only be those acceptable to the Maricopa County Environmental Services Department
(MCESD) that can be accommodated by septic systems. A public water system and public
sewer system shall be required prior to establishment of any non-residential use that
requires potable water.
e. The following Maricopa County Department of Environmental Services Department
(MCESD) conditions shall apply:
1. Development and engineering design shall be in conformance with the Maricopa County
Stormwater Quality Management and Discharge Control Regulation. It is required, the
owner/developer to prepare a Stormwater Pollution Prevention Plan and obtain approval by
Maricopa County Environmental Services Department (MCESD) prior to construction. (A
separate submittal to MCESD would be required.) It is required, upon completion of
construction, the owner to fulfill MCESD requirements and obtain a post-construction
stormwater permit.
2. If applicable, the site plan shall contain a note designating the entity responsible for
operation and maintenance of the on-lot stormwater management facilities consistent with
an approved operation and maintenance plan.

Zoning Ordinance. The property owner/s and their successors waive claim for diminution in
value if the County takes action to rescind approval due to noncompliance with conditions.
i. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows the
property owner to enjoy uses in excess of those permitted by the zoning existing on the
date of application, subject to conditions. In the event of the failure to comply with any
condition, a hearing shall be scheduled with the Board of Supervisors for consideration to
revert the zoning that existed on the date of application. It is, therefore, stipulated and
agreed that either revocation due to the failure to comply with any conditions, does not
reduce any rights that existed on the date of application to use, divide, sell or possess the
property and that there would be no diminution in value of the property from the value it
held on the date of application due to such revocation of the Zone Change. The Zone
Change enhances the value of the property above its value as of the date the Zone
Change is granted and reverting to the prior zoning results in the same value of the
property as if the Zone Change had never been granted. (C-44-17-027-M-00)

PZ-3. DILLON AERO
Case #: CPA2016001
Supervisor District: 5
Applicant/Owner: Lewis Roca Rothgerbert Christie / Flying Bucket LLC
Request: Comprehensive Plan Amendment (CPA) to change the land use designation from
Rural Development Area to Heavy Industrial CPA approval is by Resolution.
Site Location: Generally located west of 99th Ave. approximately 2 miles south of
Schumacher Ln.
Commission Recommendation: On 9/8/16, the Commission voted 6-0 to recommend
approval of CPA2016001 subject to conditions ‘a’ – ‘c’:
Provided the following conditions are met:
a. Development of the site shall be in conformance with the Narrative Report entitled
“Dillon Test Range General Comprehensive Plan Amendment”, consisting of 23 pages
including the land use exhibit, dated stamped received July 1, 2016, except as modified by
the following conditions. The Comprehensive Plan Amendment shall only apply to parcels
300-32-001A and 300-32-001D. Within 30 days of Board of Supervisors approval, the
applicant shall submit a revised Comprehensive Plan Amendment narrative report that
references the two parcels
utilized for the test range operations.
b. If the Board reverts the zoning back to Rural-190, this land use plan shall be considered
for amendment to change the land use designation back to Rural Development Area. The
Comprehensive Plan Amendment shall only apply to parcels 300-32-001A and 300-32-
001D for the test range operations.
c. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows the
property owner to enjoy uses in excess of those permitted by the land use existing on the
date of application, subject to conditions. In the event of the failure to comply with any
condition of approval, the property shall change to the land use designation that existed on
the date of application. It is, therefore, stipulated and agreed that such change due to the
failure to comply with any conditions does not reduce any rights that existed on the date of
application to use, divide, sell or possess the property and that there would be no
diminution in value of the property from the value it held on the date of application due to
such change. (C-44-17-029-M-00)

