planned as residential. Further, the amendment is intended to facilitate the development of
a planned residential community that utilizes sound planning techniques to produce a
functional, efficient, and pleasant development where residents can live in high quality new
homes conveniently located near the Loop 303 and future Deer Valley Road extension.
This will allow residents easy access to employment, retail, entertainment, and other
commercial areas thereby improving their physical, social and economic quality of life.
D. The extent to which the amendment is consistent with the specific goals
and policies contained within the plan.
This proposal seeks to amend the White Tank/Grand Avenue Area Plan and is both
consistent and compliant with its specific goals, policies, and objectives. The Area Plan
contains four Plan Elements, each of which describes the plan’s goals, objectives, and
policies in detail. Each of the elements is listed below, and an explanation of how this
proposal is consistent with it follows.
Land Use Element
Goal L1: Promote efficient land development that is compatible with adjacent land uses,
is well integrated with the transportation system, and is sensitive to the natural
environment.
The proposal promotes efficient land development that is compatible with adjacent land
uses and is well integrated with the transportation system because it is an infill site with
existing communities immediately west of it, and existing or proposed communities nearby
to its east. Its nearness to existing development allows it to integrate with nearby
ASLD – 117th Avenue and Williams Road Comprehensive Plan Amendment | 10

transportation systems while also facilitating new transportation systems in the area. The
proposal is sensitive to the natural environment as it does not propose development over
or impacting any sensitive land areas.
Objective L1.1: Encourage the timely and orderly expansion of Urban Service Area.
The proposal ties existing and proposed residential communities to its east and west
together, thereby helping to complete the residential use pattern of the area and
encouraging the timely and orderly expansion of the Urban Service Area.
Policy L1.1.2: New residential development with gross densities greater than 1.0 dwelling
unit per acre shall be located within the Urban Service Area. Maximum gross densities
will be determined based on proximity to urban services and infrastructure, and
compatibility with adjacent land uses.
The proposal is appropriate given the Site’s particular location which is in close proximity
to urban services and infrastructure. The Site is located within the Urban Service Area and
is compatible with adjacent land uses that are similarly single family residential
development.
Objective L1.2: Encourage the use of planned communities that provide a variety of land
uses, housing types, employment opportunities, and offer a safe and pleasant living and
working environment.
The proposal will result in the development of a planned residential community consisting
of three different lot sizes. It is anticipated that with the varying lot sizes, the ultimate
developer of the Site will offer a variety of housing types meeting market needs and
preferences. While the proposal itself doesn’t provide a variety of land uses, development
of the planned residential community will result in the development of a variety of land
uses in the area and in an increase of employment opportunities. As mentioned previously,
according to the National Association of Home Builders’ National Impact of Home
Building and Remodeling report the average single family home results in the creation of
2.90 jobs. Therefore, the development of this residential community which proposes 770
conceptual lots may potentially result in the creation of over 2,000 new full-time jobs. This,
together with the larger residential population caused by the development and sale of the
new homes will increase local spending, which in turn may result in new business activity
that encourages the development of office and commercial land uses in the area.
Transportation Element
Goal T1: Improve the roadway network to meet future transportation needs, promote
safety, and mitigate congestion.
The proposal improves the roadway network by utilizing existing and planned roadways,
and by bringing in new roads to the road network. The development will improve its own
internal roads and portions of external roads as required by MCDOT. This helps meet
ASLD – 117th Avenue and Williams Road Comprehensive Plan Amendment | 11

