20. OFFER OF SETTLEMENT AND ABATEMENT SUBJECT TO RECEIPT OF PAYMENT
Approve an offer of $50,000 from receiver of Pizza Revolucion, LLC (“Debtor”) in full
satisfaction of taxes, interest and penalties due for personal property (equipment) tax due
on the parcels noted below and for the specified tax years. Debtor owns 11 stores which
were placed in receivership by a judge. The Receiver sold the restaurants, including the
equipment, in March, 2015 without notice to the Treasurer. When the County learned of the
sale and approached the Receiver about the personal property taxes, the Receiver agreed
to hold funds to pay the taxes, but requested that a portion of the taxes be abated. The
purchase price was not allocated between the real property, the franchise agreements and
the personal property and the Receiver contends the buyer would not have paid more than
$50,000 for the equipment if sold separately, based on the age and condition of the
property sold. On August 11, 2016, after negotiations, the Receiver offered to pay $50,000
of the amount due. Treasurer recommends the County accept the settlement subject to
receipt of payment from the receiver. Authorize the Chair to execute settlement documents
and release of unpaid taxes conditioned on receipt of payment.

The Office of Epidemiology (EPI) would like to request a one-time use of grant fund
balance moneys to create two (2) contract positions for communicable disease
investigators to support the nurse epidemiologists with a surge in Zika investigations and to
assist with additional outbreak investigations. We are currently in the midst of a county
wide Cryptosporidium and a large Salmonella outbreak that are continuing to spread in the
community, both of which have caused us to exceed our epidemiology capacity, which is
already stressed with over 400 Zika investigations ongoing. Because we anticipate the
workload from Zika investigations to continue and likely increase for at least one year, and
the backlog of additional cases from prioritizing work to take even longer, this position
would be active until December 31, 2018

Salary: $65,458
Benefits: $29,622
Indirect Costs: $14,357

55. AQ-2013-002 RULE 345 (VEHICLE AND MOBILE EQUIPMENT COATING)
Pursuant to A.R.S. §49-479(b), set a public hearing for November 2, 2016 to solicit
comments and consider the adoption of Maricopa County Air Pollution Control
Regulations:Rule 345 (Vehicle And Mobile Equipment Coating). Upon Board approval, this
item will become effective November 2, 2016.
Rule 345 limits emissions of volatile organic compounds (VOCs) from motor vehicle and
mobile equipment coating and surface preparation operations. The purpose of this
rulemaking is to update requirements and work practices for vehicle coating operations that
emit VOCs.
Permit fees are not changing due to this action. (C-85-17-010-M-00)

56. AQ-2016-001-INCORPORATION BY REFERENCE 2015-2016
Pursuant to A.R.S. §49-479(b), set a public hearing for November 2, 2016 to solicit
comments and consider the adoption of Maricopa County Air Pollution Control Regulations:
Rule 321 (Municipal Solid Waste Landfills), Rule 360 (New Source Performance
Standards), Rule 370 (Federal Hazardous Air Pollutant Program), Rule 371 (Acid Rain),
and Appendix G (Incorporated Materials). Upon Board approval, this item will become
effective November 2, 2016.
The Maricopa County Air Quality Department (department) is proposing to revise Rules
321, 360, 370, 371, and Appendix G by incorporating federal regulations and documents
promulgated by the U.S. Environmental Protection Agency (EPA): New Source
Performance Standards (NSPS), National Emission Standards for Hazardous Air Pollutants
(NESHAP), Acid Rain and other parts of Title 40 Code of Federal Regulations. The
proposed action will include amending the incorporation by reference date from July 1,
2015, to July 1, 2016, in each of the rules and appendix to remain current with federal
regulations. The adoption of the proposed amendments to Maricopa County Air Pollution
Control Regulations Rules 321, 360, 370, 371 and Appendix G is necessary prior to
requesting the EPA’s delegation of authority to the department for the implementation and
enforcement of the federal regulations and documents.
These amendments should not have an economic impact on businesses in Maricopa
County and should not impose additional costs on the regulated community, small
businesses, political subdivisions, and members of the public beyond that already incurred
by reason of federal or state rule or law. The costs of compliance with these rules have
already occurred and were considered when the federal and state rule or law was
proposed and adopted.
Permit fees are not changing due to this action. The department did not receive any public
comments during the public comment period. (C-85-17-011-M-00)

57. RULE REVISIONS TO ADDRESS THE REQUIREMENTS OF THE STATE
IMPLEMENTATION PLAN FOR “MODERATE” NONATTAINMENT FOR THE 2008
EIGHT-HOUR OZONE NATIONAL AMBIENT AIR QUALITY STANDARD
Pursuant to A.R.S. §§ 49-479(b), set a public hearing for November 2, 2016 to solicit
comments and consider the adoption of Maricopa County Air Pollution Control Regulations:
Rule 322 (Power Plant Operations), Rule 323 (Fuel Burning Equipment From
Industrial/Commercial/Institutional Sources), Rule 324 (Stationary Internal Combustion (IC)
Engines), Rule 336 (Surface Coating Operations), Rule 342 (Coating Wood Furniture And
Fixtures), Rule 350 (Storage Of Organic Liquids At Bulk Plants And Bulk Terminals), Rule
351 (Loading Of Organic Liquids), Rule 352 (Gasoline Delivery Vessel Testing And Use),
Rule 353 (Gasoline In Stationary Dispensing Tanks). The Board is requested to authorize
the Maricopa County Air Quality Department to submit the amended rules as a revision to
the (Arizona) State Implementation Plan. Upon Board approval, this item will become
effective November 2, 2016.
Volatile organic compounds (VOCs) and nitrogen oxides (NOx) are precursors of ozone.
Since Maricopa County has been reclassified to “moderate” nonattainment for the 2008
eight-hour ozone NAAQS, the Clean Air Act requires Maricopa County to implement
reasonably available control technology (RACT) to control VOC and NOx emissions.
The following six rules are being revised to address RACT for VOCs:
AQ-2015-005-Rule 336 (Surface Coating Operations)
AQ-2015-006-Rule 342 (Coating Wood Furniture And Fixtures)
AQ-2015-008-Rule 350 (Storage Of Organic Liquids At Bulk Plants And Bulk Terminals)
AQ-2015-008-Rule 351 (Loading Of Organic Liquids)
AQ-2015-008-Rule 352 (Gasoline Delivery Vessel Testing And Use)
AQ-2015-008-Rule 353 (Gasoline In Stationary Dispensing Tanks)
The following three rules are being revised to address RACT for NOx:
AQ-2015-002-Rule 322 (Power Plant Operations)

On October 23, 2013 the Board of Supervisors approved a ten year fixed price contract
with CGI Technologies and Solutions Inc., for hosting, implementation and ongoing support
services to upgrade the County’s current financial system to an Enterprise Resource
Planning system for a not to exceed price of $44,812,465.
Maricopa County originally purchased its current financial system in 1989 under contract
number 89426. The system was brought online July 1, 1993 and has been continuously
used by the County since that time with minor upgrades. Implementation of CGI’s
Enterprise Resource Planning system will integrate all financial, budget and some
procurement activities (outside Bidsync functionality) onto one platform. Currently, each of
these functions uses different applications that do not effectively communicate with each
other which makes data integration and reporting difficult and expensive. (C-73-14-015-3-
