PLEDGE OF ALLEGIANCE - JURO FIDELIDAD A LA BANDERA Mr. Ludwig led the assemblage in the Pledge of Allegiance to the flag. Vice Chair McGee stated she met Mr. Ludwig in 1999 when she was appointed to the Washington Elementary District School Board. She stated he is a Phoenix native who has lived in various states throughout his childhood. His father was a military contractor who worked at several military bases throughout his career. He started his own practice in 1990 and lives and works in North Central Phoenix. She said he has been a precinct and state committeeman for many years, and noted the many acts of public service he has been involved in. 4. SU240025 - DYNAMITE WATER HAULING TRUCK DEPOT Applicant and Owner: Adam Pruett, BFSO Law / Bruns Damon Request: Special Use Permit (SUP) for a water truck depot in the Rural-43 zoning district Formal Meeting Minutes 11/19/2025 Page 3 of 70 Site Location: Generally located at the southeast corner of 172nd St. and Rio Verde Dr. in the Rio Verde foothills area Commission Recommendation: Commission Action: On 10/23/25, the Commission voted 9-0 (motion by Commissioner Finter D2, seconded by Commissioner Leighton D4) to adopt a motion recommending the Board of Supervisors approve SU250025 subject to conditions ‘a’ – ‘l’ as modified by the Commission. a. Development of the site shall be in substantial compliance with the site plan entitled “Dynamite Water” consisting of four (4) full size sheets stamped received September 17, 2025, except as modified by the following conditions. b. Development of the site shall be in substantial conformance with the narrative report entitled “Dynamite Water” consisting of thirty-nine (39) pages dated September 17, 2025 and stamped received September 17, 2025, except as modified by the following conditions. c. The following Planning Engineering conditions shall apply: 1. Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 2. Prior to issuance of a building permit, written confirmation will be required from the emergency fire protection jurisdiction that emergency fire protection service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. e. The applicant shall apply for any required construction permits for the appropriate occupancy within one (1) year of approval of this Special Use Permit prior to establishing the use and/or occupancy of the existing structures. f. The Special Use Permit is valid for a period of 25 years and shall expire on November 19, 2050, or upon termination of the use for a period of 90 or more days, whichever occurs first. All site improvements associated with the special use permit shall be removed within 90 days of such expiration or termination of use. g. All lighting associated within the special use permit area shall be in conformance to the Maricopa County Zoning Ordinance Section 1112. h. Non-Compliance with any Maricopa regulations will be grounds for possible revocation of this special use permit pursuant to the process set forth in the Maricopa County Zoning Ordinance. j. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. k. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning exiting on the date of application, subject to conditions. In the event of the failure to comply with any condition, and at the time of expiration of the special use permit, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with conditions, or the expiration of the special use permit, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the special use permit. The special use permit enhances the value of the property above its value as of the date the special use permit is granted and reverting to the prior zoning results in the same value of the property as if the special use permit had never been granted. l. RANGER ENERGY CENTER Case #: MCP250005 Supervisor District: 4 Applicant and Owner: Carls Toussaint, Ranger Energy Center LLC / SMT Investors Limited Partnership Request: Military Compatibility Permit (MCP) with a Plan of Development (POD) for a Battery Energy Storage System (BESS) in the Rural-43 MAAMF zoning district Site Location: Generally located at the NEC of Happy Valley Rd. & 199th Ave in the Surprise area Commission Recommendation: On 10/9/25, the Commission voted 7-0 (motion by Vice Chair Milhaven D2, seconded by Chairman Lindblom D1) to adopt a motion recommending the Board of Supervisors approve MCP250005 subject to conditions ‘a’ – ‘g’ with modification to condition ‘d.9.’ as recommended by staff as follows: a. Development of the site shall be in substantial conformance with the Site Plan entitled “Plan of Development for Ranger Energy Center“, consisting of 10 full-size sheets, dated August 8, 2025, except as modified by the following conditions. b. Development of the site shall be in substantial conformance with the Narrative Report entitled “Ranger Energy Center LLC”, consisting of 15 pages, dated June 9 2025, except as modified by the following conditions. c. The following engineering conditions: 1. Building permit documents shall include the full geotechnical report for the double ring infiltrometer tests to justify retention basin infiltration calculations and that basin(s) will infiltrate within 36hours. 