d. Amendments to the site plan and narrative report shall be processed as a revised
application in accordance with Maricopa County Zoning Ordinance Article 304.9.
e. Noncompliance with any Maricopa County Regulation shall be grounds for
initiating a revocation of this Special Use Permit as set forth in the Maricopa County
Zoning Ordinance.
f. The property owner/s and their successors waive claim for diminution in value if
the County takes action to rescind approval due to noncompliance with
conditions.
g. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows
the property to enjoy uses in excess of those permitted by the zoning existing on
the date of application, subject to conditions. In the event of the failure to comply
with any condition, the property shall revert to the zoning that existed on the date
of application. It is, therefore, stipulated and agreed that either revocation due
to the failure to comply with any conditions, does not reduce any rights that
existed on the date of application to use, divide, sell or possess the property and
that there would be no diminution in value of the property from the value it held
on the date of application due to such revocation of the Zone Change. The Zone
Change enhances the value of the property above its value as of the date the
Zone Change is granted and reverting to the prior zoning results in the same value
of the property as if the Zone Change had never been granted.

Project Summary:
1. The applicant, Stephen C. Earl of Earl, Curley & Lagarde is requesting a Zone Change for
an ADOT owned parcel (APN #136-17-048B) located off Lehi Rd., north of the Loop 202
and east of Country Club Dr. The 1.04 acre subject site is zoned IND-2 and the applicant
is requesting the zone change to IND-2 with an Industrial Unit Plan of Development (IUPD)
overlay. The proposal is to add an off-site advertising (billboard) sign to the property and
request some deviations from standards for the sign through the IUPD overlay.
2. The subject site is currently being used as an ADOT maintenance yard, where the location
of the proposed billboard would be on the eastern portion of the parcel to be viewed by
traffic on the Loop 202. The applicant is calling this a “relocation” sign as ADOT is
proposing to relocate to the subject property from the the existing location that is
affected by the South Mountain Freeway construction/widening project.
Proposed Site Plan for Billboard (Z2017077)
3. The applicant is proposing a v-shaped, 672 sq. ft. (14’ x 48’), 48’ (h), exterior illuminated
billboard. The sign size would be above the 300 sq. ft. maximum allowed and the height
would be above the 30’ maximum allowed per Maricopa County Zoning Ordinance
(MCZO) Article 1404.3.2. There is also an existing billboard located approximately 500’
west of the subject site on a separate privately owned property where a minimum 1,000’
separation distance is required per the Zoning Ordinance. Lastly, the applicant is
requesting a 0’ setback for the billboard from the north and south property lines of the
subject parcel. This also applies for the billboard to be 100’ setback from rural zoning
(north of site) and 150’ from rural zoning if illuminated where 0’ is requested.

Public Participation Summary:
10. The applicant complied with the Maricopa County Citizen Review Process by notification
through first class mail to adjacent property owners within 300’ of the subject parcel and
interested parties as well as the required posting of the site. Staff has not received any
comments from the City of Mesa or the public as of writing of this report. The applicant
provided staff with a Citizen Participation Results Report (received on 12/14/17) which
confirmed that no public response was received.
Outstanding Concerns from Reviewing Agencies:
11. N/A
Agenda Item: 3 – Z2017077

Staff Analysis:
12. Staff is in support of the proposed Zone Change and deviations requested with the IUPD
Overlay for the proposed billboard. It should be noted that the subject site since being
an ADOT owned parcel maintenance yard land use and related structures are exempt
from zoning requirements. Aerials of the site clearly show that portions of this use and
existing structures encroach into the adjacent ROW. Recommendations for approval will
only apply to the billboard in question, if the site is sold to a private entity in the future
then entitlement would need to be evaluated at that time. The applicant’s narrative
report mentions that lighting or illumination for the sign “will consist of two top mounted
400 watt 120 volt incandescent lamps, or other similar and comparable standard
illumination, at the base of each sign face and directed at an angle to illuminate the sign
faces.” MCZO Article 1112.3.2.1 requires that billboard external lighting can only be top
down, where staff will include a condition with the recommendation that the lighting
cannot exceed the maximum height of the billboard.
Aerial Photo of Subject Site and Surrounding area Billboards
13. Staff notes that that the area around the subject site which is mostly industrial land uses
and zoning includes 3 existing billboards that are meant to be viewed by the Loop 202
and 1 billboard to be viewed by Country Club Dr. See aerial image on the previous page
for reference. Staff believes that this area is suitable for the proposed billboard given the
minimal residential uses in the area, existing conditions of industrial land uses and other
billboard signage, and location on the subject site (east side of parcel) is adjacent to
ADOT ROW. The requested deviations would allow for optimal viewing from the Loop 202
where there is a bend in the highway and the site being below the height of the Loop
202. The setbacks would be justified given the location on the subject parcel is on an
acute angle adjacent to ADOT ROW. Rural zoning can only be found north of the site
which would not be facing the proposed sign.
Agenda Item: 3 – Z2017077

