Report to the Board of Supervisors Prepared by the Maricopa County Planning and Development Department Board Hearing Date: August 29, 2018 Case #/Title: Z2017115 – 26423 S. Arizona Ave. Recycling Center Supervisor District: 1 Applicant/Owner: Paul Almond, Architectural Design Group, for Anabelle Cooper Request: Special Use Permit (SUP) to allow a recycling center in the C-3 zoning district Site Location: Generally located approximately 800’ north of the northeast corner of Hunt Hwy. and Arizona Ave. in the Chandler area Site Size: Approximately 0.63 acre County Island Status: Yes (Chandler) Additional Comments: There are no outstanding issues from the reviewing agencies. There was discussion at the Commission hearing regarding potential for noise generation from machinery and visibility from the adjacent neighborhoods, particularly San Tan Vista to the east across the canal. The applicant clarified that there would be no heavy machinery and stressed that there were no public complaints about noise until the SUP public notification process. Additionally, the applicant noted the adjacent neighborhood to the east is screened from the recycling yard by a block fence. Staff notes that the block fence is in the rear yard of the developed lots in San Tan Vista across the canal is over 7 feet (h). Further, Staff erroneously stated at the Commission hearing that the canal banks east of the property are elevated. They are not, as evidenced by the attached photos. Staff noted additional zoning violations on a July 30, 2018 site visit, including plastic containers for liquid storage stacked several feet high (this is not part of metal recycling), and a mobile home stored on the site (this is not part of metal recycling unless miscellaneous non-ferrous metals as part of a heavy industrial operation). This code compliance matter will be pursued separate from the SUP. August 29, 2018 Z2017115 Page 1 of 3 The Board may wish to consider additional conditions that were not part of the Commission recommendation for approval. Such conditions may limit hours of operation and require additional screening from San Tan Vista and the Arizona Avenue frontage. Staff offers the following for consideration: 1. Hours of operation shall be limited between 8:00am and 5:00pm daily. 2. Owner shall install mesh or slats to the chain link fence along the east property line to provide screening from the canal and the San Tan Vista neighborhood. The screening material shall be maintained for the duration of the SUP. 3. Contents in the collection area shall not exceed the height of the fence line. 4. Use of heavy machinery or mechanical equipment (other than for cooling or heating) shall be prohibited. 5. Recyclable material collection shall be limited to non- ferrous metals. Commission Recommendation: On 7/26/18, the Commission voted 6-0 to recommend approval of Z2017115 subject to conditions ‘a’ – ‘g’: a. Development of the site shall be in substantial conformance with the Site Plan entitled “Special Use Permit Recycling Collection Center”, consisting of one (1) full- size sheet, dated January 16, 2018 and stamped received January 16, 2018, except as modified by the following conditions. b. Development of the site shall be in substantial conformance with the Narrative Report entitled “January 16, 2018”, consisting of 4 pages, stamped received January 16, 2018, except as modified by the following conditions. c. This Special Use Permit shall expire 10 years (August 29, 2028) from the date of approval by the Board of Supervisors or upon termination of the use, whichever occurs first. All of the site improvements that do not meet C-2 zoning district standards and cannot be readapted to a permitted use shall be removed within 60 days of such termination or expiration. d. The following Engineering condition shall apply: 1. Storage of materials, walls/fence/ parking and storm water retention are prohibited in the right-of-way. August 29, 2018 Z2017115 Page 2 of 3 e. The applicant shall obtain a driveway permit from ADOT within 60 days of approval of the Special Use Permit. f. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Special Use Permit as set forth in the Maricopa County Zoning Ordinance. g. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, and at the time of expiration of the Special Use Permit, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, or the expiration of the Special Use Permit, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the Special Use Permit. The Special Use Permit enhances the value of the property above its value as of the date the Special Use Permit is granted and reverting to the prior zoning results in the same value of the property as if the Special Use Permit had never been granted. Arizona Ave. in Chandler. My husband and I live in San Tan Vista backing up to Az. Ave within 300 ft. of the proposed center. We do not want the recycling center permitted, much less for it to expand. In the 2 years we have lived here, the traffic and noise from there has continued to get worse. I also feel it will bring down the value of our property as the center is looking more and more unkept, with all the recycling materials out in the open. Therefore, my 1 husband Mike Flores and I oppose the rezoning or request for a special use permit for the property . Electronic Signature I agree. Arizona Ave. Recycling Center Meeting Date: July 26, 2018 (continued from 4/12/18 & 3/8/18) Supervisor District: 1 Applicant: Paul Almond, Architectural Design Group Owner: Annabelle Cooper Request: Special Use Permit (SUP) to allow a recycling center in the C-3 zoning district Site Location: Generally located approximately 800’ north of the northeast corner of Hunt Hwy. and Arizona Ave. in the Chandler area Site Size: 0.63 acre Density: N/A County Island: Yes (Chandler) County Plan: Rural Development Area (0-1 d.u./ac.) Municipal Plan: Chandler - Employment Support/Opposition: Six (6) letters of opposition Recommendation: Approve with conditions Z2017115 Page 1 of 6 Project Summary: 1. Paul Almond of ADG Architectural Design, on behalf of owner Anabelle Cooper, is requesting a SUP for an existing recycling collection center about 800’ feet north of the northeast corner of Hunt Highway and Arizona Avenue in the Chandler area. The subject property is situated between Sun Lakes and the San Tan Vista subdivision. 2. On June 19, 2017, the owner of the subject property was cited under Case No. V201701043 for operating the recycling collection center without proper entitlement. This SUP will close the violation case and will allow the operation to continue for 10 years. The applicant entered into a compliance agreement to obtain full entitlement by November 30, 2018. 