2. There is a special flood hazard area (SFHA) on parcel but plans do not show encroachment into the floodplain. Any encroachment in a SFHA will require a flood use permit. 3. Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 4. Based on the conceptual design nature of the information submitted, changes to the site layout may be necessitated by the final engineering design of the site’s drainage infrastructure. 5. Maricopa County does not supply water, fire or sewer services. It is the applicant/owner’s responsibility to coordinate and secure water, fire and sewer services for this site. 6. Sealed final Grading and Drainage (Site Infrastructure) Plans and Sealed Final drainage report must be submitted with the application for Building Permits 7. The site plan should show 199th Avenue as preserving the mid-section line per the Zoning Ordinance Section 1105. The perimeter mid-section line alignment of the proposed Formal Meeting Minutes 11/19/2025 Page 6 of 70 development requires the setback line to start from a future half street Right-of-Way of 40- feet per the Maricopa County Zoning Ordinance Section 11-05. 8. Happy Valley Road is classified as a future minor arterial requiring fee dedication of a 55- foot half street from the section line. Applicant is required to provide, at applicant’s expense, an American Land Title Association(“ALTA”) Owner’s Policy of Title Insurance showing title vested in Maricopa County, a political subdivision of the State of Arizona. d. The following Rural-43 MAAMF standards shall apply: 1. Maximum Height: 50’ for substation only, all other structure shall meet the Rural-43 maximum height of 30’. 2. Minimum Front Setback: 25’ 3. Minimum Side Setback: 10’ 4. Minimum Street-Side Setback: 10’ 5. Minimum number of parking spaces: None required for non-habitable structures 6. Minimum Site Screening: 6’ high chain link + 1’ barbed wire security fence 7. Minimum Paving requirements: Dust controlled surfaces per Maricopa County Department of Air Quality. 8. Minimum setback for battery enclosures from parcel boundaries: 100’ 9. Minimum separation for battery enclosures from residential structures: 500 feet. For clarity: (i) POD approval is effective for two years from approval; (ii) new residential construction during that two-year period will not render the project nonconforming; and (iii) once building permits are issued, subsequent residential construction will not render battery unit locations nonconforming. e. All buildings subject to noise attenuation as per ARS § 28-8482(B). f. Prior to issuance of a building permit, written confirmation will be required from the emergency fire protection jurisdiction having authority that the facility has been designed in accordance with their regulations and requirements, and that emergency fire protection service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. g. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property may be considered for revocation to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the MCP. The MCP Development enhances the value of the property above its value as of the date the MCP is granted and reverting to the prior zoning results in the same value of the property as if the MCP had never been granted. This item was continued from the November 5th, 2025, meeting. (C-44-26-043-X-00) Chairman Galvin asked if there were speakers for this item. The Clerk responded there were five speakers for this item – one in favor and four in opposition. Lisa Everett, resident, noted APS is struggling to meet the needs in this area and this project will help. She said she did her research and found this to be a good location. She commented on concerns about fires and zoning, but she noted it will help with the growth and need for power in the west valley. Formal Meeting Minutes 11/19/2025 Page 7 of 70 Luimar Garza, resident, commented on stakeholders and the proximity to a military base. Peter Peterson and Judy Ray, residents, stated they are residents with property within 500 feet of the site. He said the applicants have not provided them with any information about this project in the last three meetings they have held. They are concerned about noise, water, property values, obstructed views, etc. Samantha Halderman, resident, stated she lives 380 yards from this site. She noted there are 21 families living in this area. She noted the concerns she has for her community. Murle Williams, resident, noted he is a former school principal and lives near this area. He has concerns for other families, the safety of his animals and himself, and concerns about fire hazards. Susanne Harris, resident, noted she represents herself, a resident, and the non-profit sanctuary for animals. She talked about several concerns about health and the way of life of those living in the area: fire, toxic gases, contaminated soil and water. Tom Ellsworth and Darren Gerard came forward to present on this project. MCP250005 Ranger Energy Center Formal Meeting Minutes 11/19/2025 Page 8 