Recommendation:
14. For the reasons outlined in this report, staff recommends the Commission motion for
Approval of Z2017077 with conditions ‘a’ – ‘g’:
a. Development of the site shall be in conformance with the Site Plan entitled, “Site
Plan for Minor Accessory Construction”, consisting of 2 full-size sheets, stamped
received on December 11, 2017 except as modified by the following conditions.
b. Development of the site shall be in conformance with the Narrative Report
entitled, “Clear Channel Outdoor”, consisting of 16 pages, stamped received
December 11, 2017 except as modified by the following conditions.
c. The following IND-2 IUPD standards shall apply (to the billboard only):
Minimum Front Setback: 0’ (adjacent to Lehi Rd. and Loop 202)
Maximum Height: 48’ (includes lighting/illumination)
Maximum Sign Area: 672 sq. ft.
Minimum Sign Separation: 500’
Minimum Setback to a Rural or Residential Zoning District for Illuminated Sign: 0’
Minimum Setback to a Rural or Residential Zoning District: 0’

NARRATIVE REPORT
Purpose of Request
The purpose of this request is to provide information on the request by Clear Channel Outdoor for
approval of a zone change from IND-2 (Light Industrial) to IND-2 IUPD (Light Industrial,
Industrial Plan of Development) with an administratively approved Plan of Development (POD)
for an off-site advertising sign. This zone change application seeks approval for a legal conforming
14' x 48' bulletin billboard to be relocated from 59 th Avenue and I-10 in the City of Phoenix to
this parcel owned by ADOT (Arizona Depaitment of Transportation) in lieu of just compensation
for removal of an existing sign to accommodate the State's I-10 and South Mountain Freeway
expansion project which ultimately serves the general public benefit.
This application is prompted by the ADOT which is now moving forward on construction of the
South Mountain Freeway interchange with the I-10 Freeway at 59 th Avenue in west Phoenix. Due
to the nature of the
condemnation, it was

industrial area in which a number of advertising boards already exist. No residential uses exist
adjacent to the subject site although a small sliver of ground in Lehi Road is zoned RU-43.

Description of Proposal
This request seeks a zone change from IND-2 to IND-2 IUPD on a 1.04 acre site owned by the
Arizona Department of Transportation along with minor development standards deviations to
accommodate this 48-foot high sign along the Loop 202 Freeway. The subject site is located west
of Center Street and east of Country Club Drive and situated on the south side of Lehi Road. The
irregularly shaped industrial property has approximately 515-feet of freeway frontage along the
north side of Loop 202 Freeway. The precise plan locates the billboard at the easternmost portion
of ADOT's triangular shaped industrial parcel in a leased area that is approximately 60' x 50' in
size. The sign will be a double faced "V”-shaped billboard sign and directed to its intended
freeway audience. Each face is 672 square feet in area and is illuminated by exterior lighting-no
digital faces.
The Maxicopa County Zoning Ordinance (MCZO) permits off-site advertising signs on property
zoned IND-2 subject to spacing criteria and specific development standards. To locate an off-site
outdoor advertising sign on this property, four development standards must be amended. Those
deviations are as follows:
1) Amend the maximum sign area from 300 ft. to 672 ft.; to accommodate the same size as
the existing legally non-conforming 14' x 48' bulletin billboard sign;
2) Amend the minimum sign separation distance from 1,000 ft. to 500 ft.;
3) Amend the allowed height from 30 ft. to 48 ft.;
4) Amend the County setback from 20 ft. to 0
5) Amend the required separation from residential from 1,000 to 0 ft.
2

Clear Channel Outdoor TUPD Clear ChannelI,
Application No.: Z2017077
November 2017
The Maricopa County Zoning Ordinance states that off-site signs shall be permitted uses in the
IND-2 and ND-3 zoning districts subject to Article 1404.3.1 and Article 1404.3.2. Below are the
applicant's responses to whether a deviation is being requested for that specific article section or
if the standard is being met.
ARTICLE 1404.3. OFF-SITE SIGNS, BILLBOARDS EIND-2 AND IND-3 ZONING
DISTRICTS ONLY]:
ARTICLE 1404.3.1. Off-site signs shall be permitted uses in the IND-2 and IND-3 zoning
districts and provided each such sign_ shall:
1. Maintain a distance separation from any other off-site sign of 3,000 feet of any offsite
sign on the same street when either existing or proposed sign is located three (3) miles
or greater from the boundary of any incorporated city or town.
Since this site is located less than three miles from the City of Mesa city limits this section
is not applicable. (See Exhibit A, Aerial).
2. Maintain a distance separation from any other off-site sign of 1,000 feet of any offsite
sign on the same street when either existing or proposed signs is located fewer than three
(3) miles from the boundary of any incorporated city or town.
The Property is undeveloped and is currently part of an ADOT maintenance yard. The
Property is located in a County island and is zoned Light Industrial and adjacent to the City
of Mesa city limits, Salt River Indian Reservation land and backs onto the Loop 202
Freeway. An existing off-site advertising sign is located to the west approximately 509
feet, measured in a straight line, along the northern curved portion of the Loop 202 Freeway
between Country Club and Center Street.
3