future transportation needs, promote safety, and mitigate congestion by providing
additional transportation options for commuters.
Objective T1.1: Determine the preferred location of new roadway connections and
extensions for the next 20 years.
The Pinnacle Peak Road alignment is set to be extended through the Site, and the Site will
be bisected by the future Deer Valley Road extension. The proposed development utilizes
these new roadway connections and extensions which were contemplated as part of long
term roadway planning, thereby helping to determine the preferred location of new
roadway connections and extensions into the future.
Policy T1.1.1: Preserve necessary rights of way to maintain and extend the grid system in
response to future development.
The proposal preserves necessary rights of way to maintain and extend the grid system in
response to future development.
Objective T1.4: Encourage the coordinated and timely development of new roadways.
As discussed previously, the Site is bisected by extensions of the Pinnacle Peak Road and
Deer Valley Road alignments, which are planned roadways thoughtfully integrated into the
proposal.
Policy T1.4.1: Recommend standard or compatible roadway cross-sections for application
by jurisdictions through the planning area.
The proposed development considers existing roadway standards and will meet Maricopa
County roadway requirements in order to ensure compatibility.
Policy T1.4.2: Ensure that alignments and cross-sections of major roadways in new master
planned communities are consistent with those adopted by the appropriate jurisdiction.
The proposed development ensures that alignments and cross-sections of major roadways
are consistent with those adopted by Maricopa County.
Policy T1.4.3: Review minimum street standards and subdivision requirements to ensure
adequate access for emergency vehicles.
The minimum street standards and subdivision requirements necessary to ensure adequate
access for emergency vehicles are considered with this proposal and will be incorporated
with the development.
ASLD – 117th Avenue and Williams Road Comprehensive Plan Amendment | 12

Environment Element
Goal E1: Promote development that considers adverse environmental impacts on the
natural and cultural environment, preserves highly valued open space, and remediates
areas contaminated with hazardous materials.
The proposal considers adverse environmental impacts as it proposes to develop land that
is in the vicinity of existing development on all sides. As discussed previously, the proposal
is sensitive to the natural environment and preserves highly valued open space, with at least
15% of the gross area being open space appropriately dispersed throughout the boundaries
of the Site, which may consist of retention, drainage areas, or passive and active
recreational spaces. Additionally, the proposed single family residential use is lower impact
than industrial or commercial uses on water resources. There are no known hazardous
materials existing on the Site.
Objective E1.1: Encourage developments that successfully coexist and are compatible with
significant natural features.
There are no sensitive land uses on the Site, however the Site is near the Agua Fria River.
The proposal does not impact the Agua Fria River or any floodplains as they do not exist
on the Site. Therefore, the proposed development successfully coexists and is compatible
with the natural environment.
The Site is adjacent to a largely inactive sand and gravel mining site to the east. There will
be no cross access between the proposed residential and industrial park use, and any
necessary buffering features will be provided to ensure the uses can coexist without any
issues. It is anticipated that the uses will be fully compatible.
Policy E1.1.2: Encourage land uses and development designs that are compatible with
environmentally sensitive areas such as floodplains, hillsides, wildlife habitat, scenic
areas, and unstable geologic and soil conditions.
There do not appear to be any sensitive areas existing on the Site, nor does the proposal
appear to intrude on any environmentally sensitive areas that may be in the nearby vicinity,
such as floodplains and the Agua Fria River to the east.
Policy E1.1.3: Discourage small lot residential and commercial development on land with
hillside slopes of 10% or greater.
The site does not experience a hillside slope of 10% or greater and is appropriate for Single
Family – Transitional Lot (3-5 du/ac) development.
Policy E1.1.5: Control land use and development within the 100-year floodplain to
minimize the threat to life and property.
ASLD – 117th Avenue and Williams Road Comprehensive Plan Amendment | 13

The Site does not fall within the 100-year floodplain and the proposal is compatible with
nearby sensitive areas.
Economic Development Element
Goal ED1: Promote a growing, balanced, efficient, and diversified economy, consistent
with available resources, that enhances quality employment opportunities, improves
quality of life, and is sensitive to the natural and cultural environment.
As discussed previously, the proposal may result in potentially 770 new home sites for the
community. Many of the new families residing in these homes will work in the area and
shop at nearby businesses. This will promote and support the local economy as additional
residential provides a need for new commercial within a reasonable distance of the Site to
accommodate the larger population. This promotes job growth and enhances quality
employment opportunities which in turn improves quality of life for individuals.
Additionally, the proposed development will bring substantial employment opportunities
associated with site planning, engineering, construction and sales associated with the
project.
Objective ED1.1: Expand quality employment opportunities by supporting efforts that
encourage business formation and expansion.
The proposal will bring new residents to the area which in turn will help foster new business
opportunities to meet the demands of the soon to be larger population. This will expand
quality employment opportunities.

