RESOLUTION ROAD FILE A645-R C-64-19-201-M-02 RESOLUTION ROAD ALTERED (ROAD FILE NO. A645-R) C-64-19-201-M-02 WHEREAS, on the 31st day of July 2019, the Board adopted a resolution, designated Road file A645 (C- 64-19-201-M-01), recorded in instrument 2019-0609113, declaring certain parcels along Lindsay Road and Germann Road into the County Highway system; and WHEREAS, it has been determined that Road File A645 as adopted and recorded, contained errors and should be altered to correct the errors and to update certain legal descriptions and exhibits, and WHEREAS, pursuant to A.R.S. §28-6701(A), the County is authorized to establish, alter or abandon a highway in the County; and WHEREAS, pursuant to A.R.S. § 28-6701(B), the County Engineer has filed with the Board of Supervisors of Maricopa County, Arizona, a petition praying the Board to alter Road File No. A645 (C-64-19-201-M-01) with Road File No. A645-R to correct errors and update certain legal descriptions and exhibits. Legal description and map for Road File No. A645-R, identified as Exhibits “A” and “B” are attached. Legal descriptions and exhibits referenced in Exhibits “A” and “B”, identified as exhibits (A1, B1), (A2, B2), (A3, B3), (A4-1, B4-1), (A4-2, B4-2) and (A5, B5) are attached; and WHEREAS, the day and hour set by the Board for a public hearing on said petition has arrived, and notice of said hearing has been given to the public by advertising once a week for two consecutive weeks in The Arizona Business Gazette pursuant to A.R.S. § 28-6702(A)(3); and WHEREAS, no objections to altering said highway have been filed; and WHEREAS, the Board believes that adopting the petition to alter Road File No. A645 with Road File No. A645-R according to the exhibits attached hereto, as prayed for in said petition, is in the best interests of Maricopa County; and BE IT RESOLVED that Road File No. A645 is hereby altered by Road File No. A645-R to correct errors and update certain legal descriptions and exhibits, as more fully set forth hereinabove, and that the County Engineer is hereby directed to make a plat or map of said highway and cause the same to be recorded in the Office of the County Recorder of Maricopa County as provided by law. BE IT FURTHER RESOLVED that the Board accept any right-of-way or property donated to the State or County for said highway. BE IT FURTHER RESOLVED that the County Engineer be directed and authorized, and she is hereby so directed and authorized, to negotiate with owners of parcels of private property required for the right-of-way of said public highway with the view of obtaining for Maricopa County said private property, subject to the ratification and approval of this Board. BE IT FURTHER RESOLVED that the County Attorney be directed and authorized, and is hereby directed and authorized, to initiate and prosecute actions and proceedings in the manner required by law to condemn all property required for right-of-way which cannot be obtained by donation or purchase.
