The proposed IND-2 IUPD zoning overlay is intended to limit entitled 
uses to light industrial and general commerce uses that are 
compatible with the Tonopah Arlington Area Plan’s Mixed-Use 
designation, including an industrial distribution or commercial park, 
light industrial, and manufacturing. The southern 600-feet of the 
southern parcel will be reserved for non-industrial warehouse uses 
in support of distribution operations, their employees and 
neighborhood area retail needs and uses allowing retail combined 
with outdoor storage screened and secured from public view. 
Future property owners and users will be required to resolve their 
water, wastewater services, and traffic studies at the time of plan 
of development application. The site is not presently served by any 
utilities and there is not any utility service agreement in place. There 
is not a precise plan of development proposed at this time but will 
subsequently be provided for administrative approval prior to 
construction permitting.  
 
Five memos commenting on the case were received. One memo of 
support was received by neighborhood advocacy group STOPP, 
INC, consisting of 5 board members. A second rebuttal memo was 
provided by STOPP, INC. board member Daniel Blackson in 
response to a memo of opposition submitted by Tonopah 
Residents Opposed to Incorporation. Tonopah Residents Opposed 
to Incorporation provided a memo of opposition that included a list 
of 86 names and corresponding cross streets for each individual. 
No handwritten signatures or addresses were provided on this list.

Nathan & Jessica Eastman, located around 368th Ave and Indian 
School, submitted a memo of opposition independently. Debra & 
William Brandt, located at 381st Dr & Willeta St, submitted a memo 
of opposition independently. Their names were previously included 
in the list of opposed as provided by Tonopah Residents Opposed 
to Incorporation. 88 individuals are opposed. 5 are in support. None 
of the locations listed are within 300’ of the subject parcel. 
 
 
There are no outstanding concerns from reviewing agencies. 
 
Commission  
 
Recommendation: 
On 12/04/25, the Commission voted 8-0 (motion by Commissioner 
Leighton D4, seconded by Commissioner Toma D4) to adopt a 
motion recommending the Board of Supervisors approve Z250003 
subject to conditions ‘a’ – ‘k’:  
 
 
a. Development of the site shall be in substantial conformance with the Zoning Exhibit entitled 
“Z250003 Tonopah Logistics Center Zoning Exhibit IND-2 IUPD”, consisting of 1 page, dated 
November 4, 2025 and stamp received November 5, 2025, except as modified by the following 
conditions. 
 
b. Development of the site shall be in substantial conformance with the Narrative Report entitled 
“Request for Rezoning from Rural-43 to I-2 IUPD Tonopah Logistics Center”, consisting of 16 
pages, revision dated November 4, 2025, and stamp received November 5, 2025, except as 
modified by the following conditions. 
 
c. The following Planning Engineering conditions shall apply:  
 
1. Without the submittal of a plan of development, no development approval will be inferred by 
the engineering review, including, but not limited to drainage design, access and roadway 
alignments. These items will be addressed as development plans progress and are submitted 
to the County for further review and/or entitlement. 
2. Indian School Road is a MCDOT maintained roadway classified as an arterial roadway. The 
MCDOT R/W requirement for arterial roadways is 55-65 feet (half-width). Dedication of R/W 
(0 feet existing) may be required across the frontage of the subject premises to provide the 
required R/W, as determined otherwise by MCDOTPlanning@maricopa.gov.

applicant’s expense, an American Land Title Association(“ALTA”) Owner’s Policy of Title

3. Campbell Road (north of I-10) is “public right-of-way” that has not been accepted by the 
County; and is therefore not maintained by the County. Development and maintenance of the 
roadway would be the responsibility of the developer(s).

7. Given the site’s proximity or access to I-10, the applicant should inquire of any concerns with 
ADOT via their red-letter process (email redletter@azdot.gov) 
8. Engineering review of re-zone cases is conceptual in nature. All development and engineering 
design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; 
Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT 
Roadway Design Manual; and current engineering policies, standards and best practices at 
the time of application for construction.  
 
d. The following Maricopa County Environmental Services conditions shall apply: 
 
1. Per the Safe Drinking Water Act, any water system that supplies more than 25 people or 15 
service connections per day for at least 60 days per year is classified as a Public Water 
System (PWS). If the above criteria are met, a Public Water System application and a New 
Source Approval application are required and must be submitted to the MCESD’s Drinking 
Water Program. A water quality analysis report will be required with submittal and is good 
within one-year of testing.  
2. An Approval to Construct application is required to be submitted to the MCESD’s Treatment 
Program for all PWS water treatment facilities. For questions, please contact the

