Recorder. Supervisory District No. 4 (C-64-17-062-M-01)
Bill Wayner, resident, noted his opposition to the Patent Easement Abandonment. He
stated the map shows 103rd Avenue goes through but it does not go through, the
properties have expanded and set up fences. His neighborhood has had 2 major fires
and when the fire trucks go down 104th Avenue they are blocked by a fence that causes
them to turn around. He stated this is a public safety hazard for the neighborhood.
Mitch Wagner, Intergovernmental Relations Supervisor, stated he didn’t hear of any
concerns or objections but would agree to continue this for two more weeks in order to
look into Mr. Wayner’s concerns.

19. APPOINT SUPERIOR COURT COMMISSIONERS AS SUPERIOR COURT JUDGES PRO
TEMPORE
Approve the appointment of Court Commissioners as a Superior Court Judge Pro Tempore
in accordance with Arizona Revised Statutes § 12-141. In order to obtain greater flexibility
in the use of Court Commissioners, the Superior Court customarily has all Court
Commissioners appointed as Superior Court Judges Pro Tempore so they may, on
occasion, hear contested matters. This serves the interest of judicial economy and
promotes sound case flow management. Court Commissioners would serve as a Superior
Court Judge Pro Tempore without any additional compensation other than that to which
he/she is entitled as a Court Commissioner. The appointment will be for the period
commencing July 1, 2017 through June 30, 2018. (C-80-17-008-2-00)

Bill Crowley, resident, stated he is concerned about the $150,000 dollars that is allotted
for the Aguila Youth Leadership Institute and questioned how the funds would be used.
Chairman Barney stated that it’s one of the 61 programs that fit within the nine
departments of Maricopa County. The Grant requires certain funds to go back into
community programs.
Supervisor Gallardo stated the organizations that apply go under an extensive review
for the funds. The Aguila organization serves unprivileged youth and teaches them
things such as giving back to the community. He stated the program is not based out of
Aguila, so it’s not an Aguila community or school organization but a County
organization.

Arizona $102,427. Any unused funding will be returned to CSA upon completion of the
study.
At their March 24, 2016 Board of Directors Special Meeting, the AACE Board approved the
Roadway Needs Study scope coupled with a funding mechanism whereby each
participating county would fund the Roadway Needs Study. Maricopa County will procure
consultant services to complete the Roadway Needs Study with support of an AACE
Technical Advisory Committee. At the June 17, 2016 meeting of the AACE Board, Craig
Sullivan with CSA confirmed the preferred Roadway Needs Study invoicing mechanism for
participating counties will entail CSA sending a service fee invoice to each county rather
than complete a multi-county intergovernmental agreement. Total estimated project cost of
the Roadway Needs Study is $149,991, with Maricopa County’s share to be $47,564.

60. TRANSPORTATION PROJECT APPROPRIATION LEVEL CHANGE
Allow the budget for the FY 2017 Transportation Improvement Program projects to be
appropriated at the Fund level within the Transportation Capital Projects Fund (234) rather
than at the fund and project level.
On November 16, 2016, the Board of Supervisors approved revisions to the current FY
2017-2021 five-year Transportation Improvement Program to consolidate and better design
projects within appropriation units. Expenditures that had previously been posted to the
General Ledger before the budget adjustment was approved cannot be aligned after the
fact to the revised appropriation units in the financial system. Therefore, the FY 2017
expenditure appropriation for Fund 234 needs to be budgeted at the fund level. (C-64-17-

F-1. CONSENT TO ASSIGNMENT AND AMENDED AND RESTATED SUB-USE
MANAGEMENT AGREEMENT FOR THE MANAGEMENT OF WET’N WILD
Approve the Consent to Assignment and to an Amended and Restated Sub-Use
Management Agreement to effectuate the assignment of the Use Management Agreement
between Maricopa County and CLP Phoenix AZ Waterpark LLC (C-30-08-034-1-03) for the
Management, Operation and Maintenance of the Adobe Dam Regional Park Aquatic and
Amusement Park Concession, as amended (Agreement), also known as Wet’n Wild, from
CLP Phoenix AZ Waterpark LLC to EPR Parks, LLC.
Maricopa County originally entered into a Use Management Agreement with Harvest Family
Entertainment – Arizona LLC (C-30-08-034-00) on June 18, 2008. Amendment One (C-30-
08-034-1-01) dated June 3, 2009, executed administrative changes of the primary source of
water to be used in support of recreation and irrigation. Amendment Two (C-30-08-034-1-
02) dated June 23, 2010, executed administrative changes to the development, features and
phasing of the aquatic and amusement park, revised the legal description and permitted the
sale of alcohol to the general public. Amendment Three and additional documentation
provided (C-30-08-034-1-04) dated November 26, 2013 effectuated the assignment from
Harvest Family Entertainment – Arizona LLC to CLP.
CLP, LLC has a Sub-Use Management Agreement with Arizona Parks Holding, LLC for the
operation of Wet’n Wild. CLP’s interest in the Use Management Agreement, including park
assets, and the operation of Wet’n Wild will be conveyed to EPR Parks, LLC on or about
April 14, 2017. Upon closing of the acquisition: 1) Notification will be sent to the County; and
2) EPR Parks, LLC will enter into the Amended and Restated Sub-Use Management
Agreement with Arizona Parks Holding, LLC for the operation of Wet’n Wild. All terms and
conditions of the Agreement remain in full force and effect.
All underlying property interests will remain with Maricopa County in accordance with the
Agreement. Consent to this transaction has been requested in accordance with Section 5.6
of the Use Management Agreement. All conditions of the Agreement, including payment
schedule, remain unchanged. Documentation provided by EPR Parks, LLC indicates they
have the financial assets, management and operations experience so that the aquatic and
amusement park concession will continue to be a viable recreational asset open to all
persons of Maricopa County. Initial term of the Agreement is from October 1, 2008, through
September 30, 2033, with one (1) twenty-five (25) year renewal option remaining remains
unchanged. There is no financial impact to the County. This is located in Supervisory District