 Supervisor Barney recused himself and left the dais 
Matthew Holm, Principle Planner of Planning and Development, provided a review of
items PZ-3 through PZ-4 noting site specifications and general location. He stated
multiple emails were received in opposition requiring for a super majority vote. Mr.
Holm indicated the Planning Commission approved the items with the indicated
conditions.
Heidi Short, representative for Dillon Aero, introduced the following individuals: Chris
Dillon, representing Dillon Aero; Greg Aguirre, Vice President of Dillon Aero Operations;
Mark Barnes, Dillon Aero Co-Counsel and who provides counsel on foreign trade zone
and firearms issues; she also indicated that Shelby Scharbach advised on technical
foreign trade zone questions. She gave a short presentation which contained photos
and information about the proposal request, property location, property layout, zoning
specifications, previous County approvals, aerial photos of location indicating area of
requested rezone, proximity of location to residential areas, locations of buffer area,
foreign trade zone location and specifics, testing locations, history of Dillon Aero and
property uses, equipment styles and uses, property improvements, property safety and
security, and adjacent landholder locations.
Supervisor Kunasek requested more information on firearms specifics. Greg Aguirre,
Vice President of Dillon Aero Operations, approached the podium to answer questions
regarding firearm specifics. Discussion ensued on firearm makes, models and
ammunition types used for testing at the location.
Supervisor Gallardo requested the applicant address the concerns brought forth, the
notification to adjacent property owners and how the concerns were addressed. Ms.
Short noted the following concerns were brought to their attention from adjacent
property owners and have been addressed: flight patterns are at minimal impact to
adjacent property owners; berms have been adjusted to 20’ to provide more land
protection along the buffers; information was mailed to adjacent property owners and
she was only contacted by a few that had concerns addressed.
The following individuals were registered in favor of items PZ-3 and PZ-4:
Mark Barnes
Greg Agirre
Carla Lee, resident, registered in opposition of the item then presented a video and
pictures. She noted she is in opposition due to safety concerns, the firing of weapons
outside of the berms as she has found shell casings within her property, the time in
which firing of weapons is done in the evenings through early morning and noted that
Dillon Aero has been operating outside of their zoning purposes for a length of time.
 Supervisor Chucri left the meeting 
Ms. Lee noted the proximity of the Dillon Aero location to residential areas and the
potential risk to the citizens.
 Supervisor Chucri returned to the meeting 
Ms. Lee noted that resident concerns are not being heard and requested that the Board
delay the applicant’s request in order to address the safety concerns.

Formal Meeting Minutes

Supervisor Chucri asked when she purchased her property as Dillon Aero has been in
operation for decades. Ms. Lee responded that she bought the property in 2004 and
stated there was no disclosure of Dillon Aero operating within the area. She stated a
contract was brought to the residents just days ago and a delay would give the residents
and Dillon Aero time to negotiate.
Dale Micetic, resident, noted the parcels he purchased in 2006.
Mr. Micetic purchased five acres to build a second home for the quiet and remote
location. Prior to purchasing the property he also did not discover any testing of
firearms being done near the location.
Mr. Micetic noted his concern that Dillon Aero’s years of nonconforming zoning use of
the property is only being brought before the Board because of their desire to
commercialize the firearms. He said the voice of the individual residents seems to be
much smaller than a 600 plus acre business that will feed tax dollars to the County. Mr.
Micetic applauded Dillon Aero on their success but his land value is now diminished and
he can no longer use the land for the intended purpose. He requested that the Board
deny or delay the applicant’s request.
Rudy Ruiz, resident, noted his opposition of the item, which included the extensive
zoning research he did prior to purchasing the property, which did not reveal this
problem, and Dillon Aero’s years of zoning noncompliance which they should be held
responsible for. He presented several photos of his property in proximity to the
applicant, historical landmarks within the area and photos showing the testing areas in
proximity to residential properties causing concerns. Mr. Ruiz requested that the Board
deny the applicant’s request.
JoAnn Lassell, resident, noted her opposition to the item. She explained that in 2005
she purchased approximately five acres and had no knowledge of there being a testing
range nearby. She spoke of an experience where she was approached by a man in a
helicopter while driving to her property and was told to leave the premises. It was not
until that experience that she was given any knowledge of the testing being done within
the area. Ms. Lassell stated she objects to the item, said the applicant purchased
portions of the property within the last two years knowing it was zoned residential and
spoke of her concern for the residents being located in the middle of the buffer area.
She questioned the applicant’s operational testing dates and times.
Ms. Lassell indicated her concern of being driven off her property each time testing is
taking place at the applicant’s location.
Steve Rees, resident, spoke in opposition of the item. He requested that the Board
delay the applicant’s request because of the following reasons: the residents recently
received offers but have not been given sufficient time for discussions with the
applicant, safety concerns of residents have not been addressed, berm height conflicts
and the direction firearms are said to be tested conflicts with what residents have
witnessed.
Daniel Ong, resident, spoke in opposition of the item. He stated in 1987 he bought 40
acres of property in the vicinity before firearms were ever tested in the area and his
property value has changed. He requested that the applicant’s request be delayed
because the residents recently received a proposal from the applicant and they have not
had time to assess.