3. An Approval to Construct application is required to be submitted to the MCESD’s Subdivision

4. A notice of Intent to Discharge application for a septic system is required for any construction. 
Application must be submitted to the MCESD Onsite Wastewater Program. 
5. Wastewater is not permitted to discharge to an adjacent parcel’s septic system. 
6. If conducting food service in unincorporated Maricopa, a grease trap will be required by Onsite 
Wastewater Program. 
7. Setback requirements must be maintained per Arizona Administrative Code, Title 18, Chapter 
9, Article 312, C (Features Requiring Setback). 
8. Projected flows between 3000 and 24,000 gallons per day require a 4.23 General Permit and 
may require nitrogen treatment. For Onsite Wastewater related questions, please contact the

9. An Approval to Construct application is required and must be submitted to MCESD’s 
Subdivision & Infrastructure Program for water, reclaimed water and/or wastewater system 
infrastructure. 
10. A Water Service Agreement signed by the Utility is required and must be submitted to 
MCESD’s Subdivision & Infrastructure Program if the site/development will be provided with 
water and/or reclaimed water by a Utility. A capacity Assurance Form issued by the Utility is 
required to MCESD’s Subdivision & Infrastructure Program if the site/development 
wastewater service is being provided by a Utility. For subdivision related questions, please

e. Prior to approval of construction permits for the site, documentation of compliance with the 
Arizona Game and Fish Department’s recommendations provided in the report dated March 13, 
2025 must be provided to the Planning and Development Department. 
 
f. The IUPD overlay is applied to restrict the uses of the site. Until such time as the site is served by 
sewer, uses on the site shall only be those acceptable to the Maricopa County Environmental

Services Department (MCESD) that can be accommodated by septic systems. A public water 
system shall be required prior to establishment of any non-residential use that requires potable 
water. In lieu of pre-annexation service agreement the developer must provide a ‘will serve’ letter 
from the certificated water and sewer provider(s). 
 
g. The following IUPD standards shall apply: 
1. Restricted Uses: Residential, adult oriented businesses, dancehalls, marijuana oriented 
establishments, paraphernalia (smoke & vape) shops 
2. The first 600’ measured from ultimate right-of-way for Indian School Rd shall be preserved for 
uses allowed in C-2, including stand-alone light industrial, service-oriented business, uses 
allowing retail combined with outdoor storage screened and secured from public view; uses 
listed in g.1 above are prohibited in this area 
3. Minimum lot area: 35,000 sq. ft. 
4. Minimum lot width: 150’ 
 
h. Administrative approval of a Plan of Development will be required prior to approval and issuance 
of construction permits to develop and establish the uses of the site. Prior to issuance of a 
building permit, written confirmation will be required from the emergency fire protection 
jurisdiction having authority that the facility has been designed in accordance with their 
regulations and requirements, and that emergency fire protection service will be provided to the 
facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review 
and approval will be required. 
 
i. 
Noncompliance with any of the conditions assigned to the approval of this Zone Change by the 
Maricopa County Board of Supervisors may be grounds for revocation in accordance with the 
requirements and procedures as set forth in the Maricopa County Zoning Ordinance. 
 
j. 
The property owner/s and their successors waive claim for diminution in value if the County takes 
action to rescind approval due to noncompliance with conditions.  
 
k. The granting of this change in use of the property has been at the request of the applicant, with 
the consent of the landowner.  The granting of this approval allows the property to enjoy uses in 
excess of those permitted by the zoning existing on the date of application, subject to conditions.  
In the event of the failure to comply with any condition, the property may be considered for 
revocation to the zoning that existed on the date of application.  It is, therefore, stipulated and 
agreed that either revocation due to the failure to comply with any conditions, does not reduce 
any rights that existed on the date of application to use, divide, sell or possess the property and 
that there would be no diminution in value of the property from the value it held on the date of 
application due to such revocation of the Zone Change.  The Zone Change enhances the value of 
the property above its value as of the date the Zone Change is granted and reverting to the prior 
zoning results in the same value of the property as if the Zone Change had never been granted.