of 70 Mr. Ellsworth and Mr. Gerard reviewed the slide above and noted the site is barely in the area of APZ-2. Mr. Ellsworth stated that the noise contour lines are not visible on this map. It is between the 70 day/night level and the 65 day/light level. He said no residential uses are allowed in this area. Supervisor Lesko asked if the Air Force base had concerns and Mr. Ellsworth confirmed they did not. He also confirmed there could be no residential use of this property, only industrial use. Vice Chair Brophy McGee asked for an explanation of what comes after an Military Compatibility Permit (MCP) in the process and Mr. Ellsworth gave a detailed explanation. Vice Chair Brophy McGee asked if lithium-ion batteries would be used and Mr. Ellsworth stated that was his understanding. Chairman Galvin asked the applicant to come forward. Ben Graff, representing the applicant, Mr. Graff noted that APS was not involved with this project but would be entering into an agreement with the applicant in an effort to help meet the power needs of APS. The slide above illustrates fire service for the area. Mr. Graff noted the letter of support in the slide above and explained the technology is now very safe for first responders and the batteries can be monitored remotely. He read a letter received from Luke Air Force base and noted they are completely inside the 65-noise contour. He stated the attorneys for the base said the project met all the requirements. He talked about the meetings held with the neighbors and their concerns. Some of the concerns were about desert views and he explained what is being done to help mitigate this concern. MILITARY AIRPORT AND ANCILLARY MILITARY FACILITY (MAAMF) OVERLAY DISTRICT 11 Arizona Revised Statutes (A.R.S.§ 28-8481) outlines the compatibility requirements for new development within the noise contours around military facilities. • Specifically, the low-intensity, non-residential BESS use is among the most appropriate and optimal use within APZ-2 and the 65+ DNL contour. Luke Air Force Base encourages reducing, to the greatest extent possible, residential concentrations within 10 miles of the base and auxiliary fields. Luke AFB anticipates that, over time, existing single- family homes within the 65+ DNL contour and APZ-2 will transition to non-residential uses. The MCP requirements and the policies within the Arizona Military Regional Compatibility Guidebook outline an objective to maintain clear, low-density, non-residential uses near military flight operations. Section 1010.3 - Military Compatibility Permit (MCP): The permit approved by the Board of Supervisors in accordance with this Section, and which allows for the development of uses that are consistent and compatible with the high noise or accident potential of a military airport or ancillary military facility. Supervisor Lesko asked what the distance was from Happy Valley Road to the fencing. Mr. Graffe stated the above map (green circle 2) showed the distance to be approximately 550 feet from Happy Valley Road. He assured Supervisor Lesko the fencing design was discussed with the neighbors, and they approved of the fencing stipulations. He explained what would need to occur should the applicant decide to develop anything in the green space. Supervisor Lesko asked Mr. Graff to address some of the concerns the neighbors had such as noise. Mr. Graff reiterated the measures being taken to mitigate noise. Supervisor Lesko continued by asking about toxic smoke, batteries burning, the safety of battery storage, and the chemical makeup of the batteries. Mr. Graff introduced Brian Scholl, a veteran retired firefighter from the Phoenix Fire Department. He stated he trains firefighters all over on how to handle these batteries and explained how these batteries have changed and become much safer over the years. Vice Chair Brophy McGee noted the red areas in the slide above indicated opposition to the project. Mr. Graff explained the cooling system is built into the batteries. Mr. Graff reviewed the slide above noting the conditions to mitigate concerns. Supervisor Lesko stated these battery centers are increasing in the west valley because there is a lot of open land. She said they always have to balance property rights with neighbor concerns. She noted Luke Air Force base has signed off on the project and the applicant has tried to mitigate neighbors’ concerns. She said she is going to move for approval with the conditions added for an eight-foot fence with desert colored slatting and relocation of desert vegetation. Supervisor Gallardo commented on the growth in the west valley and how it will eventually take over the rural areas. Chairman Galvin noted this is an unusual case as it had to do with compatibility with Luke Air Force base and the only alternative use for this property would be more intensive with a lot more traffic and noise, Motion for approval subject to revised conditions ‘a’ through ‘h’ to concur with the Planning Commission recommendation but with revised language to condition ‘d.6’ and new condition ‘h’ by Supervisor Debbie Lesko, seconded