AQ-2017-003-RULE 317 (HOSPITAL/MEDICAL/INFECTIOUS WASTE INCINERATORS) AQ-2017-004-RULE 325 (BRICK AND STRUCTURAL CLAY PRODUCTS (BSCP) MANUFACTURING) AQ-2017-005-RULE 334 (RUBBER SPORTS BALL MANUFACTURING) AQ-2017-006-RULE 339 (VEGETABLE OIL EXTRACTION PROCESSES) Pursuant to A.R.S. §49-479(b), convene the scheduled public hearing, to solicit comments and consider the adoption of proposed rescission of Maricopa County Air Pollution Control Regulations Rule 317 (Hospital/Medical/Infectious Waste Incinerators), Rule 325 (Brick and Structural Clay Products (BSCP) Manufacturing), Rule 334 (Rubber Sports Ball Manufacturing) and Rule 339 (Vegetable Oil Extraction Processes) and the associated proposed revision to the State Implementation Plan (SIP). Following the public hearing, the Board is requested to approve the proposed rescission of Rules 317, 325, 334 and 339 and the proposed rescission of Rules 325, 334 and 339 from the SIP. Upon Board approval, this item will become effective 12/13/2017. The Maricopa County Air Quality Department (MCAQD) is proposing to rescind Rules 317, 325, 334 and 339 and is proposing to rescind Rules 325, 334 and 339 from the SIP. Rule 317 (Hospital/Medical/Infectious Waste Incinerators) Rule 317 was adopted to control emissions of air pollutants from hospital/medical/infectious waste incinerator(s) (HMIWI). There are currently no HMIWI in Maricopa County and the department’s records indicate the last HMIWI permit was closed (source was removed) in 1998. Most hospital/medical/infectious waste is now treated using alternative technologies such as thermal treatment (microwave technologies), steam sterilization (autoclaving) and chemical and mechanical treatment. The department does not anticipate any new HMIWI will locate to Maricopa County. Rule 325 (Brick and Structural Clay Products (BSCP) Manufacturing) Rule 325 was originally adopted on August 10, 2005. The purpose of the rule is to limit particulate matter emissions from the use of tunnel kilns for curing in the brick and structural clay product (BSCP) manufacturing processes. Maricopa County currently has no sources subject to the rule and does not anticipate any new brick or structural clay product manufacturers will locate to Maricopa County. Rule 334 (Rubber Sports Ball Manufacturing) The purpose of the rule is to limit emissions of volatile organic compounds (VOCs) from natural and synthetic rubber adhesives used in the manufacture of non-inflatable rubber balls. Only one source has been subject to the rule since it was adopted in 1993 and that source ceased operations in 2009. Due to the uniqueness of this type of manufacturing and the lower costs of labor and raw materials in the Far East, the department does not anticipate any new rubber sports ball manufacturers will locate to Maricopa County. Rule 339 (Vegetable Oil Extraction Processes) Rule 339 was adopted to limit the emissions of VOCs from the extraction of vegetable oil using solvents (hexane). Maricopa County currently has no vegetable oil production facilities subject to the rule and the department’s records indicate the only issued permit was closed (source was removed) in 1999. Since the adoption of Rule 339, hexane, the primary solvent used in vegetable oil extraction processes is now regulated as a hazardous air pollutant (HAP), not as a VOC. In 2001, the EPA promulgated national emission standards for hazardous pollutants (NESHAP) for the use of hexane in vegetable oil production facilities. The vegetable oil production NESHAP has been incorporated into the county’s air quality regulations through Rule 370 (Federal Hazardous Air Pollution Program); therefore, Rule 339 is obsolete. Permit fees are not changing due to this action. (C-85-18-003-M-00)

10. AQ-2017-001-INCORPORATION BY REFERENCE 2016-2017 Pursuant to A.R.S. §49-479(b), convene the scheduled public hearing, to solicit comments and consider the adoption of incorporating federal standards into Maricopa County Air Pollution Control Regulations: Rule 360 (New Source Performance Standards), Rule 370 (Federal Hazardous Air Pollutant Program), Rule 371 (Acid Rain), and Appendix G (Incorporated Materials). Following the public hearing, the Board is requested to adopt the incorporations into the Maricopa County Air Pollution Control Regulations. Upon Board approval, this item will become effective 12/13/2017. The Maricopa County Air Quality Department (“MCAQD”) is proposing to revise 360, 370, 371, and Appendix G by incorporating federal regulations and documents promulgated by the U.S. Environmental Protection Agency (“EPA”): New Source Performance Standards (“NSPS”), National Emission Standards for Hazardous Air Pollutants (“NESHAP”), Acid