Project Summary:
1.
The applicant has requested a rezoning of 62 acres from Rural-43 to IND-2 IUPD.  The site spans 
I-10 on the north and south between mile markers 93 & 94.  Approximately 18 acres are north of 
I-10 and approx. 44 acres are south. The site lies approximately 1,979 linear feet west from the 
NWC of Indian School Rd & 411th Ave. in the Tonopah area.  Indian School Rd serve as the most 
improved frontage of and access to the parcel. There is no improved access to the site north of 
the freeway. The site is undeveloped.

The IND-2 IUPD overlay will limit entitled uses to light industrial and general commerce uses that 
are compatible with Tonopah Arlington Area Plan’s Mixed-Use designation. This may include an 
industrial or commercial park, light industrial, distribution and potentially light manufacturing or 
assembly. The southern 600-feet of the southern parcel will be reserved for non-industrial 
warehouse uses in support of distribution operations, their employees and neighborhood area 
retail needs. Large retail and strip centers are discouraged; strip flex industrial or stand-alone 
service-oriented businesses are encouraged. The IUPD prohibits adult-oriented businesses, 
marijuana-oriented businesses and operations, paraphernalia stores (smoke shops), dancehalls, 
and residential uses. Uses that will allow overnight sleeping will be limited to hotels or motels.  
The zone change does not include a precise plan of development.  Future phases will require a 
plan of development for site development. 
3.
The entire site is under unified ownership but bisected by the freeway. The northernmost portion 
of the site (north of the freeway) is bounded on the north by Campbell Rd., a public right-of-way 
that has not been accepted by the County, 415th Ave alignment to the west, I-10 to the south and 
413th Ave alignment to the east. The southern portion of the site south of the freeway is bounded 
by Indian School Rd to the south, 415th Ave alignment to the west, I-10 to the north and 413th Ave 
alignment to the east. Freeway access is via interchange at 411th Ave. 
4.
Several drainageways bisect the property north to south. A Plan of Development (POD) has not 
been included with this request but will be subsequently processed for administrative approval 
prior to construction permitting by individual developers or potential tenants. During this process, 
users will be required to resolve their water and wastewater services at the time of plan of 
development application. The site is not presently served by any utilities and there is not any utility 
service agreement in place.

Tonopah / Arlington Area Plan (Adopted September 6, 2000): The Area Plan designates the site 
and the area around the interchange of the I-10 and 411th Ave as mixed use. The proposed zone 
change will facilitate the uses the Area Plan contemplates such as light industrial parks, business 
parks, hospitals, retail and residential. However, residential uses are not permitted with the 
proposed IUPD. Development is subject to the availability of water and sewer services anticipated 
to be provided by Global Water in the future.
Public Participation Summary:

The applicant met the requirements for on-site posting and initial notification of all property 
owners within 300-feet of the site and area stakeholders. The applicant held two neighborhood 
meetings to discuss the proposal. On May 28, 2025 at 6pm at the Saddle Mountain RV Center 
recreation center, a neighborhood meeting organized STOPP (Save Tonopah Oppose Poultry 
Plant) with the applicant where it was requested that a commercial neighborhood village concept 
be considered to serve neighborhood retail needs. Around June 8th, the applicant met with Daniel 
Blackson, the chair of STOPP, on site to discuss development trends in the area. A third meeting 
with Mr. Blackson on June 20, 2025 at Black Bear Restaurant to discuss narrative changes. A 
fourth with Mr. Blackson and Doris Heisler at the Saddle Mountain RV Center on October 21, 2025 
to discuss narrative changes. A different advocacy group called Tonopah Residents Opposed to 
Incorporation, primarily representative of the area around 339th Ave and the I-10, did not support 
commercial strip-retail development on the property due to perceived increases in traffic. The 
applicant met with the chair, Keith Kronback, and more than a dozen neighbors at Wild West Café 
in Tonopah on October 5, 2025, then again with Mr. Kronback at a casino on October 19, 2025 to 
discuss narrative changes. The result of these meetings instituted changes to the original 
submittal where provisions for commercial development were made for the southern parcel as 
well as preventing retail strip centers to prevent increases in traffic. The applicant modified the 
`proposal based upon input received from the two neighborhood group’s requests for future land 
uses. Tonopah Residents Opposed to Incorporation continues to oppose the request with 
inclusion of provisions for C-2 allowed uses, with concerns about commercial uses attracting 
transient interstate traffic that conflicts with the rural atmosphere. The memo mentions a lack of 
support from the group towards the incorporation of Tonopah and perceived influence from one 
of the prominent neighborhood advocates for STOPP, which have no bearing on the proposal by 
the applicant.  Staff notes there have only been two letters submitted by the neighborhood groups, 
and no other public comment has been received on the request. 
Outstanding Concerns from Reviewing Agencies:

The Arizona Game and Fish Department provided detailed memo dated March 13, 2025. The 
department documented the presence of species in the area including the Western Burrowing 
Owl and the Sonoran Desert Tortoise.  The letter offered several recommended measures to allow 
reasonable development of the site in a minimally impactful manner.

