As development plans progress for this site, provisions for compliance with the Maricopa County Floodplain Use Regulations must be addressed. Any habitable structures on the site must comply with the Floodplain Use Regulations for Maricopa County with respect to lower floor elevation (or in the case of a manufactured type building, the elevation of the lowest structural member). 3. Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 4. Based on the conceptual design nature of the information submitted, changes to the site layout may be necessitated by the final engineering design of the infrastructure. e. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. k. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Military Compatibility Permit. A Plan of Development is approved subject to site plan entitled “Sun Basin VII Solar Project Site Plan” consisting of 8 full-size sheets, dated November 12, 2025. The Plan of Development may be amended administratively under a separate application as long as the amendment complies with the established IUPD development standards as approved by the Board of Supervisors. Staff may determine slight refinements to remain in substantial conformance with the approved site plan. Minor and major amendments to the site plan will be determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance. b. Minimum Paving: Alternative surfacing materials or methods approved by Maricopa County Air Quality to minimize dust pollution, such as but not limited to, native compacted soil or aggregate base course, may be used in driveways and parking areas. 7. Minimum Landscaping/Buffering: No landscaping or irrigation required. No screening required adjacent to rural and residential zoning districts. 8. Minimum Sight Visibility Triangles: Within sight visibility triangles at any intersection, on-site chain-link fences without screening materials can exceed a height of 2’. 9. The IUPD overlay shall limit entitled uses to power generation and distribution, BESS facilities and ancillary uses. 10. Loading and Unloading: none required. d. The following Planning Engineering conditions shall apply: 1. Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 2. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. g. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property may be considered by the Board after recommendation by the Commission at a public hearing for reversion to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change. 8. DEANNEXATION FROM CITY OF MESA TO MARICOPA COUNTY (Supervisorial District 2) Pursuant to A.R.S. § 9-471.03 convene the scheduled public hearing to determine if the public interest is served by de-annexing road right-of-way from City of Mesa jurisdiction to Maricopa County in accordance with the City of Mesa Ordinance No. 5999 and the analysis of the impact of the requested de-annexation. Right-of-way location: SW corner Brown RD and Crismon RD. Supervisory District No. 2. After reviewing the analysis and hearing those that may appear for or against the request, if the Board determines that the public interest is served by this de-annex/annexation action, a vote of approval shall direct the following: 1. File an ordinance setting forth the legal description of the public right-of-way and declaring the return of the right-of-way contingent on the fulfillment of the additional conditions of the statute in the Office of the Clerk of the Board. 2. Pursuant to ARS § 9-471.03(F), set a public hearing for March 25, 2026 to de-annex road subject right-of-way from City of Mesa jurisdiction to Maricopa County, in accordance with City of Mesa Ordinance No. 5999 and the Ordinance approved by the Board of Supervisors on this date. 3. Send notice of the date, time and place of the hearing on the requested action to each owner of real property subject to taxation adjacent to the subject public right-of-way at least twenty (20) days prior to the hearing. Legal description of the roadway to be de-annexed, identified as Exhibit "A", is attached. MCDOT Analysis: This roadway (Crismon Road) provides regional connectivity as a principal arterial roadway. Development directly fronts this roadway and improvements by the developer to this roadway necessitate additional right of way to ensure public safety. Financial Status: Cost of the roadway development falls to the developer with no initial cost to Maricopa County. Cost of maintenance moving forward is typical of roadway maintenance cost and will be the responsibility of Maricopa County. The cost of roadway maintenance provides a benefit to the traveling public. The Board action will result to add .0002 square miles to County ownership and enable the County to assume responsibility for road maintenance. (C-06-26-242-X-01)

