STOTZ FARM Case #: CPA2014006 Supervisor District: 5 Applicant/Owner: Tiffany & Bosco PA / Stotz Farm Inc. Request: Comprehensive Plan Amendment (CPA) to change the land use designation from Rural Development Area to Community Retail Centers. CPA case approval is by Resolution, attached. Site Location: Approximately 1,200’ west of the southwest corner of I-10 and Avondale Blvd. (in the Avondale area) Site Size: Approximately 10.85 acres County Island Status: Class 1 (City of Avondale) Additional Comments: A Plan of Development is not proposed at this time. The City of Avondale expressed concerns to limit potential uses. The Commission recommendation includes prohibition of occupied buildings without sewer connection. Commission Recommendation: On 2/5/15, the Commission voted 6-0 to recommend approval of CPA2014006 subject to conditions ‘a’ – ‘c’: Provided the following conditions are met: a. Development and use of the site shall comply with the narrative report entitled, “STOTZ FARM PROJECT NARRATIVE – General Comprehensive Plan Amendment Request”, including all exhibits dated submitted September 15, 2014, and stamped received September 26, 2014, except as modified by the following conditions. b. Until approval of a precise plan of development, the applicant shall submit a written report every five years from the date of Board of Supervisors approval of CPA2014006 which details the status of this project, including progress on obtaining necessary entitlements, licenses, and permits; compliance with the conditions of approval; compliance with the approved narrative report; compliance with the approved land use plan; and justification as to how the approved land use plan still represents appropriate land use planning for the property and unincorporated Maricopa County in accordance with the goals and policies in its comprehensive plan. This report shall be scheduled for public hearing by the Maricopa County Board of Supervisors (Board), upon recommendation by Formal Meeting Minutes Wednesday, March 11, 2015 Page 6 of 56 the Maricopa County Planning and Zoning Commission (Commission), to consider whether the planning justification for this comprehensive plan amendment is still present, and whether the land use designation associated with this comprehensive plan amendment still represent appropriate and better long-term land use planning in accordance with the goals and policies of the Maricopa County Comprehensive Plan. If the Board rescinds this comprehensive plan amendment and reverts the current land use designations back to Rural Development Area, all entitlements associated with this project that were conditional pursuant to the Maricopa County Zoning Ordinance may also be considered by the Board, upon recommendation by the Commission, for reversion to the prior entitlements. In such an event, the comprehensive plan land use map, and, as applicable, zoning map shall be altered to reflect Board action. c. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property owner to enjoy uses in excess of those permitted by the land use existing on the date of application, subject to conditions. In the event of the failure to comply with any condition of approval, the property shall change to the land use designation that existed on the date of application. It is, therefore, stipulated and agreed that revocation due to the failure to comply with any conditions does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation. The Comprehensive Plan Amendment enhances the value of the property above its value as of the date the Comprehensive Plan Amendment is granted and changing to the prior land use designation results in the same value of the property as if the Comprehensive Plan Amendment had never been granted. (C-44-15-061-M-00) RESOLUTION OF AMENDMENT Maricopa County Board of Supervisors BE IT RESOLVED by the Maricopa County Board of Supervisors as follows: WHEREAS, Maricopa County adopted its Comprehensive Plan in accordance with Arizona Revised Statutes to help bring about coordinated physical development consistent with the present and future needs of Maricopa County; and WHEREAS, Maricopa County recognizes the importance of having a comprehensive plan amendment process so that this plan can be responsive and flexible to meet the changing conditions of Maricopa County; and WHEREAS, Maricopa County has procedures to determine when comprehensive plan amendments are necessary, how comprehensive plan amendments are processed, and at what point comprehensive plan amendments can be presented at a public hearing by the Board of Supervisors, upon recommendation by the