by Supervisor Kate Brophy McGee Ayes: Thomas Galvin, Kate Brophy McGee, Mark Stewart, Debbie Lesko, Steve Gallardo 8. In the Chandler area Modified Conditions: The Commission recommended approval of the original proposal. However, as the project was modified, staff offers the following conditions ‘a’ – ‘l’ for the Board’s consideration: a. Development of the site shall be in substantial conformance with the zoning exhibit entitled “NEC Ocotillo Road & Pinelake Way“, consisting of one full-size sheet, dated 9/26/2025, and stamped received 9/26/2025, except as modified by the following conditions. Staff may determine slight refinements to remain in substantial conformance with the approved site plan. Minor and major amendments to the site plan will be determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance. b. In lieu of a pre-annexation service agreement, the developer must provide a ‘will serve’ letter from the certificated water and sewer provider, unless otherwise approved by Maricopa County Environmental Services Department. g. The IUPD overlay is applied to restrict the use of the site. Until such time as the site is served by sewer, uses on the site shall only be those acceptable to the Maricopa County Environmental Services Department (MCESD) that can be accommodated by septic systems. A public water system and public sewer system shall be required prior to establishment of any non-residential use that requires potable water. h. All outdoor lighting shall be in conformance with the provisions listed in Section 1112 of the Maricopa County Zoning Ordinance. Any outdoor lighting shall be placed so as to reflect light away from any adjoining rural or residential zoning district. i. Zoning approval is conditional per Maricopa County Zoning Ordinance, Article 304.6, and ARS § 11-814 for seven (7) years for the initial phase of development to have an issued construction permit which must be pursued to completion. j. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this zone change as set forth in the Maricopa County Zoning Ordinance. k. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. l. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. (AZ 361041) (Supervisorial District 1) (C-06-26-139-X-00) Marjean Lines, resident, stated she lives on Shannon St. and was concerned that this application was for selling alcohol even though a sign posted on the applicant’s fence said he will not be selling alcohol only storing alcohol. She said it is a residential area with a lot of children, and she is afraid allowing this will set a trend in the neighborhood. Robert Miles, resident, stated his property is 50 feet northeast of this property. He does not want his grandchildren, who live with him, to be that close to someone with a liquor license. He is concerned about traffic going in and out of the property so close to a bus stop for school children. Tamra Crandell, resident, stated she wanted to reiterate what the other speakers have said. She said since the neighborhood is part city and part County, there are no sidewalks for the children to walk on going to and from the bus stop. Ms. Crandell’s husband noted there is an Academy for the Autistic and a junior high school all within a block of the location. She said the applicant told everyone it was for wine storage only, but after reading the application, she discovered it was also for wine making and production. She said the neighborhood is 100% opposed to this application. Van Woods, resident, opposes this application and his concern is the truck traffic that will be parked on the street. Brock Severson, applicant, said he is proud of his neighbors for standing up for the neighborhood. He said he wanted to reiterate he would only be storing wine, not producing it. He stated a producer’s license will allow him to enter into a custom crush agreement with a winery in northern Arizona. The winery will be producing and bottling the wine and then ship it to him for storage and he will then self-distribute the bottled wine. He noted he went door to door informing his neighbors what he was trying to do and address their concerns. Supervisor Stewart asked how many deliveries Mr. Severson was expecting in a week and who he was selling the wine to. Mr. Severson responded he was expecting only one delivery a week and he was selling to restaurants and businesses that held a license to sell alcohol. Chairman Galvin asked how long the Series 13 license was for. Mr. Severson stated it had to be renewed every year. INCREASED WRIT FEE ISSUED BY A JUSTICE OF THE PEACE IN CIVIL CASES PER AMENDMENT TO A.R.S. § 11-445(A)(17) Approve an increased fee of $10.00 for all writs issued by a Justice of the Peace in civil cases, effective upon Board of Supervisors' approval. Fees collected will be deposited into the Constable Ethics, Standards and Training fund established by Section 22-138. Senate Bill 1161, enacted July 1, 2025, amends A.R.S. § 11-445(A)(17) to allow the Board of Supervisors to establish a fee of no more than $10.00 per writ issued, increased from the previous $5.00 per writ. In the 