This request concerns the lawsuit entitled DDAVP INDIRECT PURCHASER ANTITRUST

51. LICENSE AGREEMENTS WITH CITY OF PHOENIX AVIATION FOR TWO HANGARS
AT DEER VALLEY AIRPORT
Approve License Agreements P-50261 and P-50262 with the City of Phoenix Aviation
Department for the County’s use of two T-hangars at Deer Valley Airport; and authorize the
County Manager, or his designee, to execute replacement license agreements, as may be
required by the City of Phoenix Aviation Department, to document future contemplated
replacements for the two T-hangars initially assigned to the County.
These revocable license agreements provide the County use of two T-hangars at the Deer
Valley Airport to house MCSO’s fixed wing aircraft. The term of these license agreements
will continue until terminated by either party. The County may terminate either of these
license agreements with five (5) days prior written notice. The City of Phoenix Aviation
Department may terminate either of these license agreements with 30-days prior written
notice. The initially assigned T-hangars will not be in the optimum location at Deer Valley
Airport for use by MCSO. The City of Phoenix Aviation Department will work with the
County to replace the County’s assigned hangars with substitute T-hangars that are in
more advantageous locations at Deer Valley Airport to better support the operations of
MCSO. The City of Phoenix Aviation Department will require the County to execute a
replacement license agreement in the event the County substitutes any of the County’s
assigned T-hangars. This agenda item authorizes the County Manager, or his designee, to

arterial incident response program that provides emergency traffic management. The
purpose of this Agreement is to commence phase II of program with the City of Scottsdale.
The City will seek reimbursement of three equipped REACT vehicles and operate a City
owned REACT program.
On January 23, 2013, the Board of Supervisors approved an agreement to allow the
County to administer and utilize the Project funds to provide REACT services in the City.
This allowed the City the opportunity to obtain additional information regarding the
operational and financial commitments required to establish a City operated REACT
program.
The City has determined they would like to operate their own city REACT program. This
agreement will allow them to procure three equipped REACT vehicles and operate a City
REACT program beginning October 1, 2015. As a part of the Project funds, the City has
provided an in-kind contribution for $96,600 for the development of incident management
signal timing plans for the County REACT members.

56. IGA WITH THE CITY OF CHANDLER FOR ABANDONMENT AND ANNEXATION OF
WILLIS ROAD AND MCQUEEN ROAD
Approve the intergovernmental agreement (Agreement) between Maricopa County (the
“County”) and the City of Chandler (the “City”) for abandonment and annexation of Willis
Road and McQueen Road. This Agreement defines the responsibility of the County and the
City with respect to the abandonment and annexation of Willis Road and McQueen Road,
pursuant to Arizona Revised Statutes ( A.R.S.) Sections 28-304 and 28-7209.
McQueen Road from State Route 202L (Santan Freeway) to Willis Road is located in
southeastern Maricopa County and is partly under the jurisdiction of the County, the City
and the State of Arizona. The City’s Council approved a gated community located east of
the southeast corner of McQueen and Willis Roads. In conformance with the zoning
approval, a median break is needed at this intersection. To accomplish this project in a
timely manner, the City needs to acquire right- of-way that is currently under the control of
Arizona Department of Transportation (ADOT). However, due to provisions in state law
related to annexation, ADOT must first abandon the right-of-way to the County because the
area lies within unincorporated Maricopa County. The City will subsequently annex this
County right-of-way through the normal statutory process.
Under Arizona Revised Statutes (A.R.S.) Section 28-7209, ADOT must provide a four-year
advance notice of abandonment to an affected jurisdiction and the pavement must be in
such a condition that additional surface treatments and major maintenance are not required
for at least five years. However, the same statute allows ADOT and the affected local
jurisdiction to waive these requirements by mutual agreement. This waiver is needed to
ensure the City of Chandler can acquire the right-of-way to complete their project.
On April 9, 2014, the Board of Supervisors authorized the Maricopa County Department of
Transportation (MCDOT) Director/County Engineer to officially request these types of
abandonments from ADOT and to also agree to waive the specific statutory requirements
for these abandonments. This waiver would ultimately be agreed to by the State
Transportation Board. The County has no responsibility, financial or otherwise, for any

