AMENDMENT No. 2 TO FACILITY USE AGREEMENT
RECITALS
A. Chandler Unified School District No. 80, a political subdivision of the State of Arizona
(“District”) and Maricopa County, a political subdivision of the State of Arizona (“User”),
(collectively, “Parties”), are parties to that certain Agreement P-50255 dated May 2, 2017
and subsequently amended on June 26, 2018 (collectively, “Agreement”) for use of a
portion Chandler CARE Center located at 777 E. Galveston Street, Chandler, AZ 85225
(the “Facility”).
B. The term of the Agreement expires June 30, 2021.
C. The Parties now mutually desire to enter into this Amendment No. 2 (“Amendment’) to
amend the Agreement to extend the Agreement term at no cost to the User.
AGREEMENT
NOW THEREFORE, in consideration of the foregoing and other good and valuable
consideration, the receipt and sufficiency of which are hereby acknowledged, District and
User agree to amend the Agreement as follows:
1. The Recitals are incorporated herein by this reference.
2. Capitalized terms used in this Amendment without definition shall have the meanings
assigned to such terms in the Agreement, unless the context expressly requires otherwise.
3. The Agreement term is hereby extended three (3) years, to commence on July 1, 2021 and
expire on June 30, 2024. This Agreement, as amended, is subject to termination pursuant
to the provisions of A.R.S. §38-511.
4. The foregoing paragraphs contain all the changes made by this Amendment. All other
terms and conditions of the Agreement and subsequent amendments thereto will remain
the same and in full force and effect.