2025 fifty-seventh legislature, first regular session, the Arizona State Legislature amended A.R.S. § 11-445 regarding the Constables Ethics, Standards and Training Board fund under Senate Bill 1161. Effective July 1, 2025, each County Board of Supervisors shall set a fee on each Writ issued by a Justice of the Peace in their respective counties. The fee to be set is no more than $10.00 per writ and shall be administered by the Constable Ethics, Standards and Training Board. The fees established by the Board of Supervisors requires the Constable Ethics, Standards and Training Board to use 80% of the monies for Constable training, equipment, and related grants; and 20% will be used for funding the Constable Ethics, Standards and Training Board. A.R.S. § 22-138(A) directs, on notice from the board, the state treasurer to invest and divest monies in the fund pursuant to section A.R.S. § 35-313, and monies earned from investment shall be credited to the fund. Monies in the fund are exempt from the provisions of section A.R.S. § 35-190 relating to lapsing of appropriations and are continuously appropriated to the board for the purposes of this section. The intent of the increase of the writ fee is to provide sufficient funding for the training of Constables throughout the State of Arizona to increase the knowledge, training, and professionalism of all Constables and to increase the ability of the Constable Ethics, Standards and Training Board to adequately perform its mandated duties. Currently, many counties do not provide funding for Constables’ training even though training is mandated by law. The collection of funds from the increased writ fees will alleviate this problem by making funding for training available to all Constables. The result should be that the public will benefit from the availability of training for all Constables who should be able to more effectively serve their constituents in a professional manner. The Human Services Department approved indirect rate by the U.S. Department of Health and Human Services for FY2026, for salaries and employee related expenses is 24%. The total Contract funding amount is $892,248 of which $71,955.65 is for salaries and employee related expenses. Therefore, indirect costs are $17,269.35 and fully recoverable. The Contract revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the revenues is not prohibited by the budget law. This amendment combines HIV and Hepatitis C prevention services which provide access to quality testing and Linkage to Care (HTL) for persons residing in Arizona. Although these awards have now been combined, they have both been awarded separately to the Department in previous years, but it is unknown if either will be awarded in the future. Neither of the services is mandated but both provide a direct benefit to the citizens of Maricopa County through the current services they provide. This aware is non-competitive and no cash or in-kind match is required. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. CANVASS THE RETURNS FOR THE NOVEMBER 4, 2025 SPECIAL DISTRICT ELECTIONS Canvass the November 4, 2025 election returns for the Maricopa County Special District, including the Maricopa County Special Health Care District, North County Fire and Medical District, the South County Fire and Medical District, and the Superstition Fire and Medical District in accordance with the Official Results prepared by Maricopa County Elections Department. The Maricopa County Elections Department has prepared the Official Returns from all county precincts within the applicable districts, declaring the vote for the Special District Election held on July 15, 2025. Roger Pickerill, resident, expressed his concern for the 185,614 undeliverable ballots and asked why were undeliverable. Chairman Galvin stated they would be hearing from staff as they make their presentation. Formal Meeting Minutes 11/19/2025 Page 54 of 70 Merissa Hamilton, resident, noted her concerns with this election such as not enough ballot replacement facilities, not enough in-person voting, and the two ballot bins found after the election. She proposed some solutions. Chairman Galvin asked Zach Schira, Assistant County Manager, and Scott Jarrett, Director of the Elections Department to come forward to make their presentation for the November 4, 2025, Election. Scott Jarrett addressed the questions about the undeliverable ballots, stating these questions would need to be answered by the Recorder. Mr. Jarrett began by explaining what it means to canvass an election. He noted in a jurisdictional election there are other entities involved. He stated the cities and towns are certifying agents for their entities and they have all certified their results. He explained there is a period following the certifications that allows for the elections to be challenged. 