AGREEMENT WITH US DEPARTMENT OF JUSTICE, DRUG ENFORCEMENT ADMINISTRATION FOR THE DEA PHOENIX TASK FORCE FFY2026 Approve the Amendment to the agreement approved on 11/02/22 (C-50-23-066-X-00) and acceptance of up to $66,465.75 from the U.S. Department of Justice, Drug Enforcement Administration for MCSO participation in the DEA Phoenix Task Forces. The term of this agreement is October 1, 2025, through September 30, 2026. The grant award is recurring and has been awarded to the Sheriff's Office since 1998. A cash or in-kind match is not applicable. There is no future or ongoing contribution required following termination of the grant period. The Sheriff’s indirect cost rate for FY26 is 27.660%. Indirect costs have been calculated as up to $18,384.43 and are unrecoverable per item 7 of the Agreement. The $18,384.43 will be absorbed by the Sheriff’s Office General Fund (100) operating budget. The grant award is not a mandated function but provides a benefit to the citizens by enhancing public safety through illegal drug interdiction. The grant award is not competitively bid. This agreement reimburses overtime costs for three deputies assigned to the Phoenix Task Force, up to $22,155.25 per deputy for a total of $66,465.75. These revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. GRANT FUNDS FROM ARIZONA DEPARTMENT OF EMERGENCY AND MILITARY AFFAIRS Approve and Accept grant funds from Arizona Department of Emergency and Military Affairs, Grant No. EMF-2025-EP-05007, CDFA# 97.042, in the amount of $1,145,936.40. These grants are for emergency planning within Maricopa County. The grant award begins on July 1, 2025 and ends June 30, 2026. Authorize the Chair to sign all documents related to these grant funds, as applicable. The Department will not be recovering the allowable 8.85% de minumus rate based on the total direct charges, which totals $101,415.37. The grant award is reoccurring and has been awarded to the department for the past thirty (30) years. The department has a match requirement of $1,145,936.40. During the grant award period, the match for this grant comes from the General Fund (100-D150-1510 and 100-D150-1520), Palo Verde (207-D150-1510), and the Intergovernmental Agreements (215-D150-1510-CTIGA). Maricopa County does not have to fund any additional costs for the program. The grant award is a mandated function for emergency preparedness through the Robert T. Stafford Act. This grant provides funds for recipients to build and maintain emergency management programs at the state and local level. This grant award is non-competitive and all counties in the State are eligible to apply for funds to support their Emergency Management Programs. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. MOU WITH THESMILEZONE, INC FOR ORAL HEALTH SERVICES FOR HEAD START PROGRAM PARTICIPANTS (Supervisorial District: All) Approve a non-financial Memorandum of Understanding (MOU) between TheSmileZone, Inc., (Provider) and Maricopa County (County) administered by its Human Services Department. The purpose of the MOU is for Provider to provide Oral Health Services to Head Start Program participants by conducting onsite oral health services at Head Start program locations which may include exams/screenings, prophylaxis (cleaning), possible x-rays and restorative care, fluoride treatments, dental sealants as needed, along with providing dental outreach to students and their families to encourage preventative oral health activities. TheSmileZone, Inc. will provide onsite dental equipment and oral health services to Head Start Program (Participants) at various Head Start Program locations. The County and Provider will collaborate to offer Oral Health Services to Participants ages 0-5. AMENDMENT TO THE IGA WITH ARIZONA DEPARTMENT OF EDUCATION FOR TEACHER REGISTERED APPRENTICESHIP PROGRAM (Supervisorial District: All) Approve a financial Amendment to the Intergovernmental Agreement (Agreement) between Arizona Department of Education (Subrecipient) and Maricopa County (County) administered by the Human Services Department – Workforce Development Department (Program). The Subrecipient and the County collectively are referred to as the “Parties” and individually as a “Party.” The purpose of this Agreement is for the County to support the Arizona Department of Education’s Teacher Registered Apprenticeship Program (TRAP). The Teacher Registered Apprenticeship Program is designed to provide aspiring educators with a structured pathway to the teaching profession. Apprentices gain practical classroom experience under the guidance of experienced teachers while completing their academic coursework. In July 2025 the County provided the Subrecipient with $1,500,000 in American Rescue Plan Act (ARPA) State and Local Fiscal Recovery funds (SLFRF) UNDER Assistance Listing Number (ALN) 21.027 to administer the Apprenticeship Program. The purpose of this Amendment No. 1 is the following: A. Reduce total Agreement funding amount by $700,000, from $1,500,000 to $800,000. B. Extend Agreement expiration date from June 30, 2026, to August 31, 2026. C. AMENDMENT TO MARICOPA COUNTY HOME CONSORTIUM 3 YEAR-INTERGOVERNMENTAL AGREEMENT (Supervisorial District: All) Approve an amendment to the Maricopa County HOME Consortium 3-Year Intergovernmental Agreement (“Agreement”) with geographically contiguous municipalities consisting of the cities and town of: Avondale, Chandler, Gilbert, Glendale, Peoria, Scottsdale, Surprise, Tempe, and County of Maricopa (collectively, the “Consortium” or the “Maricopa HOME Consortium” or the “Parties”; and individually, “Consortium Member” or “Party”) for the U.S. Department of Housing and Urban Development (HUD) HOME Investment Partnerships Programs (“HOME”). The purpose of the Amendment is to seek approval to add the City of Goodyear as a member of the Consortium with all