accordance with their requirements.
s. The applicant or his successor shall obtain approval of any development plans from the
applicable Fire Marshall prior to any construction.
t. This Special Use Permit shall expire forty (40) years from the date of approval by the

Permit as set forth in the Maricopa County Zoning Ordinance.
y. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval is temporary
and allows the property to enjoy uses in excess of those permitted by the zoning existing
on the date of application, subject to conditions and stipulations. In the event of the failure
to comply with any condition or stipulation, and at the time of expiration of the Special Use
Permit, the property shall revert to the zoning that existed on the date of application. It is,
therefore, stipulated and agreed that either revocation due to the failure to comply with any
conditions or stipulations, or the expiration of the Special Use Permit, does not reduce any
rights that existed on the date of application to use, divide, sell or possess the property and
that there would be no diminution in value of the property from the value it held on the date
of application due to such revocation or expiration of the Special Use Permit. The Special
Use Permit enhances the value of the property above its value as of the date the Special
Use Permit is granted and reverting to the prior zoning results in the same value of the
property as if the Special Use Permit had never been granted.
z. If a building permit for the facility has not been issued by May 11, 2022, this SUP and the
related Comprehensive Plan Amendments (CPA200808, CPA2009016, CPA200917, and
CPA200919) will be scheduled for public hearing by the Maricopa County Board of
Supervisors, upon recommendation by the Maricopa [County] Planning and Zoning
Commission, to consider reverting the zoning to Rural-190 and the related land use
designations to Open Space and Rural respectively. Additionally, in the event of reversion,
the Land Management Plan associated with CPA200004 shall be implemented.
aa. Prior to any ground disturbance activities and prior to the issuance of any construction
permits, the developer shall provide assurance in an amount and form acceptable to the
Maricopa County Planning & Development Department sufficient to restore or stabilize the

entire site in the event the project is abandoned, expires, or otherwise becomes defunct.
Additionally, in the event of reversion, the Land Management Plan associated with

h. At the time of each precise Plan of Development the applicant shall demonstrate
compliance with the Carefree Highway Scenic Corridor Study Design Standards.
i. The following Maricopa County Department of Environmental Services Department
(MCESD) conditions shall apply:
1. The onsite septic system designs will be submitted to MCESD for approval. Wastewater
discharge will consist of typical sewage only, and will not include any motor oil, gasoline,
paint, varnish, solvent, pesticides, fertilizer, or other material not generally associated with
toilet flushing, food preparation, laundry, or personal hygiene (ACC R18-9-A309.7a).
2. The owner will abandon the septic systems and connect to a public sewer system when
one is available, and participate in a fair share of the public sewer system funding.
3. Development and engineering design shall be in conformance with the Maricopa County
Stormwater Quality Management and Discharge Control Regulation. The owner/developer
shall prepare a Stormwater Site Plan (SWPP) and obtain approval by MCESD prior to
construction (a separate submittal to MCESD is required).
4. Upon completion of construction, the owner shall fulfill MCESD post-construction permit
requirements. This will include appropriate operation and maintenance requirements.
5. The property will be developed according to the permitted and prohibited land use table.
j. The property owner shall submit a ‘will serve’ from the Daisy Mountain Fire Department
for fire protection services for the project site. A copy of the ‘will serve’ letter shall be
required as part of the initial construction permit submittal.
k. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a
revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance.
l. The property owner/s and their successors waive claim for diminution in value if the
County takes action to rescind approval due to noncompliance with conditions.
m. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows the
property to enjoy uses in excess of those permitted by the zoning existing on the date of
application, subject to conditions. In the event of the failure to comply with any condition,
the property shall revert to the zoning that existed on the date of application. It is, therefore,
stipulated and agreed that either revocation due to the failure to comply with any
conditions, does not reduce any rights that existed on the date of application to use, divide,
sell or possess the property and that there would be no diminution in value of the property
from the value it held on the date of application due to such revocation of the Zone
Change. The Zone Change enhances the value of the property above its value as of the
date the Zone Change is granted and reverting to the prior zoning results in the same value
of the property as if the Zone Change had never been granted.
n. Zoning approval is conditional per Maricopa County Zoning Ordinance, Article 304.6,
and ARS § 11-814 for seven (7) years for the initial construction permit outside of the
Special Use Permit area and an additional seven (7) years for each subsequent phase,
within which time the subdivision infrastructure permit or construction permit for each
phase must be obtained. The applicant may request an extension of this timeframe
pursuant to MCZO requirements. The applicant shall submit a written report every seven
years from the date of Board of Supervisors approval of Z2015013 which details the status

