PZ-1. LUKE LAND 58 Case #: CPA2015001 Supervisor District: 4 Applicant/Owner: Jack Gilmore – Gilmore Planning and Landscape Architecture Request: Comprehensive Plan Amendment (CPA) to change the land use designation from Mixed Use Employment to Medium Density Residential (5 - 15 d.u./ac.) CPA case approval is by Resolution, attached. Site Location: Approximately at the northwest corner of Glendale Ave. and the 127th Avenue alignment (in the Glendale area) Site Size: Approximately 55 acres County Island Status: NA Additional Comments: Each of these two cases requires a motion. Three additional conditions were added to Z2015002 and recommended for approval by the Commission. Commission Recommendation (1st motion): On 4/9/15, the Commission voted 7-0 to recommend approval of CPA2015001 subject to conditions ‘a’ – ‘g’: a. Development and use of the site shall comply with the narrative report entitled, “A Comprehensive General Plan Amendment for Luke Land 58”, including all exhibits dated revised February 19, 2015, and stamped received February 20, 2015, except as modified by the following conditions. b. If the Board takes action to amend or revert/rescind subsequent zoning, this land use plan shall be considered for amendment to change the land use designation back to the prior Mixed Use Employment. c. The total number of residential units shall not exceed 274 dwelling units. d. Prior to initial Final Plat approval or initial precise plan of development, the applicant shall submit to the Maricopa County Planning and Development Department a “will serve” letter and verification of approval of a Maricopa Association of Governments (MAG 208) amendment from Liberty Utilities. e. The following Luke Air Force Base condition shall apply: Luke Land 58 shall notify future occupants/tenants that they are located near a military airport with the following language: “You are locating in a residential dwelling inside the State Statute defined “territory in the vicinity of a military airport,” which means that aircraft flying in this area are authorized to fly as low as 1,500 feet above the ground. You will be subject to direct overflights and noise by Luke Air Force Base jet aircraft in the vicinity. Luke Air Force Base executes an average of approximately 165 overflights per day. Although Luke’s primary flight paths are located within 20 miles from the base, jet noise will be apparent throughout the area as aircraft transient to and from the Barry M. Goldwater Gunnery Range and other flight areas. Luke Air Force Base may launch and recover aircraft in either direction off its runways oriented to the southwest and northeast. Noise will be more noticeable during overcast sky conditions due to noise reflections off the clouds. Luke Air Force Base’s normal flying hours extend from 7:00 a.m. until approximately midnight, Monday through Friday, but some limited flying will occur outside these hours and during most weekends. For further information, please check the Luke Air Force Base website at www.luke.af.mil/urbandevelopment or contact the Maricopa County Planning and Development Department.” Such notification shall be permanently posted on not less than a 3 foot by 5 foot sign in front of all leasing offices and be permanently posted on the front door of all leasing offices on not less than 8½ inch by 11 inch sign. f. The applicant shall submit a written report every five years from the date of Board of Supervisors approval of CPA2015001 which details the status of this project, including progress on obtaining necessary entitlements, licenses, and permits; compliance with the conditions of approval; compliance with the approved narrative report; compliance with the approved land use plan; and justification as to how the approved land use plan still represents appropriate land use planning for the property and unincorporated Maricopa County in accordance with the goals and policies in its comprehensive and applicable area plan. This report shall be scheduled for public hearing by the Maricopa County Board of Supervisors (Board), upon recommendation by the Maricopa County Planning and Zoning Commission (Commission), to consider whether the planning justification for this comprehensive plan amendment is still present, and whether the land use designations associated with this comprehensive plan amendment still represent appropriate and better long-term land use planning in accordance with the goals and policies of the Maricopa County Comprehensive Plan and applicable area plan. If the Board rescinds this comprehensive plan amendment and reverts the current land use designations back to ‘Mixed Use Employment’ all entitlements associated with this project that were conditional pursuant to the Maricopa County Zoning Ordinance may also be considered by the Board, upon recommendation by the Commission, for reversion to the prior entitlements. In such an event, the comprehensive plan land use map, area plan land use map, and, as applicable, zoning map shall be altered to reflect Board action. g. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property owner to enjoy uses in excess of those permitted by the land use existing on the date of application, subject to conditions. In the event of the failure to comply with any condition of approval, the property shall change to the land use designation that existed on the date of application. It is, therefore, stipulated and agreed that revocation due to the failure to comply with any conditions does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation. The Comprehensive Plan Amendment enhances the value of the property above its value as of the date the Comprehensive Plan Amendment is granted and changing to the prior land use designation results in the same value of the property as if the Comprehensive Plan Amendment had never been granted. The following Planning Engineering (Drainage, Flood Control and Transportation) comments shall apply: 1. Drainage review of planning and/or zoning cases is for conceptual design only and does not represent final design approval nor shall it entitle applicants to future designs that are not in conformance with Section 1205 of the Maricopa County Zoning Ordinance and the Maricopa County Drainage Policies and Standards. 2. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance and current engineering policies, standards and best practices at the time of application for construction. 