Clear Channel Outdoor IUPD 3 Clear Channel Outdoor
Application No.: Z2017077
November 2017
It should be noted that while the separation is approximately 509 feet, the signs (existing
and proposed) are located on a curve or bend of the Loop 202 Freeway and hence giving
the appearance that they are not in a straight line along a street thus helping to offset an
appearance of clustering. The double faced "V"-shaped billboard sign is directed to its
intended freeway audience.
This request seeks to reduce the separation standard between signs to 500-feet. The request
is necessary because the property is only 500-feet wide and while the sign is placed as far
to the east as possible it cannot be moved further to the east due to this being the narrowest
point of the property. If the narrowest point of the property were reversed and along the
west side of the property the sign could be moved farther east but this is not the case.
When consideration is given to the surrounding industrial land uses, the curvature of the
Loop 202 Freeway, the narrow parcel width, and that the fact that the sign is moved as far
to the east as possible while still accommodating the sign lease area on the narrowest part
of the property, we believe the 500-feet separation is sufficient separation to allow freeway
travelers the ability to safely read the existing and proposed signs without having visual
clutter and/or major distractions.
4

Clear Channel Outdoor IUPD rA, Clear Channel
Application No.: Z2017077
November 2017
Furthermore due to the curvature of the Loop 202 Freeway and the placement of the
proposed sign, the requested spacing does not create visual obstruction between existing
and proposed signs. The proposed separation does not negatively affect the existing sign,
or the adjacent jurisdiction or Salt River Indian Reservation land, or any residential districts
south of the Loop 202 Freeway.
3. Such sign may be illuminated but no flashing, intermittent or 'doling illumination shall
be employed. Any lighting used shall be in accordance with the adopted outdoor light
control provisions (see Chapter 11, Section 1112. herein).). Any off premise sizn within
150 feet of a rural or residential zone boundary shall be non-illuminated. (Emphasis
added)
A deviation from this standard is being requested because a small 19 feet x 503 feet strip
of land, owned by ADOT in Lehi Road is zoned RU-43. The actual distance to a
developed of future residential development is approximately 1,200 feet which more than
meets the spirit of this standard.
The proposed sign will not have any flashing, intennittent or moving illumination. The
sign illumination will consist of two top mounted 400 watt 120 volt incandescent lamps,
or other similar and comparable standard illumination, at the base of each sign face and
directed at an angle to illuminate the sign faces. The bulbs will be fully shielded, will not
be directly visible from the ground, will produce less than 40,000 lumens per fixture
(Output of 35,000 lumens), and shall not cast more than 1,017 lumens per fixture beyond
the sign face per MCZO Chapter 11, Section 1112.3.2.
4. Such sign shall not be located within 100 feet of any rural or residential zoning district
boundary, whether or not separated by a public right-of-way.
Again, the request fundamentally complies with this standard. The nearest residential
district is approximately 1,200 feet to the south across the Loop 202 Freeway (See Exhibit
B, Aerial Area Map). However, there is a small 9,975 sf. strip of land in Lehi Road that is
zoned RU-43. For this, a deviation from this must be requested.
5. Such sign shall not be located within 500 feet of any park, school or roadside rest area.
The request complies with the standard. The nearest park is over 3,800 feet to the south
across the Loop 202. The nearest school is Whitman Elementary School and is located over
3,000 feet to the south across the Loop 202 Freeway (See Exhibit B, Aerial Area Map).
There are no roadside rest areas within many miles of this site. No change is being
requested.
5