ASLD - 117th Avenue and Williams Road Zone Change | 3

I. Introduction
A. Background
The subject property is State Trust land under management of the Arizona State Land
Drive alignment, which will be completed by 2021, will bring accessibility to this property
and allow for growth. The Deer Valley extension has already influenced the rezoning of
land immediately adjacent to the east of the subject property for a planned residential
community called Rose Estates. Now that this property is located between residential
communities of similar densities, and the subject property itself will be bisected by the
future Deer Valley Road extension, it should transition to a type of development more
compatible with the growing surrounding area.
B. Purpose of Request
Rose Law Group, on behalf of the Owner, proposes a zone change on approximately 198.6
acres from Rural-43 (RU-43) to Single Family Residential – 6,000 Square Feet Per
Dwelling Unit (R1-6) with a Residential Unit Plan of Development (RUPD) overlay. This
is being requested in order to create a 198.6 gross acre single family residential community
with comparable density and product sizes as found in the general vicinity. A General
Comprehensive Plan Amendment is being requested concurrently with this zone change
application.
The proposed community is envisioned to include up to 770 lots and an overall gross
density of 3.9 du/ac, with common passive and active open space. The project site
highlights its proximity to neighboring and future communities by placing circulation
routes and homesites accordingly. Additionally, with the extension of Deer Valley Road
and the associated bridge improvements, vehicular and pedestrian connections to the east
and west are anticipated.
II. Site Analysis
A. Property Location
The subject property is approximately 198.6 acres within unincorporated Maricopa
County, and is located just east of the W. Pinnacle Peak Rd. and N. 117th Ave intersection
(the “Site”). The Site is rectangular in shape and experiences approximately 6,615 feet of
frontage along N. 117th Ave. to its west, and approximately 6,615 feet along the N. 115th
Ave. alignment to its east. Approximately 4,160 feet to the east of the Site lies the City of
Peoria jurisdictional boundary and further to the west is Sun City and the City of Surprise
city limits. The Site is approximately 3,470 feet south of the Happy Valley 303 interchange
and will be intersected by the future Deer Valley Road extension. A legal description is
provided.
B. Existing Conditions
The Site is vacant and undeveloped, bordered by the Crossriver single-family residential
neighborhood to the west, and vacant undeveloped property and a sand and gravel mining
site to the east. The property east of the Site was recently approved for a Comprehensive
ASLD - 117th Avenue and Williams Road Zone Change | 4

Plan Amendment (#CPA2019013) and a zone change (#Z2019112) for a planned
residential community called Rose Estates.
The Site falls within the Maricopa County White Tank/Grand Avenue Area Plan and is
designated “Small Lot Residential (2-5 du/ac)” and “Mixed Use Employment” land use
designations. A General Comprehensive Plan Amendment of the Mixed Use Employment
area to “Single Family – Transitional Lot (3-5 du/ac)” is proposed with this application.
III. Description of Proposal
A rezoning is being proposed to entitle the Site to allow for a planned residential community
development. The proposed community utilizes an underlying “Single Family Residential – 6,000
Square Feet Per Dwelling Unit” (R1-6) zoning and proposes an RUPD overlay to accomplish
flexible development standards. These development standard variations are outlined in Table 1 –
R1-6 Development Standards Comparison herein.
The Site’s land use plan is divided into 7 parcels and will include up to 770 lots. A minimum lot
size of 45x115 is being proposed with 60x125 lots being the largest proposed size. This results in
a total maximum proposed density of 3.9 gross dwelling unit per acre on the subject 198.6 gross
acre Site, which falls within the density provided in the Site’s Small Lot Residential (2-5 du/ac)
and proposed Single Family – Transitional Lot (3-5 du/ac) Comprehensive Plan designations. The
lot sizes may vary but will be developed in accordance with the underlying RUPD development
standards.
Homesites respond to passive open spaces throughout the project area creating visual corridors.
Sensitivity to future adjacent uses are planned through drainage channels provided along the
perimeter of the property, which envisions future landscaped tracts. See Exhibit B – Conceptual
Land Use Plan for the proposed land use plan.
Primary access for the majority of the Site (Parcels A-F) is proposed from Pinnacle Peak Road
while secondary access is gained through N. 117th Ave. Parcel G will obtain access from the future
Deer Valley Road extension which is planned to be completed in 2021 and incorporates right-in
right-out access for Parcel G. The primary entry includes monumentation signage, as well as
dramatic views of the Agua Fria River to the east. Local Public Streets stem from N. 117th Ave.,
and are proposed as 50’ right of ways. Street sections include attached 5’ foot sidewalks
throughout. Residential parking spaces will meet the requirements of two spaces per unit as
outlined in Chapter 11 of the Maricopa County Zoning Ordinance.
The proposed development will provide a minimum of 15% open space appropriately dispersed
throughout the boundaries of the subdivision which may consist of retention, drainage areas,
passive and active recreational spaces. A centralized park is depicted adjacent to Parcel C which
equates to approximately 3.9 acres or 1.9% of the gross project area. Drainage channels account
for an additional open space of 3.2 acres or approximately 1.6% of the gross area. Since there is no
plan of development proposed with this zone change application, specific open space areas are not
yet indicated. Open space not shown on Exhibit B – Conceptual Land Use Plan will be provided
as part of the design and platting of the Site, and will result in a total open space equal to at least
15% of the gross area, generally distributed between subdivision and community open space.
Future proposed internal pedestrian paths connect to the future 5’ sidewalk along Deer Valley Road
where possible, thereby providing multi-modal access to larger County and Peoria communities.
ASLD - 117th Avenue and Williams Road Zone Change | 5

