Between the City of Phoenix
and
Maricopa County
This Amendment No.2 to Agreement No. 138048 ("Agreement") is between the
City of Phoenix, a municipal corporation of the State of Arizona ("City"), and Maricopa County, a
political subdivision of the State of Arizona ("Maricopa County") (collectively, "the Parties" or
"Party").
RECITALS
1. The Agreement was entered into on or about January 1, 2014, to provide
reciprocal services for solid waste and recyclable materials.
2. The Agreement will expire on December 31, 2016.
3. The parties mutually desire to amend the Agreement to exercise the second
option and extend the term.
NOW THEREFORE, in consideration of the foregoing mutual promises contained herein and other
good and valuable consideration, the sufficiency and adequacy of which the Parties acknowledge
the City of Phoenix and Maricopa County agree to amend Agreement No. 138048 as follows;
1. The term of the Agreement is hereby extended one (1) year to commence January 1, 2017,
and expire December 31, 2017. This Agreement is subject to termination pursuant to the
provisions of A.R.S. §38-511.
2. The effective date of this amendment is the date of execution by the Maricopa County Boards
of Supervisors.
3. Except as otherwise amended herein, all other terms and conditions of the Agreement and
any prior amendments not in conflict shall remain in full force and effect. If there is a conflict
or ambiguity among amendments and the Agreement, the documents in the following order
prevail and control: (1) the most recent amendment; (2) Amendment No. 1; (3) original
Agreement.
