is imperative that the County provide funds to ensure the Network remains solvent. The County will utilize

partners through a grant making process to meet increased demand due and ensure public health protections
due to COVID-19. Of the funding, $90,000 is for AFBN's administration of the grant-making process.
COMPETITION IMPRACTICABLE CATEGORY (Check applicable box, attach documentation or provide explanation below.)
Maricopa County Procurement Code MC1-351 states: “Competition Impracticable” means an acquisition where, competition is
impractical because of standardization, warranty, or other factors as approved by the Board of Supervisors.
NOTE: The following are unlikely to be sufficient Competition Impracticable justifications:
• Personal or department preference for a product or vendor

• Lack of department planning resulting in limited time to conduct a competitive procurement
• Special incentive or deal offered (can be assessed in open and competitive solicitation)

THIS IS A COMPETITION IMPRACTICABLE PROCUREMENT BECAUSE (attach additional page if needed):
The Arizona Food Bank Network (AFBN) consists of 5 large food banks, including three in
Maricopa County, and nearly 1,000 agency partners that distribute food to individuals/households
in need. AFBN has the expertise to determine which food bank agencies are qualified to receive
funds that are critical to support increased demand, increased staffing needs, delivery, increased
refrigeration and cooling capacity, mobile and drive-thru distributions, and increased storage
capacity as a result of COVID-19 pandemic and its economic impacts. AFBN will review
applications, administer grants, and distribute $2,010,000 on behalf of the County to agencies
who meet qualifications including, handling food safely, equitable food distribution, and ensuring
the food will not be sold or exchanged for goods and services. Further, as part of this contract the
County would oversee the awarding process to ensure appropriate distribution of monies.

the proposed contractor.
AFBN has established food banks and partner agencies that provide critical services. AFBN
has the specialized expertise to evaluate and administer grants to these food banks and partner
agencies.
PRICE
MC1-352-B states: The Using Agency requesting a Competition Impracticable Procurement shall provide written evidence
to support a Competition Impracticable determination containing an explanation of why the proposed procurement
process is advantageous to the County; and the scope, duration, and estimated total dollar value of the procurement.
Price has been fairly and reasonably established by: Comparison to public sector contract pricing
Comparison to previous comparable purchases Discount off published catalog pricing
from a different vendor Market survey
Independent estimate Other, explain:
Describe methodology and results (attach any written supporting data, e.g., survey or market analysis):
Staff compared cost estimates from the contractor to a previous contract with the Arizona Food
Bank Network for similar food assistance services and found the costs were comparable
reasonable. Additional review of the contractor's prior performance indicated the contractor
used funds in a reasonable and cost effective manner.
$90,000 is for AFBN to administer the grants and projects. This is 4% of the funds that AFBN
will be administering on behalf of the County ($2,010,000). This is less than the 10% of
administrative costs typically deemed reasonable through federal Uniform Guidance.