2025 November Jurisdictional Election Canvass Wednesday, Nov. 19, 2025 Formal Meeting Minutes 11/19/2025 Page 55 of 70 Mr. Jarrett reviewed the slide above explaining the County serves as a vendor who administers these elections. He noted that voter turnout was higher than previous elections at 26.56%. Chairman Galvin asked for confirmation that the curing period for this type of election is three days and for other types of elections it is five days. Mr. Jarrett confirmed that was correct. Mr. Jarrett reviewed the slide above and stated the Elections Department is always looking for ways to improve. He said they were able to implement real-time tracking after the election, but they discovered that there was no real-time tracking system that would alert them on election night if something was not brought into the warehouse. He said this is what happened on election night. Supervisor Stewart asked what the cause of the issue with the missing ballot bins was. Mr. Jarrett stated he has slides coming up that explain the circumstances. The Elections Department cleared the queue of all ballots ready for Pre-Tabulation processing on the morning of Election Day. On Election Day morning, approximately 6,000 affidavit envelopes needed signature curing 116,950 Dropped Off or Voted on Election Day Posted Final Results on Saturday (E+4), after the Friday night (E+3) cure period. This is consistent with prior Jurisdictional Elections. Mr. Jarrett stated the new measures would be ready by the March 2026 election. Zach Schira explained that when the Board took back its statutory authority in 2019, it took over a largely paper-based, manual operation. He said in the last six years, the department has been trying to professionalize and implement technological solutions. Chairman Galvin emphasized that this Board is keenly interested in making the voting experience as efficient as possible and as airtight as possible. He said he is glad there is an independent party performing a review. Blue Transport Bins Post Election Review (1 of 3) Blue Transport Bins Post Election Review (2 of 3) Formal Meeting Minutes 11/19/2025 Page 58 of 70 Mr. Jarrett reviewed the three slides above and explained what happened with the two transport bins that were found the next morning with seals intact. He then explained the process for the transport of the bins and where the problem occurred in the process. Chairman Galvin clarified what occurred and what should have occurred when the blue bins were put on the delivery truck and unloaded downtown. Mr. Schira noted the issues the department has faced with polling places and the strategies they have used to gain repeat polling places. Supervisor Stewart asked if any voters were disenfranchised because of this issue. Mr. Schira and Mr. Jarrett both said no voters were disenfranchised. Chairman Galvin asked Tom Liddy to come forward to clarify disenfranchisement. Mr. Liddy said traditionally, it is a purposeful act by someone in governmental authority to prevent someone from voting. He explained in this case, the Elections Department and Recorder’s staff are mandated by state law to receive the ballots, do signature verification, and determine if there is a variance in the signature comparisons. The Recorder is then mandated to reach out to the voter. Mr. Liddy stated there were 2,800 plus ballots that the Recorder made a heroic effort and successfully fulfilled his duties. Mr. Liddy reminded the Board that legislature had significantly shortened the curing period. Supervisor Stewart asked if the vendor had been approached with this chain of custody issue previously or made any recommendations that would have fixed this issue ahead of time. Mr. Jarrett explained there are many redundancies and this issue gives them an opportunity to get better. Supervisor Stewart turned his attention to the replacement centers. He noted Mr. Jarrett said he had expanded the replacement centers and Supervisor Stewart asked if that was a responsibility that was within his purview. Mr. Jarrett responded in this election it was within the context of working with jurisdictions, asking them to provide a replacement center and then talking with the County Manager and the Chairman’s Office to be sure there was a budget to expand. He said the jurisdictions are charged $1.00 per voter and if more expansion is needed, they would have to increase the fee. Blue Transport Bins Post Election Review (3 of 3) Formal Meeting Minutes 11/19/2025 Page 59 of 70 Vice Chair Kate Brophy McGee asked what parameters were used to decide where voting centers would be placed. Mr. Jarrett explained they do a heat map analysis that usually places voting places within 1.8 miles from each other. He said because this election was all mail, the statute called for one voting place per jurisdiction. Vice Chair Brophy McGee asked for clarification on the information being circulated about a broom closet for a Fountain Hills vote center. Mr. Schira stated the location of the incident was in the west valley and not Fountain Hills. He said this was corrected in a press release on Friday. Vice Chair Brophy McGee asked for confirmation that the ballots were always secure and were not left behind in a broom closet. Mr. Schira confirmed they were not. Supervisor Gallardo thanked the election staff for their service. He noted how much the