Formal Meeting Minutes

Chairman Hickman noted a letter of approval was received from Luke Air Force Base
and placed on file.
Ms. Short addressed the residents’ concerns stating 378 acres of buffer zone is
intended to be open space, she noted the timeline on the proposals offered to the
residents and assured the Board that the firearms are not discharged in a northern or

Supervisor Kunasek asked what the zoning requirement is for the discharge of firearms.
Mr. Holm stated under the zoning ordinance a testing facility such as Dillon Aero falls
within Industrial 3 and in this particular instance the requirement for a rezone from the
Rural 190 to the Industrial 3 is triggered. The Industrial Unit Plan of Development
(IUPD) overlay will help limit the use and prohibit other uses that may require heavier
infrastructure such as water and sewer.
Supervisor Kunasek said the State Legislature passed a bill in the past that limited the
approval of shooting ranges and the discharge of firearms. He asked if legal research
has been done to make sure the ordinance is in conformance with state statute. Mr.
Holm responded he is not aware of any issues with the zoning ordinance not being in
compliance with state statute.
Supervisor Kunasek noted the safety issues that brought about the regulation of
shooting ranges and the discharge of firearms and asked if staff is aware of any
drainage issues. Mr. Holm responded that staff has looked at the site with no specific
concerns and noted if there are changes in height to the berms then an additional
review of the drainage plans would occur. Discussion ensued regarding drainage flow.
Supervisor Kunasek noted continuing the item has been brought up and it may be a
good idea to make sure the ordinance is in accordance with state statute.
Supervisor Chucri concurred with Supervisor Kunasek noting that additional time would
allow the residents and the applicant to consider the specifications on the proposals
they received.
Supervisor Gallardo spoke regarding concerns on firearm discharge overspray and
noted additional time should be given to allow property owners and the applicant to
continue discussions.
Chairman Hickman stated continuing the item would allow the residents’ concerns to be
addressed and asked the applicant if continuing the item would create any difficulty.
Ms. Short responded that two weeks would not create a problem.

Commission Recommendation: On 9/8/16, the Commission voted 6-0 to recommend
approval of Z2016004 subject to conditions ‘a’ – ‘k’:
Provided the following conditions are met:
a. Development of the site shall be in conformance with the Site Plan entitled, “Dillon Aero
Flying Bucket Property”, consisting of 10 full-size sheets, stamped received July 1, 2016
except as modified by the following conditions. Within 30 days of Board of Supervisors
approval, the applicant shall submit a revised site plan showing the IND-3 IUPD zoning
district only applies to the testing operations on parcels 300-32-001A and 300-32-001D and
identify the location of the proposed 20’ (h) berms.
b. Development of the site shall be in conformance with the Narrative Report entitled
“Dillon Aero Test Range Rezoning Request”, consisting of 13 pages stamped received
August 16, 2016, except as modified by the following conditions. Within 30 days of Board
of Supervisors approval, the applicant shall submit a revised narrative report indicating the
IND-3 IUPD zoning district only applies to the testing operations on parcels 300-32-001A
and 300-32-001D and address the location and height of the proposed 20’ (h) berms.
c. The applicant/property owner shall submit a ‘will serve’ letter from The Goodyear Fire
Department or other fire department approved by Maricopa County staff for fire protection
services for the project site. Alternatively, Maricopa County staff may accept alternative
means of fire protection deemed acceptable to staff. A copy of the ‘will serve’ letter or other
materials deemed acceptable by Maricopa County staff shall be required as part of the
initial construction permit submittal.
d. The owner shall apply for building permits for all existing structures. The owner shall
receive final inspections on all existing structures from Planning and Development within
one year from Board of Supervisors approval of Z2016004.
e. Approval of this Zone Change is contingent upon compliance at all times with all
conditions and requirements imposed on the property or applicant by Alcohol, Tobacco,
Firearms and Explosives (ATF); Homeland Security (HS); and all U.S. Customs and Border
Protection (CBP) requirements for the property, applicant or operations and the associated
Foreign Trade Zone. If at any time the property, applicant or operations are not in full
compliance with all ATF, HS or CBP requirements or if the applicant uses the property for
commercial recreational and sporting purposes (such as charging a fee to allow members
of the public to target practice or otherwise use the property), the zoning may be scheduled
for public hearing by the Maricopa County Board of Supervisors (Board), upon
recommendation by the Maricopa County Planning and Zoning Commission (Commission),
to consider revocation of zoning.
f. The applicant/owner shall submit a written report outlining the status of the development