Staff Analysis:
11.
Industrial zoning is appropriate adjacent to the I-10 major logistics corridor. The proposed IUPD 
overlay is compatible with the area land use plan designation of mixed use and the area 
transformation from rural farm to industrial farming, evidenced by the nearby Hickman’s Egg 
Ranch. The preference for commercial development within the first 600’ of the site from Indian 
School right-of-way is requested according to public participation feedback. There is a lack of 
neighborhood commercial services in this area of Tonopah (411th Ave and Indian School) that 
does not solely cater to interstate travelers. The site follows the industrial development spurred 
by the development of Hickman’s Egg Ranch, an industrial egg farm, opposite Indian School Rd. 
The rezone with IUPD intends to restrict uses of the site by prohibiting heavy industrial uses, adult-
oriented uses, and residential uses. The IUPD would also ensure that future development under a 
POD would be dependent on the provisions of public water and public sewer service, anticipated 
to eventually be served by the Global Water. 
Recommendation:

Staff recommends the Commission adopt a motion recommending that the Board of Supervisors 
approve Z250003 subject to the following conditions ‘a’ – ‘k’:

the Arizona Game and Fish Department’s recommendations provided in the report dated 
March 13, 2025 must be provided to the Planning and Development Department.

The IUPD overlay is applied to restrict the uses of the site. Until such time as the site is 
served by sewer, uses on the site shall only be those acceptable to the Maricopa County 
Environmental Services Department (MCESD) that can be accommodated by septic 
systems. A public water system shall be required prior to establishment of any non-
residential use that requires potable water. In lieu of pre-annexation service agreement 
the developer must provide a ‘will serve’ letter from the certificated water and sewer 
provider(s).

The following IUPD standards shall apply:

oriented establishments, paraphernalia (smoke & vape) shops
2.
The first 600’ measured from ultimate right-of-way for Indian School Rd shall be 
preserved for uses allowed in C-2, including stand-alone light industrial, service-
oriented business, uses allowing retail combined with outdoor storage screened and 
secured from public view; uses listed in g.1 above are prohibited in this area
3.
Minimum lot area: 35,000 sq. ft.

Minimum lot width: 150’
h.
Administrative approval of a Plan of Development will be required prior to approval and 
issuance of construction permits to develop and establish the uses of the site. Prior to 
issuance of a building permit, written confirmation will be required from the emergency 
fire protection jurisdiction having authority that the facility has been designed in 
accordance with their regulations and requirements, and that emergency fire protection 
service will be provided to the facility. Prior to issuance of the certificate of occupancy, 
local fire protection jurisdiction review and approval will be required.
i.
Noncompliance with any of the conditions assigned to the approval of this Zone Change 
by the Maricopa County Board of Supervisors may be grounds for revocation in 
accordance with the requirements and procedures as set forth in the Maricopa County 
Zoning Ordinance.
j.
The property owner/s and their successors waive claim for diminution in value if the 
County takes action to rescind approval due to noncompliance with conditions. 
k.
The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to 
enjoy uses in excess of those permitted by the zoning existing on the date of application, 
subject to conditions.  In the event of the failure to comply with any condition, the property 
may be considered for revocation to the zoning that existed on the date of application.  It

any conditions, does not reduce any rights that existed on the date of application to use, 
divide, sell or possess the property and that there would be no diminution in value of the

the date the Zone Change is granted and reverting to the prior zoning results in the same 
value of the property as if the Zone Change had never been granted.

The Arizona Game and Fish Department (Department) appreciates the opportunity to review  
Maricopa County Case No. Z250003 (Project), a Zone Change with Overlay request for a parcel 
approximately 63 acres in size located at the interchange of 411th Ave and Interstate 10 in 
Maricopa County, Arizona. The Department understands that the proposed rezoning would 
change the zoning from Rural-43 to Industrial Ind-2 IUPD, for the purpose of building a light 
industrial park for distribution and potentially light manufacturing or assembly. The Project site 
is broken up into two parcels, with the north parcel located just west of 411th Avenue and north 
of the I-10, and the south parcel at 411th Avenue and Indian School Road, both in largely 
undisturbed Sonoran desert scrub habitat. 
 
