Dear Mr. Palma,

The Lower El Mirage Wash runs southeast of Dysart Road, approximately “% mile south of
Greenway, and continues south to the Lower El Mirage Basin at the southwest corner of Cactus
Road and El Mirage Road. The majority of the wash is under City of El Mirage ownership, with
the exception of the segment between Dysart Road and the BNSF Railroad Line which is
privately owned.

In the 1990’s, a residential subdivision was planned, and subsequently developed along both
sides of the wash. The wash area was supposed to be dedicated to the City during this time,
however, this dedication did not occur.

The City has maintained the wash area over the years for the community’s health and safety as
required by the Flood Control District of Maricopa County’s Floodplain Management Plan.
While this parcel (and subsequent contiguous parcels that the City expects to acquire over time)
has very little — if any — real value as it is undevelopable, El Mirage simply desires to acquire this
important wash area in furtherance of the City’s duties and public purpose relating to flood
control. With this letter, and the attached Parcel Offer Form, we are requesting your
consideration to accept the City’s offer pursuant to A.R.S. §42-18303(E) so the City of El
Mirage may take possession of the referenced wash parcels as originally intended.