of this project, including progress on obtaining subdivision infrastructure and/or
construction permits. The status report to be administratively reviewed by Planning and
Development with the ability to administratively accept or to carry the status report to the
Board of Supervisors (Board), upon recommendation by the Planning and Zoning
Commission (Commission) for consideration of amendments or revocation of zoning for
undeveloped parcels. Status reports will be required until completion of the initial
subdivision infrastructure and/or construction permits for each zoning parcel (C-2 CUPD).
(C-44-17-036-M-00)
Darren Gerard, Assistant Director, Planning and Development, provided background
information on items PZ-6 to PZ-7 noting a zone change, permitted uses and the project
phases. He said it is the recommendation of the Planning Commission to approve the
requests.
Ed Bull, representing the applicant through Arizona Commercial Real Estate, presented
architectural designs of the building, dimensions of the building, building aesthetics,
signs, the locations of the signs, landscaping, and photos of the location in reference to
major and minor arterial roads. He noted all issues have been resolved with the
community.
Supervisor Kunasek noted other projects along Carefree Highway and the significant
amount of work that has gone into the project.
Paul McAllister, representing New River/Desert Hills Community Association, Inc., read
from and offered a letter to the Clerk to place on file. He has been a resident since
1994 and has provided advice on Planning and Development issues since 1998. His
background as a general contractor was working on design and construction of
commercial and residential projects. He noted his concern that if the project is
approved as presented the impact may be more than what is intended.
Ann Hutchinson, representing New River/Desert Hills Community Association, Inc., read
from and offered a letter to the Clerk to place on file. She has been a resident since
1994 and is currently the Planning and Development Liaison for the Association. She
noted several itemized concerns for both items PZ-6 and PZ-7: condition “h” standards
being ignored; proximity of proposed access to Carefree Highway too close to 7th Street;
recommended conditions “d” and “c” to allow uses that are not among the study
recommended uses; no explanation for low water use; and plan to reroute existing
washes into new channel may not address the concerns raised in the September 2004
Adobe Dam/Desert Hills Area Drainage Master Plan; movement of the wash to be
approved administratively.
Mr. Gerard indicated the Department would need to come back to the Board to approve
any changes to the alignment. Supervisor Kunasek asked what would happen if the
conveyance does not happen. Mr. Gerard responded that the site plan layout would
remain the same and would have to come back to the Board of Supervisors for
approval.
Ms. Hutchinson noted concerns on signage dimensions, signage height and lighting.
There was discussion on several specific conditions. Mr. Bull addressed the concerns
with photos and details of the exterior wall sign dimensions and lighting; monument sign
dimensions and location determinations due to certain constraints; development of
additional access roads as the location develops; and light pole specifics on type,
dimensions and locations.

does not represent final design approval nor shall it entitle applicants to future designs that
are not in conformance with current County Design Standards.
g. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a
revocation of this Special Use Permit as set forth in the Maricopa County Zoning
Ordinance.
h. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows the
property to enjoy uses in excess of those permitted by the zoning existing on the date of
application, subject to conditions. In the event of the failure to comply with any condition,
and at the time of expiration of the Special Use Permit, the property shall revert to the
zoning that existed on the date of application. It is, therefore, stipulated and agreed that
either revocation due to the failure to comply with any conditions, or the expiration of the
Special Use Permit, does not reduce any rights that existed on the date of application to
use, divide, sell or possess the property and that there would be no diminution in value of
the property from the value it held on the date of application due to such revocation or
expiration of the Special Use Permit. The Special Use Permit enhances the value of the
property above its value as of the date the Special Use Permit is granted and reverting to
the prior zoning results in the same value of the property as if the Special Use Permit had

the (Arizona) State Implementation Plan. Upon Board approval, this item will become
effective November 2, 2016. (C-85-17-009-M-00)
Volatile organic compounds (VOCs) and nitrogen oxides (NOx) are precursors of ozone.
Since Maricopa County has been reclassified to “moderate” nonattainment for the 2008
eight-hour ozone NAAQS, the Clean Air Act requires Maricopa County to implement
reasonably available control technology (RACT) to control VOC and NOx emissions.
The following six rules are being revised to address RACT for VOCs:
AQ-2015-005-Rule 336 (Surface Coating Operations)
AQ-2015-006-Rule 342 (Coating Wood Furniture And Fixtures)
AQ-2015-008-Rule 350 (Storage Of Organic Liquids At Bulk Plants And Bulk Terminals)
AQ-2015-008-Rule 351 (Loading Of Organic Liquids)
AQ-2015-008-Rule 352 (Gasoline Delivery Vessel Testing And Use)
AQ-2015-008-Rule 353 (Gasoline In Stationary Dispensing Tanks)
The following three rules are being revised to address RACT for NOx:
AQ-2015-002-Rule 322 (Power Plant Operations)

Pursuant to A.R.S. §49-479(b), convene the scheduled public hearing, to solicit comments
and consider the adoption of Maricopa County Air Pollution Control Regulations: Rule 321
(Municipal Solid Waste Landfills), Rule 360 (New Source Performance Standards), Rule
370 (Federal Hazardous Air Pollutant Program), Rule 371 (Acid Rain), and Appendix G
(Incorporated Materials). Upon Board approval, this item will become effective November
2, 2016.
The Maricopa County Air Quality Department (department) is proposing to revise Rules
321, 360, 370, 371, and Appendix G by incorporating federal regulations and documents
promulgated by the U.S. Environmental Protection Agency (EPA): New Source
Performance Standards (NSPS), National Emission Standards for Hazardous Air Pollutants
(NESHAP), Acid Rain and other parts of Title 40 Code of Federal Regulations. The
proposed action will include amending the incorporation by reference date from July 1,
2015, to July 1, 2016, in each of the rules and appendix to remain current with federal
regulations. The adoption of the proposed amendments to Maricopa County Air Pollution
Control Regulations Rules 321, 360, 370, 371 and Appendix G is necessary prior to
requesting the EPA’s delegation of authority to the department for the implementation and
enforcement of the federal regulations and documents.
These amendments should not have an economic impact on businesses in Maricopa
County and should not impose additional costs on the regulated community, small
businesses, political subdivisions, and members of the public beyond that already incurred
by reason of federal or state rule or law. The costs of compliance with these rules have
already occurred and were considered when the federal and state rule or law was
proposed and adopted.
Permit fees are not changing due to this action. The department did not receive any public
comments during the public comment period. (C-85-17-011-M-00)