61. ROAD DE-ANNEXATION FROM CITY OF PEORIA TO MARICOPA COUNTY
Pursuant to A.R.S. §9-471.03(D), set a hearing for February 18, 2015 to determine if the
public interest is served by de-annexing road right-of-way from City of Peoria jurisdiction to
Maricopa County in accordance with Peoria Ordinance No. 2014-32. Also, for the hearing,
direct MCDOT to prepare an analysis of the requested action.
Right-of-way location: 99th Avenue from North of Olive Avenue to Peoria Avenue.
At the hearing, if after reviewing the analysis and hearing those that may appear for or
against the action, the Board determines that the public interest is served by this de-
annex/annexation action, the Board shall file in the Clerk of the Board’s Office an ordinance
setting forth the legal description of the public right-of-way and declare the return of the
right-of-way contingent on the fulfillment of the additional conditions of the statute which
would include setting a second public hearing on this matter.
MCDOT Analysis: The City of Peoria annexed a land area east of a line 40’ east of the 99th
Avenue section line on May 23, 1963. On November 21, 1966, The Board of Supervisors,
adopted a resolution declaring 99th Avenue to 65 feet east of the 99th Avenue section line
for a road improvement project, project 56-372. A 25 foot strip of the roadway declared was
in Peoria jurisdiction. By declaration of 99th Avenue, the operation and maintenance of the
25’ strip in Peoria jurisdiction was assumed by Maricopa County. The Department of
Transportation has maintained the entire width of 99th Avenue to 65’ east of the 99th
Avenue section line since the construction of the MCDOT road improvement project. Since
a 25 foot portion of 99th Avenue lies within City of Peoria jurisdiction, Peoria and MCDOT
have agreed that it is in the best interest of both parties to de-annex from the City of Peoria
that portion lying within the 99th Avenue corridor that is maintained by MCDOT to avoid
confusion between the two entities as to which is responsible for the road maintenance,
regulation and policing as well as a benefit to the public by making it easier to determine
which entity to contact regarding issues related to the road. Also, since MCDOT is currently
maintaining the road in question, there would not be additional financial burden due to this
action beyond what it already has. MCDOT would assume full liability in the de-annexed
strip as the City of Peoria would no longer be the jurisdiction of record. Supervisory District
No. 4 (C-64-15-072-M-00)
Blue Crowley, resident, stated that the item shows how the County is trying to get the
public involved. He noted that the explanation from MCDOT is well written for the
public.

S-1. COMPETITION IMPRACTICABLE PROCUREMENT WITH SULZER EMS FOR ROOF
BEARING REPLACEMENT AND RELATED EXPENDITURE APPROPRIATION
REQUEST
Approve a Competition Impracticable in accordance with the Maricopa County Procurement
Code, section MCI-351, for the amount of $400,000, with Sulzer EMS for replacement of
bearings for the retractable roof at Chase Field. The project will be paid for with funds from
the Stadium District (680) Facility Reserve Trust Fund (450) Long Term Project Reserve
Account.
Approve an increase in the amount of $400,000 to the Stadium District (680) Long Term
Project Reserve Fund (450) Non Recurring Non Project (0001) expenditure appropriation.
The bearings, which allow for the movement of the retractable roof on Chase Field, are
nearing the end of their useful life and should be replaced for the 2015 Major League
Baseball season to ensure the continued function and operation of the facility. This is a
Competition Impracticable procurement because:
1. All other local vendors in this field that have been contacted by the MCSD and Arizona
Diamondbacks have deferred this work to Sulzer EMS as the only local agency capable to
perform the work. Vendors capable of doing this work are outside of the local area, and
would require the MCSD to pay additional travel and per diem costs.
2. Sulzer EMS is the only firm that has been prequalified by the designer of the roof and is
able to perform the work without requiring the designer to be on site for the duration of the
work. Sulzer EMS has performed the procedural repairs to the designer’s approval and
specifications in prior work. The selection of another firm will require the MCSD to pay the
entire cost of having the designer on site at all times to provide installation oversight.
3. As Sulzer EMS has provided this specialized work before. They already own a set of the
project specific equipment and equipment specifically fabricated for this facility which would
mitigate the MCSD need to purchase two complete new sets of equipment, as well as the
lead time for another firm to fabricate the equipment at a cost to the MCSD. Due to the
immediate need for the repairs Sulzer will manufacture and procure a second set of the
specialized equipment required only for this work and will turn the second set of equipment
over to the MCSD at the conclusion of the work.
4. Sulzer EMS' knowledge of our systems and procedures will reduce the labor hours and
time required to complete the work and provide a cost savings to the MCSD.
The work constitutes a Capital Repair under the Related Use Agreements governing the
facility, and thus will be paid for from the Long Term Project Reserve Account. (C-68-15-
