a. Development of the site shall be in conformance with the Narrative Report entitled
“Dillon Test Range General Comprehensive Plan Amendment”, consisting of 23 pages
including the land use exhibit, dated stamped received July 1, 2016, except as modified by
the following conditions. The Comprehensive Plan Amendment shall only apply to parcels

c. The granting of this change in use of the property has been at the request of the

compliance with all ATF, HS or CBP requirements or if the applicant uses the property for
commercial recreational and sporting purposes (such as charging a fee to allow members

k. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows the
property to enjoy uses in excess of those permitted by the zoning existing on the date of
application, subject to conditions. In the event of the failure to comply with any condition,
the property shall revert to the zoning that existed on the date of application. It is, therefore,
stipulated and agreed that either revocation due to the failure to comply with any
conditions, does not reduce any rights that existed on the date of application to use, divide,
sell or possess the property and that there would be no diminution in value of the property
from the value it held on the date of application due to such revocation of the Zone
Change. The Zone Change enhances the value of the property above its value as of the
date the Zone Change is granted and reverting to the prior zoning results in the same value
of the property as if the Zone Change had never been granted. This item was continued
from the October 5, 2016 meeting. (C-44-17-030-M-00)

31. AMENDMENT LEASE AGREEMENT WITH BAR/JCR PHX FLEX INVESTORS, LLC AS
SUCCESSOR IN INTEREST TO VINEYARD/KIOWA, LLC.
Formal Meeting Minutes
Wednesday, October 19, 2016
Approve, and authorize the Chairman to execute, Amendment No. 6 to Lease No. L-7330
with BAR/JCR PHX Flex Investors, LLC, a Delaware Limited Liability Company., as
successor in interest to Vineyard/Kiowa, LLC (Lessor) for 10,557 square feet of
office/classroom space located at 2150-1 South Country Club Drive, Mesa, Arizona.
Maricopa County Head Start is currently leasing 18,508 square feet of office space at
2150-1 South Country Club Drive in Mesa. Due to Program budget cuts and a reduction in
staff, Head Start no longer needs to occupy the entire space. Amendment No. 6 will reduce
the size of the Leased Premises to 10,557 square feet, establish a fixed monthly rent,
memorialize the landlord refurbishment work required to demise the premises, and extend
the term of the lease. Head Start will reimburse the Lessor for one-half of the cost of the
work to demise the premises in an amount not to exceed $16,280.00. Effective November
1, 2016, the annual rental rate will be $195,304.50 ($18.50/sf) plus rental tax of 2.25%. By
this Amendment the term of the Agreement shall commence on November 1, 2016, and
extend for three (3) years through October 31, 2016, unless terminated earlier as provided
for in the Agreement. County’s use of the property also includes the right to use five (5)
parking spaces per 1,000 square feet of rentable space, which includes one (1) covered
reserved parking space per 1,000 square feet of rentable space, and four (4) uncovered
reserved parking spaces. The County may terminate the Lease at the end of any fiscal
year for non-availability of funds. All other terms and conditions of the original Agreement
as amended and approved not amended hereby remain in full force and effect.
This Agreement is subject to termination pursuant to the provisions of A.R.S. §38-511, the
provisions of which are incorporated herein by this reference. (C-22-03-110-4-07)

32. EXCEPTION TO MULTILINGUAL PAY POLICY
Approve an exception to the Multilingual Pay Policy (B7005) and allow Head Start/Early
Head Start employees who were receiving journey level multilingual pay prior to their
contracts ending at the end of FY 2016 due to a change in funding and who were rehired in
FY 2017 to receive multilingual pay on their rehire date without retaking the multilingual pay
test.
The Multilingual Pay Policy states “An employee who has or is receiving journey level
multilingual pay must retake the journey level test b) If reinstatement of multilingual pay is
desired when the employee leaves County employment and subsequently returns.” The
policy also states “Unless otherwise specified, the effective date for the implementation of
journey level multilingual pay will be the first day of the next pay period after the employee
passes the journey level test.”
Because the separation was temporary due to a change in funding, Human Services would
like to request this exception. This would reduce the time and resources needed for these
employees to retake the journey level multilingual pay test that they already passed. (C-22-

47. AQ-2016-003-RULE 280 (PROPOSED FEES)
Pursuant to A.R.S. §49-479(b), set a public hearing for January 4, 2017 to solicit comments
and consider the adoption of proposed amendments to Maricopa County Air Pollution
Control Regulations Rule 280 (Fees). Following the public hearing, the Board is requested
to adopt the proposed amendments to Rule 280 (Fees). Upon Board approval, this item will
become effective January 4, 2017.
Rule 280 establishes the fees charged to owners and operators of sources of air pollution.
The Maricopa County Air Quality Department (department) is largely funded by a fee for
service model by charging permit application fees, annual administrative fees, hourly fees
for staff time to process Title V and Non-Title V permit applications and emission based
fees. Revenues generated from fees cover the operating costs of several programs within
the department. Currently, revenues generated by fees exceed the expenses of the fee
funded programs within the department, resulting in a yearly positive balance in the
department’s fee fund. The department is proposing dust control permit fee reductions in
Rule 280 to balance fee revenues with the expenses of the department’s fee funded dust
program. Rule 280 was last revised in 2010 and fees have been adjusted annually
thereafter per the Consumer Price Index (CPI). The department is unable to revise the fee
rule annually; therefore, fee adjustments are made annually per the CPI and a revised fee
schedule is established annually. The revised fee schedule is posted annually on the
department’s website. The department is proposing to update all of the Title V, Non-Title V
and General Permit fees to the most current 2017 Air Quality Fee Schedule. In addition,
the department is proposing to make several other revisions to update and improve Rule
280, including asbestos refunds options, accelerated permit processing, and expanded
general permit options. (C-85-17-012-M-00)

approved the receipt of two FEMA awards totaling $373,191. Since then, FEMA has
alerted the District to an error in the calculation of the award. Subsequently, the District

storm, combined with the remnants of Hurricane Norbert, causing record precipitation
amounts and flooding in Arizona. Flood Control District of Maricopa County sustained
heavy deposits of vegetation, trash, sediment, and debris at is various dam structures,
compromising their integrity. The storms also damaged some structures, which required
repairs by the District.
On October 23, 2014, the District entered into a disaster assistance agreement with the
State of Arizona Department of Emergency and Military Affairs (DEMA) to be reimbursed
for 75% of the cost of repairs. On November 5, 2014, Governor Brewer’s request for
Disaster Declaration in Maricopa County was approved by President Obama. As a result,
the Federal Emergency Management Administration (FEMA) made funding available to
reimburse the District for debris removal and repairs around the County. Federal dollars
would come to the District through DEMA as well.
The District received two notices of award. On April 28, 2016, it received the first award
letter for $17,489. On May 27, 2016, it received the second award letter for $355,702. On