Under Title 17 of the Arizona Revised Statutes, the Department, by and through the Arizona 
Game and Fish Commission, has jurisdictional authority and public trust responsibilities to 
conserve and protect the state fish and wildlife resources. In addition, the Department manages 
threatened and endangered species through authorities of Section 6 of the Endangered Species 
Act and the Department’s Section 10(a)(1)(A) permit. It is the mission of the Department to 
conserve and protect Arizona's diverse fish and wildlife resources and manage for safe, 
compatible outdoor recreation opportunities for current and future generations.  
 
For your consideration, the Department offers the following comments and best management 
practices for minimizing impacts to wildlife and their habitat that may be affected by 
development of this area based on the agency’s statutory authorities, public trust responsibilities, 
and special expertise related to wildlife resources and recreation: 
●​ A variety of Arizona Species of Greatest Conservation Need (SGCN), such as the 
Sonoran desert tortoise and western burrowing owl have the potential to occur within the 
Project area. Project proponents may want to consider conducting surveys for these

species. If wildlife are encountered during Project activities, the Department recommends 
moving them out of harm’s way, no more than 0.25 mile outside the Project boundary 
within similar habitat. Please note that the Arizona State Wildlife Action Plan was 
recently updated, and the Department has an interactive website, Arizona Wildlife 
Conservation Strategy , that includes the most recent list of SGCN to help navigate and

identify conservation opportunities. Additionally, the Project site falls within the 10(j) 
designated, experimental nonessential population area of the endangered Sonoran 
Pronghorn. While it is not anticipated that pronghorn will be present in the area due to the 
lack of suitable habitat, if pronghorn are detected during Project activities please notify 
the 
USFWS 
and 
the 
Department’s 
Sonoran

●​ To the extent feasible, the Department recommends maintaining the ephemeral washes 
that occur in the Project area in their natural state without fencing or other barriers to 
wildlife movement. These washes serve multiple functions in the ecosystem, including 
landscape-level conveyance corridors for wildlife movement.   
●​ The Department’s Wildlife Compatible Fencing Guidelines provide information on how

fencing impacts wildlife, ways to design fencing to prevent wildlife entanglement and 
impalement, and to ensure wildlife movement is not restricted. Department personnel are 
available as resources to help determine appropriate fencing design and layout that will 
achieve its objective while reducing impact on wildlife. 
●​ If trenching or digging of large holes is necessary, the Department recommends 
trenching/digging and backfilling crews work closely together to minimize the amount of 
open trenches/holes at any given time. Where trenches/holes cannot be back-filled 
immediately, the Department recommends escape ramps be constructed in each hole and 
at least every 90 meters in trenches. Escape ramps can be short lateral trenches or wooden 
planks sloping to the surface. The Department recommends that slopes be less than 45 
degrees (1:1) and trenches/holes that have been left open overnight be inspected and 
animals removed prior to backfilling. 
●​ Artificial lighting could impair the ability of nocturnal animals to navigate (e.g., owls, 
migratory birds, bats, and other nocturnal mammals), and may affect wildlife behavior 
and populations (Davies et. al. 2013 ). The Department recommends using only the

minimum amount of light needed for safety. If feasible, “warmer” narrow spectrum 
lighting (amber, orange, red) is wildlife-friendly and should be used as often as possible 
to minimize the number of species affected by lighting. It is also beneficial that all 
lighting is shielded, canted, or cut to minimize the amount of upward shining light. 
●​ To minimize the potential introduction or spread of exotic invasive species, including 
aquatic and terrestrial plants, animals, insects, and pathogens, the Department encourages 
the Applicant to take precautions to wash and/or decontaminate equipment before

entering and leaving the site. See the Arizona Department of Agriculture website for a

list of prohibited and restricted noxious weeds  and the Arizona Native Plant Society for

recommendations on how to control them. To view a list of documented invasive species 
or to report invasive species in or near the Project area, visit iMapInvasives , which is a 
7
national cloud-based application for tracking and managing invasive species.  
●​ The Department recommends landscaping with native drought-tolerant species that 
represent the natural surrounding landscape and can help support wildlife and pollinator 
species in the area while reducing dust and erosion. 
 