1. Building Height – Maximum 50’
2. Parking – 0 spaces provided
3. Screening – 4’ (h) cattle fencing with warning signs
h. The following Engineering condition shall apply:
1. All development shall include its associated infrastructure, including but not limited to
roads, drainage channels and swales, and retention. Each area developed for the purpose
of this use shall provide or exceed its required 100-year, 2-hour retention volume. All
retained water, up to 100-year, 2-hour storms volume, shall drain within 36 hours of the
storm event that provided the retained storm water. All drainage infrastructure shall be
connected to its downstream elements so as to create a connected system according to
the layout and designs submitted. No drainage infrastructure shall be reduced in capacity
or effectiveness going downstream.
i. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a
revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance.
j. The property owner/s and their successor waive claim for diminution in value if the
County takes action to rescind approval due to noncompliance with conditions.
k. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows the
property to enjoy uses in excess of those permitted by the zoning existing on the date of
application, subject to conditions. In the event of the failure to comply with any condition,
the property shall revert to the zoning that existed on the date of application. It is, therefore,
stipulated and agreed that either revocation due to the failure to comply with any
conditions, does not reduce any rights that existed on the date of application to use, divide,
sell or possess the property and that there would be no diminution in value of the property
from the value it held on the date of application due to such revocation of the Zone
Change. The Zone Change enhances the value of the property above its value as of the
date the Zone Change is granted and reverting to the prior zoning results in the same value
of the property as if the Zone Change had never been granted. (C-44-17-030-M-00)

54. PROPOSED REVISIONS OF THE MARICOPA COUNTY PARKS AND RECREATION
DEPARTMENT USER FEE SCHEDULE
Pursuant to A.R.S. §11-251.08 and 11-251.13, set a public hearing for December 7, 2016
to solicit comments and consider the adoption of proposed revisions of the Maricopa
County Parks and Recreation Department User Fee Schedule. Upon Board approval, this
item will become effective January 1, 2017.
By this action, the Department wishes to:
1. adopt a $5/person general admission fee for users of the Hassayampa River Preserve
Conservation area for users over 12 years old;
2. adopt a $100/day fee for the use of the DOC kitchen;
3. reduce the annual pass replacement card fee to $3.00; and,
4. remove the room restriction on the meeting room fee.
Upon Board approval, these fee changes will become effective January 1, 2017, except as
to members of the Friends of Hassayampa and The Nature Conservancy who will pay the
new fees on January 1, 2018 as more fully detailed below.
The adoption of a Hassayampa River Preserve entrance fee is in anticipation of the
transfer of operation and ownership of the Hassayampa River Preserve from The Nature
Conservancy (TNC) to the County. TNC currently charges $5.00 per person admission for
the general public; $3.00 per adult for TNC members with children 12 and under admitted
free; and free entry for each member of the Friends of Hassayampa and holders of a TNC,
Arizona Chapter Pass (limit 2 adults/pass). Maricopa County proposes one fee for all

parties $5.00 per person with children under 12 admitted for free. However, pursuant to the
County’s Operations Plan with TNC, current members of Friends of Hassayampa, holders
of TNC, Arizona Chapter Passes and TNC Members, will pay fees currently charged by
TNC through December 31, 2017. After that time, general admission fee will be
$5.00/person for all entrants, except children 12 and under free. This entry fee and the
remaining fee changes will enable the Department to apply any changes in fees to off-set
park operations and maintenance.
The Parks and Recreation Commission held a public meeting regarding the proposed fee
revisions on September 20, 2016. No comments were received from the public. The
meeting was advertised on the Parks’ website and in the parks. The changes to fees
