MCP2016003 was approved on September 7, 2016 for Arizona Auto Shippers, a vehicle transportation company; this amendment would add a static billboard at the southeast corner of the site, near Butler Dr. The proposed billboard will be located 200’ north of the main travel lanes of Northern Parkway, visible to traffic traveling both east and westbound. The billboard is proposed with two static faces 14’ x 48’ or 675 sq. ft. which in in compliance to the zoning ordinance. The applicant is requestion to allow an additional 15’ in billboard height, Maricopa County Zoning Ordinance, Article 1403.3.1.F.2 (new reference Article 1103.3.1.6.B.i per MCZO Update effective January 9, 2026) states that billboards within 300’ of the main travel lanes of a freeway are limited to a max. 48’ above adjacent grade or elevation of the main travel lanes of a freeway immediately adjacent to the billboard or subject property (whichever is greater but not to exceed 70’). The applicant is requesting the deviation to allow construction of an 85’ billboard to be visible to traffic in both travel directions. February 25, 2026 Z250021 Page 2 of 3 Commission Recommendation: On 1/22/26, the Commission voted 6-0 (motion by Commissioner Rochwalik D3, seconded by Commissioner Lindblom D1) to adopt a motion recommending the Board of Supervisors approve MCP250006 subject to conditions ‘a’ – ‘k’: a. Development of the site shall be in substantial conformance with the Site Plan entitled “Butler Drive Billboard”, consisting of two full-size sheets, stamped received December 4, 2025, except as modified by the following conditions. b. Development of the site shall be in substantial conformance with the Narrative Report entitled “Northen Parkway and 143rd Ave Billboard”, consisting of four pages, dated November 21, 2025, and stamped received December 4, 2025, except as modified by the following conditions. c. The following Rural-43 & AD-2 Military Compatibility Permit standards shall apply (MCP2016003 and MCP250006): 1. Standard Parking Spaces: 0 2. ADA Parking Spaces: 0 3. Driveway/parking surface of compacted gravel 4. Maximum allowed height for billboard: 85 feet d. The following Planning Engineering conditions shall apply: 1. Building permits shall be required for the required site grading. The permit application must include existing fencing erected without a permit. 2. The site is almost wholly contained within a Special Flood Hazard Area (SFHA) (Floodplain – FEMA Zone A). As development plans progress for this site, provisions for compliance with the Maricopa County Floodplain Use Regulations must be addressed. Any habitable structures on the site must comply with the Floodplain Use Regulations for Maricopa County with respect to lower floor elevation (or in the case of a manufactured type building, the elevation of the lowest structural member). 3. Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 4. Based on the conceptual design nature of the information submitted, changes to the site layout may be necessitated by the final engineering design of the infrastructure. e. The following Transportation conditions shall apply: 1. An approved MCDOT Right of Way Reservation Action Request to reduce the Future Right of Way 25-feet is required prior to the submittal of the Building Permit. February 25, 2026 Z250021 Page 3 of 3 f. The following Maricopa County Department of Environmental Services Department (MCESD) condition shall apply: 1. Water and Wastewater services shall be provided upon installation of the modular office trailer with appropriate permits to be obtained. g. All habitable buildings shall be subject to noise attenuation per ARS § 28-8482(B). h. All outdoor lighting shall conform to the Maricopa County Zoning Ordinance. i. Noncompliance with the regulations administered by the Maricopa County Environmental Services Department, Maricopa County Department of Transportation, Drainage Review Division, Planning and Development Department, or the Flood Control District of Maricopa County may be grounds for initiating a revocation of this Military Compatibility Permit as set forth in the Maricopa County Zoning Ordinance. j. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. k. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Military Compatibility Permit. The Military Compatibility Permit enhances the value of the property above its value as of the date the Military Compatibility Permit is granted and reverting to the prior zoning results in the same value of the property as if the Military Compatibility Permit had never been granted. This request is an MCP amendment to for the addition of a billboard. The underlying zoning is Rural-43 MAAMF and AD-2 MAAMF The site consists of 2.75 acres and is located at the northeast corner of Butler Dr. & 143rd Ave. in the Glendale area and within the statutorily defined high noise or accident potential zone of Luke Air Force Base (LAFB), specifically within the 80 LDN noise contour. On September 7, 2016 the Board of Supervisors approved case MCP2016003 for Arizona Auto Shippers, a vehicle transportation company and building permits were obtained for the commercial structures, fences, and grading (B201702000, B201702578, B201901021, B201908142). 2. The subject proposal is for a static billboard at the southeast corner of the site, near Butler Dr. The proposed billboard will be located approximately 200’ north of the main travel lanes of the Northen Parkway, visible to traffic traveling both east and westbound. The billboard is proposed with two static faces 14’ x 48’ or 672 sq. ft., which is in compliance with the zoning ordinance. 3. The original MCP was approved with deviations ordinance standards for standard parking regulations including ADA parking requirements and parking area surface. The applicant is requesting to allow an additional 15’ in billboard height. Envision Glendale 2040 (adopted 2016): The City of Glendale General Plan designates the site as Luke Compatible Land Use Area. The Glendale General Plan describes this designation as areas that are delineated by the 1988 JLUS 65 LDN noise contour. The Plan supports the state legislation related to the operations of the military facility and discourages residential and other noise sensitive land uses within the Luke Compatible Land Use. Public Participation Summary: 10. The applicant complied with the public participation requirements according to MCZO Section 304, including notification of property owners within 300’ of the subject site and posting. Registered areas of interest were contacted by the applicant and staff regarding the military compatibility permit request. To date staff has not received public comments. Outstanding Concerns from Reviewing Agencies: 11. N/A MCP250006 Page 6 of 8 Staff Analysis: 12. The proposed amendment is in line with the MCP2016003 approval. The subject site is located within City of Glendale county island. The MCP implements the existing zoning district overlay in place to protect Luke Air Force Base. The Glendale General Plan identifies the region as Luke Compatible Land Use Area. The City of Glendale did not provide comments on the MCP application. Luke Air Force Base issued a letter via the County’s Use Compatibility Consistent Determination process that the proposed uses and billboard height are compatible and consistent and therefore would not impact base operations. MCP250006 was routed to areas of interest, including Luke Air Force base and staff did not receive any concerns regarding the proposal. 13. Staff considers the new proposed deviations with the MCP Amendment to be acceptable. The military airport and ancillary military facility compatibility is preserved with the previously approved an new deviations. Finally, staff notes that reviewing County agencies do not have any objections to the request, nor is there any known opposition to the request. Therefore staff recommends approval of case MCP250006 subject to the approved conditions under case MCP2016003. Recommendation: 14. Staff recommends the Commission adopt a motion recommending that the Board of Supervisors approve MCP250006 subject to the following conditions ‘a’ – ‘k’: a.