This proposed community stands to complete the land use connection between the Crossriver and
Deer Valley Ranch communities. These networks will support the community and ultimately
contribute to the livability of the area.
A. Development Standards Comparison
The development standard variations described in Table 1: R1-6 Development Standards Comparison are
proposed and will facilitate the development of the planned residential community. Specifically, the
minimum Front Yard setback is proposed to be reduced from 20’ to 10’, the Rear Yard setback from 25’ to
15’, and the Lot Width from 60’ to 45’. These setback reductions are in line with changing market demands
and homeowner preferences that don’t want to be burdened by large maintenance responsibilities.
Additionally, the minimum Lot Area is proposed to be reduced from 6,000 sq ft to 5,175 sq ft, and the
maximum Lot Coverage is proposed to be increased from 50% to 55%. This, similarly, will allow smaller
lot sizes requiring lesser maintenance expense for homeowners, while also maximizing home size on the
particular lot. Smaller lot sizes also allows for more economical housing options, thereby improving
housing affordability for new homeowners.

IV. Relationship to Surrounding Properties
Given the Site’s current and longstanding vacant status, the proposed development is envisioned to
positively impact the surrounding area as it will bring much needed housing to an established
suburban area. With up to 770 new homes at full build out, at an average of 2.75 persons per
household (according to the U.S. Census for Maricopa County), we estimate that the planned
residential community will bring approximately 2,117 new residents to the area, which in turn may
bring approximately 1,155 individuals to the area’s employee base (estimated 1.5 employees per
residence). For nearby commercial and other non-residential, the proposed development will
ASLD - 117th Avenue and Williams Road Zone Change | 6

provide an increase in customers and potential employees, thereby increasing economic
opportunities and supporting existing and new businesses. It is likely that some of the new
employee base residing in the proposed community will find employment in the nearby surrounding
area. Additionally, the proposed development will bring various employment opportunities
associated with site planning, engineering, construction and sales associated with the project.
Overall, development of the proposed community will result in an improvement to the area’s
economic vitality.
Adjacent property to the north of the Site is State Trust Land and is similarly vacant and
undeveloped land. Land immediately south of the Site appears to be an aggregate materials site.
Immediately to the west are the Crossriver and Dos Rios residential communities, and to the east
is the proposed Rose Estates planned residential community. Properties in the near vicinity of the
Site, located within one mile generally east and west, are also single-family residential communities
similar to that which is being proposed. Since surrounding land uses are primarily residential, the
proposed R1-6 RUPD district is consistent with existing land use patterns and is suitable for the
area. Table 2: On Site and Surrounding Uses, Comprehensive Plan and Zoning Designations
below provides a summary of existing and surrounding land uses.
The proposed development is further supported by the recent design and funding of the Deer Valley
Road extension, which has been recognized as a new east-west corridor needed to serve existing
and future development of the area. This extension includes the construction of Deer Valley Road
from its current condition at 109th Avenue northwest to the current condition of Williams Drive.
This design includes; an all-weather bridged crossing over the Agua Fria River, five lanes in total
(two in each direction with a continuous left turn lane), bike lanes, sidewalks, and landscaping.

