AN ORDINANCE OF THE CITY OF SURPRISE, ARIZONA,
EXTENDING AND INCREASING THE CORPORATE LIMITS
OF THE CITY OF SURPRISE, ARIZONA MARICOPA
COUNTY, STATE OF ARIZONA BY ANNEXING A PORTION
OF PEORIA AVENUE, EAST OF SARI VAL AVENUE AND WEST
OF REEMS ROAD PURSUANT TO THE PROVISIONS OF
ARIZONA REVISED STATUTES § 9-471 AND AMENDMENTS
THERETO, BY ANNEXING CERTAIN ROADWAY
CONTIGUOUS TO THE EXISTING CITY LIMITS OF THE CITY
OF SURPRISE.
WHEREAS, Arizona law establishes a simplified procedure for annexing
roadway in ARS, § 9-471 (N);
WHEREAS, the real property described in Exhibit A, attached hereto and
incorporated herein by reference, and as illustrated on the map attached hereto as
Exhibit B, which is likewise incorporated herein, is right-of-way (hereafter "right-of-way")
dedicated to the public and located in Maricopa County;
WHEREAS, the City of Surprise, Arizona is desirous of extending and increasing
the corporate limits of the City of Surprise, Arizona to include the right-of-way;
WHEREAS, the right-of-way is adjacent to the existing corporate limits of the City
of Surprise, Arizona for the entire length of the proposed annexation;
WHEREAS, through this Ordinance, the Mayor and Council is requesting the
governing body of Maricopa County, Arizona to give its mutual consent to the
annexation of this right-of-way located within Maricopa County, Arizona; and
WHEREAS, by adoption of this ordinance, it is the intent and desire of the Mayor
and Council of the City of Surprise, Arizona, to annex the right-of-way to the City of
Surprise, Arizona, and to give their mutual consent thereto.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the City of
Surprise, Arizona, as follows:
SECTION 1. That, subject to the concurrence of the Board of Supervisors of
Maricopa County, Arizona, the territory in the Maricopa County right-of-way as
described in Exhibits A and B attached hereto is hereby annexed to the City of Surprise,
Arizona, and that the present corporate limits of the City of Surprise, Arizona are hereby
extended and increased to include the Maricopa County right-of-way described in
Exhibits A and B attached hereto, all of which such right-of-way is contiguous for the
entire length thereof to the present corporate limits of the City of Surprise, Arizona.

SECTION 2. That a copy of this Ordinance, together with an accurate map of the
territory hereby annexed, be forthwith filed and recorded in the office of the County
Recorder of Maricopa County, Arizona.
SECTION 3. The annexation herein provided for shall become effective upon the
last of the following to occur:
1. The effective date of this Ordinance, in the manner prescribed by law, or
2. The date that the consent of the governing body of Maricopa County,
Arizona consenting the annexation herein enacted shall become
effective in the manner provided by law.
PASSED AND ADOPTED by the Mayor and Council of the City of Surprise,

DESCRIPTION
PEORIA AVENUE ANNEXATION
A portion of Section 30 Township 3 North, Range 1 West of the Gila and Salt River Base and
Meridian, Maricopa County, Arizona described as follows:
BEGINNING at the northeast corner of said Section 30 being also the southeast corner of
that real property as described in the City of Surprise Annexation Ordinance 02-15 as
recorded in instrument 2002-1392213, records of said County;
Thence along the east line of said Section 30 South 00 011'40" East 30.00 feet to a point on
the north line of that reel property as described in the City of Glendale Annexation Ordinance
1020 as recorded in Docket 12843 Page 767, records of said County;
Thence along said north line North 89"061 7 0 West 2640.22 feet to a point on the north-south
midsection line of said Section 30;
Thence continuing along said north line North 89°11 1 1" West 2210.72 feet to a point on the
west line of said Section 30;
Thence along said west line North 00°05'17" East 30.00 feet to the Northwest corner of said
Section 30 being the southwest corner of the aforementioned City of Surprise Annexation
Ordinance 02-15;
Thence along the north line of said Section 30 and the south line of said Ordinance 02-15
South 89°11 1 1" East 2210.55 feet to the north quarter corner of said Section 30;
Thence continuing along said north line and said south line South 89°061 7" East 2640.34
feet to the POINT OF BEGINNING.
Containing 3.34 acres, more or less.