Rain and other parts of Title 40 Code of Federal Regulations. The proposed action will include amending the incorporation by reference date from July 1, 2016, to July 1, 2017, in each of the rules and appendix to remain current with federal regulations. The adoption of the proposed amendments to Maricopa County Air Pollution Control Regulations Rules 360, 370, 371 and Appendix G is necessary prior to requesting the EPA’s delegation of authority to the MCAQD for the implementation and enforcement of the federal regulations and documents. These amendments should not have an economic impact on businesses in Maricopa County and should not impose additional costs on the regulated community, small businesses, political subdivisions, and members of the public beyond that already incurred by reason of federal or state rule or law. The costs of compliance with these rules have already occurred and were considered when the federal and state rules or laws were proposed and adopted. Permit fees are not changing due to this action. The MCAQD did not receive any public comments during the public comment period. A Notice of Final Rulemaking will be distributed per normal procedures once approved. (C-85-18-004-M-00)

The change would remove the criminal conviction question from the standard employment application and prohibit County departments from inquiring about an applicant’s criminal history prior to a decision to make an offer. Some county departments, primarily those dealing with law enforcement, have more stringent rules and/or must comply with federal or state statutes related to the criminal history of employees. 34. APPROPRIATION ADJUSTMENT FOR HUMAN SERVICES DEPARTMENT CDBG TRUST FUND & GRANT FUND Approve an increase in the appropriated budget for Human Services Department (D220) Human Services Grant fund (222), Operating (0000) in the amount of $5,449,652 in revenues and $5,449,652 in expenditures as identified on the Fiscal Year 2017-2018 Grant Summary Worksheet on file in the Office of the Clerk of the Board. The appropriation adjustment brings the Human Services Fund (222) budget to the total amount of $46,292,282. Approve an increase in the appropriated budget for Human Services Department (D220) Human Services CDBG Housing Trust fund (217), Operating (0000) in the amount of $1,088,154 in revenues and $1,088,154 expenditures as identified on the Fiscal Year 2017-2018 Grant Summary Worksheet on file in the Office of the Clerk of the Board. The appropriation adjustment brings the Human Services CDBG Housing Trust fund (217) budget to the total amount of $11,451,675. The appropriation adjustment is necessary as the carry forward amounts of prior year grants and award amounts of new grants differ from the amount approved in the Fiscal Year 2017-2018 Budget Appropriation. Grant revenues are not local revenues for the purpose of the constitutional expenditure limit, and therefore expenditures of these revenues are not prohibited by the budget law. The approval of this budget adjustment does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. The indirect cost rate is 22.9% as approved by the Department of Health and Human Services. Most of the grants for Fiscal Year 2017-2018 allow for indirect cost recovery as reflected in the funding agreements. Detail of financial impact and grant summary worksheet are attached to be on file with the Clerk of the Board’s Office and retained in accordance with Arizona State Library Archives and Public Records (ASLAPR) approved retention schedule. 75. PROPOSED REVISIONS OF MARICOPA COUNTY PARKS AND RECREATION DEPARTMENT USER FEE SCHEDULE Pursuant to A.R.S. §11-251.08 and 11-251.13, set a public hearing for February 21, 2018 to solicit comments and consider the adoption of the proposed changes to the Maricopa County Parks and Recreation Department User Fee Schedule. Upon Board approval, this item will become effective April 1, 2018. The Maricopa County Parks and Recreation Department, with consultation from the Parks and Recreation Commission, has determined the necessity to revise its user fee schedule in order to bring the user fees more closely in line with typical fees for similar systems and to recover fees for services. This will enable the Department to apply any changes in fees to daily park operations and maintenance and needed repairs to parks facilities. The Parks and Recreation Commission held a public meeting regarding the revised fees on November 14, 2017 and no comments were received from the public. The meeting was advertised on the Parks website, through social media and in the parks. The Board must set this matter for public hearing pursuant to statutory requirement. (C-30-18-011-M-00)