V. Location & Accessibility
The Site is conveniently located approximately 3,470 feet south of the Happy Valley/303
interchange, making it highly accessible to both local and regional traffic. A portion of the Site has
frontage along the future Deer Valley Road extension which will build a connection between the
east end of Williams Drive at 117th Avenue to the west end of Deer Valley Road at 19th Avenue,
ultimately providing an east-west corridor between 107th Ave. and El Mirage Rd. This construction
is highly beneficial to the Site and the surrounding area, as it will provide alternative access routes
and alleviate congestion between Sun City West and Peoria. As previously mentioned, Pinnacle
ASLD - 117th Avenue and Williams Road Zone Change | 7

Peak Road will be the primary access point for the majority of the community, while N. 117th Ave.
will be utilized for secondary access. The future West Pinnacle Peak Road between N. 117th Ave
and the Rose Estates community is currently the subject of a Right-of-Way application with the
Arizona State Land Department. The right-of-way is expected to be sold at auction in October
where the applicant of that application intends to purchase it and subsequently construct the right-
of-way to create an access road to Rose Estates. Portions of the Site will also take access from the
future West Pinnacle Peak Road extension. Parcel G will obtain access from the future Deer Valley
Road extension via a right-in, right-out driveway which will be the only direct access to the future
Deer Valley Road for the Site. Secondary access for Parcel G will be obtained from N. 117th Ave.
VI. Circulation System (On & Off-Site)
As previously mentioned, off-site circulation will take access from W. Pinnacle Peak Rd. and Deer
Valley Road. Additionally, N. 117th Ave. will serve secondary access purposes for the majority of
the Site. Table 3: Roadway Analysis below outlines; affected roads, the classification, the current
condition, and any improvements that are necessary as a result of this proposal. All necessary
improvements will be at the cost of the developer, unless otherwise stated.

VII. Development Schedule
The Arizona State Land Department operates differently than private property owners when it
comes to planning and the entitlement of land. As State Trust Land, development phasing of the
Site will begin following the ASLD’s disposition of the land. The ASLD is mandated by the State
Constitution, Enabling Act and State Statute to maximize revenue to the Trust’s Beneficiaries, and
as such, realizes greater value when land is sold with a level of entitlement that assures the buyer
of allowable land uses. Since the ASLD is not the ultimate developer or end user of the property,
detailed site planning is best achieved after the land has been acquired by the developer. Through
this initial entitlement phase, the ultimate purchaser and the local community has assurances of
ASLD - 117th Avenue and Williams Road Zone Change | 8

allowable land uses. After disposition, the developer must proceed with site planning according to
the County’s established site plan review processes.
The Site will be prepared for disposition by public auction following Board determination of this
request. Prior to holding the auction, the ASLD must advertise the sale of the Site for ten
consecutive weeks. The sale will then be awarded at the public auction to the highest bidder. After
disposition, the final site planning will take place, and the Site will need to be patented before any
development could occur. It is anticipated that the earliest disposition would occur no less than four
months after Board determination.
Conceptual development parcels have been visually identified on Exhibit B – Conceptual Land
Use Plan. The site data table from the Conceptual Land Use Plan has been provided below in
Table 4: Site Data Table. All parcel lines, lot sizes, and total number of dwelling units (not to
exceed 770 units and a density of 3.9 du/ac) and their associated improvements are conceptual and
subject to change.

VIII. Community Facilities & Services
The Site is within the Peoria Unified School District boundary and specifically designates Zuni
Hills Elementary and Liberty High School as the applicable schools. Nearby public parks include
Alta Vista Park located about one mile east of the site. The proposed development will also offer
both passive and active recreational areas. Sun City West, Lake Pleasant Towner Center and
Camino a Lago Marketplace are all within close proximity of the site and offer commercial
resources.
IX. Public Utilities & Services
The Site will have access to necessary public utilities and services such as refuse, sewer, water,
electric, police and fire. The following utility companies will provide services to the proposed
community:
- Water - EPCOR Water
- Sewer - EPCOR Water
- Refuse – Private Company
- Electric – Arizona Public Service
- Police – Maricopa County Sheriff’s Office
- Fire – Arizona Fire and Medical Authority
A summary of existing and proposed water, sewer and draining conditions is provided below.
ASLD - 117th Avenue and Williams Road Zone Change | 9