Planning and Zoning Commission; and WHEREAS, Arizona Revised Statutes requires that amendments to the Comprehensive Plan be approved by resolution of the Board of Supervisors; and WHEREAS, the Maricopa County Board of Supervisors has carefully considered this comprehensive plan amendment, has held a public hearing regarding this Formal Meeting Minutes Wednesday, March 11, 2015 Page 7 of 56 comprehensive plan amendment, and finds that this comprehensive plan amendment constitutes an overall improvement to the Maricopa County Comprehensive Plan, and to Maricopa County in general. AGENCY ITEMS AND STATUTORY MATTERS ARTÍCULOS DE AGENCIA Y ASUNTOS REGLAMENTARIOS COUNTY OFFICERS - OFICIALES DE CONDADO Clerk of the Court - Secretario de la Corte 7. CLERK OF THE SUPERIOR COURT REQUEST FOR REVIEW OVER BASELINE Per the Board approved FY 2016 Budget Guidelines and Priorities, approve allowing the Office of Management & Budget to review the following requests over baseline in the amount of $2,484,101: • Personnel Services for Fill the Gap positions $191,701 (Operating expense, Fund 100) • Outside Services for Restitution, Fines, and Reimbursements (RFR) Project $2,292,400 (Non-Recurring expense, Fund 100) Fill the Gap Fund (FY 2016 Request over Baseline) While the Clerk’s Office has submitted budgets either at or below target, there are additional FTG expenditures requiring allocation into the General Fund. This overage is included within our FY 2016 requested General Fund budget. Fill the Gap is an award funded by state and local revenues that continues to decline. This fund pays for staff positions, primarily comprised of courtroom clerks assigned to Criminal divisions. Unlike FY 2016 where fund balance was utilized to offset operational costs, FY 2016 will end with a minimal fund balance, creating an additional need above threshold of $191,701 in personnel expenditures (equaling a FY 2016 total of $576,678 FTG to be allocated to the General Fund). Once again this fund will be reviewed annually and if revenues are recorded higher than expected, personnel costs will be allocated back to the FTG special fund. Formal Meeting Minutes Wednesday, March 11, 2015 Page 11 of 56 RFR (Restitution, Fines, and Reimbursements) Project (FY 2016 Carryover Requested) We diligently continue to work toward minimizing impact on our Office and County funds in the budgeting strategy. While our long term strategy is to develop an integrated financial system to effectively manage all criminal financial transactions, it is noteworthy that we began with the RFR system as the first of several legacy systems requiring replacement. Our system is 20 years old, and manages approximately $2.5 billion in fines, fees and restitution payments; in addition, it is a primary source of revenue for numerous County and Court agencies. Failure of the system would be disastrous across multiple agencies from a revenue and victim perspective. Additionally, supporting systems such as General Ledger and Trust will require replacement due to their age and inability to integrate with our newer systems. The Clerk’s Office expects expenditures of $109,341 in the current fiscal year non-recurring allowance provided for this project. We request carryover of any remaining allowance, anticipated to be $2,292,400, in order to continue replacement of the RFR legacy system in FY 2016. We anticipate that replacement of this system will continue into 2018, at a total estimated cost exceeding our original allocation. Preliminary estimates indicate the need for a minimum of an additional $1.5 million within FY17 or FY18. ADMINISTRATIVE ADJUSTMENT TO THE APPROPRIATION ADJUSTMENT FOR HUMAN SERVICES DEPARTMENT GRANT Approve an administrative adjustment to the approved appropriated budget for the Human Services Department. The administrative adjustment corrects the CDBG Housing Trust Fund (217) budget amount from $17,131,833 to $17,204,787. The administrative adjustment is necessary to reflect the correct amount approved in the Fiscal Year 2014-2015 Budget Appropriation Adjustment. Grant revenues are not local revenues for the purpose of the constitutional expenditure limit, and therefore expenditures of these revenues are not prohibited by the budget law. The approval of this budget adjustment does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. § 42-17105. The indirect cost rate is 18.4% as approved by the Department of Health and Human Services. Most of the grants for Fiscal Year 2014-2015 allow for indirect cost recovery as reflected in the funding agreements. A revised detail of financial impact and grant summary worksheet are