rights, responsibilities and obligations as set forth in the 3-Year Agreement and as applicable in US Department of Housing and Urban Development (“HUD”) regulations. The Agreement, which was renewed and approved by the Board of Supervisors on June 14, 2023, designates Maricopa County as the lead agency for the Consortium, and to assume responsibility for ensuring that the Consortium’s HOME Program is carried out in compliance with HUD rules, regulations, and requirements, including requirements concerning a comprehensive housing affordability strategy. Each of the above listed municipalities approved the automatic renewal of the Agreement. Renewal of the Agreement provides full legal authority for the Consortium to continue to undertake or assist in undertaking housing assistance activities for the HOME Program. The Agreement term is July 1, 2023, through June 30, 2026, for Federal Fiscal Years 2024-2026. This grant provides continued lifesaving medical and support services to people living with HIV/AIDS (PLWHA) through the Ryan White Part A HIV Emergency Relief Grant Program. The Not-to-Exceed amount is $3,270,266 for the budget period March 1, 2026, through February 28, 2027. The term of the grant is March 1, 2025, through February 29, 2028. The grant award is recurring and has been awarded to the department for many years. This is a non-competing continuation and there is no cash or in-kind match required. This is not a mandated service but provides a benefit to our citizens with the provision of health related and support services for up to 4,500 people Living with HIV/AIDS. Should the grant cease, on-going contributions should not be required. The grant allows for the full indirect rate of 16.69% for FY26. Indirect cost is estimated to be $467,741.36, all of which is recoverable. All program costs are allocated to the grant so there will be no additional burden on the department’s operating budget. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. The PO was issued by ADHS on February 5, 2026. The not-to-exceed amount of the PO is $332,038.67 for the budget period February 1, 2025, through February 28, 2026. The IGA term is January 01, 2023, through December 31, 2028. The STI Control Services grant award is reoccurring, non-competitive, and has been awarded to the Department for several years. This grant funds an IGA that supports infrastructure to provide surveillance, prevention, policy development, and communication to expand and identify new infection control interventions. There is no cash or in-kind match required, and indirect costs are fully recoverable. Should this grant be discontinued, ongoing cash contributions will not be required as this is not a mandated function. As such, there will be no cost that will need to be absorbed by the Department’s operating budget. MCDPH's indirect rate for FY26 is 16.69%. The indirect costs are estimated at $47,491.01, all of which are recoverable. Departmental indirect rates are established at the beginning of each fiscal year, and the future indirect rates will be collected at the corresponding rate. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the revenues is not prohibited by the budget law. This Amendment does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. AMENDMENT TO IGA WITH ARIZONA DEPARTMENT OF TRANSPORTATION FOR USE OF THE POWERLINE FLOODWAY AND SR-24 DRAINAGE CHANNEL MAINTENANCE ROADS AND ACCESS RAMPS (Supervisorial District 1 and 2) Approve Amendment No. 1 to the Intergovernmental Agreement (IGA) FCD 2020A027 between the Flood Control District of Maricopa County (District) and the Arizona Department of Transportation (ADOT) for shared use of the Powerline Floodway and SR-24 drainage channel maintenance roads and access ramps. The purpose of this Amendment to the existing IGA is to allow for joint use of new future maintenance roads within the defined Exhibit area. The purpose of the original IGA was to define the relationship between the District and ADOT with referencing to allowing joint use of the maintenance roads and access ramps between the two agency facilities. PURCHASE AGREEMENT AND CONVEYANCE DOCUMENTS FOR SALE OF REAL PROPERTY FCD FP-029-1EX, FP-029-2EX AND FP-029-3EX (Supervisorial District 3) Pursuant to A.R.S. §48-3603(I), the Flood Control District (District) requests the Board of Directors approve the sale of FCD Parcels FP-029-1EX, FP-029-2EX and FP-029-3EX (APN 202-11-011B, 202-11-024 and 202-11-025C) and authorize the Chair to execute a deed by and between Flood Control District of Maricopa County as Seller, and J Wesley Smith, as Buyer, and authorize the Chair to sign all other documents approved by legal counsel required to dispose of/transfer the property without further Board action. This District property was purchased as part of the Flood Control District of Maricopa County’s Floodprone Properties Acquisition Program and was declared excess to the needs of the District by the Board of Directors on April 26, 2017 (C-69-17-024-8-00). On October 15, 2025, District parcels FP-029-1EX, FP-029-2EX and FP-029-3EX were appraised at a value of $38,000.00. On January 22, 2026, the Maricopa County Real Estate Department held a public auction for District parcels FP-029-1EX, FP-029-2EX and FP-029-3EX that resulted in a winning bid of $38,000.00.