3. The recycling business is a one-man business, operating between 8:00 am and 5:00 pm daily. The business entails collecting, sorting and distributing recyclable metals. There are typically 10-20 customers per day. Export shipments of sorted materials occur once per day. The tenant uses the existing carport for shade and operations, including customer check-in, weighing of recyclables, and cashing. The balance of the property is used for recycling operations. A bathroom facility will be provided in a 10’x20’ prefabricated building. 4. Historically, the property contained a house which was later converted to a bar. The house was demolished sometime in 2017 while the carport remains standing. The southern portion of the property contains a wireless communication facility permitted under Z2011077. A billboard also stands on the property. Existing On-Site and Adjacent Zoning / Land Use: 5. On-site: C-3 / Recycling Collection Center North: C-3 / Vacant South: C-3 / Medical Marijuana Dispensary East: Rural-43 RUPD / Canal and SFR Subdivision (San Tan Vistas) West: Arizona Ave. and R1-6 RUPD/ Single-Family Residential Community (Sun Lakes) Z2017115 Page 2 of 6 Zoning Map Aerial-photo Z2017115 Page 3 of 6 Utilities and Services: 6. Water: On-site septic Wastewater: On-site well School District: Chandler Unified Fire: City of Chandler Police: City of Chandler Right-of-Way: 7. There are no County rights-of-way adjacent to the property. Arizona Avenue (SR-87) is within the jurisdiction of ADOT. Adopted Plans: 8. Vision 2030: The property is designated Rural Development Area (0-1 d.u./ac.) 9. City of Chandler General Plan: The property is designated “Employment”, primarily consisting of industrial and business parks. Public Participation Summary: 10. The applicant complied with the Maricopa County Citizen Review Process with the required posting of the property and notification by first class mail to adjacent property owners within 300’ of the subject parcel and interested parties, including the City of Chandler. As of the date of this report, staff received six letters of opposition from residents at Sun Lakes, all of whom live within 300’ feet of the property. The residents cited truck traffic and noise as their primary concerns. Outstanding Concerns from Reviewing Agencies: 11. ADOT provided comments stating that they have no objections to the zone change request. However, a driveway permit would be required for access on to SR-87. Staff has provided a condition for approval that would require the applicant obtain the driveway permit within 60 days of approval of the SUP. Staff Analysis: 12. Staff believes that the SUP is both reasonable and necessary to close the land use violation (V201701043). With the current zoning of C-3, the recycling collection operation is not allowed without a SUP for an interim industrial use for a duration of no more than 10-years. 13. Although the use proposed is typically allowed in an industrial zoning district, the use will be limited to recycling collection. There will be no manufacturing or processing of recyclable materials, nor is there any heavy machinery to generate noise. Staff believes the use is compatible with the neighboring commercial uses, particularly the medical marijuana facility to the south. This narrow strip of land between the highway to the west and canal to the east is physically separated from the adjacent San Tan Vista residential neighborhood to the east. It is also an extension of a larger mix of non-residential uses Z2017115 Page 4 of 6 further north between the highway to the west and the railroad to the east. All opposition comes from Sun Lakes on the west side of the highway. There is no street connection between Sun Lakes and SR-87 in this area. Recommendation: 14. For the reasons outlined in this report, staff recommends the Commission motion for Approval of Z2017115 with conditions ‘a’ – ‘g’: a. Storage of materials, walls/fence/ parking and storm water retention are prohibited in the right-of-way. e. The Special Use Permit enhances the value of the property above its value as of the date the Special Use Permit is granted Z2017115 Page 5 of 6 and reverting to the prior zoning results in the same value of the property as if the Special Use Permit had never been granted. Special Use Permit for a Recycling Center. This is a formal protest to this request. I own property within 300 feet of the site noted in the Palo Verde subdivision. A 55+ community with homes all over $250,000 and up. This site would definitely have an impact of our property values. Traffic along Arizona from Riggs and Hunt is already excessive with semis etc heading to concrete plant or to Casa Grande or Tuscson and is also used to reroute traffic when accident occurs on Hwy 10. We have all complained about the noise of the trucks breaking etc at the corner of Arizona and Hunt without this recycling center. More trucks, noise, smells, rats ,rodents and everything else that comes with a recycling plant would be very detrimental to this area. Need to put this away from residential subdivisions. I plan on attending the Planning and Zoning Commission meeting on Thursday March 8, 2018 at 9:30 am along with neighbors. This request is Protested. We do not want the recycling business to continue as it is, and definitely don't want it to expand. From our back patio, we see the top of the temporary structure they recently added, a shipping container, and the remainder of the building they partially tore down, plus the stacks of materials, bags of cans and other items they are recycling. There is additional noise, trash and traffic in the area since they have expanded their business. Please call Christine at (602) 527-1922 or Phil at (480) 250-0740 if you have any questions. Spencer, and I am the owner of record of the property located at 11233 E Bellflower Ct. Chandler, AZ 85249 With Legal description as: Lot 20, Santan Vista, according to book 517 of maps, page 34 and re-recorded in book 523 of maps, page 6 records of Maricopa County, AZ Dear Mr. Tavassoli, I want to specifically appeal and oppose issuance of a special use permit for recycling center at the property on Arizona Ave. near the corner of Hunt Hwy - referred to as CASE # Z2017100-26423. Specifically, this business which has grown into a recycling business over the last year or so has introduced a significant amount of noise and heavy truck traffic directly across the wall from the quiet residential areas of our subdivision, and our personal home which is valued at nearly $1,000,000. This business cannot proceed to conduct this inappropriate noise in the vicinity of our subdivision with the current zoning, and is in violation of the current zoning. Therefore I specifically oppose the application for this property to be re-zoned or for a special use permit to be issued for continuation of this business. Please keep me in touch with the proceedings. Sincerely, Philemon Spencer 11233 E Bellflower Ct.