voting process has changed over the years thanks to technology. He stated that this issue was discovered because of the process that is in place. Chairman asked Recorder Justin Heap to come forward with his prepared statement. He stated he wanted to inform the Board of the changes that were made to the signature verification on this election cycle. He gave the details of the previous process and said the process led to a lot of delays and a lot of questions. He then gave details on the new process used for this election cycle and elections going forward. He compared the new process efficiency with the 2024 election and noted in 2024 there were just over 113,000 same-day dop-off ballots and it took the Recorder’s Office over two days to verify the signatures. In the current election cycle with the new process there were 117,669 same- day drop-off ballots where the signature verification took eight and one-half hours. Mr. Heap asked Rey Valenzuela to come forward. Mr. Valenzuela began by speaking to the 185,614 ballots returned as undeliverables. He said the national trend is a 10% attrition because of voters moving. The number that moved was 175,435 per the United States Postal Service (USPS). He also noted that out of the 2,288 ballots in the blue bins, there were 30 that needed curing and only 11 of those did not make it through curing. Chairman Galvin asked about number comparisons and asked if there was a new user interface and Mr. Valenzuela confirmed there was. Chairman Galvin asked how many ballots had to be cured. Mr. Valenzuela stated there were 15,000 that had to go to the curing level. Chairman Galvin had concerns about the higher percentage of cured ballots. Supervisor Gallardo stated he had concerns on the signature verification. He asked what signatures were being used for curing. Recorder Heap said those working on signature verification look at the signature on the ballot envelope, then the signature on the voter’s registration card, and other historic signatures like a signature from a previous election, a SiteBooks signature. Vice Chair Brophy McGee stated she was very concerned about the number of rejected ballots for this election and asked if there was going to be a deep analysis on the process to find out how come there were so many. She also questioned the number of undeliverables and asked if it was inappropriate to perform list maintenance with the USPS data before mailing the ballots. Recorder Heap responded they are trying to get greater access to the USPS database for voter list maintenance. Supervisor Lesko thanked the Recorder’s Office and Elections Department, and the volunteer workers for their hard work. She had concerns about signature verificarion and ballot curing. He asked for the Recorder’s support in imploring the legislature to push forward a clean bill passed for the early voting tabulation process. Mr. Schira said the jurisdiction will be responsible for canvassing. Mr. Jarrett stated they would be back before the Board to present their election plan. Dianne Barker, resident, commented on air quality and public transportation. Lezley Shepherd, resident, commented on protecting children from inappropriate content in County libraries. Roger Pickerill, resident, talked about hand counting votes. Marissa Hamilton, resident, commented on her supply chain experience and the need for chain of custody improvement. Jim Hagedon, resident, commented on his inability to talk to his Supervisor and speed limit inconsistencies on Cotton Lane. Blue Crowley, resident, commented on not being able to comment on transportation items on the consent agenda and the lack of buses. He thanked the attorneys that participated. He wished everyone a Happy Thanksgiving. Jen Pokorski thanked the Board for their approval of the SkillBridge Program that will help people retiring from the military apply for positions with the County within six months of their separation. It is in partnership with the Department of Defense. Supervisor Lesko noted she went on a tour of MCDOT and the Flood Control District and stated what a great job they do with great employees. She visited Grand Canyon University and spoke to one of their classes. She thanked the City of Surprise for inviting her to their Veterans Day Parade, following the parade she visited an assisted living center Surprise and met two veterans who were over 100 years old. She thanked the Board, her staff, and all County employees for their hard work. Vice Chair McGee stated her activities could be found in her newsletter. She noted the City of Phoenix Desert Horizons Police Precinct is partnering with Debra Stark, City of Phoenix, District 3 for a turkey drive that benefits St. Mary’s Food Bank. She wished everyone a Happy Thanksgiving. Chairman Galvin recommended a documentary by Ken Burns on the American Revolution. He said it was riveting. He wished everyone a Happy Thanksgiving. The proposed amendment provides a time extension of 5 years from December 2025 to December 2030 and changes the annual cost of the agreement from $27,000 to $30,000 due to rising computing costs.