Application No.: Z2017077
November 2017
6. Such sign shall not be audible in any manner.
The request complies with the standard. The sign will not be audible in any manner. No
change is being requested.
7. Special Conditions:
a. On State Route 74 between U.S. 60-89 and Lake Pleasant Road, no off-site signs shall
be permitted within six-hundred sixty (660) feet of said highway right-of-way.
Not applicable. This site is not located along State Route 74 between U.S. 60-89 and Lake
Pleasant Road.
b. On U.S. Highway 60-89 from Estrella Freeway to Wickenburg, no off-site signs shall
be permitted within six-hundred sixty (660) feet of said highway right-of-way.
Not applicable. This site is not located along U.S. Highway 60-89.
In addition to Article 1404.3, the County's Zoning Ordinance also lists additional development
standards when property is within the IND-2 or IND-3 zoning districts. Article 1404.3.2 Off-
site signs in IND-2 and IND-3 zoning district are subject to the following development standards:
1. Such sign shall not exceed three-hundred (300) square feet in area.. A sign may utilize
embellishments up to of ten percent (10%) of the sign area.
This request seeks to amend the maximum sign area from 300 feet to 672 feet to accommodate
the same legal non-conforming 14' x 48' bulletin billboard sign size to be relocated to this site.
As mentioned, ADOT is constructing the west leg of the Loop 202 which will ultimately
connect to the I-10 freeway. This new freeway leg has caused ADOT to condemn land
including existing billboard rights to allow the completion of the long anticipated I-10 Loop
202 South Mountain connection. The requested size area is the same as what exists today and
is necessary to allow viewers the ability to safely view the sign and its context from the freeway
while maneuvering at higher speeds and along at a curve of the Loop 202 Freeway. The larger
sign area allows the sign message to be read from a farther distance while traveling on the
freeway. An illustration of the sign is attached as Exhibit D.
2. Such sign shall not exceed thirty (30) feet in height.
This request seeks an approval to increase the sign height to 48-feet whereas 30-feet is allowed
by right. The zoning district standard of 30-feet is not sufficient to allow the proposed sign to
be read in a safe manner from the adjacent depressed freeway when consideration is given to
6

Clear Channel Outdoor ILTPD LA Clear Channel (
Application No.: Z2017077
November 2017
the visual obstruction of 10-20-foot high collective obstructions located along the top of the
freeway right-of-way. These obstructions in effect cause the site to be depressed. The 48-feet
height for this sign is primarily need to compensate for the elevated berming, the depressed
site and the freeway slope which restricts the view for vehicles traveling in both directions.
The berming along the freeway creates a visual obstruction for signs that are placed too low
and a sign that is too low creates visual difficulty for motorist traveling along a curved portion
of the freeway. Additionally, the proposed increase in sign height and orientation is designed
so that it allows the image to be seen by freeway motorists rather than the closest residential
districts which is south of the Loop 202 Freeway and more than 1,000 feet away from the site.
3. Such sign may be double-faced or "V" shaped, provided the "V" shape is designed so
that it is no greater than fifty-four (54) inches between faces at the apex and the angle
between the faces of the sign is no greater than forty-five (45) degrees.
No change is being requested. As shown on Exhibit D, Site Plan and Billboard Detail, the sign
will be "V" shaped with the maximum distance between the faces at the apex being 54 inches
and the angle between the faces being 45 degrees. This request meets this standard.
4. Such sign shall be freestanding.
No change is being requested. As shown on Exhibit D, Site Plan and Billboard Detail, the sign
will be freestanding. This request meets this standard.
5. Shall maintain the same property line setbacks as required by the underlying zoning
district.
The only requested deviations from the development standards are for the off-site advertising
sign in its lease area. While it appears that the requested setback is a major setback deviation
from the ND development standard, it really is not with respect to the freeway. The sip face
is at the edge of the +1- 300-feet wide freeway right-of-way but nowhere near the travel lanes
or off-ramp. . In most cases, setbacks are measured from the vertical structure and if that were
the case here, there would not be a need for a setback reduction since the actual placement of
the sign pole meets the minimum 20-feet setback requirement. Additionally, when
consideration is given to the approximately 300-feet Loop 202 Freeway right-of-way and the
fact the intended viewers are freeway travelers it is better to have the sign closer to the actual
freeway pavement so that it can be easily read by the intended viewers. The perceived
reduction in setback does not impact any properties as the reduction is only along the freeway
right-of-way. The sign face is actually over 100-feet from the closest freeway travel lane.
Finally, due to the irregular shape of the site, a reduction of the setback from Lehi is requested
down to 0 ft. The requested deviations from the development standards are in bold on the
below table.

Application No,: Z2017077

The construction of the off-site sign will be in one phase after all entitlements and permits have
been granted.
Conclusion
The purpose of an off-site sign is to provide visual advertisement in a safe manner to motorists
traveling along the Loop 202 Freeway. The site is obstructed by an approximately 10-20 feet high
visual obstruction along the freeway right-of-way which effectively creates a visual obstruction
for the site. Allowing the increase sign height allows for better visual sign placement and one that
is more in line with the existing off-site sign to the west. The proposed height or setback or sign
area is not detrimental to the surrounding properties or the County or the City of Mesa in general.
We believe the requested sign height and area is vital to creating a safer readable sign and one that
can easily be read from the adjacent freeway. This location is very appropriate for the relocated
sign, the presence of other signs in the area necessitates that several existing standards be amended
to accommodate the relocated sign. These adjustments are the least necessary to accommodate the
new sign.