The Department would also like to encourage private developers and Maricopa County to use the 
Arizona Online Environmental Review Tool administered by the Department’s Heritage Data

Management System (HDMS) as part of their standard operating procedure for review of new 
construction and development. This tool is a useful resource that provides baseline information 
on special status species such as Arizona’s Species of Greatest Conservation Need and Species of 
Economic and Recreational Importance. The Department entered this Project as an example 
(please see the attached HDMS report).

STOPP, Inc is a non-profit organization "committed to protecting the communal and
social well being for the Community of Tonopah..." We previously commented on
Case # 225AA03, which is a request to amend zoning from Rural-43 to IND-2 IUPD at
locations NEC of 415th Avenue and Indian School Road and a second parcel at SEC of
41sth Avenue and Campbell Avenue. The intent of the zoning amendment is to
construct Logistics and Distribution Warehousing.
0n May 28,2025 a group representing STOPP and the community met with Ed
Reichenberg of Clear Vista Management who represents the property
owners/developers. Mr. Reichenberg proposed a modification to the zoning
amendment where the south acreage and Indian School Road frontage of Parcel
506-34-011-B would be zoned commercial.
With this change STOPP Board supports Case # 2250003. However, there must be a
traffic study and solutions to the following concerns:
. The additional amount of truck traffic it would generate
. The intersection of Indian School Road and 47Ls. Avenue isn't constructed to
accommodate semi-truck turning and
. Backup of traffic southbound 411th Avenue I-10 overpass because trucks are
waiting to fuel at the Pilot gas station.

Dear Mr. Daniel Johnson,  
As residents of Tonopah, we respectfully submit our comments regarding the proposed zone change, case 
#Z250003, and the subsequent resubmittals. Most concerning is the proposed use of the 600-feet of the 
southern parcel for C-2 (commercial). 
  
Despite some wording adjustments in the latest resubmittal, the core issue persists. During our community 
meeting with Ed, it was made clear that a significant number of Tonopah residents strongly oppose the 
introduction of any commercial shopping development at this location. This concept is not aligned with the 
character or desires of our community. Its proximity to I-10 would inevitably attract transient traffic, 
conflicting with our rural atmosphere.  
 
We are also concerned about the disproportionate influence of a single vocal resident who, despite 
representing only a small minority, appears to be shaping the direction of this proposal. This individual has a 
documented history of pursuing initiatives contrary to the will of Tonopah residents. This includes repeated, 
unsuccessful lawsuits against Hickman Farms (tellingly, that disdain for Hickman’s is echoed throughout the 
zoning proposal), as well as current persistent efforts to incorporate Tonopah despite the fact that the 
measure has already been rejected by the resident voters.  
 
It is troubling that this resident has taken steps to personally guide Ed around Tonopah, potentially skewing 
Ed’s perception of community sentiment. This pattern of behavior—misrepresenting the broader community 
while advancing personal agendas—has caused considerable frustration among residents who feel sidelined 
in the process.  
 
We urge Arizona Planning & Development to recognize that the proposed C-2 zoning does not reflect the 
wishes of the majority in Tonopah. We do not wish to see this shift to C-2 at this intersection which, rather 
than benefiting locals, would serve as a magnet for Interstate travelers. It simply is not the right location for 
community shopping and would be detrimental to the rural atmosphere of the area. 
  
We thank you in advance for taking this all into account. Please don’t accept a C-2 zoning change which 
would have a huge negative impact on our community’s rural nature.

I am in support of the filing for the Tonopah Logistic Center zoning case #250003.  It has 
been a pleasure working with Ed Reichenberg and I wish the owners well in developing 
their property. 
 
Unfortunately, you have received a letter dated October 26, 2025 from other Tonopah 
residents that refer to me without mentioning my name, which include comments that do 
and do not have anything to do with the zoning case.  Since the comments are now public 
record, I would like to offer this feedback: 
 
• 
In my opinion, the Tonopah Logistic Center is aligned with the Tonopah – Arlington 
Area Plan. 
 
• 
The voice, siz, and residency of STOPP members that previously made comments is 
little different than the Tonopah Residents Opposed to Incorporation that signed on 
to their letter.  Their voice as well as every other voice in Tonopah should be heard. 
 
