A RESOLUTION OF THE MAYOR AND COUNCIL OF THE CITY OF
EL MIRAGE, MARICOPA COUNTY, ARIZONA, DECLARING AS
PUBLIC RECORD EXTENDING AND INCREASING THE CORPORATE
LIMITS OF THE CITY OF EL MIRAGE, ARIZONA, PURSUANT TO
THE PROVISIONS OF ARIZONA REVISED STATUTES, § 9-471(N), BY
ANNEXING THERETO CERTAIN COUNTY RIGHT-OF-WAY
CONTIGUOUS TO THE CITY OF EL MIRAGE.
WHEREAS, Arizona Revised Statutes § 9-802 provides a procedure whereby a
municipality may enact the provisions of a code or public record by reference, without setting
forth such provisions, provided that the adopting ordinance is published in full,
WHEREAS, it is in the interest of the City of El Mirage to control and maintain the
thoroughfares which provide access to the City; and
WHEREAS, Arizona Revised Statutes § 9-471(N) allows annexation of a county right-
of-way with no taxable real property adjacent to the city by mutual consent of the governing
bodies of the County and City; and
WHEREAS, the portions of Olive Avenue, including the intersection of El Mirage Road
and Olive Avenue described in Exhibit "A" and shown in the attached map, Exhibit "B", are
adjacent to the City of El Mirage for their entire length and contain no taxable real property;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of El
Mirage, Arizona, that:
Section 1. The City of El Mirage, contingent on the consent and mutual approval of the
Maricopa County Board of Supervisors, hereby annexes and declares to be a part of
the corporate boundaries of the City of El Mirage that property shown on the
attached Exhibit "A", "Legal Description" and Exhibit "B" "Exhibit Map".
Section 2. The corporate limits of the City of El Mirage and all maps reflecting the corporate
limits of the City shall be amended to include the annexed property described in
Section 1 above.
Section 3. This resolution, its attached legal description and exhibit map, and the final
approval of the Maricopa County Board of Supervisors shall be filed with the
County Recorder of Maricopa County, Arizona.
PASSED AND ADOPTED by the Mayor and Council of the City of El Mirage this 7th
day of September, 2017.
