c. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows the
property to enjoy uses in excess of those permitted by the uses existing on the date of

February 13, 2019 meeting. (C-44-19-089-M-00)
Jen Pokorski, Director of Planning and Development, reviewed item PZ-6 and noted the
item was continued from the February 13, 2019 meeting to allow the developer to speak
with neighbors about their concerns. Traffic and density were the primary concerns.
Regarding traffic, the developer is providing left turn lanes at Maryland Avenue. The
developer must submit a traffic impact study to see if there are additional improvements
that need to be made. MCDOT is also evaluating the traffic and will be ultimately
installing traffic lights at El Mirage within the next several years. Regarding density, the
applicant made adjustments to their site by increasing size of lots that are adjacent to
existing homes. Neighbors have withdrawn opposition to this rezoning proposal which
means it no longer triggers a super majority vote. Ms. Pokorski noted Planning
Commission approval on the item and read the following proposed stipulation
amendments:
a. Development of the site shall comply be in substantial conformance with the
Narrative and Zoning Exhibits entitled “Seasons at Riverside”, consisting of 8 7
pages full-size sheets, and stamped received December 17, 2018, and the one-
page zoning exhibit entitled “Seasons at Riverside Conceptual Site Plan Option 3K
30” and dated February 7 25, 2019, except as modified by the following conditions.
b. The following R1-6 RUPD standards shall apply:
9. Lots 1-5 will be 90 foot wide and 13-17 will be single story. In an attempt to clarify
she said: All lots are 90 foot wide and limited to single story. Lot numbers are
not consecutive.
(Clerks Note: The b.9 stipulation was clarified prior to the vote)
i. The following conditions shall be the responsibilities of the
subdivider/homebuilder/developer and shall not be construed as a guarantee of
disclosure by Maricopa County:
1. The subdivider/homebuilder/developer shall provide a separate written
disclosure statement, for the signature of each buyer, acknowledging that this
subdivision is located adjacent to or nearby a mining operation that may cause
adverse noise, odors, dust, vibration and other externalities and that such uses
are legal and should be expected to continue indefinitely. The disclosure shall
be an exhibit or addendum to the “Purchase Contracts” and “CC&Rs.” The

disclosure shall be presented to prospective homebuyers on a separate, single
from for them to read and sign prior to or simultaneously with executing a
purchasing agreement. The above referenced information shall also be included
with the Subdivision Public Report to be filed with the State of Arizona
Department of Real Estate, as required by Arizona Revised Statute 28-8486
and Arizona Revised Statute 28-8464. This responsibility for notice rests with
the subdivider/homebuilder/developer and shall not be construed as an
absolute guarantee by Maricopa County for receiving such notice.
2. The Final Plat shall contain the following statement on the cover sheet in a
prominent location: “This property is adjacent to or nearby a mining operation
that may cause adverse noise, odors, dust, vibration and other externalities.
Such uses are legal and should be expected to continue indefinitely.”
Brennan Rey, representative of Richmond American Homes, thanked the neighbors for
their cooperation in the process. He reviewed the changes made since the item
continuance. He thanked the Board and Planning and Development staff for their work
on the item. Mr. Rey clarified stipulation b.9 and stated, of the 90 foot wide lots, 1-5 and
13-17 shall be limited to one story. He recommended approval with the amended
stipulations as read by Ms. Pokorski.
Chairman Gates acknowledged the following speakers:
Allison Bouns, resident, commented on what a good experience it was and thanked all
the involved parties to the satisfactory outcome resulting in an agreement. She
personally thanked Supervisor Hickman for his willingness to come out and speak with
the neighbors.
Carroll Frizon, resident, thanked Supervisor Hickman, Brennan Rey and Jose Castillo
for their assistance. He was appreciative of the continuance so the parties could work
out an agreement.
Supervisor Hickman acknowledged the cooperation of neighbors with developers. He
asked how soon the traffic lights might be installed if the Charter School were to
contribute financially. Jennifer Toth, Director of Transportation, explained the order in
which projects are completed are dependent on funding. A financial contribution to this
particular light installation project would assist in funding costs which in turn could move
forward for earlier installation.
Prior to the motion the Clerk asked for clarification on stipulation b.9. Ms. Pokorski
clarified that lots 1-5 and 13-17 with single story restriction.
Chairman Gates acknowledged the hard work that went into this process and it shows
how well the system can work when everyone is involved.
Motion to concur with Planning Commission recommendation for approval as amended
by Supervisor Hickman, seconded by Supervisor Chucri.