• 
I don’t have a history of pursuing initiatives contrary to the will of Tonopah 
residents.  I moved to Tonopah in 1978 and have been very involved in the 
community.  The following shows my support of the Tonopah community and their 
support of me: 
 
o Saddle Mountain Unified School District Governing Board (30+ years) 
o I was selected by Maricopa County Planning & Development (1996) to 
participate in a group to discuss the possibility of a private prison in 
Tonopah.  The effort evolved into a Tonopah Transition Team, who 
presented a concept of a Tonopah community council to the community. 
o The community agreed to create a community council and I served on the 
first Tonopah Valley Community Council and continued to serve for five 
more years. 
o I was a board member of the Tonopah Fire District non-profit organization 
until it dissolved.  
o I’m currently a board member of the Arizona Fire & Medical Authority 
Foundation (non-profit). 
o I’m currently a member of American Legion Post #137 Post Executive 
Committee. 
o I am and have been Tonopah Precinct Committeeman (elected) for many 
years and often a State Committeeman. 
o I’ve recently been elected to Chairman of the STOPP non-profit organization

There haven’t been unsuccessful lawsuits against the Hickman Family Farms, Inc. 
Hickman Family Farms, Inc was sued by three entities for the Tonopah egg 
production plant being a nuisance.  There were three lawsuits and Hickman Family 
Farms, Inc. settled all three out of court.  I was plaintiff in nuisance lawsuit CV 2017-
11959 where Hickman Family Farms, Inc. agreed to five settlement terms.   The 
lawsuit was successful. 
 
• 
The Tonopah egg production plant has changed the trajectory of development at 
411 Avenue and Interstate 10.  It is not longer the “gateway to Maricopa County” as 
once envisioned in the 1990’s by the Tonopah Community Valley Council and 
Maricopa County Planning & Development. 
 
• 
I was part of the group sponsored by the Tonopah Community Valley Council that 
studied incorporation of the community.  Eventually an incorporation election was 
held March 10, 2009 and failed 60%-40%.  The Tonopah community has grown and 
there have been many changes.  I believe that it’s timely to have another 
incorporation election so the community can make a decision.  I advocated for an 
incorporation election – nothing more. 
 
• 
I don’t have a “disdain” for Hickman’s.  The operation of the Tonopah egg production 
plant has been problematic.  (See https://tonopahstopp.com/?ckattempt=1 ) 
 
• 
I didn’t take “steps to personally guide Ed around Tonopah, potentially skewing Ed’s 
perception of community sentiment.”  Ed Reichenberg invited me and he asked me 
for feedback.  Mr. Reichenberg is a very seasoned professional and there is no way 
that I could skew his perception of the community sentiment. 
 
I’m very dedicated to the Tonopah community and look forward to its positive 
development.

I started a FB Group in Opposition of Incorporation ( Tonopah Residents Opposed to Incorporation,™ )

which has about  633 members where we are also in Opposition of this I attached a letter with about 75 
names on it as most people will be unable to attend this meeting so we felt a group letter was needed    
 
A lot has changed sense our letter was first sent to PND as Hickman's Egg Farm has sold to a very large 
company and no one knows what the new owners (JBS) are going to do as they are the Largest Beef 
producer and the 2nd largest pork , Chicken  producers and own a very large Trucking company in the US. 
 
So if the 600ft is Zoned commercial and a shopping area is put in it will Plug access up to right around to 
300 Homes west of this location on Indian school Rd as this is the only main access road to the Homes 
and Hickman's and will cause many safety Issues for our School Buses with the added Traffic from 
travelers stopping as I10 is right there.   
 
We Feel if any Type of Mall for shopping should be around the area of Salome HWY and WintersBurg Rd 
as this area is more for Commercial and is in center of Tonopah not at the fare end of Tonopah where 
most locals do not go to as it is closer to go to Buckeye for 50% of the locals. As the area that we are 
talking is the least residential area out here and is mainly Agricultural and should remain that way as that 
industry is the largest suppler of Jobs in the area other then APS.

Regarding Z250003 scheduled for a Planning & Zoning hearing on 12/04/2025:  
 
We would like to express our opposition to any C-2 zoning type uses being proposed in Z25003 - Tonopah 
Logistics Center.  We are unable to attend the meeting but stand with other members of the "FB, Tonopah 
Residents Opposed to Incorporation" group in stating that any rezoning that would bring C-2 zoning to this 
area of Tonopah would be detrimental to the rural atmosphere of the area, for which we moved out here to 
enjoy.