attached to be on file with the Clerk of the Board’s Office and retained in accordance with Arizona State Library Archives and Public Records (ASLAPR) approved retention schedule. HUMAN SERVICES DEPARTMENT REQUEST FOR REVIEW OVER BASELINE Per the Board approved FY 2016 Budget Guidelines and Priorities, approve allowing the Office of Management & Budget to review the following request over baseline: • Homeless Program dedicated position and operational support $120,000 (Operating expense, Fund 100) There is a need for Maricopa County to be more actively involved in the planning and coordination of activities to address homelessness. Human Services currently neither uses General Funds for the HSD homeless program departmental operations nor does the HSD have a dedicated position for the homeless program initiative. The coordination and participation in homeless activities is currently being done at the Director level as there is no available grant funding for this activity. Without a dedicated position, HSD is unable to take full advantage of opportunities that could create more housing placements and reduce the homeless population in the County. With this funding to create a Homeless program position, HSD would have the opportunity to increase outside funding from the private sector, faith-based community, and other community-based organizations to address homelessness. A General Fund position for homelessness would be able to develop new Non-County funding sources, for example, through grants, the Housing Authorities throughout the County, Department of Corrections, and money allocated to those who are Severely Mentally Ill. In addition, HSD would be able to grow existing partnerships that promote regional solutions for homelessness. Currently, it is primarily the County, City of Phoenix, and the State that are involved in efforts to end homelessness. However, homelessness is not just a central Phoenix issue, but rather a problem that affects the entire Valley. This position would be able to organize efforts in other localities and municipalities to create regional solutions to this problem, which includes capitalizing on municipal funds rather than County Formal Meeting Minutes Wednesday, March 11, 2015 Page 29 of 56 funds. Furthermore, HSD would be able to link efforts to the County Smart Justice Initiative. By creating regional solutions, there will be more opportunities for placements of homeless people that then results in the decline of homelessness in Maricopa County. (C-22-15-049-2-00) Supervisor Hickman noted the increasing number of requests coming to the Board by many departments for review over baseline. He commented on the financial impact on the County by recent legislative actions. Supervisor Gallardo commented on the importance of this request for needed services such as the Homeless Program. Motion to approve by Supervisor Hickman, seconded by Supervisor Kunasek Ayes: Chucri, Hickman, Barney, Kunasek, Gallardo 49. AMENDMENT TO IGA WITH THE UNITED STATES GEOLOGICAL SURVEY FOR WATER RESOURCES INVESTIGATIONS Approve amendment to Intergovernmental Agreement (IGA) FCD 2014A012, between the United States Geological Survey [Agreement #14WSAZ00200 (USGS)] and the Flood Control District of Maricopa County (District), for the period of October 1, 2014 to September 30, 2015. The amendment adds a new scope of work item to physically measure Manning’s n-value roughness coefficients (n) in order to calibrate hydraulic model roughness. The original total cost of the IGA is $263,980. The new total cost including this amendment is $338,980. The District’s costs under this Agreement will be $188,950, with the USGS contributing the remaining $150,030. Payments from the District are to be made quarterly. This Agreement will develop and evaluate long term flood histories on watercourses in Maricopa County, and provide information critical to the determination of the risk of flooding in these watercourses. This amendment covers a pilot study in 2 streams in Maricopa County, the Gila River and Lower Indian Bend Wash. The study will be used to test and develop new methods for quantifying n over a range of flows during a single event, and to enable better prediction of vegetation response to flows. The new technology and methods that will be incorporated into the study will allow physical determination of n over a range of flows and a variety of streams with greater accuracy than was previously possible. The information generated by the USGS’s ongoing work is vital to the safety of Maricopa County residents, and to the continuing hydrologic studies performed by the District.