A. Water
The Site is located within EPCOR’s Northeast Agua Fria water service area and is State
Trust Land, managed by the Arizona State Land Department (ASLD). Water is provided
from Agua Fria Water Plant 7, which is located to the southwest of the intersection of El
Mirage Road and Loop 303/Bob Stump Memorial Highway. The project site generally
slopes to the southeast, with the Site’s highest point in the northwest corner (~1,266-ft) and
the lowest point in the southeast corner (~1,216-ft).
Existing water infrastructure includes a 16-inch main that runs east/west along Pinnacle
Peak Road, extending east until it intersects 117th Avenue. Additionally, a 12-inch water
main runs east/west along Williams Road, extending east until it reaches 117th Avenue. A
16-inch water main runs north/south along 117th Avenue, bordering the western frontage
of the Site. This water main extends to the north before capping off just south of Happy
Valley Parkway. The 16-inch main is reduced to a 12-inch main to the south of Pinnacle
Peak Road, where it eventually intersects with the 12-inch main in Williams Road. The
12-inch main continues to the east along Williams Road. The water mains in 117th Avenue,
Pinnacle Peak Road, and Williams Road have an invert depth of approximately 5-ft below
grade.
A planned improvement includes the Deer Valley Road Alignment, which extends
Williams Road to the southeast to connect to the existing Deer Valley Road. Potential
water system improvements include an eastward extension to the 16-inch water main in
Pinnacle Peak Road, or an extension to the 12-inch main in Williams Road along the future
Deer Valley Road Alignment. Both of these potential options could bring service to both
the Site and the adjacent Rose Estates Property, which is located directly to the east of the
Project. See Exhibit C – Water Narrative Exhibit.
B. Sewer
Existing wastewater infrastructure includes a 10-inch sewer main that runs north/south
along 117th Avenue. This 10-inch main collects wastewater from a commercial building,
to the south of Happy Valley Parkway. As the 10-inch main extends south along 117th
Avenue, it transitions into a 12-inch main to the south of the Dos Rios subdivision. Once
the 12-inch main extends to the south of Pinnacle Peak Road, it transitions into a 15-inch
main. The 15-inch main along 117th Avenue provides wastewater services from the
adjacent Crossriver development to the west. The 15-inch main extends to the south until
it reaches Williams Road, where it then extends to the west to the intersection of 119th
Avenue and Williams Road. Additionally, a 10-inch sewer main extends to the east from
123rd Avenue along Williams Road until it reaches 119th Avenue. From Williams Road, a
15-inch sewer main extends to the south along 119th Avenue. This sewer main is increased
in size from a 15-inch main to an 18-inch main near the southeast cul-de-sac in Crossriver
Unit II. From that point, the 18-inch sewer main extends to the south along 119th Avenue
toward an existing lift station, picking up wastewater from the Rio Sierra subdivision to
the east along the way. Wastewater is then conveyed to the south along 119th Avenue, then
to the east along Rose Garden Lane. Finally, the wastewater is conveyed to the south to
the EPCOR wastewater treatment plant. Discussions with EPCOR indicated that there are
no concerns with capacity within the existing sewer mains at this time.
ASLD - 117th Avenue and Williams Road Zone Change | 10