Applicant / Owner: MPA Architects; Simone CRE / Melvin Family Revocable Living Trust
Request: Zone Change from Rural-43 to C-1 CUPD
Site Location: Approximately 650’ north of the NEC of Jackrabbit Tr. & McDowell Rd. in the
Buckeye area
Commission Recommendation: On 1/31/19, the Commission voted 8-0 to recommend
approval of Z2018076 subject to conditions ‘a’ – ‘g’:
a. Development of the site shall be in conformance with the Narrative Report entitled
“Dollar General Z2018076 Narrative Report”, consisting of 4 pages, dated December 16,
2018, and stamped received December 26, 2018, except as modified by the following
conditions.
b. The applicant/property owner shall submit a ‘will serve’ letter for fire protection services
for the project site. A copy of the ‘will serve’ letter shall be required as part of the initial
construction permit submittal.
c. All buildings shall be subject to noise attenuation as per ARS § 28-8482(B) and
Maricopa County requirements.
d. Noncompliance with Maricopa County Regulations shall be grounds for initiating a
revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance.
e. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows the
property to enjoy uses in excess of those permitted by the zoning existing on the date of
application, subject to conditions. In the event of the failure to comply with any condition,
the property shall revert to the zoning that existed on the date of application. It is, therefore,
stipulated and agreed that r revocation due to the failure to comply with any conditions,
does not reduce any rights that existed on the date of application to use, divide, sell or
possess the property and that there would be no diminution in value of the property from
the value it held on the date of application due to such revocation of the Zone Change. The
Zone Change enhances the value of the property above its value as of the date the Zone
Change is granted and reverting to the prior zoning results in the same value of the
property as if the Zone Change had never been granted.
f. The following C-1 CUPD standards shall apply:
1. 6’ wood-slotted fencing adjacent to rural zoning district along the north and east property
lines.
g. The CUPD overlay is applied to restrict the use of the site. Until such time as the site is
served by sewer, uses on the site shall only be those acceptable to the Maricopa County
Environmental Services Department (MCESD) that can be accommodated by septic
systems. A public water system shall be required prior to establishment of any non-
residential use that requires potable water. (C-44-19-092-M-00)

Planning Commission approval on the item and there are no added stipulations.

project and noted the large donation given by Petsmart. Currently the animals are being
housed in the downtown county campus and if there were more suitable housing
elsewhere, it would free up that valuable real estate for better use. The MOU mandates
that should the project funds be depleted, the Board of Supervisors and Sheriff will

Several people turned in speaker’s slips indicating the topic was Wildlife Killing
Contests.
Marcia Olsen, representing Saguaro Precinct, declined to speak.
Tina Meredith, resident, spoke in opposition of Wildlife Killing Contest (WKC). Ms.
Meredith learned about the WKC in August 2018. These contests amount to signing up,
paying $25 for a day of killing coyote, fox, and bobcats to accumulate points to
determine a winner. She stated that pictures of the dead animals are taken and sent to
the organizer who determines the winner and sends a cash prize. When the Arizona
Game and Fish Department go to vote on a rule to ban these contests, Ms. Meredith
would like the Board to oppose this kind of senseless killing.
Linda Bolon, resident, spoke in opposition of Wildlife Killing Contest. Ms. Bolon has
been actively involved in public education concerning coyote populations for the past 15
years. Based on science, she states the lifecycle of the coyote with regards to
predation, reproduction and territory is disrupted when these contests are allowed.
Through Ms. Bolon’s research, she states the populations of coyotes are self-regulating
when left alone. She has an online petition with over 15,000 signatures asking Governor
Ducey to pass a resolution and law to prohibit these contests.
~ Supervisor Chucri left the dais ~
Doug Treadway, resident of Dewey, Arizona, spoke in opposition of Wildlife Killing
Contest. He is opposed to the senseless killing of wildlife and states these contests
have no place in a civilized society. As a hunter for 35 years, he is not against ethical
hunting but is against killing for killings sake. The wildlife that is held in public trust
needs to be treated humanely and with dignity. Mr. Treadway would like the Board to
take a bold stance against WKC.
~ Supervisor Chucri returned to dais ~
Glen Bolon, resident, spoke in opposition of Wildlife Killing Contest. Mr. Bolon spoke
about the danger to the public because these contests are held on public land. There is
an ecological necessity of predators in the wild and these contests interrupt the balance
of nature. He stated WKC have no place in a civilized society and would like the Board
to pass a resolution to ban WKC in Maricopa County.
Matt Francis, resident, spoke in opposition of Wildlife Killing Contest. Mr. Francis said
that when resolutions regarding the ban on WKC are passed by local governments, it is
a reflection of the local community. There have been resolutions passed in Tucson,
Pima County, Dewey-Humboldt, Yavapai County, and City of Flagstaff, prohibiting these
killing contests. Mr. Francis stated that with the passage of these resolutions, public
awareness is improved and support for The Arizona Game and Fish Department’s “new
rule” to ban the WKCs statewide is increased. He said that when resolutions are
passed, they are circulated to other cities and counties that may not have considered
the issue. This sharing of information has the potential to give confidence to a
municipality to draft their own resolution. Mr. Francis gave a packet of information to
each board member.