3. The project limits are not located within a Special Flood Hazard Area. The applicant should be aware that the Flood Control District of Maricopa County has conducted a major stormwater management study in this area. The Loop 303 Corridor/White Tanks Area Drainage Master Plan (ADMP) is available for use by developers. New development in the wastershed is expected to acknowledge and assess their project for compatibility with the ADMP. Deviations from the ADMP must be documented, and an engineering analysis provided that shows the deviations do not increase downstream flood peaks, volumes or other flood hazards. A copy of the Loop 303 Corridor/White Tanks ADMP is available at the Maricopa County Flood Control District office for review. Non-compliance with the regulations administered by the Maricopa County Environmental Services Department, Maricopa County Department of Transportation, Drainage Review Division, Planning and Development Department, or the Flood Control District of Maricopa County may be grounds for initiating a revocation of this Military Compatibility Permit as set forth in the Maricopa County Zoning Ordinance. g. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property owner to enjoy uses in excess of those permitted by the underlying zoning existing on the date of application, subject to conditions. It is, therefore, stipulated and agreed that revocation of this Military Compatibility Permit due to the failure to comply with any condition does not reduce any rights that existed on the date of application to use, divide, sell, or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation. The Military Compatibility Permit enhances the value of the property above its value as of the date the Military Compatibility Permit is granted and revocation results in the same value of the property as if the Military Compatibility Permit had never been granted. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval is temporary and allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions and stipulations. In the event of the failure to comply with any condition or stipulation, and at the time of expiration of the Special Use Permit, the property shall revert to the zoning that existed on the date of application. PZ-6. LOTS 125, 124A & 124B OF DESERT VILLAGE NO. 2 Case #: S2015003 Supervisor District: 2 Applicant/Owner: James Cook Request: Resolution abandoning a 25’ portion of a 40’ easement for future roadway and drainage within Lots 124A, 124B & 125 of Desert Village No. 2 Site Location: APNs 220-52-040C, 220-52-039C & 220-52-039D (10200, 10310 & 10318 of E. Broadway Rd., Mesa AZ 85208) Site Size: Approximately 0.95 ac. (cum.) Density: Approximately 3 d.u./ac. County Island Status: Class 1 (City of Mesa) Staff Recommendation: Approve Additional Comments: Desert Village No. 2 is a single-family residential subdivision of one-third acre lots in the R1-18 zoning district. The subdivision is located on the north side of Broadway Rd. between Crismon Rd. and 104th St. It has been traversed by the Central Arizona Project canal isolating the lots along Broadway Rd. from the remainder of the subdivision. The plat was recorded in Book 77, Page 24 MCR in 1958. The plat indicated a 40’ easement for future roadway and drainage along the north side of Broadway Rd. at the southern boundary of the plat. This affected all lots along Broadway Rd. including the subject Lots 124, 124A & 125B. This easement would accommodate a total half-width of 65’ for Broadway Rd. MCDOT has determined that only 55’ is needed. (See the approved Request for Future Right-of-Way Reservation Reduction, attached.) The easement in question also accommodates drainage; however, the entire 40’ is not necessary for drainage. There are pending permits: • B201403017 (Lot 125 – new custom single-family residence with 6’ x 327 LF block fence), • B201403015 (Lot 124B – new custom single-family residence with 6’ x 262 LF block fence), & • B201403014 (Lot 124A – new custom single-family residence with 6’ x 299 LF block fence). The permits will require a Drainage Clearance (including an engineered Grading and Drainage Plan) to ensure development of the lots does not adversely impact drainage including the reduced size of the drainage easement along Broadway Rd. Staff believes based upon established land use and development patterns that the full 40’ easement for future roadway and drainage is not necessary for the public safety or welfare. The proposed, remaining 15’ easement for future roadway and drainage will be sufficient. There is no concern with abandoning a 25’ portion of the easement. See the attached Resolution. 12. IGA WITH MURPHY ELEMENTARY SCHOOL DISTRICT #21 FOR FINANCIAL SYSTEM SERVICES Approve an Intergovernmental Agreement (IGA) between Maricopa County on behalf of the Maricopa County Education Service Agency (MCESA) and Murphy Elementary School District #21 for Financial System Services. This Agreement outlines the responsibilities of each of the parties’ management of the County and School District Financial System of record as part of the MCESA Financial System Support Consortium. The Parties agree to cooperate and assist each other in meeting the mutual obligations and duties of each office because it is law, good public policy and benefits the citizens of Maricopa County. A-1. SETTLEMENT AND MUTUAL RELEASE AGREEMENT, AND CHANGE ORDER NO. 39 TO CONTRACT 2011-025 WITH LAWRENCE CONSTRUCTION COMPANY Approve the Settlement and Mutual Release Agreement between Maricopa County and Lawrence Construction Company (LCCO) pursuant to the terms in the agreement resolving all remaining claims. In addition, consistent therewith, approve Change Order No. 39 to Contract 2011-025 (C-91-11-180-5-00) with Lawrence Construction Company (LCCO) in an amount of $319,260.00 for the Northern Parkway - Sarival Avenue to Dysart Road Project , Project No. TT195. Change Order No. 39 rescinds 102 days of liquidated damages per final negotiations between MCDOT and Lawrence Construction Company (LCCO), and as a result establishes a new completion date after the original April 18, 2013 contract completion date. LCCO’s request for a time extension associated with the MSE Wall design and construction is denied. This change order provides full and complete compensation for settlement of all claims in accordance with the Settlement and Mutual Release Agreement included as Attachment “A” to Change Order No. 39. The two major issues that are addressed and resolved with the Settlement and Mutual Release Agreement are as follows: 1) 243 days of liquidated damages (LD’s) and traffic control charges assessed, as required by the contract, against the contractor for the delayed completion of project, and; 2) the holdback of $198,085.35 of contract funds, as required by the US Department of Labor (DOL), for unpaid fringe benefits owed by one of LCCO’s subcontractors, Tierra Contracting, Inc., to its employees. As additional background, during the first half of 2014 (after Dec. 2014 project completion) LCCO and MCDOT worked together to negotiate and execute Change Order No. 38 which resolved nearly all of the project issues, except for the LD’s and DOL holdback.