The existing lift station (Northeast Agua Fria Lift Station #1) is located at the northwest
corner of Lone Cactus Drive and 119th Avenue. The lift station also collects wastewater
from developments to the west. According to EPCOR, the Northeast Agua Fria Lift Station
#1 is not expected to be near capacity at this time and should be able to manage additional
flows. However, capacity and potential impact of expected build-out flows shall be fully
examined prior to design.
Generally, the Project’s nearby existing sewer infrastructure conveys wastewater to the
southwest, relative to the Site. However, the project site slopes to the southeast, with some
portions of land having an elevation lower than the sewer inverts along 117th Avenue.
Therefore, a potential option would be to route sewer flows underneath/through the
Crossriver Unit II subdivision to the south of Williams Road. The invert elevation at the
manhole in the 18-inch sewer main in 119th Avenue (at the southwest corner of Crossriver
Unit II) is 1,212.90-ft. The lowest existing ground elevation on the Site is approximately
1,216-ft at the southeast corner. When taking the adjacent Rose Estates Property into
consideration, the lowest existing ground elevation is approximately 1,200-ft at the
southeast corner. Therefore, it may be difficult to convey wastewater from the Site’s east
side and Rose Estates Property to the existing sewer main. For this reason, an additional
lift station may be required on Williams Road or 119th Avenue.
There is a significant drop in elevation approximately halfway across the project site, going
from west to east. When considering the Site alone, it may be possible to convey
wastewater from the Site’s parcels to the north of Williams Road to the sewer main along
117th Avenue. The invert of the existing 15-inch main at the intersection of 117th Avenue
and Williams Road is 1225.74-ft. In addition, it may be possible to convey some of the
wastewater from the Site’s parcels to the north of Pinnacle Peak Road to the invert in 117th
Avenue and Pinnacle Peak Road, with an invert elevation of 1,240.86-ft.
The existing ground elevation of the Site’s southeast corner to the north of Williams
Road/Deer Valley Road alignment is approximately 1,232-ft. However, the lowest existing
ground elevation of the Site (to the north of Williams Road) is located approximately 400-
ft north of the proposed Williams Road/Deer Valley Road alignment, near the northeast
corner of proposed Parcel F on the eastern border of the Site, with an elevation of
approximately 1,227-ft. Therefore, some flow from the Site’s eastern portions in Parcel F
above Williams Road may need to be routed to the south below Crossriver Unit II, or to a
proposed lift station.
The Site’s Parcel G to the south of Williams Road and portions of Rose Estates Property
may be able to tie into the existing main on 119th Avenue below Crossriver Unit II, but
existing elevations in the Rose Estates Property may make conveyance from southeastern
portions of the site difficult. If a lift station is deemed necessary with further analysis, the
lift station shall serve as much flow as possible from the Site and adjacent Rose Estates
Property.
Existing and future conditions have been modeled with SewerCAD. Model results can be
seen in the corresponding 117th & Williams Road Wastewater Constraints Analysis Exhibit
summary, attached as Exhibit D – Wastewater Constraints. Please note that projected
ASLD - 117th Avenue and Williams Road Zone Change | 11

flows from the Site and the adjacent Rose Estates Property are included in the model at the
manhole at the intersection of Pinnacle Peak Road and 117th Avenue for more conservative
results.
C. Drainage
The area surrounding the Site generally slopes to the southeast at approximately 0.8
percent. The Site is impacted by local offsite stormwater runoff approaching the Site from
the north, generated by undeveloped desert between Hatfield Road and Loop 303. The
western boundary of the site is formed by the Dos Rio and Crossriver subdivisions, which
retain the respective runoff onsite. The eastern boundary of the site is formed by a sand and
gravel operation and undeveloped desert which do not impact the Site. The Site currently
consists of undeveloped desert which ultimately drains to the Agua Fria River located east
of the Site. According to the effective FEMA Flood Insurance Rate Map (FIRM)
04013C1235L, revised October 16, 2013, the Site is entirely located within Zone X. FEMA
defines Zone X as areas of 0.2% annual chance flood; areas of 1% annual chance flood
with average depths of less than 1 foot or with drainage areas less than 1 square mile; and
areas protected by levees from 1% annual chance flood. It should be noted that a
Conditional Letter of Map Revision (CLOMR) was prepared and subsequently approved
to document a proposed revision to the effective floodplain and floodway in the vicinity of
the Site. The revisions are based on the proposed construction of Deer Valley Road across
the Agua Fria River, which passes through the Site between Parcel F and Parcel G. The
limits of the revised floodplain extend closer to the Site, however, do not impact the site.
The effective and proposed floodplain and floodway limits are illustrated in the Conceptual
Drainage Exhibit, attached as Exhibit E – Conceptual Drainage Exhibit.
The proposed drainage improvements associated with the construction of Deer Valley
Road include a dual 36”x22” concrete arch culvert to manage flows generated by the
proposed development under existing conditions. A series of channels and retention basins
are proposed along the north side of Deer Valley Road, and a storm drain network is
proposed at the intersection of Williams Drive, 117th Avenue and Deer Valley Road,
discharging to an earthen channel at the northeast corner of the intersection.
As part of Site improvements, a drainage channel is proposed to collect offsite flows along
the northern boundary of the Site. The channel will drain to the northeast corner of the Site
and continue south along the eastern boundary of the Site, discharging near the northeast
corner of Parcel C, ultimately draining to the Agua Fria River, consistent with existing
drainage conditions. For onsite management, the requisite retention will be provided
throughout the Site in accordance with current Maricopa County design guidelines. Given
the Site’s proximity to the Agua Fria River, a reduced retention requirement may be
pursued with the project’s development. Since the Site will be designed with appropriate
offsite and onsite drainage controls and stormwater retention, and the historic outfall will
be maintained, no adverse impact to downstream properties or infrastructure is expected as
a result of development.