Lain Kahlstrom, resident, spoke in opposition of Wildlife Killing Contest. Ms. Kahlstrom
thanked the Board for reviewing the information she sent last month and offered to be a
resource for the Board regarding the WKC. She stated that of the many constituents the
Board has, a majority of those would be opposed to how wildlife is treated with regards
to WKC. She explained that California and Vermont have banned WKC and six other
states have pending litigation. Ms. Kahlstrom stated resolutions in other cities and
counties have been passed and explained that the Arizona Game and Fish Department
is proposing a rule to ban WKC. Ms. Kahlstrom emphasized that until the ban is passed,
it is important to keep pursuing a resolution.
Lori Girshick, resident, spoke in opposition of Wildlife Killing Contest. Ms. Girshick
explained that many people do not know what a WKC is and are shocked when they
find out. It is not considered hunting or about getting the fur or population control.
Coyote and other predators are territorial and population is typically self-regulating
based on available resources. She said protection of livestock has been a stated reason
and yet the participants get in a car and drive to a designated location for the contest.
Ms. Girshick talked about the wildlife ecosystem and the balance that exists in nature.
These WKC have a negative or opposite effect on population control.
Dr. Linda Ruehlman, resident, spoke in opposition of Wildlife Killing Contest. Dr.
Ruehlman stated that she wanted to address the psychology of animal killing. She said
there is a lot of scientific information available which links the killing of animals to
domestic violence and other antisocial behaviors. The WKC is often a family affair and
can glamorized killing for children who witness the violence toward animals. She stated
that there are many “crimes” against animals and when participants engage in a WKC,
they consider it a “contest,” not a crime. She announced that we need to join other
communities in Arizona and across the country in standing against WKC.
98. Supervisors'/County Manager's summary of current events
Resumen de temas de actualidad de los Supervisores/Administrador del Condado
Supervisor Chucri said it is helpful to hear from constituents on subjects that the Board
may not be aware of.
Supervisor Gallardo thanked the public speakers for their attendance and stated he was
not aware of the Wildlife Killing Contests. He informed the public about the Melrose
Street Fair to be held on Saturday, March 2, 2019.
Supervisor Hickman commented that this is the first he had heard about the Wildlife
Killing Contests and he intends to follow up within District 4. He informed the public that
the Sun City West Sheriff Posse has not been in service over the last 30 days. He has
been in contact with the Sheriff’s Office to get additional volunteers.
Chairman Gates thanked the Greater Phoenix Chamber for inviting him to the State of
the County meeting. He was able to talk about all the great events going on within
Maricopa County. He stated he will be attending National Association of Counties in
Washington D.C. regarding next generation 5G wireless deployment. He thanked the
Judicial staff for their volunteerism as they put on the Maricopa County Regional Mock
Trial over the weekend of March 1-3, 2019 by Arizona Foundation for Legal Services.