(E2 Memo – rev2)
Job Site Address: ASLD 117th Ave & Williams Rd.
APN(s): N/A – State Trust Land
This application is to specify zoning for future development and does not include a
Plan of Development.
PND Engineering Plan Review (DPR, FCD and PND Transportation) has reviewed the
2nd submittal of the Zone Change application routed for review on May 05, 2021, and
has no objections provided that the following conditions are made part of any approval:
The following conditions will apply as part of any approval:
1. Without the submittal of a precise plan of development, no development approval
is inferred by this review, including, but not limited to number of proposed
building lots/units, drainage design, access and roadway alignments. These items
will be addressed as development plans progress and are submitted to the County
for further review and/or entitlement.
2. A traffic impact study (TIS) must be submitted with future entitlement
(preliminary plat or POD) application(s) as is required by MCDOT. The TIS must
also be submitted to the City of Surprise for their review.
3. Any approval and progression in the entitlement process may be contingent on the
progression of MCDOT TIP TT0248 which includes extension of Williams Drive
across the Agua Fria River to Deer Valley Road which extends through the site.
4. The only access that will be allowed for the Williams Drive/Deer Valley Road

alignment will be at one location along Parcel G as a right-in right-out. A second
access point for Parcel G will be needed along the 117th Avenue alignment.
5. Future right-of-way dedications, offsite improvements, and any additional right-
of-way needed shall be addressed by future entitlement (preliminary plat or POD)
application(s) and submittal of a traffic impact study (TIS)”.
6. R/W dedication (130 feet)) along the development site’s portion of Pinnacle Peak
Road will be required as part of any future entitlement application(s), unless
otherwise determined by MCDOT Planning.
7. Engineering review of re-zone cases is conceptual in nature. All development and
engineering design shall be in conformance with Section 1205 of the Maricopa
County Zoning Ordinance; Drainage Policies and Standards; Floodplain
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current
engineering policies, standards and best practices at the time of application for
construction.

Good morning Martin,
The attached is the concept plan for the site for the zone change companion case which is
Z2021001. You may access the other relevant documents to the case using the notification link I
previously sent below and case numbers CPA2021001 and Z2021001. The County does not require a
TIA until the time of preliminary platting as the site is conceptual until it moves to the plat stage. We

can add a condition in the conditions of approval requiring the applicant to forward a TIA to Surprise
for comment at the time of preliminary platting.
Regarding your request that at minimum that the entirety of the Williams Deer Valley Road Project
be completed, I think you should probably speak to the engineer on the case, Doug Jones, and
MCDOT’s Senior Planner, Lynndsay O’Neill about what the plans are related to Williams and how it
will interact with the proposed site. I have copied them on this e-mail.
Thanks. Please let me know if you have any questions.

Adam,
Can you please provide the TIA, and site plan for this case. I am the Transportation Planning
Manager for the City of Surprise and am trying to evaluate the transportation impacts for this
project.
As you are aware this area currently relies on the intersections of El Mirage and Bell Road and 117th
and Happy Valley to access the region; both of which are at or nearing capacity.
If there isn’t any transportation documents associated with this project the City would request that
at a minimum the Williams Deer Valley Road Project be completed as outlined in the County’s DCR.
Once the additional documents are provide we can provide a more detailed transportation
response.

Hi Chris,
There were 10 people including I believe 3 from the applicant. They may be holding another meeting. The
concerns were primarily use of amenities (parks) and traffic.
You can watch the video here: https://www.youtube.com/watch?v=jms1zU9DL_0&feature=youtu.be
See attached for their conceptual plan. Also, I have attached some preliminary comments (our staff meeting

Hi Adam-
I hope you are doing well. Say, I have a Councilmember that was inquiring about this CMPA and Rezone. A
couple of questions:
• What was the attendance like at the 2/11/21 virtual open house?
• Do you have a Conceptual Development Plan you can email me? – I didn’t see it through the link
